02:44This is Beyond the Tape and I'm Mark Pesant.
02:47This is day 10 of the state of emergency.
02:50Of course, there are certain legal parameters that we have to also weigh in as we look at
02:54the state of emergency and of course, the rights of the citizens.
02:58And no better person to explain any questions that you may have in the coming hour than
03:05a tenured law with the Trinidad and Tobago Police Service, Corporal Zahir Ali.
03:11Welcome and happy new year.
03:12Well, good evening to you Mark and good evening to Trinidad and Tobago.
03:18Good evening to our family and Beyond the Tape, TB6, my colleagues in the law enforcement
03:23agencies.
03:26And happy new year to you, Mark, and extended to all our stakeholders.
03:30It's indeed a pleasure and honor to be here again this afternoon, Mark, beginning a new
03:33year.
03:35It's a pleasure to make my appearance on this particular program for 2025.
03:39But let me indicate at the outset, Mark, let me take the opportunity to join with you in
03:44extending my condolences to Mr. Randall Hector, state prosecutor, and to his family in particular.
03:55And also to use this opportunity again, you know, to advise members of the public to continue
04:00to exercise that due diligence to ensure their safety and security.
04:06It is very clear that crime and criminality has invoked our supreme law.
04:12We have seen a couple days ago, Her Excellency, utilizing the constitutional authority and
04:17power, you know, to give us the Emergency Powers Regulation 2024 to govern, you know,
04:22the state of affairs in Trinidad and Tobago.
04:24And I recall distinctly, Mark, with you and other persons, stressing about the importance
04:30of crime and criminality.
04:32If we are not careful, it can manifest itself to impact a wide public interest, or I should
04:39say public safety on a large scale.
04:42And if we just look at the declaration of Her Excellency, you will see that it was clearly
04:46enshrined in relation to the acts by certain persons that created that likelihood to impact
04:53public safety and security.
04:54So I just wanted to begin with that, and hopefully I'll be able to, you know, share some information
04:59as you need arise.
05:00But again, a pleasure to join you on the platform, and, you know, thank you very much for, I've
05:05seen progress with Beyond the Tape, and I must acknowledge it publicly, and, you know,
05:09when I look at Beyond the Tape, Mark, I am seeing the voice of the people, and I want
05:14to say immediately that from a legal context, legally speaking, I see that the voice of
05:19the people is directly associated with democracy.
05:22So I just want to hand back over to you now.
05:24Yeah, well, certainly.
05:25You know, you speak of the state of emergency, and I think, you know, in the President's
05:30term, you know, enlisting various conditionalities under the law, of course, the state of emergency.
05:37One of the things that I saw, and it was not discussed quite significantly until within
05:44the last 24 to 48 hours, was that premise.
05:48We talked about the reason the government gave was the proliferation of high-powered
05:53weapons on the streets.
05:54Yes.
05:55Married to, of course, gang violence across Trinidad and Tobago, wearing its ugly head
06:00in 2024, accounting for a huge chunk of the 624 homicides that this country faced, which
06:10was a new record, eclipsing the 2022 number of 605.
06:17There was this, in the state of emergency, under the rules there, it speaks to a gun
06:27amnesty.
06:28Yes.
06:29And I just wanted for you to kind of clarify or bring the viewers up to speed in terms
06:34of how that works, and if you can, if there has been any kind of information that you
06:41could share with us as it relates to anybody or any persons coming in and handing in illegal
06:48firearms.
06:49Well, I think, Mark, that's a very piercing but an important question.
06:55And I recall a couple days ago when I was called by the Commissioner of Police to join
06:59her on the press conference on OLESD.
07:03That question came up from members of the media, and again, I see through your good
07:06self that, again, the question arise.
07:09And I'm saying that for my humble and respectful view at this time, that while the regulations,
07:13the emergency regulation, the regulation, Emergency Powers Regulation 2024, clearly
07:21provides for such amnesty.
07:25If we read the law properly, from my understanding, it requires some clarity in reference to a
07:31identified prescribed period in which that can happen.
07:35If you read the laws, it provides the avenue for such declaration.
07:40But if you look at it in its entirety, and I stand corrected at this time from my information,
07:44I'm not seeing any prescribed period in which persons can bring forward firearms and ammunition
07:49and be afforded that immunity at this time.
07:51So I think that, and I'm happy that you asked that question, so for persons who are listening,
07:56the various authorities, that question continues to arise, and maybe we should be looking to
08:02seek some certainty with whether, in fact, that period is clearly prescribed so that
08:08members of the public can be well advised.
08:09But excellent question.
08:10And I know that a huge part of this, as we would obviously be to double down on criminal
08:18elements and more so gangs and their activities, whether it be murderous or otherwise, kidnappings,
08:25et cetera.
08:26I don't know if you would have been familiar with, Jamaica had the state of emergency for
08:33an extended period of time.
08:36The opposition would have supported such back in 2018, 19, 20, 21 give or take.
08:42I was there when they first declared it.
08:44I spent a couple of days in Mubi.
08:47One of the things that I realized, and there was a columnist wrote about it last week in
08:54the Express, and something I would have read and seen as well was that what they did for
08:59their state of emergency is that they focused a lot on a lot of hotspot areas, or at-risk
09:04communities.
09:05Yes.
09:06And not only focusing on these at-risk communities, but finding solutions within those communities
09:13of how to engage these young men in a better way of life, a more positive way of life.
09:22And they have seen significant decreases over a period of time in those communities of gun
09:29violence and, in essence, homicides in Jamaica has dipped, I mean, their population is close
09:36to 3 million, but per capita, ours has been higher, I think, this year, last year, sorry,
09:43and the year before that.
09:46Is that something that maybe the commissioner would have also discussed in terms of looking
09:51at specific areas that maybe if the powers that be would make suggestions was that have
09:58certain areas under that kind of state of emergency or certain imposition of a curfew
10:05of some sort to kind of negate the activities of a lot of these gang members going to and
10:12from an area or going into a rival area, et cetera.
10:15Just a question.
10:16Well, Mark, again, I can see your deep analysis and from your submissions, there's a lot of issues
10:24that I need to address quickly.
10:26One, when you spoke about the engagement of the particular areas that we know based on
10:32intelligence to be prone to serious criminality and gang and gang-related activities,
10:38when we are looking at the secondary aspect in terms of that social intervention,
10:43looking at other ministries coming in to lend that support, to look at root causes, basically,
10:48it's an important element.
10:50But at this time, Mark, the primary efforts with reference to the use of this emergency
10:56powers is what is taking priority to weed out and to seize as many firearms as possible
11:04so that you can at least make those places safer to be able to go in to administer the
11:09secondary aspect in which you spoke about.
11:12And your second issue with reference, so using the powers to further manage persons
11:18in terms of, for example, you said the movement of persons to and from places.
11:21May I say under the emergency regulation powers 2024, the commissioner of police is given
11:27that wide authority.
11:29If she believes in the particular circumstances that individuals freedom of movement or even
11:35I should go as far as to say even travel, if that should be restricted because those
11:39persons are a threat to public safety and security, the regulations provides that authority
11:45to her and it also provides the authority even to her excellency to issue orders to
11:50be able to treat with particular issues that may be impacting public safety and security.
11:55So I don't know if that answers your question, but there is and there are, I should say,
12:00deep enshrined powers in the regulations.
12:03Well, certainly, Corporal, we're going to be discussing a lot more things as it relates
12:07to the state of emergency as we go along.
12:09And of course, I know a number of people will be calling in having questions about particular
12:13things.
12:14And of course, there's also the other side to that, that a lot of people are concerned
12:18of the abuse of power by the police and so on.
12:22But we will get to that later in the program.
12:25We're now going to go to our headlines.
12:37So, those were some of the headlines within the last 24 hours.
13:03You know, on Mondays, we usually profile or highlight a number of missing persons on this
13:10program with the assistance of the Hunter Search and Rescue Team.
13:15And unfortunately, there was a gentleman by the name of Anthony Mark who apparently went
13:20missing on November 6th of last year.
13:25And it seemed that there was a road fatality around that time.
13:30He was missing, sorry, in early November.
13:33And it seemed that about five years later, there was a road fatality along the highway
13:41in the Kearney District.
13:44And it turned out that unfortunately, that person that was struck by a vehicle was only
13:52identified yesterday by members of his family as Mr. Anthony Mark.
13:59So, we want to obviously extend our sympathies to his family and the passing of Mr. Mark
14:06who was only identified yesterday, almost about, I'd say, two months after he had gone
14:13missing.
14:14So, you know, it's pretty sad, you know, that somebody would go missing and then, you know,
14:19they're struck by a vehicle and it takes a while before you actually get to identify
14:24or find out that that's the person.
14:26Yeah, I think, Mark, let me extend my condolences to the family immediately and, you know, those
14:29things are, you know, only the family will be able to tell you how deeply, you know,
14:33impacted they would be in relation to that.
14:36My condolences to the family.
14:37And Mark, just permit me, just for a matter of certainty.
14:40Sure.
14:41That question that you asked about the amnesty, I just want to read the authority that is
14:46available.
14:47But I want to stress on something to bring about the point that I made earlier.
14:52Under Section 11 of the Emergency Powers Regulation 2024, no person who surrenders
14:56any firearm, ammunition, or explosive during any period that is prescribed and otherwise
15:04in accordance with an order to surrender shall be prosecuted under the Firearms Act or Regulation
15:09for illegally purchasing, acquiring, or possessing such firearm, ammunition, or explosives prior
15:15to the time of such surrender or at that time.
15:18So I just need to just reflect on two areas.
15:20During any period that is prescribed and otherwise in accordance with an order to surrender.
15:26So hence why I indicated it at this time.
15:29Those two issues have not been answered.
15:31However, the authority is there if the authorities wish to make use of the provisions.
15:38So I just wanted to ensure that there is certainty in terms of the guiding members of the public
15:43and also if the authorities are listening and feel that the time has come for such a
15:49declaration then the authority is provided in the Emergency Regulations to exercise that
15:54option.
15:55I will certainly ask you a question about that a little later.
15:58But we want to go to an unfortunate situation that occurred last night.
16:03The country recording its fourth murder for the year, the shooting of 19-year-old Nigel
16:13Lutchman.
16:15Authorities say that about 7.30 his mother was driving the vehicle, a black Toyota Acqua,
16:21seen just in your video.
16:22They are at the corner.
16:23They approached the corner.
16:24I believe it's St. Bob's Road and St. Francois Valley Road.
16:31And apparently a vehicle pulled in front of their vehicle and two masculine men came out.
16:39They ordered the mother out of the vehicle, but she refused.
16:42And then they opened fire shooting 19-year-old Nigel Lutchman dead.
16:48Well, Mark, again, just looking at that video, it brings me to emphasize a point, to turn
16:55it out into a big one, more importantly to the law enforcement agencies.
16:59That while there may be clearly enshrined the Emergency Powers Regulations that speaks
17:05directly to particular matters.
17:08The ordinary, and I'm using the word the ordinary law and the ordinary protocol governing policing
17:13in relation to being an intelligent driven police service, it's important for us to continue
17:18to police the place with all the other laws that are available and just do not, you know,
17:24place our dependency, if I should say, on the Emergency Powers Regulations.
17:28You indicated something quite important just a while ago and I want to reiterate it.
17:33And it goes back into the declaration that Her Excellency have indicated that persons
17:40and I will go to say persons have acted in a manner likely to prejudice public safety.
17:47And when one look at it in context, it is easily the same that the criminal gangs that
17:57are in conflict is the groups that the Emergency Powers is directed to ensure that it protects
18:03the wider public interest.
18:05So you may have seen instances where there is the shooting, murder, as in this case.
18:11And I'm humbly asking for us to continue to use all the other laws that are available
18:16to continue to police Trinidad and Tobago to be able to support that drive for public
18:22safety and security.

45:31earlier for our beloved citizens of Trinidad and Tobago, we are already in a public emergency
45:37and I'm asking you all kindly this afternoon to let us be responsible in our engagement,
45:42in our expressions, in our conduct.
45:44We live in a society that has different, different race, different religion, different associations
45:52and I would like us to respect each other.
45:54You know, let's go back to, you know, that level of discipline, production and tolerance
45:58and I'm asking you sincerely that let us direct our efforts towards bringing us out and restoring
46:04public safety and security in Trinidad and Tobago and not add to a situation that may
46:09further add to a division or further place public safety and security at risk.
46:15Right.

46:25So Corporal Ali, I have called you time after time and I have asked for your assistance,
46:27of which you have assured me I would have gotten and it's now heading into two years
46:38since my scenario.
46:39Let me, let me, let me, let me just reiterate with you.
46:47So, there was a situation where I was held up in Port of Spain, and well, now you know that I am a FUL holder, and in doing so, one of the bandits was shot.
47:04He wasn't, you know, he wasn't unalive, but he was wounded. Of which, I keep asking, my business place has been targeted twice since, and now that these perpetrators know that I do have a firearm, it is harder for me now.
47:27I don't know, what do I do? Do I now close down my business? Do I now, I don't know, stay locked up in my house? Do I now stop trying to see about my family? Because they tried to rob me, and I defended myself, and now my firearm has been taken away.
47:44And every time I call and I talk to the corporal in charge and whatever, it went through all the processes. It actually finished the forensic, it finished all the processes, all. And right now, as he keeps saying, he's waiting on an OK from the Commissioner of Police to release the firearm back to me. Can you please help me once more?
48:14And, you know, I will endeavor to, you know, inquire as to, you know, the status of that matter. But, you know, Mark, this particular area, and you know, not just the school, but I know that is a concern, and I think that we should really have a look with reference to persons who are involved in matters where they had to discharge a lawful firearm in preservation of their life or the life of their family members or in defense of their property.
48:44And, you know, the seizure of the firearm for extended period, you know, basically, you know, we need to balance that right. And again, I'll take this opportunity on public platform, you know, to give the members of the public an assurance that I will again bring it to the authorities for consideration to probably look at our policy to ensure that there's, you know, fairness with reference to how we are, the TTPS is treating with those issues. But again, call out, we'll inquire into it.
49:09And I did mention, you remember there was an incident a couple months ago with a friend of mine who owns a restaurant in the Port of Spain area.
49:16Yes.
49:17And, you know, similar situation. And then, of course, we know when that happens, what happens, the firearm has to be taken by the police and investigation is launched and so on and so forth before it is returned.
49:31And of course, I did tell you that that period of time leaves the person or persons vulnerable to criminal elements in the future.
49:39Yes. And as I said, let me give the assurance that I'll make that, you know, a priority to at least at least submit a policy document or make some proposals to ensure that we can, you know, iron out our issue to ensure that persons continue to enjoy the license for their continued protection, you know, providing that the investigation is completed or even in the course of the investigation where other alternatives, you know, can be exercised in those circumstances.
50:05So, you know, Cora, thank you again for bringing it to the attention and continue to exercise patience and due diligence as we go forward.
50:11And just quickly before we go to break, I know that you spoke about these gel blaster guns and these toy guns.
50:17Yes.
50:18And DCP Benjamin was on the show yesterday. One of the very interesting and very critical things that he raised was the fact that they had reports that some of these toy guns were being used in actual robberies and so on.
50:30Well, Mark, again, and I'm happy that you brought that up.
50:36The reason why I'm also very concerned about these particular objects resembling firearms, imitation firearms, it was so significant that if you look at the schedule of the anti-gang legislation, which the public emergency is targeting criminal gangs, you will see that the fact that they put imitation firearms used for the commission of offenses in the schedule, it means that it's of significance.
50:58And if groups are seeing opportunities to make use of these particular objects, then it is important for us to respond appropriately to ensure that not only objects that are proven to be firearms, but even objects that resemble firearms, where in the night, where it's low light, Mark, could you imagine that one of these objects is pointed to you?
51:21Yeah, you wouldn't be able to tell the difference.
51:24You know, so hence why I'm saying for public safety and security, and I saw some videos as well where a number of persons would appear to be on the public road. Now, it appeared that they were having fun, but what about persons who are passing in the public road? Do I know whether that's fun or whether there's two gangs that are in conflict?
51:41True, true.
51:42So we need to be careful.
51:43I agree too. And you know, store owners, we want to make a quick buck. You know, a lot of you all have brought in these toy guns and so on. I think you have to rethink, you know, going forward because certainly it is going to cause a problem in this country. We're going to take a short break and we'll be back. Stay with us.

53:50Welcome back to Beyond the Tape. I'm your host Marc Bessant. It's Legally Speaking Wednesdays with Attenuate Law of the Trinidad and Tobago Police Service, Corporal Zakir Ali.
54:11We just wanted to kind of, I know people have seen this video already, but just the sheer horror of the killings in this country and the video that was circulated following the five persons who lost their lives in Pittsburgh lands in Laventille in late December.
54:32You know, when you look at, it's like becoming a part of normal living for some people by just seeing this, but certainly these people have families and sometimes it can be rather disturbing seeing images like this posted on social media or even things being said about persons that are not true.
54:54As the gentleman would have pointed out, people posting things on social media that might be erroneous and causing irreparable damage to persons and their reputation.
55:04And Marc, you know, again I want to reiterate, we are asking members of the public to be responsible in their dissemination, in their publication, in the use and enjoyment of social media.
55:17Even in a formal media context, be responsible. I want to emphasize that we are in a period of public emergency. The constitutional law, the supreme law of the land has been engaged by Her Excellency.
55:28That doesn't happen every day. This is a significant matter of Trinidad and Tobago.
55:32I am pleading with you as a citizen, as a police officer, as an attorney at law, as a member of the society, as a son of the soil, to appreciate that the trigger of this public emergency, when you look at last year and especially the end of last year, that the mayhem and the serious threat to public safety.
55:51Now we have an opportunity for all of us, all of us, every stakeholder, to play our role, to bring us out and to restore public safety and security.
56:00And wherever you get the opportunity to play your role, let us play to the best of our ability, including being responsible in our expression.
56:07And I want to repeat that. And also for the law enforcement agencies and the supporting agencies, ensure that you continue to observe the rights that still exist, where persons are detained, where you are going to execute searches, and generally speaking, when you are exercising your powers, to ensure that we are balancing the rights, we are following due process, and as a society, we are acting properly within the rule of law.
56:33So Mark, I want to thank you very much for this afternoon to share this information, and I hope that members of the public were well guided, and if there are any other issues, feel free to call on me.
56:43We definitely are really grateful for clearing up a lot of the things that people want to find out about the state of emergency, and as it refers to their rights, their constitutional rights, and as you indicated, even though the emergency regulations are in effect, there are things that citizens still have their rights.
57:04And I think that the setting up of this three-man committee by the Prime Minister, if people have concerns or they feel that they have been violated in some form or fashion, you have that committee that you can refer to, you can seek legal redress, and of course, also write particular reports to them.
57:24Well, in reference to that particular tribunal and the preventative order in the hand of the Minister, God's willing, Mark, I'll deal with that on the other occasion, to ensure that there's a clear perspective as to the power of that tribunal and what that tribunal could do, and also to discuss the preventative order, which is a very strong power given to the Minister of National Security under the emergency regulations.
