Part 5:

Another genuine eye-opener as to the reality of dealing with the health system in the USA in 2023. In this call, 4 months after no updates, I check on the status of my complaint with the Florida Department Of Health by calling their office and am transferred to investigator Adam Blahut. An argument ensues, I believe I have supplied sufficient information to substantiate my interaction with doctor Wayne J. Broth who told me in a 2022 phone consult that no injuries appeared in MRI images which in-fact show I had broken the underside of my skull. This MD abruptly ended our consult when I simply asked his first name. The call was recorded and can be seen in other videos on youtube channel My Medical Nightmare. The medical practice is unresponsive following consult they will not talk to me. I signed a form that gave the Dept. permission and consent to go get the records they needed from the MD and medical practice and the language on the form reads as such. Blahut tried to twist the language in that consent document to try and say my complaint had not been pre-qualified to be investigated. The consent in-fact gives the department of health permission to obtain those records in my complaint from the time I signed it.

Most disturbingly, like something out of a spy movie, when I told Mr. Blahut I was recording our call, I was told the state of Florida would deny the existence of my complaint against this doctor. This agency is operating in the stone ages. Healthcare seeking public should be free to document their interactions with all of these parties and the agency should be there to represent the common people against the interests of millionaire MDs.

My experience seeking redress after being given incorrect medical advice by a licensed medical doctor in the state of Florida. In August, 2022 I filed a complaint with The State Of Florida Department Of Health VS Dr. Wayne Broth of Florida and New Jersey. 4 months of inactivity was reached after an exchange in Sept. 2022 with Adam Blahut. They requested evidence the MD reviewed my scans. I believe I provided substantial proof to this end, including copies of emails from their office stating Dr. Broth reviewed the images. Blahut and the FL. Health Dept. did not communicate with me following an email response I gave and this is unprofessional. I found out nothing had been done to investigate my case for 4 months only when I called them to inquire in January, 2023.

FL. Dept. Of Health straddles 2 eras of technology, they accept complaints via email (1990's) but only issue responses through postal mail paper letters (1700's).

August 11th I received a confirmation letter my complaint was received signed by investigator & government analyst Adam Blahut.

00:26All right, so this is a recorded telephone call with the Florida Department of Health.
00:34This is in reference to a complaint I filed against Dr. Wayne J. Broth.
00:43This stems from a telemedicine phone consultation that I had done regarding an MRI scan, or more like a couple
00:58of MRI scans, that he looked at for me back in the summer of 2022.
01:06So, I filed my complaint in August 22.
01:12I sent my medical records more than adequate information to substantiate that this doctor had looked at those MRI scans,
01:25and that their consultation had taken place.
01:31I made all that public. You can see them in my videos in my YouTube channel.
01:37Some kind of impasse had been reached in September 2022 with the Florida Department of Health.
01:50They did not communicate to me from this point, and they simply told me that I needed to send in
02:01more information.
02:04This doctor and his medical practice are unresponsive when they're trying to communicate, and it's kind of hard to get
02:13records if the doctor won't communicate with you, okay?
02:17But, yeah, I believe that I sent in adequate information for them to commence with the investigation.
02:26Also, I filled out this form when I filed my complaint that gives the Florida Department of Health permission to
02:39go and get the records and whatever they need from the doctor and the medical practice directly.
02:46They don't have to go directly to the doctor and they don't have to go around in circles when it's
02:57unnecessary, all right?
02:58They don't have to use me as a facilitator or middleman.
03:01I gave them permission to go directly to the doctor, which is what they should do.
03:07But that, of course, requires that this state of Florida agency actually do some work.
03:17And as you can see in a lot of my videos, this is the big problem at this level of
03:25American industry and business.
03:30You'll hear in this call where, yeah, I get into an argument with Adam Blauhow, investigator for the state of
03:42Florida.
03:44When I told Adam Blauhow that I was recording our telephone conversation, which is my right in the state of
03:55Alabama,
03:58He told me that if I recorded our conversation to document this exchange and make it public that the state
04:12of Florida would simply deny the fact that I filed the complaint in the first place.
04:20And this should be like a huge shocker to any person out there in the state of Florida and beyond.
04:32This is your government representatives at work, okay?
04:39Medical patients, the public out there, we have a right to record and document our exchanges with,
04:50the people that represent us.
04:52And this should not mean that they then go and deny or try to deny the fact that we filed
04:59a complaint against a doctor who we perceive have done us wrong
05:05or engaged in some kind of malfeasance, fraud, or didn't do his job properly.
05:13And this is something that seriously needs to be changed in the state of Florida.
05:18Remember, this government agency, they're living in the Stone Ages.
05:22This type of mentality, this is like something from ancient history, all right?
05:29All the secrets, the denial.
05:32This is stuff from Germany, okay?
05:35After World War II.
05:37This is what the U.S. adopted.
05:39Or Operation Paperclip, etc.
05:42This is the kind of thing that governments use against enemies.
05:47So following our argument, I was hung up on.
05:52Looks like the state of Florida may have some laziness or elements of corruption operating in this Department of Health
06:06sector.
06:12Thank you for calling the Florida Department of Health, Medical Quality Assurance, Consumer Services, and Compliance Management Unit.

07:27Good morning, Department of Health.
07:29Yes, ma'am. Who am I speaking with, please?
07:33My name's Chasity.
07:35Okay, hello, Chas.
07:37Okay, how can I help you?
07:38Yes, ma'am.
07:39I filed her complaint back in August.
07:44And I have not received an update on the status.
07:47I just wanted to check the status of my complaint, please.
07:51Okay, just for a moment.
07:57Do you have the reference or complaint number?
08:01Yes, ma'am.
08:03Okay, let me get you over to your investigator, okay?
08:06All right, thanks.
08:07All right, ma'am.
08:09Thanks.
08:11Hi, my name is Tom Blanco.
08:13I'm an investigator with the Florida Department of Health.
08:15How can I help you today?
08:17Yes, sir.
08:17I submitted a complaint to you guys back in August.
08:22And it's been a little while.
08:24I just wanted to check on the status of my complaint in the investigation, please.
08:29I still need proof that Dr. Brom is actually the one who interpreted the images.
08:36Okay.
08:37Without some sort of record signed by him stating that, you know, oh, I looked at these images and, you
08:46know, this is what I'm interpreting as it's a he said, she said situation.
08:51And I can't move forward with it.
08:54No, sir.
08:54It is not a he said, she said situation.
08:57I gave the state of Florida, you guys, the Department of Health permission to get those records from that doctor.
09:06And that's what you should have done.
09:08Okay.
09:09My case is...
09:10I do not have the authority at this point to obtain the records on my own.
09:15At this point, we're trying to determine, is there a potential issue here that needs addressed?
09:20I determined, yes.
09:21Because you need to provide me something that shows that she interpreted those images.
09:31Okay.
09:31My case is an example of telemedicine.
09:34They're a medical practice, and the doctor that you mentioned, they are doing telemedicine over the telephone.
09:41I am in the state of Alabama, and there are no records that were supplied to me.
09:47They offer a free MRI review, and I applied for this on the Internet.
09:51I sent in all of my email communications.
09:54You have lots of proof.
09:56So that's bull.
09:57The ball is in your court, sir, and it's to you guys.
10:01You need to do your job properly because I'm recording this telephone conversation,
10:06and I plan to document this and make this public.
10:11You're free to do so by the Florida statute unless the Board of Medicine, in this case,
10:18chooses to move forward with disciplinary action.
10:22All complaints are confidential, so all the Department of Health will do is deny that the complaint exists.
10:28Okay.
10:28We'll take that up with the state of Florida, sir.
10:33You're negligent in your duties in your office as well, sir.
10:38Per statute, you have the right to file a complaint, but also per statute,
10:42you must provide me with what I need to make a full assessment of your complaint.
10:48You have not done so.
10:50Even with the telemedicine statute, they are still required to keep records.
10:55So if you sent them something, there is going to be a record at their office going,
11:02yes, we received something from Mr.
11:06and we did the following with it.
11:09That is required by the telemedicine statute.
11:12So if you sent them something, you need to make a request for records to that office for whatever they
11:19have.
11:20I don't have to do that because I signed the form that gives you guys permission to get those records.
11:25And the ball is in your court.
11:27You need to do your job, sir.
11:30Sir, as I explained, at this point in the process, I do not have the authority to obtain the records
11:35on my own.
11:36I gave you permission.
11:38I signed the paper.
11:39You got permission.
11:41That gives us the authority to use what you send us.
11:45If the determination is to open it to investigation, then we would be able to obtain the records on our
11:50own.
11:51But until that determination is made, I don't have the authority to get it.
11:56Okay, I've seen you what was needed, and you are negligent, sir.
11:59I would like to speak to your supervisor.
12:01Okay.
12:03He is teleworking right now.
12:05Yeah, I really believe that.
12:06I'm sorry, would you repeat that?
12:09Yeah, I really believe that.
12:11Actually, I don't.
12:12Yeah, I'm going to speak to him right now.
12:14Sir, let me finish what I am saying.
12:17I think you've said quite enough.
12:19Sir, if you do not let me finish what I'm saying, I will terminate this phone call.
12:23That's what I was going to say.
12:25I can drive.
12:26Listen, sir.
12:27I can drive down to Florida.
12:29It would take about seven or eight hours and speak to you in person about this.
12:33Sir, if you would let me finish my sentence.
12:35No, you're finished.
12:36We're done.
12:37Sir!
12:39My supervisor is teleworking, so I need to put you on hold for a moment.
12:42Yeah, I want to talk to him right now.
12:44I want to talk to him right now.
12:47I need to put you on hold for a moment is what I would have said.
12:52Do you have an issue with that?
12:53I mean, you guys have taken too long with this thing.
12:57I mean, in Florida, you guys should have some standards, I would think.
12:59I guess everybody will find out what your standards are really all about now.
13:03Do you have an issue with that?
13:03Do you have an issue with that?
13:03Do you have an issue with that?
13:03Do you have an issue with that?
13:03Do you have an issue with that?
