32:54we as citizens want the ttps to go but i want to focus on your conference vulnerable youth
33:00a multi-sector integrated approach and i believe you had a lot of stakeholders and i want to focus
33:09directly on deterrence authority in march 2021 the 30th of march there was a news day article
33:23whereby five escapees boys escape two of them were killed ambushed somewhere lavatila and move up
33:38and well let me leave my cards on the table i have an issue with deterrence authority and the fact
33:44that that was one of you i believe your stakeholders what deterrence authority did at that point in time
33:51they acknowledged there were gaps in their security arrangement but what they did and it is alleged
34:00that instead coming to the police first or at the same time they pursued an angle to get those boys
34:08and which it involved a gang leader one of the gang leaders and one of the biggest gang in trinidad
34:17somewhere because apparently they felt at that point in time it might be more
34:25feasible to get a quick response other than the police service my take on it if deterrence authority
34:33at that point in time had no confidence in the ttps where we are now and second to me that
34:41has been an
34:42outstanding investigation for the perpetrator of that crime the deaths of two 16 year old because three
34:51other boys there will witness to the information the newspaper apparently interviewed witnesses
35:01from my bandage and the report so i'd like to hear your take on deterrence authority and how they
35:09from my bandit perspective ttps and how the tps will overcome situations like that all right thank you
35:17caller mr ali thank you very much caller thanks for your kind comments um at the beginning of your
35:21submissions um thank you very much for that um the i will say at the outset that um and you've
35:28made
35:28reference to the children's authority um i want to say that it's important for us to be examining every
35:34single state institution in trinidad and tobago and i say that in the context where sometimes you establish
35:39an agency and the operationalization or the implementation of the law or the or the um
35:46constitution of the establishment if you are not consistently looking for ways to improve the
35:52systems you're going to have a situation where maybe there may be a lack of human resource maybe there
35:56are lack of processes um maybe there's a systemic um challenges and there's no effective um mutual
36:03understanding or collaboration with very important relevant agencies so i think that coming out of
36:08this symposium as well is for the state agencies to recognize where the deficiencies may lie and how
36:13best we can improve and fill those gaps but hearing children um escaping from lossful custody whether they
36:19were victims um and removed uh place of safety whether they are persons who may have been offenders um
36:25children escaping from an authority that has the responsibility to protect them is a serious matter and it's
36:31important for us to really look at those systems and see whether in fact we need to make any sort
36:36of
36:36intervention but um like always i always like to give persons the opportunity to be heard um with me
36:41to really get a true picture so what it is happening but thanks for bringing it to the to the
36:45um to the
36:46forefront and you know definitely we'll be paying some attention in terms of strengthening our children's
36:51authority and you know with me when these things come to a light it's important for us to look at
36:55it with a
36:56positive lens you know let us look and see um how best we can assist to improve to strengthen the
37:01authority because the authority is there for our purpose correct and if if things like this happen
37:05we should be quick to do uh an analysis to determine well um what should we do what steps should
37:11we take
37:11um to be able to treat you these matters but kola thanks very much for bringing it forward maybe the
37:15special victims unit could step in to assist that degree i'm just saying you know as a way of support
37:21and i'm happy that you said that because if you have a children's authority and from a law enforcement
37:25perspective what you have just said very important because the child protection unit fall under the
37:29special victims department and what you'll want you'll want a closer um involvement between the
37:34children's authority and the child protection unit they cannot be like this so that when something
37:38happens immediately you will have a response you won't have to know having to go through a bureaucracy or
37:43having to you know having to engage other officers to be able to get involved you are basically
37:48you are basically within that one-stop shop because if you're on child protection there must be a law
37:54enforcement component and that component of law enforcement must be close to what's happening
37:58all right now there is a media release from the ttps and i need everyone to please pay attention to
38:04this because this is very important so a public advisory protests in the vicinity of police stations
38:11the trinidad and tobago police service acknowledges and respects the constitutional right of all
38:16citizens to engage in peaceful assembly and to express their views in all lawful and responsible manner
38:24however the ttps wishes to advise members of the public that police stations are critical operational
38:31facilities responsible for the detention of persons the safeguarding of evidence and the coordination of
38:38emergency responses in this regard any gathering or protest activity in the vicinity of a police station
38:45must be conducted in strict compliance with the laws of trinidad and tobago persons and groups are reminded
38:53that according to the summary offenses act chapter 11 or two public marches and processions now i'm just only
39:02reading one of the guidelines here that i think will stand out for most of us or if not all
39:08of us notwithstanding any
39:10rule of law to the contrary no person may organize lead or take part in any public march unless a
39:18permit has been issued in respect thereof of the commissioner of police
39:23a person who desires to organize any public march shall at least 48 hours before but no more than 14
39:33days
39:33before the day on which such public march is to take place apply to the commissioner of police for a
39:41permit
39:42mr ali i think that is important for us to put that in the context now i'll begin by indicating
39:46that when we have a law
39:48that regulates public marches and in this what you have just read and timelines to make applications and for example
39:55the 14 days and the 48 hours and so forth you have to understand what the law is trying to
40:00accomplish the law is trying to
40:02indicate that if you're having a public march the law is trying to balance all interests so that a public
40:07march may be designated a particular road but there may be other persons who traverse that road or have
40:12other rights with reference to that road so if you are granting permission all these things might be
40:16factored to ensure that there's a balance in terms of enjoyment of rights especially when we speaking in a
40:21democracy and in a public context significantly as well that 14 days window is to be able to do some
40:27inquiries to understand well okay how many persons what's the route what may be the risk factor so that
40:32law enforcement can also dedicate resources to be able to now ensure that there's a peaceful march
40:36to ensure that there is no conflict between rival groups next thing you see you are advocating for
40:41a particular course but you know the what you're advocating for now it's a grievous to another group
40:47you can have conflict you can have um violence and hence why we need to understand why these regulations
40:53are in place i'll balance it by saying that perhaps under the summary offenses up oh sorry under the summary
40:59offenses sorry um that provides the pathway to for permission yes that it wouldn't hurt to also look
41:05and review conduct a review in terms of whether in 2026 20 30 years after whether those laws are still
41:13directly relevant or they need to be relaxed or they need to be simplified or you know you know it's
41:19always good to be looking at those things but for now it is the law the process is there and
41:23we have
41:24to abide by the rule of law and i hope that the the the citizens recognize that what you have
41:29read
41:30in no way prohibited a march it basically tell you about the application process yes and then give the
41:36police commissioner the opportunity to be able to say yes or no when your decision is made then you will
41:41know whether there's a um justifiable denial and then you could see what are your other avenues but
41:46if you are not following the the process you cannot be aggrieved because you are not following the
41:52process the law says to follow that process not ttps do it the right way all right we take that
41:55short

45:33and it seems like they have this club you know with these vans and they go out and and they
45:38do
45:38have the excursions and all these things but they were on this beach columbus bay in particular and
45:44this was the behavior of some of the drivers and the caller called in and said would you consider
45:50this as any sort of traffic offense because it's on a beach and not on a roadway and we got
45:56the
45:57information where it's yes what's in a public space and persons are able to you know be there
46:04and you cannot behave in that manner because endangering others endangering yourself reckless
46:09behavior so they would there were matters where you could be charged as even with a traffic offense
46:18well you know thanks to the thanks to the education as well with me and those who may have responded
46:22but i will probably take a different context as well that if perhaps that leaves the um the sea or
46:30the
46:30that beach and where we are seeing those vehicles if in fact it was not classified as a road
46:35in my view it aggravates the situation it means therefore that a vehicle if it's not a road what what's
46:41the purpose of the vehicle being on on the beach correct so if you look at it in a different
46:44context
46:45as well it actually aggravates the situation where if it was a public road well i have the i have
46:49the the right to be there the question is well how i'm driving might be reckless and so forth but
46:54if there was no if we even determine that okay it's not in my public road then there's no reason
46:59for
46:59that vehicle to be yeah um in that particular area so so you can find another way to deal with
47:04it as
47:04well so i will be seeing a vehicle going on to the beach there as you know um a strict
47:09case of one
47:09time driving using the vehicle as a weapon in relation to those circumstances that's when you need

48:23left about four or five houses away from me on the other side so the bar music doesn't really worry
48:27him but
48:27he said i cannot hear when you have your music so loud so he said uh he said he tell
48:32me he looked at
48:32me he said he tell me but but but but but what about when they come and they pack up
48:37up by my place
48:38and they're making a certain new york people are so how you know it's my people that's a public road
48:43and anybody could park here he said the reason why because they went they came across by you i said
48:47what you did about it i said you know you could get in problems for making all this noise and
48:51he said yes i
48:52know so i said well all i asked him is to put it down a little bit that's all so
48:56he's so he's looking
48:57at me i said anyway the lord bless you he said the lord bless you too when i came over

49:03family no after that he never played the noise loud louder and that is so it's really really happy
49:09officer i'm very concerned about about what is happening with this history and a sudden murder and
49:15you know and you know and and the pd and stuff like that and i am saying what can be
49:21done really
49:21when we do not we're not on the soe because the soe they're doing their own thing because they feel
49:27they could get away killing doing that and then without an s3 now the police will have extra things
49:33and you explained something to me the other day and i really understood it if they decided you
49:38without any see what and what they could do but i am concerned because every day i cannot remember the
49:44last day that we didn't have at this could you anyone if you remember all the all the best children

50:32the honorable minister of homeland security and the permanent secretaries we discussed the policy
50:35policy and that should be going on its way to the um cabinet i know that the citizens are very
50:40um
50:40uneasy they're very excited about that policy to be able to have some reform you know so let us
50:45continue to um to exercise our patience ensure that policy go on causing necessary impact um with
50:51reference to the issue of noise but you know your points are well taken and um uh you know thanks

51:00look at the human being the greatest of all the supreme being for most of us as human beings

51:51entire organization and the entire organization feels the pain of a very very few so i'm just saying
51:57that balance even in our constitutional rights i spoke about the the the um protest issues a while
52:03ago correct and we have to follow that you have to do it that's right you have to do it
52:09the right
52:09way there's a protocol that and there must be a balance because you want a right to what
52:12to have a match but what i may not want to have that around me but what if the street
52:17that you're
52:18using is a street that i have to traverse or work so i don't want to have any congestion so
52:22how do i
52:22strike a balance so the commissioner may have to say okay use the left lane and leave the right lane

54:25satisfied that i have done my part if i'm doing my part with me and you are not doing your
54:29part at
54:29least i feel fulfilled i'm doing my part but if you are not doing your part and i have opportunity
54:34to
54:34do my part and i'm not doing it where are we so perhaps if i'm doing my part perhaps you
54:39might
54:39motivate me that's going to do my part that's correct and then now you can so it you know we
54:45must understand you know that when we're speaking society and you know i always use this term as well
54:51i see you enjoying the the um examples that i'm giving so i'll share one more this afternoon
54:55Whitney as a society we should be looking at ourselves as as a body if your head hurts my toe
55:02must feel the
55:02pain if your hand hurts my leg must feel the pain and when we start to think like that then

55:15one more if you are eating and your neighbor is hungry you shouldn't be satisfied with her
55:22because then what you want for yourself you should want for your brothers correct and that's important
