34:55I have a couple of observations and a couple of questions.
35:01Parliament makes the laws, right?
35:05And they are sent in by the President.
35:09These laws are made for who?
35:15Who are the laws made for?
35:23Let's take off your television or mute the volume so we can hear you.
35:27And you can just ask the questions back to back.
35:31Okay, then.
35:33The next thing is...
35:37After the laws are sent in, they become law.
35:43Now, we have three laws, for instance, which is...
35:47The inspection law, the seatbelt law, and the cell phone law.
35:55Now, the seatbelt law is to stabilize.
35:59The inspection law is to make sure your vehicle is roadworthy.
36:05And the cell phone law is to prevent you from driving distracted.
36:11Now, my three questions to this.
36:15These things are...
36:17Why do government officers, police officers, and government agencies do not wear seatbelts?
36:29They do not inspect their vehicles and they consider driving down the road talking on cell phones.
36:37Less distracted.
36:39Less inclined to get in an accident and get injured.
36:43And are their vehicles always roadworthy?
36:47I will listen to you all.
36:49So, wait. Before you go, are you hearing me?
36:53Yes.
36:54When you say their vehicles, you mean their personal vehicle or the vehicle that belongs to the TTPS?
37:02All government vehicles, basically, they are uninspected.
37:07They don't carry inspections because they are never stopped in a traffic stop.
37:14To make sure they are properly roadworthy, they have local taillights, traffic lights, green, black tint, and all these things.

37:28Whitney, I think that he has raised some very significant matters here.
37:33And while I say significant matters, one of the first questions he asked in terms of when parliament make laws
37:39and whether the law is made at the stage of assent by the parliament
37:43or whether there is a need for a proclamation from the president as a further step.
37:48The question was who the laws are directed to.
37:50And he takes me back into when I was studying the subject of jurisprudence,
37:56we were looking at various theories.
37:58And this is one of the questions in terms of who really the law is directed to.
38:01And the law, in the legal framework that we find ourselves in, the law, no one is above the law.
38:09So, basically, the law should be directed to everyone.
38:11Now, there will be circumstances where, just by way of example, like in the seatbelt issue,
38:17why the law would clearly establish a person's requirement to wear seatbelts and the consequences that may follow.
38:25Authorities like the licensing office, in conjunction with the commissioner of police,
38:29would have issued certain regulations and legal notice to ensure that police officers,
38:35and maybe an argument on a tactical context, to be able to respond quickly
38:39when they're involved in the execution of their duties officially.
38:42But I think I want to accommodate the caller's submission in a broader sense,
38:46in the context where if we are looking at even, for example, in the case where vehicles are rented,
38:52it may not be the strict government vehicle, but vehicles that are rented for government purposes.
38:57I think it's important for us to ensure that if persons are using these vehicles on the roadway,
39:02other motorists will want to ensure that these vehicles are also roadworthy.
39:07Because you can have public officials going about their official duties,
39:10but if the vehicles are not roadworthy, it can end up in...
39:16Structural damage.
39:17It could end up in accidents, and maybe had it not been for the defect,
39:22we may not have had the accident and so forth.
39:24So I want us to accommodate his suggestion in terms of when we are looking at the development of the law,
39:29in terms of whether, in fact, we should now stretch and consider whether, in fact,
39:33he spoke about inspections, seatbelts, and cellular phone,
39:36whether, in fact, that should be across the board with reference to all public officials
39:40in relation to, one, the official capacity, but also some room, like I mentioned before,
39:45like police officers who are in their official execution of their duties when they are on active patrol.
39:51At any point in time, they may have to disembark the vehicle to be able to deal with a crime.
39:55So I want to treat it in a balanced sense.
39:57The law is for all of us.
39:59No one is above the rule of law, but there's always room to give some consideration to that
40:03because we may find situations where vehicles that may be assigned to a ministry,
40:08whether rented or maybe fully under the ministry,
40:11are not probably within the requirements of the Motor Vehicle Road Traffic Act and the regulations.
40:18Now, I'm aware from a TTPS context, we have a standing order, SO49,
40:22which talks about the upkeep of a vehicle to ensure that a vehicle is properly inspected,
40:26in good working condition, its appearance and turnout is proper, and that sort of thing.
40:30So different ministries may have to look at different policies, but we can look at it in a mature way.

44:06We continue the conversation because school is still, you know, the topic of choice among many of us.
44:14And I want to know where we are when it comes to safety for our children.
44:19And I know you wear two hats, or many hats. I've just given you two.
44:23But you wear many.
44:25And where the law is concerned, protecting our children, we started off with that as we started the show.
44:31Well, Brittany, I don't know if you read in my mind, but I was about to, you know, venture back into that area as well
44:36because I think a very important stakeholder that we have not mentioned
44:39when we are speaking about the protection of our nation's schools and the safety and security for our children.
44:48I think that we have to factor in the children's authority, you know, without prejudice to you all.
44:53You know, you all need to be the leader when we are speaking about looking at the best interest of the child
44:58and looking at even where the child is in an educational institution to ensure that within that educational institution
45:04that children's education are not affected by others.
45:07So, for example, and this is why we have a simple example.
45:09If you have a child where a parent is unable to control that child for whatever reason,
45:13let's say that child is exhibiting abuse or drugs or exposed to gang activity
45:18and that child now is going into a school system and basically affecting the other students.
45:22It's important for the stakeholders and in this context the children's authority to be moved
45:28to be able to now see where they can render the assistance to be able to assist that parent
45:33who may be unable to control that child because you may find that it may be costly
45:37for that child to be properly assessed and so forth.
45:39So, I want to, you know, from a legal context, I want to say that the educational institution,
45:44the principal in particular who is responsible for discipline and the well-being of the school
45:49should always keep in mind that a stakeholder that should be invoked is the children's authority.
45:54Now, I know that many educational institutions, Whitney, are very careful to basically move reports
46:00because they do not want a stigma to be attached to a particular school.
46:03But I want to say to you all that we are fighting a scourge of violence in Trinidad and Tobago
46:08and do not try to suppress matters that are within your domain that you are seeing on an everyday basis
46:15where other children have been affected and you are not taking the steps to report it
46:19to get the intervention that is required.
46:21Let us go and look beyond a stigma because the worst stigma you could get is suppressing an activity
46:28that results in a murder on your school compound.
46:30We have a call on the line. Let's take that call. Hello, good evening.

46:35Good afternoon.
46:38I just want to pose two questions to Corporal Lally.
46:44But I am going back to the fact of the notification, right?
46:49Yes.
46:50Two things. First question.
46:53Is a magistrate court or high court a public or private place?
46:59And if it is a public place, right?
47:03I don't know if a judge or magistrate would allow a member of the public to produce his proceedings in the court.
47:13So two very important questions and it pertains to the use of cell phones.
47:19So I need to be edified if the magistrate court or the high court is a public or private place.
47:27And if it is a public place, would a judge or magistrate allow someone to pick up the phone and record how the proceedings?
47:37I listen to all of it.
47:40A beautiful question.
47:42Yeah, my eyebrows went up too because I really am excited to hear your response to this.
47:48Well, a beautiful question and these are things that cause me to think and really stretch my imagination.
47:56Let's make a beautiful comparison.
47:58In terms of a magistrate court and a high court, a court, from my understanding, unless there is a special direction issued,
48:04like in the case of, for example, a children's court and so forth, where it is restricted,
48:08normally the public have access to come in and listen to the hearings and that sort of thing.
48:13But within the court procedure as well, you will have judges or magistrates actually laying down court rules in terms of what can be done and what cannot be done.
48:20So in this case, based on what the caller is saying, if we are defining a magistrate court or a high court as a public place where the public have access,
48:29then the question is, if someone pulls out their cell phone in that particular area and starts to videotape, how would we look at that?
48:35But again, if the policies are laid down clearly, where a court is concerned, then there is something that is prohibited, sorry, such conduct.
48:44But when you're in the public generally going about your normal activities and you see a police activities unfolding and you want to take a recording of what's happening,
48:56I want us to factor in something there, in my view, that when police are taking action, they are taking action in the public interest.
49:03And the said public interest will require that the police act properly.
49:07So if you look at it in that context, we will see, okay, you can see a balanced position that the public interest wants you to act.
49:13So if there's a contravention, the police, the citizens are saying, why are the police not acting?
49:17When the police act, the same public interest requires the police to do what? Not abuse the authority when they're acting within the law.
49:23But we could say the same thing for the court system, the masters or the magistrates, the judges, because it's almost the same thing.
49:32You're laying down the rules, yes, and if an officer verbally says, do not record at this time, isn't that laying down a rule?
49:41Well, you see, the thing is, if we were to put a rule in a wide public sphere like that, in my respectful view, as opposed to court,
49:47there may be very grounding issues to say, okay, why you may not want someone using a cell phone in a court system.
49:54Case in point, let's use a technical example. Would it interfere with the technology within the court?
50:02Because sometimes, from my experience, sometimes officers come in with cell phones.
50:05If they don't turn off the cell phone, at some time when the court is ongoing, it starts to interfere with the recording.
50:11You hear noises, you hear contamination.
50:13So from a technological context, you may be justified in saying, well, no cell phones, to not distort the recording,
50:19because those extracts are important subsequent to the hearing when matters are concluded.
50:25So we kind of just make an outright comparison with what's happening in the courtroom as to what would happen in a wider public sphere.
50:33So great question, but I think it will all come down to the issue of, what is the court rules?
50:38And outside in the public domain with the police, there is a law that says, don't impede me, don't obstruct me, don't threaten me.
50:44So if your actions are borderline, then we can act accordingly.
50:48So I think that the law was balanced in my respectful view.
50:50But where the court is concerned, there are many, and I just use a technology issue, but there are many other issues.
50:55Who knows, maybe there will be a situation where witnesses may become intimidated when they're seeing cell phones coming out in the courtroom.
51:01And members of the media, you know in some matters, Brittany, members of the media are warned in terms of what they can publish and what they can't publish as well.
51:09So it's all geared towards, what are the rules that governs that particular area?
51:13This is the first time you give me a politically correct answer. I'm just saying.
51:18I am just saying because it's still not adding up to me in any way, shape or form.
51:23Because the officer could feel like the person who's recording could put their life in danger too.
51:28I can counteract what you're saying within the court, but it's two different playing fields.
51:34But it is still one where it is a public space because persons could come into any matter or most of the matters and sit in.
51:41But is it the case also for persons entering a police station where a person is recording something that is happening in a moment with them, with an officer?
51:51Is that restricted?
51:53Well, remember at the end of the day, if you're looking to apply the law, the law didn't actually specify a particular place.
51:58It just spoke about where a police officer is impeded, obstructed or threatened.
52:02So wherever that may be unfolding, because there are official duties taking place in the charge room as well, so it hasn't specified a particular place.
52:09But it's a healthy, it's a very healthy, healthy arm.
52:12And that's why I smile with that question because I know what's happening in the court domain.
52:16I know the rules in the courtroom and what's in the wider public.
52:19And there's a law that governs and protects the police in the wider public.
52:22It's for the police to use it properly and without malice.

55:07Again, I want to endorse our calls earlier for that aggressive response that we require in our school system.
55:19We need to keep that environment conducive for teaching and learning.
55:26And we need to ensure that it's not porous for criminal elements to be infiltrated in the school system.
55:32It's a very serious matter.
55:33And the best way we can do that is for the stakeholders' response, children's authority, the principal, the Ministry of Education, the TTPS.
55:40I want to see that sort of representation.
55:42And, you know, those who may be listening, in keeping with the strategic plan of the commissioner, police, and the executive, you know,
55:48I am prepared to start using those pillars effectively where the school system are concerned.
55:53So if there are educators, there are principals, ministry officials, we are prepared and ready to start engaging you
55:59to be able to bring awareness for these particular legislation that are very serious in order to ensure that there's a prevention,
56:06as opposed to having us having to come and detect crime.
56:10We should be geared towards prevention, especially in the school system, to ensure that, you know, that we save the next generation of Trinidad and Tobago.
56:17But, Whitney, it's always a pleasure.

56:29Now, before we wrap things up, I am trying to find ways for our parents out there to understand and take responsibility,
56:41not by us going before the court or getting legislations put in place to, you know, be that master.
56:50Yes.
56:51To make sure you do the right thing when it comes to our children.
56:54Because I'm a parent and I'm also responsible.
56:57And I may slip up sometimes.
56:58I'm just saying I never know.
56:59Yes.
57:00When it comes to my child.
57:01Yes.
57:02And understanding, we need to understand the responsibility that we have.
57:05Yes.
57:06When it comes to anything happening with our children and other persons.
57:09Yes.
57:10It will affect us.
57:11Yes.
57:12And, legally, it could really fall on us in a major way.
57:15Well, Whitney, just so, you know, to help you with that, under the Children's Act,
57:18it is very clearly identified the roles and responsibilities of a parent, a legal guardian, or someone who may be in a position of responsibility.
57:28So, I couldn't agree with you.
57:29Let us print that legislation or, in the world of technology, let us go and find it and let us take some time reading it.
57:35You are a parent.
57:37Understand how serious the responsibilities are where a parent is concerned.
57:41Because, more than ever, we are hearing more and more parents and persons coming out saying that parents should be held accountable for their child or children's actions.
