02:23Good evening Trinidad and Tobago and welcome to Beyond the Tape. Today is Wednesday the 5th of June and that means today's a great day because we're going to see the Warriors take on Grenada in the first round of the qualifier for the World Cup and of course we wish the Warriors all the best.
02:40Now even though we spoke about that today is Wednesday so that means we speak everything legal and of course you will also have the opportunity to chime in and talk to us and let us know some of your concerns that you may be either involved in or see and you're not sure how to operate legally, where would you be placed?
02:58So many times we always say it seems like the law doesn't really stand at the side or defend those who are not criminals, the law-abiding citizens we call them, but more so we're seeing more and more that a criminal element as we are seeing of late, everything is bail, bail, you can do almost anything in this country and it seems like you can get bail but is that really the case?
03:25So of course our tenured law on every Wednesday on Beyond the Tape we are always honoured to have Corporal Ali here with us, we welcome you and good evening.
03:33Good evening to you Whitney.
03:34How was your day today?
03:37It was mixed, there were busy parts and there were times that I had some time to ponder and think about all that is happening around us in Trinidad and Tobago, but good evening to you again and Jackie, family on Beyond the Tape, citizens of Trinidad and Tobago and those who are out of your jurisdiction.
03:55With me let me begin, I know that you opened by making reference to a football game, a football match and I'm happy that you begin this afternoon with a positive in reference to sport and I think it's important that every time we have sport, whether it be football, cricket in particular, you see a coming together of a nation.
04:22You see people of different culture, tradition, ethnic group, religion, what have you, coming together for a common good and I think it's important for us to reflect on that especially what's happening now and I'd like to just build on it by taking this opportunity on behalf of us to welcome all the international teams who are participating in the Cricket World Cup in Trinidad and Tobago, across the Caribbean and even in North America.
04:48I want to say welcome to all the teams, I hope that you all enjoy your stay in Trinidad and Tobago, across the Caribbean and North America.
04:56But with me on a legal context, a legal note, I know that you got a very strong opening, I want to just remind respectfully Trinidad and Tobago, with reference to this high profile and this matter of public importance, with reference to, as he's referred to Mr. Christmas, Liss was charged and is presently before the court.
05:20I wish to respectfully advise members of the public, I've looked on subsequent to the charge and I just want to identify first to myself and to everyone else, being an officer of the court, do not forget or be conscious of the sub judice rule.
05:38And basically, it's a Latin term, it simply means that this matter is now engaging the courts or is before a master of the high court and there's an important reason for that.
05:50While I am aware that everyone will want the opportunity to comment and express their views, I want us to still appreciate that there must be, we must observe due process and we must ensure that Mr. Christmas Liss is entitled to a fair trial and to ensure that we observe all the protocol governing this particular matter.
06:10It's important for many different reasons, so I just want to begin with this afternoon, just a word of caution to just to advise persons to be responsible when they're expressing their views, especially where this matter has been positioned.
06:23So I just wanted to begin with that.
06:24I think most persons are confused, that's really the case, so they may speak out of context or with of course with emotions because I think many persons don't really understand how the sedition law works and it is a bit confusing because it's something that it may be foreign to most and another custom hearing.
06:45Well, I'm happy that you said that in terms of looking at persons who may be curious about the application of the law.
06:51What I want to say to you that you have the best opportunity now to sit back and look and see how this matter progresses and hopefully in the process you'll get a full understanding as to the law of sedition and perhaps in the future with the necessary approvals, maybe we can probably venture into the sedition law deeper.
07:11But for now, I just want to ensure that everyone is acting responsibly and ensure that due process is observed and that is for all the stakeholders.
07:20So it's not only in the context of defense, it's in the context of the prosecution and most importantly, we don't know whether in fact this matter may attract a jury trial or a judge alone trial or it may be at a magistrate level.
07:31So just be cautious. I know that you all are very interested in this matter but as an officer of the court, it's my responsibility and my duty to ensure that we observe the protocols, due process and the sub judice rule and also to ensure that the pretrial publicity is not one that is geared towards an unfair trial for all the stakeholders.
07:55So I just wanted to begin with that this afternoon. But Renan, Tobago, we have seen what happened over the last couple of days with me.
08:01I remember on this very set, I shared a conversation with you where I was just reflecting and the part I was reflecting on today, I've seen many different persons at different level of the society have spoken on this matter, responded to this matter.
08:19And again, it is reason for us to recognize that when we are speaking about crime and more so gang related crimes, that it has the capacity to affect all the rights under Section 4 of the Constitution.
08:33And in the last occurrence, we see that a place that's supposed to be a place a person goes to be cared for, to receive medical attention, we've seen that criminal elements are intended and now causing those places to be a place that is not safe anymore.
08:49So we looked at it before in terms of the impact on education. We looked at it in the context of your right to your home in terms of home invasions.
09:00So we have seen many different rights being impacted and it's important for us as a community, as a society to recognize that crime will basically, if not controlled immediately, will reach into every sphere and no one will be spared in relation to where these criminal activities are concerned.
09:16I don't want to go further, but I must join you to echo condolences to the persons who may have lost their lives in the flight of trying to assist other persons.
09:27You know, we have heard from the reports that persons were conveying persons to save their life and they were met with deadly force and they succumbed to the injuries.
09:39I want to echo the condolences to those families and again, to show exactly the collateral impact, social, economic, health wise, in relation to where crime is concerned.
09:49So Trinidad and Tobago, we are again taking this opportunity to urge every single one of us that we have very serious business on our hands and let us play our role, play our part to be able to protect the people of Trinidad and Tobago and those who may be visiting us.
