03:00Of course, it's Legally Speaking Wednesdays.
03:04And for those of us who were glued to our televisions last night, you would have known
03:09that with just three results left, Donald Trump crossed the critical threshold of 270 electoral votes.
03:21So he's now the new President of the United States.
03:25Well, I mean, he'll be inaugurated next year, of course.
03:29And Kamala Harris, you know, losing in her attempt to become the President or the Democrat elect for that spot there.
03:39And of course, it's a bittersweet day for us here today, of course,
03:43because we had some good news early this morning around 2 a.m.
03:47Businessman Suvish Ramnarine, who had been kidnapped for about 25 days,
03:53was released by his captors in the Kanupia area this morning.
03:59About three hours later, just before 5 a.m.,
04:04police officers were conducting an exercise, an anti-crime exercise in the Southwestern Division.
04:11And they went to an area in Guapo Village on St. Rose Street
04:18where they would have executed a warrant for arms and ammunition.
04:22And of course, during that exercise, P.C. Krishna Bandahar from the Sipario CID was on duty.
04:33And apparently, he saw some suspects leaving the premises through another route.
04:39He had chased, and in that ensuing gun battle, injured one of the suspects and also killed one of the suspects.
04:48Unfortunately, P.C. Bandahar, who also suffered some gunshot wounds,
04:54was rushed to the Point 40 General Hospital and he died about half an hour later around 5.20 a.m.
05:01So we want to send out our condolences to his family
05:05as well as the officers of the Trinidad and Tobago Police Service
05:09who, across the country and who also worked with him.
05:13And on that note, of course, I want to introduce you today to Corporal Zahir Ali,
05:19also a legal attorney for the Trinidad and Tobago Police Service. Welcome, sir.
05:24Well, good evening to you, Mark.
05:26Good evening to Trinidad and Tobago and persons who may be visiting our beloved Trinidad and Tobago.
05:31Mark, I want to thank you very much for highlighting very critical issues at a very early stage this afternoon.
05:38And please permit me to respond to them immediately.
05:41Let me join the international community to extend congratulations to the elected president, Donald Trump,
05:49and to demonstrate again the power of the people when it comes to elections.
05:56Secondly, on a more serious and unfortunate situation,
06:00let me also join with you in extending my condolences to the family,
06:08the colleagues, the entire TTPS on Trinidad and Tobago with that unfortunate situation this morning.
06:15As we speak, Mark, I wish to indicate that the Deputy Commissioner Intelligence and Investigation
06:20and a party of officers are presently en route to visit the family
06:24and also the Southwestern Division, that particular police station,
06:28to ensure that the necessary support in whatever format is given
06:36or are given as the case may be to the officers belonging to the Southwestern Division.
06:39So I just want to indicate that.
06:41And I also want to take this opportunity to signal immediately to Trinidad and Tobago
06:46that the incident this morning is a clear demonstration that there is no respect for the rule of law.
06:52The suspect would have clearly demonstrated that he is bent on breaching the rule of law.
07:00And I want to advise all my police officers who are presently in search of the suspect
07:06to ensure that they apply the rule of law to the letter of the law and I say no more.
07:12With reference to the issue surrounding the kidnapped victim,
07:16Mark, again, I know on this particular platform you have deliberately chosen this platform
07:21to make and plead for the release of that individual.
07:24And again, hearing that news of the release of the kidnapped victim,
07:28again, very, very good news and I want to just, as a matter of caution,
07:32indicate to Trinidad and Tobago that notwithstanding that the victim has been released,
07:37the investigation is very wide open as a matter of fact.
07:40It even creates even more interest now that we have the victim in hand.
07:44So members of the public, if you have information,
07:47if you have any intelligence that can support the inquiry,
07:50use your formal channels or use your confidential channels to ensure
07:54that the police benefit in order to detect and solve that particular crime.
07:58And looking at both the kidnapped victim, the shooting this morning, Mark,
08:02it's important, legally speaking, under the criminal law,
08:05I want to ensure that the citizens of Trinidad and Tobago,
08:08and particularly those who may be inclined to do any act
08:13that may be without lawful authority or without reasonable cause
08:18that leads to impeding the apprehension and the prosecution of the suspect
08:25or the suspects both in the shooting incident involving the police
08:29and the police also who was injured, who is, you know,
08:32I wish him a quick recovery as well, and also to this kidnapped victim,
08:35that persons whom may have done any act to impede an apprehension
08:40or prosecution of the suspect, I want to let the members of the public know
08:43that that can land you in a contravention of the criminal law
08:46and you yourself could be answering questions when it comes to the criminal law.
08:50You know, we have heard it in layman terms, harbouring a criminal,
08:53harbouring a murder suspect.
08:55I want to make sure on this program that you are fully aware.
08:57So those persons who may be aware or may be assisting in one way or the other,
09:02that suspect evades law enforcement.
09:05I want to indicate to you clearly, your best option is to turn that individual
09:10over to law enforcement before law enforcement taps on your door
09:13and you or yourself is found wanting what the criminal law is concerned.
09:17Now, I just want to, on a point of clarification,
09:20I'll give you some good news.
09:21Sure.
09:22Is that following that exercise, I had a discussion with ACP Meister
09:27and he told me that the second suspect was held within,
09:31I believe, two hours after the incident, or three hours,
09:34hiding out in a spot nearby also with a firearm.
09:38So, rest assured, that second suspect was indeed apprehended by the police
09:43and I can also clarify, contrary to what you saw on social media,
09:48that there was only one police officer that was shot and injured
09:53and obviously passed away at the Point Forty General Hospital
09:57and that was confirmed also by ACP Meister
10:01because, you know, there's always a lot of erroneous information on social media
10:05and we always tell people to always look at mainstream media.
10:08Sometimes having it first doesn't mean you're always correct.
10:11Yes.
10:12You know, and I myself will always try to double and triple check something
10:15before I post it online for my station or for the Daily Express
10:20and I think a lot of us pride ourselves in not always wanting to be first
10:23but wanting to be accurate.
10:25Yes, and Mark, on your own point,
10:27in terms of that responsible journalism that you were speaking about
10:30and again, hence why, you know, many times that, you know,
10:34there's matters that, you know, I'm called upon to, you know, comment on,
10:37I'm very careful in terms of how we respond,
10:39in terms of speaking to the facts of the matter
10:41because especially circumstances like this,
10:43it's only when you get the opportunity,
10:45like in, for example, the officers who were involved in the shooting this morning,
10:48only when you get the opportunity to get a full report
10:51of the officers who were on board,
10:53they will be in the best position to tell you exactly how many suspects,
10:56exactly what transpired.
10:58So yes, you know, I know that we are eager sometimes
11:00to place information in the public domain
11:02and there are pros and cons to that
11:04but, you know, I'm happy that you took the position
11:06and I hope that all persons who may be exercising
11:10that social media platform
11:12also respects, while they are not formally journalists,
11:15but understanding that your publication
11:18can also prejudice
11:20or, you know, misrepresent
11:23very, very serious matters.
11:25So I want to thank you very much for that, Mark,
11:27but again, very important issues this afternoon
11:29and members of the public,
11:31it's been a pleasure to be here.
11:33All right, we're going to go to our headlines now
11:35and we'll be back.
12:01So those are some of the headlines, of course,
12:24making the news within the last 24 hours
12:29and, of course, one of the very good news topics
12:34deals with kidnapped,
12:36well, formerly kidnapped businessman
12:39Suvish Ramnarain
12:41who was taken from Rob's bar in Cunupia
12:45on October 12th, on Saturday, October 12th.
12:48So this morning, apparently,
12:51and you would have seen these images
12:54that were circulated on social media,
12:56he was sitting there quite calmly
12:58and then you see a number of persons
13:02purportedly in tactical police uniforms
13:05ushering him out of the establishment.
13:08Of course, Mr. Ramnarain is going calmly
13:12because he probably thinks
13:14because they also have a SUV with a strobe light
13:17and then they also,
13:19they put him in one of the vehicles
13:21and they took his other vehicle,
13:23which is parked, if you could just,
13:25at the bottom of the screen you'll see another SUV
13:27this is another angle of him
13:29going with the alleged imposters
13:33going into those vehicles
13:36and I think his family, certainly,
13:39and we have been,
13:41and Corporal Ali will agree that
13:43we have been for the last three weeks
13:45asking for a safe release
13:48and we are happy that those that heard that plea,
13:51of course, would have returned him safely to his family.
13:54He was dropped off around 2 a.m. this morning
13:56in the Kanupia district.
13:58He later made his way to the Kanupia police station,
14:01I understand, with the help of residents.
14:03And, of course, you also know that
14:05that central area, there's been a lot of talk
14:08about extortion
14:10with a lot of business people
14:12and this is the Kanupia, main area of Kanupia
14:14where a lot of business people,
14:16not only in Kanupia but in Chagwanas
14:18and other environments,
14:20have spoken about extortion by people
14:24and most of them are afraid, obviously,
14:26to come to make a formal police report
14:30but we want to encourage you guys
14:32with the extortion unit
14:34to obviously heed the call
14:36and going there and speak with the police officers
14:40of that unit
14:42and hoping that you get some kind of assistance.
14:45So, Sydney, a very happy ending
14:47and I know there was a lot of anxiety
14:50and uncertainty by his family
14:52and, of course, Trinidad and Tobago and, of course, the police
14:54but here he is back home with his loved ones.
14:57And, Malcolm, again,
14:59just for the matter of the record,
15:01when we are speaking about the kidnapping
15:04or abduction of a human being
15:06and a demanding of a sum of money
15:08for the release of that individual,
15:10I always stress on the dignity of the human being.
15:15You know, only that victim will know
15:18the last 25 days,
15:20the circumstances that he attained.
15:23And, you know, when we are seeing kidnapping,
15:25the police protocol,
15:26to show you how serious this matter is,
15:28the protocol that kicks in,
15:30apart from the district station
15:33informing the anti-kidnapping unit,
15:35there is also, within the police protocol,
15:37the need to inform the Homicide Bureau of Investigation.
15:39Now, why am I saying that publicly?
15:41It clearly demonstrates that
15:43there is the reasonable foreseeability
15:46that when you are speaking about the kidnapping,
15:48taking and carrying away of an individual,
15:50you already start contemplating death.
15:52So, I'm just saying that it's significant
15:54because you don't know when you're going to take an individual,
15:56when in fact there will be some level of resistance
15:58and someone is killed in the process.
16:00Or even someone trying to escape their kidnappers
16:04and they themselves are shot in the process.
16:06So, it's a very, very serious crime.
16:08The Anti-Kidnapping Act will speak to the sanctions
16:12that are associated with kidnapping and kidnapping for ransom.
16:14So, again, this is a crime that, you know,
16:17I'm calling on Trinidad and Tobago
16:19to, again, look at the Anti-Kidnapping Act
16:21where if you are aware of a kidnapping
16:23or you are aware of a kidnapping that's about to be committed,
16:25you have a duty, a statutory duty under law
16:28to report it to a police officer
16:30so that the necessary actions can be taken immediately.
16:33I always use this opportunity as well, Mark,
16:35that, you know, when we're speaking about missing persons
16:37and the police response,
16:40these are matters that we should not be taking lightly
16:42and we should be, you know, activated in such a way
16:45that the TTPS is in pursuit of rescuing this victim
16:48as opposed to departing to a particular station.
16:50So, I'm happy that you placed some light on that particular area.

19:11It's Legally Speaking Wednesdays.
19:14I'm your host Mark Bosander of course joined
19:16today by Corporal Zahir Ali, Legal Attorney with the Trinidad and Tobago Police Service.
19:21We want to remind you of the numbers to call.
19:246231711 extension 1992, 1993, 1996, and 1997.
19:29So, we just want to go back to the incident this
19:34morning in point 40 involving police constable Krishna Bannaha. Now the
19:42incident allegedly occurred up at St. Rose Street in Guapo and if you look
19:48it's the house I believe to the left of your screen there just after the shed
19:52where I believe that the search warrant for arms and ammunition was executed by
19:59the police in this particular matter and of course in so doing PC Bannaha was
20:11on the outskirts parked in a vehicle that's Mr. Bannaha he's just about 25
20:16years old has only four years service according to ACP Meister so he had a lot
20:23to look forward to in his life and of course in an unguarded moment suspects
20:30came out of the house from another another area while the police were
20:33entering from another location. He saw them and he gave chase. They shot at him
20:41he shot back and of course you know the protocols there you must observe of
20:47course and of course he was wounded he also killed one of the suspects and the
20:52other one was held later on but just just for the public to understand the
20:56rules of engagement from a legal aspect when a police officer is faced under you
21:02know the use of force policy. Well before we go to the use of force policy and I
21:07think it's a relevant question on this time. Many times on this platform I spoke
21:13about the criminal law arc in terms of section four which speaks about the use
21:16of force in the prevention of crime, assisting in the arrest of offenders or
21:23persons suspected at large. It's a clear case where when police officers in this
21:29case based on the report they are executing their duties the execution of
21:33a search warrant and they are met with deadly force. The officers are mandated
21:40or I should say authorized in law to use such force as reasonable in these
21:44circumstances. So in this case you are met with deadly force the proportionality
21:48is that you will return deadly force. So before we go to any use of force policy
21:52which is an internal policy, the law of the land, the Parliament has given the
21:57police that autonomy and may I say the autonomy that the police have in that
22:01particular section four, every citizen have the said authority when it comes to
22:05their life being in immediate danger or the life of someone else. So I want to
22:09make that abundantly clear in terms of that particular criminal law act. Where
22:12the use of force policy comes in is in relation to where as an organization
22:17you'll be given firearm, you'll be given baton, your uniform, the pepper spray,
22:22the taser and those things will come into deal with particular situation. So
22:25in this particular instance while you may have had non-lethal force in your
22:29possession what you are met with is deadly force. So it may be a straight
22:33case that you revert to your deadly force to be able to deal with the
22:37situation. So again I hope that brings clarity to the situation in reference to
22:41police officers and having the ability and the authority in law to respond to
22:45situation. Now Mark may I just make one point in relation to that. It's important
22:49for members of the public to understand that when police are executing a search
22:52warrant, there is two things normally. They are executing a search warrant maybe for
22:57firearms and ammunition or drugs or they may be executing a search warrant for
23:02evidence. In both instances those are official duties of the police where they
23:07are carrying out basically directions or orders of the court because they would
23:10have applied and gotten search warrants or go to locations and this is the risk
23:15that police officers are faced on a daily basis when we are trying to defend and
23:21protect our nation. So members of the public you know we always say that the
23:24public is the police and the police is the public. This is an oath officer who
23:28has now lost his life trying to do what Mark? Uphold the rule of law because going
23:32to that location without giving too much because I know it's subject to an inquiry
23:36but the warrant is in the periphery. It means that this was a situation where
23:40you are going to gamble, where you are going on a line. This is where you're
23:44going to do the public business and you are met with the deadly force. I might add
23:48that apart from the fact that there was a shooting of a civilian right? Yes. That
23:53ACP Meister said that that will be thoroughly investigated and there were
23:58also allegations made by persons in the house that that police officers were
24:03roughed with a teenager and he also said that will also be addressed but we want
24:08to take a listen to ACP Meister who was on the scene early this morning.
24:38He was taken to the 414 General Hospital where he died on arrival. I want to take this opportunity of course to express our deepest condolences to his family, his immediate family.
24:51So basically that's what we have right now. An investigation has since been launched into the police involved in the shooting and we will appraise members of the public.
25:01One of the suspects was fatally shot. There was a second suspect who fled the scene
25:07and right now as we speak we have officers who have launched a search party looking for that second suspect.
25:15We had warrants, we had different armed activities taking place. So it was a combination of exercises in the entire southwestern division.
25:22That was just one of several exercises. One firearm was recovered. One of the
25:28Glock pistols was recovered. That Glock pistol, what we observed, that Glock pistol had its selector adjusted so that particular firearm could have fired automatically.
25:39And that's a point you made about the adjustment of that selection. So when you press a barrage, a gunfire, you know, with the Glock that they found in the possession of one of the suspects.
25:55Of course, the other suspect was later held. This interview obviously would have been done prior to the suspect being arrested.
26:03Mark, just before you go forward, let me acknowledge ACP Meister for the efforts in his southwestern division and may you respectfully urge him and the executive of the TTPS
26:14that, you know, I hope that that search broadens across all police divisions to ensure that, you know, I always use the example here that, you know, when the head hurts, the two must feel the pain
26:25and we must not be restricting the search for that suspect, you know, unless the intelligence is suggesting that he's somewhere in the southwestern division.
26:32You know, I want to acknowledge you, welcome Mr. Meister, but encourage the executive for the TTPS to be, you know, on the ground with the view of making a quick and swift arrest in these circumstances to ensure that we send the message that is required to be sent when you are interfering unlawfully with the TTPS, which is entrusted by law to protect the citizens of this beloved Trinidad and Tobago.
27:00All right, so we just quickly want to go to a video following a shooting. I understand the person was shot and killed not far from here at Duncan Street in Port of Spain this afternoon.
27:14You're seeing there a police vehicle blocking the road near Duncan Street and we understand somebody was shot in a vehicle. We don't have the person's identity just yet, but what I can tell you is that that is the 536th murder for the year.
27:33For the corresponding period last year, we had 489. Of course, it's not an envious figure to boast about in any measure because one murder is one too many and we are hopeful that, you know, the perpetrator is in this particular matter and of course all the other outstanding homicides will be brought to justice.

30:17Joined today by Corporal Zaheer Ali, attorney at law with the Trinidad and Tobago Police Service.
30:24And we're talking just at the break in reference to protocols observed and so on.
30:33And I know Mr. Meister, ACP Meister had spoken about the fact that there's still an investigation outstanding as it relates to the shooting of the civilian who died, a suspect and of course the police officer that was shot.
30:46And all these other allegations that apparently relatives of the person or persons are making in reference to this.
30:54So there will be a thorough investigation. He gave that assurance of course and we'll hear more about that later in the TV6 News.
31:01Just for the clarity as well Marc, when things like this occurs, normally what you have in protocol, normally an assistant superintendent in the division will be appointed to lead the investigation to ensure that no stone is left unturned.
31:14And you know we always hear about the police, professional standards bureau and even the police company's authority as additional oversight body to ensure that there's due process in what's happening.
31:23So you know just to give the members of the public that you know Mr. Meister always balance the scale because you know once allegation is made in a particular situation, you know we cannot be looking at it with one eye but there must be objectivity in terms of approaching these issues.
31:36So I'm happy that you raised that as well.
31:38Of course, most definitely. We just want to switch gears a little bit here and we want to look at a video involving a pedestrian that was knocked down in the Point Forty area sometime this morning.
31:51So this is the footage, the person is attempting to cross the street.
31:59And it seems that this vehicle lost control.
32:03To me it looked like there was actually two pedestrians crossing the street there.
32:07Coming off the curb, crossing, the car is coming down at a kind of speed that the man swerves, loses control of the vehicle and the back end of the vehicle hits one person and ends up in the drain and the other on the roadway.
32:22And sitting there and there's somebody running to the aid of, well to both persons apparently.
32:30We understand one of them injured was a lady.
32:33And I know that we had Mr. Batson last week on the program.
32:41And he spoke about, you know, this is one of the injured victims here lying on the ground as people rush to their aid of course.
32:55And the road was also wet.
33:03So it seems that he saw them, he says, the drivers talking to the people over there.
33:14Of course he loses control of the vehicle, the road is also wet.
33:20So if you're going at a particular speed and you're trying to match break and people are crossing in very close proximity, the vehicle fished out of course.
33:28And as we were saying, Mr. Batson last week was talking about there has been an uptick in, if you look at the 2024 statistics to date in terms of accidents, a 62% increase in relation to pedestrians.
33:49Pedestrians, you see there in 2023 was 26.
33:54And in 2024, 42.
33:56Of course I figure perhaps in the last couple of days I've gone up maybe to 46, 47 because I know there were a couple other accidents that took place over the last week where people were injured or killed, if memory serves me right.
34:12And with of course the weather and of course with the Christmas season coming around the corner, we want to urge drivers to exercise caution on the roadways.
34:24Well Mark let me just stretch that out a little bit and I see that you're using the word caution.
34:28Just to go back from our preliminary stage, when you're going Mark and you're doing a regulation test, you're doing a driving test, it's indicative that you'll be trained and advised to observe the road traffic regulations.
34:41And just hearing your commentary this afternoon, you in a situation where the roads that you're on as a motorist, it will have speed limits, it will have road signs.
34:54And you know I'm not pronouncing on this matter because I know it will be subject to an inquiry, but again to urge the motorists in Trinidad and Tobago, and you spoke about this particular season, that we need to be responsible and ensure that there's a section that sometimes as motorists we do not pay attention to.
35:07Driving in the minimum with due care and attention.
35:11Driving, we ain't speaking dangerous driving as yet, but just driving with due care and attention where you're aware of your surroundings, you're aware of the conditions of the road.
35:19So it's a responsibility that resides with you, but understand that that responsibility, you have a duty to care for the other persons that you'll be coming into contact with, whether it be motorists or pedestrians.
35:29And Mark, we must not stay away from also advising the pedestrians as well.
35:34That sometimes there may be an authorized place for crossing, but we have a culture that we're just looking to just use the first opportunity to cross a main road or a road that is busy.
35:47So the pedestrians ensure that you also observe your road safety practices as well in these circumstances.
35:52But again, unfortunate situation, and I hope that a diligent inquiry is conducted to even go to looking at the mechanics of that particular vehicle to ensure that there was no defect for that vehicle.
36:03Just in case someone crossing, where in fact you still, if your vehicle was working properly, you could have come to a stop to avoid contact with other persons.
36:10Certainly, of course, as you talk about defects, you know, whether your tires are in need of changing and so on.
36:15That's correct.
36:16It's also important because, you know, traction on the roadway and so on.

36:53Officer, my point is, if I have an FUL, I went through all the tests to get the FUL, am I supposed to take that FUL and lend it to somebody who did not go through anything?
37:07What happens with that?
37:08That's my point.
37:09Another thing is, I saw where the same beach I spoke about, the Flawpot Beach, where the bandits were robbing people, I saw they got a body there in the bush area, they got a body there.
37:21And my last point is, on yesterday's program, they were talking about the right to own for officers, you know, for different businesses, and that is a very good thing that is taking place.
37:31But I saw one police officer who had to protest because he didn't get his back pay and whatever.
37:37And I listened to another program and they said there are many others who they have left retired and they are up to now they cannot get their back pay and that is so ridiculous.
37:45Something has to be done about that.

37:56Mark, the first issue that you raised in relation to a person who has made an application up to an FUL and then decides to, you know, part, you know, without justification, without authority, we are speaking a contravention of the firearms act.
38:10You are transferring a firearm to someone who is not authorized.
38:13And when you look at the firearm, just for me of public information, legally speaking, that particular FUL and the conditions, it is very clear that you are to be protecting that firearm from unauthorized persons.
38:24So if you are transferring that firearm to someone who is not authorized, whether it be in the hands of the commissioner, police, or in any other circumstances, you yourself is, you know, putting yourself in harm's way.
38:35So FUL holders, you know, be cautious as to how you conduct yourself with your FUL.
38:40And I think the other two matters was just a body found in a bushy area.

38:46Right. Again, you know, we call for that due diligence, you know, from the members of the community, you know, regional cooperation.

43:51Of course, you know, there was the attempt on a lady they tried to allegedly kidnap in a black SUV, Prado.
43:58And there were two SUVs at the front and the back of her.
44:01She was able to kind of push one of them out of the way and drove off.
44:06A couple of weeks ago, that was just after the shooting of the police officer, a couple of days after that.
44:13Okay.
44:15So I think he's alluding to that.
44:17Okay, well, if that's the case, we'll probably get another update on whether, in fact, it's been investigated and if so, what's the status of that matter.

44:31Officer, I call on China or something, right?
44:34There's a section on the Exchange Control Act, right, number 29, section 50.
44:49It actually states that there is 12 legitimate organizations, which is the bank, and there are six other traders, I think, that we're supposed to only sell or buy for a trunk.
45:11But when you check almost every shop of businesses you walk into, there is signs stating that you are for sale, be buying or selling.
45:22So is that legal or is that illegal?
45:25Well, a beautiful question, caller, and I thank you that you have actually, you know, took me to that particular legislation.
45:35I do have it before me, but if you are reading it in the way that you have read it publicly, that it authorized and has designated entities to be able to deal in the transaction regarding foreign exchange,
45:46and you are going to a particular establishment and seeing these signs, it means that definitely, in the minimum, this matter should be reported immediately to the appropriate authorities so that they can look into those matters based on what you have shared with me.
45:58However, what I'll do, Mark, on the next occasion, we'll have something to say to be able to support that question that was asked this afternoon.

46:29We are about to change the year, and that hasn't happened as yet.
46:34So let me pose one question to you.
46:37If there is a foreign invasion, and the father has the FUS, can anybody in the house use that FUS at that point in time?
46:53I would like to know.
46:55Well, caller, again, two very good and strong submissions.
47:01One is the first issue regarding someone who is authorized from the fire section.
47:04I know that the members of the public want to engage those persons effectively, Mark, and I know that they have made several calls.
47:11So perhaps maybe I can probably urge you to make that request to the TTPS so that we have someone from the fire section to come to answer all the issues that person may be having.
47:22But the second issue, a very good question, especially in the times that we are living.
47:25I don't like the term home invasion, though.
47:28I think it's a term that we are using loosely, but when we speak about robberies and break-ins and acts of violence, maybe even anti-gang matters, that we can define it as that.
47:41But the question is whether, in fact, someone who has a legitimate firearm in the house, another person in the house who is not authorized can use the firearm.
47:51I'll say publicly that if your life is in immediate danger, your family life in immediate danger, whoever reaches that firearm can use that firearm in relation to defense.
48:00We will speak to answering that question later.
48:04We are looking at your self-preservation, and let us make it even a little more interesting.
48:09Could you imagine the FUL holder is injured and the firearm is available to other members of the house?
48:16What are we going to say? That we're not going to have access to defend the life of the FUL holder and everybody else in the house?
48:22So I will take the position where anyone in that house, if your life is in immediate danger, other persons in that house, and you have the opportunity to use that firearm, use it.
48:33And I'll advise the police to do a diligent investigation so that we can see at all material times that the use of force that we spoke about, that section 4, and the elements of self-defense,
48:45is alive and well in that particular situation.
48:48So I hope I answered that question.

49:08I know that Forex matter that you referred to, I know that there are people buying and selling Forex, and they're not legitimate people supposed to be doing such.
49:20I actually got a call from a friend, he was saying that they were putting people, they were looking at people that were on a watch list for conducting such transactions.
49:32Yes.
49:34By law enforcement, apparently he's looking into something like that.
49:37So there might be some merit to what you have alluded to.
49:40Yes.
49:41People, I guess, because you're not a bank, of course.
49:44That's correct.
49:45And they deal with the foreign exchange issue wholly and solely in most cases.
49:51I do believe you have a caller on the line.

49:56No, I have an observation here concerning police officers getting shot and killed.
50:02This year, if I recall, it's very often police officers getting killed.
50:07And you also notice that when three or four violent combat fire, and there's one police officer in one fire, you don't have a chance.
50:15So I think you should have more than one police officer in this establishment, which they are guarded, because the owners really don't care about anybody, you know.
50:24All they care about is taking their money.
50:26The police officer is a family man, too.
50:28He has to go home and get to his wife and children.
50:30And I think the TKPS should do something about police working by themselves.
50:36They don't have a chance when three or four violent combat gun.
50:39Have a blessed one.

50:44And if I may take that caller's submission in the angle where probably having a look at police operation in terms of the planning.
50:52And I spoke about the issue of risk.
50:54When you're planning an operation, you must know what is the risk that is involved.
50:58So you'll know how many officers that may be required, or whether in fact you need a specialist team to be able to do that first entry that you require.
51:06So again, excellent thinking on behalf of members of the public.
51:10And I hope that the TKPS executive and other decision makers are listening.
51:15That when situations occur, they must all be doing a review to see whether in fact we can now enhance our operational capacity and capability when situations like this happen.

51:29And I know just to go back to the firearm license matter.
51:34I know there was a story a couple of days ago I came across where apparently a prison officer was detained because he gave his firearm to his friend at a bar.
51:45And the man was brandishing the firearm.
51:48And police came in and asked, do you have a FUL license for this?
51:51FUL, sorry.
51:52And he said, no.
51:53And he said, my friend.
51:54And he's upstairs.
51:56So obviously, it's a no-no to hand over your firearm to your friend to hold or to brandish in any manner.
52:01Because brandishing a firearm, even if your license holds, of course, correct me if I'm wrong, you can also be charged.
52:07Well, Mark, it's clear.
52:09When you are making your application and doing your training and your certificate of competence, it's clear that when you draw that firearm, it's for a definite purpose.
52:15Exactly.
52:16So when there's no established purpose and you have a firearm in your hand, you can be having a firearm, possession of a firearm, not to endanger life.
52:21Because there's no legitimate ground for you to be having the firearm, not holstered, if I should say that.
52:27But, again, I have seen too many times, Mark, in recent times, some matters have, you know, came to me.
52:33And I recognize even from a TTPS context and even from a citizenry context, you know that FUL booklet, Mark?
52:39Not many persons take the time to read that booklet in its entirety.
52:43And because that booklet is folded, the paper is folded, and you're opening a book.
52:48But if you unfold and unravel that document, you're going to see that there are many stipulations, conditions, guidelines, rules, in addition.
52:56And some have been now imported from the firearms into the FUL to guide you.
53:00So it's not about just having a booklet to say, okay, I'm authorized to carry the firearm.
53:03Are you aware of your protocol and what is expected of you regarding those firearms?
53:08Because, you know, I'll deal with that situation on another occasion.
53:11But we have seen also persons who are going through, leaving Trinidad and Tobago, Mark, leaving the jurisdiction.
53:17And they are now being stopped at Piaco.
53:19When you stop them, there's a wrong of ammunition.
53:21When you ask, well, where is your fireman ammunition?
53:23It is home.
53:24Where are you heading to?
53:25England.
53:26You are not complying with the Firearms Act when you are leaving the jurisdiction of Trinidad and Tobago.
53:30You are obligated to lodge that fireman ammunition to ensure that it is safe.
53:34So sometimes persons are taking chances, and you are caught within the law with no defense.
