00:00All right, let's get started with Major League Baseball, a new television deal, which I'm going
00:04to tell you about here in just a minute. And the reason why the commissioner of Major League
00:07Baseball spoke yesterday is because essentially they have a new deal. And as part of that,
00:12they were able to ask questions were reporters about other topics. And the top topic of the day
00:16outside of streaming and broadcast news was sports betting. And so Major League Baseball
00:22at this point is having to answer questions on what they're calling as a new integrity crisis.
00:27Friday, members of a Senate committee sent a letter to the commissioner, Rob Manfred,
00:31communicating a concern with baseball and other pro sports, confronting and seeking answers about
00:37the pitcher's alleged scheme involving those two pitchers on Cleveland, Ortiz and Class A.
00:42Rob Manfred, the commissioner, said the league would fully respond and cooperate on time to
00:45the Senate inquiry, saying, quote, the ability to discern inappropriate patterns is really important.
00:51We understand the prop betting market from the very beginning. I'm glad we've done something
00:55about it. He's alluding to having max wagers on some of these bets of $200. But then he goes on
01:00to say the rest of the program right now, we're generally prepared to move forward under the rules
01:04that we have now. So we'll see if Major League Baseball has any further reaction. We also know
01:08the National Football League is under some question as well with their prop bets, trying to limit them
01:12or eliminate them entirely. Also, Major League Baseball made an announcement yesterday that their
01:18broadcast deal, which is worth hundreds of millions of dollars, is headed toward NBC, Sunday Night
01:23Baseball, and the first round of the playoffs. NBC is now the primary national carrier of Major League
01:29Baseball. But in addition, Netflix will have opening day, the Field of Dreams game in Iowa, and also
01:35Home Run Derby. And ESPN is also going to have some out-of-market games, but they're not the primary
01:39carrier. They will take over MLB TV. So essentially, you can purchase MLB TV through MLB TV or through
01:46ESPN. But the bottom line is that NBC is getting back baseball for the first time since 2000.
01:51The games will also stream on Peacock. All-Star Week coverage will be on NBC. And naturally,
01:57it's about $800 million, which means it's a really good deal for Major League Baseball.
02:01And then we'll see what happens in a few years as they try to consolidate all of these deals.
02:05Now, as far as the National Football League is concerned tonight, the Buffalo Bills, coming off a
02:10stellar performance last week, will take on the Houston Texans tonight. CJ Stroud out at quarterback for
02:16the Texans. It will be Davis Mills, but it is a home game. They know what that usually means on primetime
02:20games and Thursday night football. Bills minus five and a half total, 43 and a half over at the Fan
02:26Duel Sportsbook. Huge game for Houston, by the way, to stay in the playoff mix. Here is Josh Allen on going
02:32on the road on a short week trying to capture a victory.
02:35I'm not calling, like, a team that doesn't blitz a whole lot. They're not a lot of exotic looks.
02:40They just kind of put the ball down and play. They're fantastic in the back end. I think their
02:46front is great. They're getting a lot of pressure on the quarterbacks. So, yeah, we're going to have
02:51our hands full. But again, on a short week, just trying to put together a game plan, watching as
02:55much film as we can, trying to develop as good of a plan we can, and ultimately comes down to
03:00executing on Thursday. Yeah, I mean, they have a great defense. They disguise a lot in coverage,
03:05a lot of different blitz packages where they're showing one thing and end up getting to another
03:11thing post-snap. And I mean, it's credit to them. They do it at a high level. A lot of those guys
03:15have played together for a long time. So they're able to kind of feed off each other and make each
03:20other look good and make each other's disguises actually believable. So a lot of our game plan is
03:26just really not letting the pre-snap stuff kind of bog you down too much and really just reacting and
03:33playing fast post-snap. Meanwhile, the Cincinnati Bengals, a sight for sore eyes at practice
03:38yesterday. Quarterback Joe Burrow back on the practice field, full participant for the first
03:44time since September. Probably won't play this week against the Patriots, but Thanksgiving looks
03:49like you're going to see Joe Burrow back with the Bengals. Meanwhile, first career start is on deck
03:54for Shador Sanders, who came in relief of Dylan Gabriel last week for the Cleveland Browns.
03:59They'll face off against the Raiders this week. And Sanders said to take some good with some bad
04:04from last week and try to get better. Yeah, mentally and emotionally, I'm in a great place
04:09overall. And life is always going to be adversity. Things aren't always going to go as planned, but
04:15I would say I'm prepared for everything. The same how I always am. Knowing exactly where
04:23everybody's going to be prepared, understand that they have a great defense. They coached by a great
04:28coach, you know, and they have a great players on that side of the ball. So just doing what I can,
04:34you know, to prepare mentally, you know, physically, emotionally, to make sure my best self.
04:42Meanwhile, the Green Bay Packers could be without Josh Jacobs this week. He didn't practice yesterday.
04:47They're great running back, but he is questionable, could potentially play in this week's game.
04:52Vikings will take on the Packers in a divisional battle. Matt LaFleur talked about Emmanuel
04:56Wilson potentially getting the ball. And of course, Wilson did score a touchdown this past week.
05:02Yeah, I just think that, first of all, I think Ben does a great job with those guys, but
05:06just, it speaks to his development. I can tell you, you know, his rookie year is nonstop. He,
05:15I was always in his ear, you know, kind of getting on him pretty good, but it's a credit to him
05:20in regards to being able to take the coaching and just show up, I would say, with a sense of urgency
05:26every day. There was a lot to learn coming from where he came from to where he is now,
05:31but I think he's embraced that. He's embraced the challenge and then he's maximized his opportunities.
05:38New York Jets will start Tyrod Taylor this week against the Ravens. And over in college basketball,
05:43we saw a pretty big win for Arizona last night. They defeat UConn 71 to 67 and have some really
05:50big wins on their schedule already this season. Jaden Bradley had 21 points. UConn sort of gave
05:56this one away late in the game and Dan Hurley wasn't happy about that. You know, brutal loss just
06:02because we, you know, we fought so hard, you know, to, to get a lead down the stretch. And then,
06:08you know, obviously they have that bad miss, you know, up one bad miss at the rim.
06:15Just got to secure that defensive rebound, come down, execute, maybe get a, you know, get,
06:20get a three point lead, four point lean. They pick it up off the ground, turn and score,
06:24take a one point lead. So, yeah, really tough, you know, tough loss because we could have stole it.
06:29I mean, literally stole it. We were out rebounded obviously by 20 and, you know,
06:34versus a high level opponent. You're not going to have many nights where you could steal one
06:38versus top five team when you get out rebounded by 20. Meanwhile, Alabama Crimson Tide, keep things
06:45rolling, get a big win over Illinois at the United Center. Labarian Phylon from Alabama had 24 points
06:52and five assists. Will be a fun showdown Monday as Bama takes on the Zags in Las Vegas. Here's Brad
06:58Underwood on the victory. Again, it was, it was, it was, it was their night. They played better than
07:04we did. A lot to learn from for us in that, in that moment, you can't have a lane violation.
07:11You know, when they miss the front end of a one-on-one, we had a couple back-to-back turnover
07:16sequences that hurt you, but I love our team. I love where we're going to be. I thought our two
07:23freshmen didn't play great tonight, but they had something to do with that. So my hat's off to
07:30Alabama and, and they're obviously going to have a great season and I hope to see them in the final
07:36four. Jalen Brunson returns for the Knicks. He had 28 points and New York beats Dallas by a final of
07:43113 to 111. Guess who had a triple double on the Denver Nuggets? I'll give you a hint.
07:48It's the picture of the guy you see right there. Nikola Jokic, 28 points, 12 assists and 11 rebounds.
07:54Denver beats New Orleans, 125 to 118. Red hot Houston Rockets win their fifth straight,
08:01114 to 104 over the Cleveland Cavs. And no surprise here as Oklahoma City has been the very best team
08:08in the NBA. They're now 15 and one with a 113 to 99 win over the Sacramento Kings as Shea Gilgis

08:32landscape, sports betting landscape and legal landscape as well as it pertains to sports.
08:37And Dan, great to have you back here on Newswire. I know it's been a minute or two since you and I
08:42have caught up. Appreciate you coming back on the show. My pleasure. I think my three-year suspension
08:46is over. So I'm excited to be back for the program. Has it been that long? It cannot. I don't recall
08:54what I did, but yeah, it took a while to get back, to claw my way back. So I decided to wear a suit for
09:00the occasion. First time ever. That's nice. That's nice. Yeah. I think the last time we left, it was
09:06like some not allowed to go on the internet in some country you were living, but that's a story for
09:10another day. But anyway, let's get started here because yesterday or this week, a very interesting
09:16event from the CFTC. One of their nominations, their nominee, Michael Selig, was finally put to
09:22the test. And with these prediction markets, no one seems to be answering questions as to what the
09:28future could potentially hold. Is prediction market sports betting? Is it not? And Selig, who of course
09:34is expecting a nice bump here in salary and pay and a new job, didn't really seem to be all that
09:39interested in challenging these prediction markets, saying that he is going to leave it up to the
09:45courts, saying several times he's going to leave this to the courts as it pertains to prediction
09:49markets. So it's been a while since we've talked. What do you make of this whole prediction market
09:54business? It seems like a lot of companies are jumping in. DraftKings, FanDuel even leaving the
10:00American Gaming Association. There's just no stopping this train, and it doesn't seem like anybody's
10:05willing to even challenge it at this point. Well, because it has the full-throated support of the
10:10Trump administration. Donald Trump Jr. is a strategic advisor to Polymarket, to Calci.
10:17Truth Social is now in a partnership with Crypto.com. Wall Street is behind this. The White House is
10:24behind this. Major financial institutions like Citadel, Susquehanna, Silicon Valley. And if we're
10:30going to analogize to David versus Goliath, the Goliath are the prediction markets because they
10:36have the full support of the federal government now as exemplified by nominee Selig's non-answer
10:43and dodging of an obvious question. If you place a bet on the outcome of an NFL game, is that gaming?
10:48He couldn't even concede that. And the reason he did not make that concession is that there is a
10:54regulation in the CFTC rulemaking in which gambling contracts, gaming contracts are per se prohibited
11:03as contrary to the public interest. When Congress created this whole mess back in 2010, no one ever
11:09thought that sports betting was a vehicle which could be conducted on the derivatives markets. It
11:15stayed silent for 15 years and only through a very creative lawyering by Calci's legal counsel
11:21did the notion of like swaps now encompassing outcomes and sporting events come into the
11:27public sphere. It is just this mysterious argument that has gained traction over the last couple of
11:34months, but the courts have increasingly rejected that premise. So the future of the prediction
11:40markets, I think at least for now, may be in the hands of the federal courts. But the good news
11:44for those who support prediction markets is that these court battles may last for another two to three
11:50years before we get clarity around the law. And nominee Selig was handpicked by Donald Trump, not
11:57because he was neutral on prediction markets, but because he would do nothing to slow it down and to not
12:04even be able to define what gaming is. Every first year gaming attorney knows what gaming means. Sports betting,
12:12casino, that is quintessential gaming. And he wouldn't even give an inch on that because to do so would have
12:18compromised the legality of the prediction markets because CFTC is not pushing back, has not taken any action to
12:25limit or restrict the kinds of event contract that event contracts that these companies are now listing, all of which are
12:33tied to outcomes of sporting events, quintessential sports betting.
12:37So let's play it forward here a little bit. And even though it may come down the line, we understand
12:44these companies could operate in the space for a while. So how will the pending court cases impact all
12:50of it? And certainly will it potentially make an effect on whether or not they're able to operate? And could
12:57this eventually get to the Supreme Court, just like sports betting did several years ago?
13:01I think we're on a path to the US Supreme Court because there are conflicting lower federal court
13:08rulings. Six different states are in litigation with Calci currently. Two decisions initially went
13:14Calci's way. Three decisions recently went the state's way. I think the more recent trend in how the courts are
13:22looking at this issue is to try to determine whether Congress could have intended when it amended the Dodd-Frank
13:28Act to resolve the financial crisis in 2010, whether part of Congress's design was to allow for sports gambling to be
13:37conducted on derivatives markets. Anyone who's followed the legislative history and knows about the Wire Act and
13:44PASPA, which both set forth a federal policy against sports betting, I think we know what the answer is, but the
13:52courts seem somewhat divided on it. And at this point, it means that the path for prediction
13:58markets will last at least for a couple more years. But ultimately, this issue will be decided by either
14:03the courts or Congress. So if the courts shut it down, they can be resurrected if Congress changes the law.
14:13So with them operating as they have, and certainly knowing now that FanDuel and DraftKings, the two
14:19biggest sports betting operators, are jumping into the fray at this point, does this just appear
14:24to be too big to fail, Dan? Does it feel like prediction markets are just here to stay permanently?
14:29No. It may seem that the genie is out of the bottle and that there's this irreversible momentum.
14:36But when you think about Wall Street, Silicon Valley, the White House, those are some powerful allies in the
14:43corner of the prediction markets. But nothing stays the same forever. This administration only has four more
14:48years. But most importantly, judicial rulings, court decisions could shut this down. And nothing is too
14:55big to fail if courts determine that it is not authorized under federal law and or violates state
15:02law or federal law. And that determination has yet to be conclusively made by the courts.
15:08If and when the courts reach that determination, yeah, then it shuts, then it gets shut down. Nothing
15:13is too big to fail if the courts say it's illegal. The backdoor option, the plan B for the Trump
15:20administration and for the pillars of Wall Street and Silicon Valley is to go the congressional route.
15:25And the recent NBA and Major League Baseball betting scandals and allegations may create some momentum
15:32for Congress to intervene here and provide a safe harbor for the markets.
