00:00One day after TNTAC approached the Industrial Court seeking an injunction against the OWTU
00:05to prevent further acts of industrial action, the OWTU held a press conference and encouraged
00:10workers to continue protest action.
00:13This after the Court did not grant injunctive relief to the Commission.
00:16So they failed, they failed to get an injunction yesterday, but they didn't stop there, didn't
00:24stop there.
00:25We are reporting to the Court now today that what?
00:29That the workers did not report for work.
00:32The workers reported for work, but the vehicles still not repaired.
00:36And we are saying that insofar as you make those vehicles available, those workers will
00:42be able to go out and work.
00:45We are calling on TNTAC management to provide safe roadworthy vehicles for the workers and
00:53stop bullying the workers to operate under unsafe conditions.
01:00Roger sought to make it clear that the workers have been using their own time before and
01:04after work and during their lunch hour to stage protest action.
01:09And he says it is for this reason that the injunction was not granted.
01:14We asked for the records of who did not report, they could not say, they could not provide
01:19that.
01:20And we said to them that, listen, you have on record numerous reports of a number of
01:25vehicles that are with defects that cannot operate.
01:29Protest action that does not affect the Commission's operation is not industrial action.
01:36And we urge the workers, we instruct the workers, I'm going to do it publicly, to continue to
01:42not engage in industrial action, but however, continue to engage in protest action, which
01:49is not industrial action.
01:52However, the Commission maintains that some workers failed to report for rostered duty
01:57during the protest period on the 25th and 26th of October, which severely impacted the
02:03Commission's operations.
02:05The Commission's application for injunctive relief has been adjourned to the 11th of November.
