07:28and directed the Delhi Police to place on record the standing order governing its use.
07:36With the use of force now under judicial scrutiny, it remains to be seen who will ultimately be held accountable
07:43for the alleged use of pellet guns.

08:06My first guest today is Irshad Mansouri.
08:09He is a 25-year-old who suffered severe pellet injuries to his face and neck during the protest last
08:17week in Central Delhi.
08:19Irshad, first of all, thank you very much for coming on the show.
08:23I know it's not easy.
08:24You've just recovered from being in hospital for several days.
08:29How are you, first of all?
08:31I'm feeling quite better than earlier.
08:34So I can make conversation here.
08:36And you had injuries where?
08:38In my upper body.
08:40The major injuries on my face, including eyes, nose, forehead and some pellets on my skulls.
08:49And after that, after the face, I have some pellets on my neck and my right shoulder.
08:55And what was the doctor? These are pellet injuries with some metallic or plastic?
09:00What was it?
09:00They used like those pellets like rubberic and with metallic.
09:06So there's rubber but with a metallic and they've removed all of that.
09:09So how many days were you in hospital?
09:11I was there like more than four days.
09:13You were four days in hospital.
09:15Now, I want to understand what happened on July 20th.
09:19You chose to go to the protest, explain the events.
09:22First of all, why did you choose to go to the protest?
09:24Why did you go to the protest?
09:25Because I just want to raise my voice with my younger sister, my younger brother and the youth.
09:32So that's why you went out of solidarity.
09:34It was the first time you were going there to Jantar Mantar or?
09:37Yeah, it was my second time.
09:39Second time during these protests.

09:41What happened on 20th?
09:43So basically according to the CJI, the timing was like 9 a.m.

10:18Yeah, I was there at 9 a.m. in front of Kerala Bhavan.

12:45and after 10 seconds I listened to a fire sound

12:54I hit a bullet type and a cartoon type
12:57and after hitting it, it penetrated my skin
13:03and went into my skin. Then I got a second hit
13:07and that was my second hit
13:12and then again some parts of the particles
13:17through neck and shoulder

13:21On a sudden basis, I got a lot of blood loss.

13:33what can I do? How can I stop my bleeding?

21:09I don't know what provoked the violence
21:12but you have this

21:16use of pellet guns
21:19why should that have happened at all

21:21couldn't the police handle it
21:23in a better way
21:25that's one aspect

22:02is that what the state
22:03is expected to do

22:05mislead the people
22:06and say that no no no
22:07we didn't you know
22:08use pellet guns
22:09when there's evidence
22:10you saw one person
22:12right before you
22:12there are so many others
22:14and yet the police said
22:15no no no
22:16we didn't use pellet guns
22:17I mean that's not fair to
22:19the people of India
22:20you know
22:21I take your point
22:23Justice Lokur
22:24because
22:25yes the police clearly
22:27in its fact check
22:28seemed to suggest
22:29that there were no pellet guns
22:30used at all
22:32but the Supreme Court today
22:34Justice Lokur said
22:35pellet guns form part of a graded response
22:38under existing police rules
22:40and cannot be therefore banned
22:42without successfully challenging those rules
22:45as ultra virus
22:46under article 21
22:47so there is the state's duty to maintain public order
22:51and of course the danger of harm being caused by metallic
22:56or partly metallic pellets
22:58even when used in exceptional circumstances
23:00so I'm just trying to understand
23:01can this be settled by law
23:03at the end of the day
23:04that there can be a ban
23:05given that the court also seems to be doing some kind of a balancing act
23:11well firstly
23:12you know
23:13when the Supreme Court is aware of
23:16that all this has happened
23:17you know
23:17which we are seeing on TV
23:19almost on a daily basis
23:20the Supreme Court can certainly
23:23certainly
23:25under article 142 of the constitution
23:27say that
23:27listen
23:28we are passing an order
23:29that henceforth
23:31pellet guns will not be used
23:33in peaceful protests
23:35that's it
23:36you know
23:37and if there is some order
23:38or there is some SOP
23:39or something
23:39that can be stayed
23:41I mean it's not such a big deal
23:43you know
23:44so
23:46I'm sorry
23:47but I think the Supreme Court should
23:48immediately pass a stay
23:50and say no more
23:51of these pellet guns
23:52because
23:53there is the
23:54because
23:56justice
23:56there is the constitutional test
23:58of necessity
24:01and proportionality
24:02that the state cannot use force
24:03that is excessive or disproportionate
24:05to the threat face
24:07that's a very clear principle
24:08of law
24:09I presume
24:10so in that sense
24:11do you believe

24:13that the courts now
24:14need to reinforce
24:15that principle
24:16much more strongly
24:17does that require a complete
24:19ban on pellet guns

24:21very very clear guidelines
24:23or should that be left

24:25since they are supposedly
24:26the experts in policing
24:28would the judges be stepping
24:29outside their boundaries
24:30if they deem what
24:32if they decided what
24:35otherwise is seen as
24:36executive action
24:38you see it's like this

24:40the police carry
24:42pellet guns
24:43right
24:44there is a possibility
24:45that they may be used
24:47okay
24:48and if they are used
24:49there is a possibility
24:51that somebody might get
24:52a serious injury
24:53there is only one
24:55there's already one person
24:56who might be losing an eye
24:57I hope he doesn't
24:58but there is a person
25:00who might be losing an eye

25:03should the state
25:04take a chance like that
25:07then listen

25:08we carry pellet guns

26:24now they've come into the heart of the capital
26:27and been used on protests
26:29majority of whom were peaceful
26:31I think we need to emphasize that
26:33majority of them were youth and student protesters
26:36peaceful
26:36now the police is trying to make the argument
26:39they were marching on to parliament
26:40they were you know
26:41they were 100 meters away from parliament
26:43they included some anti-social elements
26:45and
26:46I mean all of this of course
26:47off the record
26:48much of it
26:49do you believe a distinction can be made
26:51between Kashmir Valley
26:52and what happens in the heart of the national capital
26:54it's okay to use pellet guns
26:56if it's in the Kashmir Valley
26:57and not in Delhi?

27:02people in the Kashmir Valley
27:04are also citizens of India
27:06and I'm of the clear view
27:09that you cannot use pellet guns
