10:02in parliament today in the lok sabha debate when he said that amit shah authorized the use
10:08of pellet guns against the students to quote him those students were shot on the instructions of
10:15amit shah now clearly the government is up in arms saying where is the proof of any of this this
10:21is a
10:21total lie rahul gandhi must apologize to the home minister on the floor of parliament how do you
10:27respond can rahul gandhi have said it so boldly that these the pellet guns were used on the
10:33instructions of the home minister where is the proof of that if the leader of the opposition made a
10:41statement in parliament i assume that he will take responsibility for that statement i can't comment on
10:51a statement made in the lok sabha i know that pellet guns were used uh two shots were fired from

11:04it was from one gun or two guns i can't say and three people were suffered pellet injuries that is

11:32he then said that only two things could have happened either the home minister instructed
11:37the firing of pellet guns or he didn't know about it in one case he's culpable in the other case

11:43incompetent the question is on a sensitive matter like this shouldn't you be more careful when you
11:49make remarks in parliament there will be those who'll say if you have proof that the home minister
11:53instructed it by all means go for amit shah in the absence of hard proof do you believe the home
11:59minister is either culpable or incompetent because in the heart of delhi pellet guns were used against
12:04protesters my answer is the same as your first question the point is pellet guns were used
12:13somebody must be directly responsible somebody must be vicariously responsible somebody must be
12:21accountable now which category does the home minister fall i can't say but either he's directly
12:31responsible or he's vicariously responsible or he's accountable
12:41no i i i will press you one more time on this before moving you've been a home minister of

12:46country are you saying that every time pellet guns are used the home minister is directly responsible
12:51responsible or vicariously responsible i can't remember any occasion apart from jammu and kishmir where
13:02pellet guns were used during my time as home minister in the rest of india by the central forces
13:14if somebody can point out an occasion where pellet guns were used i will answer that question
13:26okay let me point out as home minister in 2010 during the upa government you oversaw the security
13:32response to the kashmir valley summer unrest which resulted in the deaths of 112 protesters in police
13:38firing and it was under your tenure sir that pellet guns were first introduced and deployed by the crp
13:44as a less lethal alternative to live ammunition in crowd control situation in jmk is the are you
13:51saying that it was okay to do it in 2010 in jammu and kashmir it's not okay to do it
13:56in the middle of
13:56the national capital i answered the previous question by saying except in jammu and kashmir there is a
14:05separate sop for jammu and kashmir and jammu and kashmir was riots was a terrorist infested state and
14:17therefore there was a separate sop for jammu and kashmir and then in fact in 2016 after the narendra modi
14:27government came into office they improved upon or expanded the sop for jammu and kashmir we are not
14:35talking about jammu and kashmir you are moving away from delhi to talk about uh something happened
14:43in jammu and kashmir 16 years ago that is irrelevant to the use of pellet guns on peaceful protesters

14:59i i'll come back to what happened in delhi but you are drawing a distinction then between jammu and
15:04kashmir and delhi am i correct you're saying jammu and kashmir has a very different sop and therefore
15:09in jammu and kashmir you believe that crpf can be authorized to use uh pellet guns but not in the
15:15national capital is that the distinction you're making i can't recall the terms of the sop i
15:22answered the first or second question by saying except in jammu and kashmir there is an sop for
15:30the rest of india there is an sop for jammu and kashmir you please look into the sops and share

15:59pellet gun should be used in the rarest of rare cases use of other non-lethal weapons for crowd
16:05control like chili grenade shells tear gas shells should be made of plastic so that out being on
16:11fire fired it may melt and cannot be picked up by the protesters so there are recommendations that you
16:16use this as per the rules that i have in the rarest of rare cases do you believe what happened
16:21in delhi
16:22was the rarest of rare cases where the police can say doctrine of necessity was is the reason why we
16:28use pellet guns no not at all the delhi situation was not the rarest of rare cases this sop applies
16:39to the rest of india and if i remember correctly the sop for the rest of india again keep jammu
16:49and
16:49kashmir aside rest of india the pellet guns are used only by the anti-riot police the raf or maybe
17:00crpf it is not used against unarmed protesters civilian protesters peaceful protesters this report
17:11that you rely upon which is reflected in the sop bans or prohibits the use of pellet guns or any
17:21other
17:22lethal weapon against unarmed peaceful protesters that delhi situation was unarmed protesters civilian
17:34protesters peaceful protesters there was no justification at all i repeat there was no justification at all
17:44to issue pellet guns to the raf and for one or two jawans the raf to use the pellet guns
17:53there were the two errors
17:56one the issue of pellet guns one the issue of pellet guns and the second is the use of pellet
18:03guns
18:04in the situation in delhi in fact the other situation which was reported in bihar or ak-47 is worse
18:14the ak-47 is carefully preserved in an armory in fact i've treated that not only the jawan
18:23use the ak-47 the armory in charge who issued the ak-47 should be holed up
18:35can i can i circle back to the immediate question of instructions official records as per a general
18:42diary entry mr chidambaram filed at the parliament street police station show raf personnel fired plastic
18:49pellet pellet rounds and other munitions on the directions of a deputy commissioner of police rank
18:54officer after alleged stone pelting uh so i want to get it very clear in a situation like this where
19:02the diary shows a dcp rank officer gave the instructions for the raf to use it because as
19:08you say only the raf is authorized as per the sop to use it not the delhi police is the
19:14home minister
19:15of the country responsible or accountable in your view for what a dcp has authorized what else will
19:22the diary entry say what else will a diary entry say it will not say that you authorized or i
19:30authorized
19:31it will only say an immediate senior authorized the point is whether anyone else in the hierarchy
19:40was responsible either directly responsible or vicariously responsible or politically accountable
19:47that is the issue what else will a diary entry say what else will a how do you find no
19:54no but
19:55no no no i but but your your leaders i come back to it your leader is holding the home

20:02accountable now and wants his resignation he's even gone to say he wants the home minister to resign now
20:07the point is i all is this pure politics is this pure politics or is it is it a desire

20:21uh you believe should not have been done in the first place so i mean is does the opposition does
20:27the congress party want a genuine inquiry into it or do you want the home minister's head

20:38demanded a parliamentary committee to inquire some people have demanded a judicial commission to
20:45inquire so inquiry has been demanded it's only in an inquiry that who gave the orders and who gave the
20:58uh blessings will be found out are you not understanding the distinction between direct responsibility and vicarious responsibility and political
21:10accountability
21:15no so so what do you hold the home minister guilty of uh direct responsibility or political accountability i didn't
21:24make this speech
21:25no no he's your leader no no i mr chidabrab let me be clear did no no there can be
21:30two interpretations
21:30one is that rahul gandhi jumped the gun or that rahul gandhi wants to hold the home minister politically accountable
21:37or you want you believe the home minister is politically accountable or directly responsible or culpable
21:42you have access to you have access to the lop and you can ask him what did he mean by

22:43made a speech i'm assume that he will take responsibility for the speech and explain his

23:42parliament who makes a speech will assume responsibility for what he said in parliament
23:47and anyway parliamentary speeches are fully protected from inquisitive questions like yours
23:54in the constitution you know that okay can i therefore ask you a final question a petition

24:09two victims of pellet injuries is calling for a complete ban on pellet guns for use against civilian
24:15assemblies do you agree with that what if a civilian assembly turns violent if there is stone pelting
24:20do you believe there should be a total ban please understand the sop the rarest of rare cases in a
24:29riot
24:30situation pellet guns are the last resort there are several graded responses in the sop please read the sop
24:41there are graded responses in the sop it's only less lethal methods can be adopted and the
24:50last of the last of it is pellet guns the situation in delhi at the junta mantra was nowhere near
24:57that
24:57situation nowhere near that situation there were several graded responses that could have been tried
25:04and not all uh javans of the raf not all javans of the uh delhi police all constables of the
25:14delhi police
25:15used pellet guns either one or two raf constables use them use the pellet gun so it is a uh
25:25egregious
25:26mistake it's an egregious mistake that the javan or javans of raf were armed with pellet guns who issued the
25:36pellet gun who ordered the pellet guns to be used these can only be established in an inquiry
25:45one last week

35:56of the country where pellet guns have been used several times in the past.
36:01I am talking of Jammu and Kashmir where the real suffering has taken place where at times civilian protestors, in
36:08some cases unarmed, have been targeted through pellet guns.
36:12Therefore, questions are being raised over whether Jammu and Kashmir should be treated differently to the rest of the country.
36:20One of the most recognizable survivors of pellet gun injuries, Insham Mushtaq is now speaking out.
36:27Her story is instructive, she is calling for a complete ban on pellet guns.
36:33Here is Mir Fareed's report.
36:38Insham Mushtaq was just 14 when her life changed forever.
36:43In the summer of 2016, Shopeyan was on the boil over the killing of Hizbul Mujahideen terrorist Burhan Vani.
36:50Insham Mushtaq had gone to close the window of a room when a barrage of pellets hit her eyes.
37:06Insham is calling for a ban on pellet guns.
37:21She claims the government has not fulfilled promises made to her.
37:48Pellet guns used in Delhi on July 20th against protesters agitating against people leaks were first introduced in Jammu and
37:55Kashmir.
37:56By the then Omar Abdullah government to quell violent protests.
38:00During the 2016 violence, according to official figures, 16 were killed and 6,000 injured.
38:06PDP chief Mehbooba Mufti was heading the coalition government with the BJP during the period.
38:11People like Insham, who are now advocating that pellet guns should be banned.
38:16And while the debate has raced post the JNZ protests, but in Kashmir, we have seen pellet gun in action.
38:24And even the people who have used it and the people who have suffered, they will tell you that this
38:31quite definitely is not a non-lethal means of crowd control.

38:44Our big question today was, is Rahul Gandhi justified in targeting the Home Minister, Amit Shah, on the pellet controversy?

38:55The Home Minister must be held accountable for the use of pellet guns, lati charge and other alleged excesses against
39:01young people demanding a foolproof education system.
39:04He cannot evade parliament when the nation demands accountability.

39:16And since the RAF comes under the Home Minister, definitely Amit Shah has a lot to answer for.
39:23Okay, let's turn from there to our other big story today.
39:28And our other big story today is coming from Mumbai.
39:31Mumbai, where from premium membership, premium membership clubs to shocking hygiene lapses.
39:38Some of Mumbai's most elite clubs, restaurants are under eye of a storm.
39:43Their kitchens are being closed, licenses suspended.
39:46Why?
39:46Because cockroaches, moldy food and dirty kitchens are being found in some of the kitchens of these exclusive clubs.
39:55The Maharashtra FDA has now cracked down, suspending the licenses of multiple food joints both on the street as well
40:04as in leading clubs and restaurants.
40:06Mustafa Sheikh has this report.
40:25Cockroaches, open drains, moldy food.
40:31These visuals are not from a roadside eatery, but from Mumbai's most prestigious clubs.
40:38Just weeks after action against Rustam Ice Cream Parlor and Parsi Dairy, the Food and Drug Administration has now turned
40:45its attention to some of the city's biggest private clubs.
40:51Suspending the food licenses of RK Juhu Jimkhana, MIG Cricket Club and the Willingdon Sports Club.
40:57Also, the Cricket Club of India and the Appanna Juhu Jimkhana.
41:03These inspections paint a disturbing picture.
41:06One club allegedly had flies in food preparation areas, poor hygiene, improper food storage and even stale food.
41:15Another reportedly had live cockroaches, cross-contamination risks and no food or water safety records.
41:22Elsewhere, inspectors flagged dirty floors and poor drainage.
41:27Taken together, the inspections reveal what officials describe as a systemic breakdown in food safety practices, cockroach infestations and flies
41:36around food.
41:36Expired and moldy ingredients, unsafe storage, poor segregation of food, rusted equipment, dirty kitchens and basic hygiene protocols allegedly being
41:46ignored.
42:11So, these food safety officers visited a premise.
42:14There are FSSAI guidelines which are to be followed.
42:18They check if these guidelines are being followed.
42:20For the case of CCI club or the other clubs when the team visited, they found that severe hygiene and
42:27structural issues were being seen.
42:29They also found that there have been pest infiltration, unhygienic storage, structural decay.
42:36These things were common in all of the clubs.
42:41The FDA says that the crackdown is far from over.
42:44It has directed school canteens to apply for food licenses and has banned junk food on campus.

42:58I am joined by Thukaram Munde, the man making all the headlines in Mumbai could set a precedent for the
43:04entire country.
43:05He is, of course, in charge of the Food and Drug Administration of Maharashtra as commissioner.
43:10The crackdown taking place on restaurants, clubs and several food eateries across Mumbai and Maharashtra.
43:18I appreciate your joining us, Mr. Thukaram Munde. Someone told me this morning you are the new singham in town.
43:24You are going around cancelling or suspending licenses of eateries across Mumbai and Maharashtra.
43:31Is that how you see your role on some kind of a personal crusade?
43:36I am actually a food safety commissioner of Maharashtra.
43:40And my expectation that this becomes a public movement where everybody of us eat safe, standard and healthy food.
43:52No, so are you saying that this is not a personal crusade and therefore what you are doing is only
43:59your job as food safety commissioner of Maharashtra to crack down on what you believe are unhygienic places not following
44:07the rules?
44:10Absolutely, that's my role.
44:15But, you know, what does that say that suddenly in 2026 someone comes and says clubs that have been established
44:22like the Cricket Club of India for almost a hundred years,
44:25you are suspending their licenses, many restaurants have been in existence for decades.
44:30Does this mean that the kitchens of these places have existed like this for years, no one did anything till
44:37you have come?
44:40No, I think we have to understand in the context, Rajiv, if you are really looking at it.
44:44Before 2011, there was a prevention of food adulteration act.
44:49The whole focus was on preventing adulteration.
44:52In 2011, as per 2006 act, which we started implementing in 2011, food standards and safety came in.
44:59So this is a 360 degree change. And this 360 degree change will require change in approach also, changing culture
45:06also of both food business operators and regulators as well.
45:11I think we are maturing over a period of time. Regulations have come over a period of time.
45:15Till now there are around 22 types of regulations in food sector. We are trying to implement it.
45:19When we change the system, that to a big degree, from preventing adultery cells to safe and standard food, there
45:26is going to be annoying.
45:28We have to accept that. And our purpose, as a Food Safety Commissioner of Maharashtra, my purpose is actually, when
45:34I started there was a strategy,
45:36what we decided a goal is safe food, safe breath, safe Maharashtra. That was the overall arching goal.
45:41And the strategy for that we decided what we call PE or EP. First is empowerment of the people.
45:47Second is enabling businesses. And third one is enforcing the law as it is.
45:53So this, we are going with E3 strategy, where all the stakeholders will benefit ultimately, leading to better health of
46:01the people.
46:03I'll come to those specifics in a moment, but I want to know, you have the full support of the
46:07government on this,
46:08on this crackdown that you have on these places across Mumbai?
46:15Absolutely. That's how I work on behalf of the government itself.
46:22But, you know, but how do you respond, Mr. Munde? Today, the Bombay High Court, one of the judges said
46:27that the Food and Drug Administration should take a realistic view that this is India,
46:33that the standards of compliance that you are expecting here may not be what it is in other parts of
46:41the world, dare I say.
46:42How do you respond to those who say, we are living in India, you may have the odd fly here,
46:48dare I say, a cockroach around.
46:51You can't expect 100% compliance that should lead to instant suspension of a license.
46:59I have not heard of those comments, but this has come to you or place people.
47:05Be as it may whatever High Court has said.
47:08These standards are prepared by poor safety authority of India, and those are applicable across India.
47:14So those are realistic standards, considering you here, conditions here.
47:19And it is not about 100% compliance, it is stages, depending on what type of non-compliance is there.
47:27So we issue improvement notices to those where food safety is not compromised.
47:32But if food safety is compromised, which is going to affect the health of the person who is going to
47:37consume it,
47:38that is where the severity goes up. That is where the sensitivity goes up.
47:42And that's where we take actions like a suspension.
47:46Where it is substandard or not unsaid, you implement notices and they improve on them.
47:52Once they comply, we take action as per that.
47:56Now, when the suspension is done, it is not a closure of a business.
47:59It is just a suspension of that activity till the food business operator complies with those norms.
48:06Once they comply, then they can come in, appeal to me, we respect it.
48:10And again, if they have found an order, they can start their business over again.
48:17But is there any pick and choose, Mr. Munde?
48:19Are you taking the same stand on government and semi-government and municipal canteens,
48:25where we know the kitchens are often in filthy condition?
48:28Are you observing them with the same inspection rigor or are you targeting private establishments at the moment?
48:36I think you might have, you have run stories about BMC canteen being closed.
48:41We have inspected Mantralaya canteen also.
48:43We are taking action in Mumbai.
48:46We are taking action in Pune, Nakho, Chetrabai, Zambajinagar, everywhere.
48:49It is not about pick and choose.
48:51It is not about clubs.
48:52It is not about restaurants.
48:54It is across the board, food business operators are there, whether it's milk and dairy products,
49:03whether it's about grocery, whether it's about restaurants.
49:06It is about even roadways, roadside food eateries also.
49:11So, it's neither pick and choose, neither discrimination.
49:14It is about food safety of the people.
49:18Sir, the fact is that you have targeted over 100 or nearly 100 food outlets have been shut in a
49:26short span,
49:27many of them iconic places in Mumbai.
49:30Now, there are those who fear this will affect long-standing businesses, employment, hospitality sector in general.
49:37Aren't you worried that by these actions of yours, there will be potential job losses?
49:42It will impact Mumbai's street food culture and that will have an economic cost?
49:49Absolutely.
49:49There is economic cost about the food businesses which are operating.
49:54We are not setting them down.
49:56We are either giving improvement notice or suspension.
49:58At the same time, we have to consider the cost, economic and social cost of those who will eat unsafe
50:04food
50:05and affect on them also.
50:07One single eatery may have 20, 25, 50 people who are employed.
50:11But every day, there will be hundreds of people who are eating the food over there.
50:15So, you have to take care of them also.
50:16So, you have to balance this out.
50:17So, while balancing this out, unsafe food cannot be allowed.
50:21And these norms are not something new.
50:24They are in existence since 2011.
50:27But, you know, you're saying that the laws have changed and become tougher since 2011.
50:35That's my precise point that I raised earlier.
50:38These places have existed from the, you know, for almost 100 years, many of the places you've cracked down on.
50:43How suddenly have you decided that these places are violating the law?
50:47It either means your predecessors were not observing the law and that you have suddenly decided to target them now.
50:54How will you respond to that criticism?
50:57If I can call it a criticism.
50:59First thing, we are not targeting.
51:00These are inspections based on either the complaints or intelligence or analysis.
51:05It's not something targeting a particular place, particular injury, particular business or a trade.
51:10Absolutely not.
51:11So, it's basically awareness among the people have run up.
51:15We are much more active because earlier we did not have that much offices.
51:20Offices have been recruited.
51:21So, all these things have been playing now.
51:25They are falling in place.
51:26So, as a result, people are also aware because we have launched online portal for that, complaints.mahayabdi.in.
51:34We are receiving a lot of complaints on that.
51:36We are using EI also.
51:38So, all these factors are there.
51:39It's not a single factor.
51:41Right.
51:41As you are describing, we are targeting somebody.
51:45Sir, may I ask though, if a license is suspended, are you giving them a timeframe within which they have
51:52to get their facilities right, improve them?
51:55Or is this going to be a prolonged period where they will be shut down?
51:59Once you suspend a license, is there a timeframe within which they have to get their act together, one month,
52:05three months, fifteen days?
52:07How are you proceeding against the places you've suspended?
52:11I think there is a clarity about it.
52:15Once license is suspended, what they are supposed to, food business operators supposed to do, comply with the deficiencies and
52:21submit a report.
52:22Generally within the 14 days, maximum.
52:24That is what the general time is.
52:25Once they submit, we inspect, my officer goes and we inspect the place.
52:30And then, on the basis of re-inspection reports, we take a call out of it.
52:35It's not about three months.
52:36Generally, two weeks time.
52:38Generally, they comply.
52:39Re-inspection report is there.
52:41Hearing before me is there if they are filled.
52:43And we take a call out on the marriage.
52:47My final question, there will be those critics, cynics, who will say that are Tukaram Munde and the FDA using
52:53this to blackmail establishments?
52:55Is there any concept of blackmail, sir?
52:57Are you blackmailing them?
52:59Absolutely not.
53:05Okay, I'll take your word for it there, Mr. Munde.
53:08Either way, yes, we need greater food safety and better hygienic standards.
53:12So, I am with you on the crusade, provided it's done transparently and is the same for all.
53:18But for now, I appreciate you joining us.
