02:20and at that point I ran into Alyssa's room she was okay I woke her up said
02:27something bad has happened to your dad and that's where I called 9-1-1

02:35I was sleeping I heard a gun noise go off
02:38okay so this gun noise is like a gunshot
02:42yeah I turned up in the light when I got my husband and it's really really bad
02:47is he awake no he's dead he's dead so you think somebody came in and shot him yeah
02:58okay while I'm talking to you my partner is dispatching units out okay
03:03about 3 20 in the morning there was a 911 call that came in to dispatch we immediately called code
03:09three lights and sirens driving as fast as we can to get to the scene
03:17and you said the front door is open
03:18and was the front door open when you went to bed no
03:25I realized our front door was open
03:28you're scared you're just holding each other crying and not knowing if someone's still even in
03:35there a million things go through your head of what's going on and are you safe
03:41going to the scene dispatch kept giving updates
03:45the female inside told dispatch that she thought she heard footsteps inside the house
03:58at this time we're thinking there is still a shooter inside the residence
04:03it was very dark and there was no lights on inside the house
04:30going into the house to the right
04:32show us your hands
04:33was a bedroom
04:36made entry into that bedroom and we noticed there was a subject in the bed under the covers
04:43we're yelling sheriff's office show us your hands multiple times and we're getting no response from the
04:50subject that's in the bed under the covers
04:56I was thinking am I gonna see a deceased person or I'm gonna encounter someone pointing a gun at me
05:19at that point we don't know if this person is a suspect or a victim or what
05:24so I had my partner detained until we figure out what's going on my attention got drawn back out towards
05:29the hallway
05:34I see this female and a child with her
05:38she has a phone in her hand she says her name is Melissa
05:44I learned that the caller was Melissa Oxley and she had her six-year-old stepdaughter Alyssa Oxley with her
05:50the male subject in the first bedroom was a 17 year old Craig Nichols brother Melissa Oxley
06:01you're almost like frozen you're paralyzed basically like all this is happening and you have no control and you don't
06:07even know what's going on
06:09I had brain matter on me and I was saturated in blood blood splatter on her human tissue they're on
06:18her Melissa and Craig were secured waiting for detectives at that time
06:46I arrived approximately 20 minutes after the initial call they had everybody secured
06:53what I do is I kind of walk in start looking around the scene for me as an investigator at
06:59the time I really want to see what I was looking at I could tell that there was a shotgun
07:04wound to the back of his skull
07:06there was brain and blood matter throughout the bed onto the walls and little babies on the cushions
07:16we learned through the wife Melissa Oxley that his name was Ben Oxley
07:21it appeared when I did my initial investigation that he was asleep when he was killed
07:33the fact that someone was shot in their own home was shocking
07:38but then Ben Oxley was shot in the middle of his sleep that was terrifying when someone goes to bed
07:48you're thinking about what you're going to do the next day what are you going to pack for kids lunches
07:54you're not thinking you're going to be shot especially because you feel safe in your home
08:04nobody nobody thinks that this is going to happen to them
08:12I met Ben in 2003 when I was working at Western Nevada Supply and he had been a customer there
08:18for years and had tried getting us to date for over a year and then finally I said yes and
08:26we went to dinner the first time and he actually brought Alyssa with him
08:32his daughter was his priority Alyssa was everything to him he was so joyful fun loving dad he drove himself
08:43to be the best he could be for Alyssa
08:46Ben grew up in Hawaii and he was a very laid back casual guy friends with everyone he accepted all
08:54of Melissa's family members took in her brother Craig
08:58her stepfather lived across the street from them so no one's a stranger it makes you think this could happen
09:06to anyone if it happened to Ben
09:15someone being killed in their sleep is very troubling how did this happen without somebody seeing it or hearing it
09:23they separated us right away they had me in the kitchen like instantly into interrogation basically
09:34my initial contact with Melissa she said she was awakened by a gunshot and the smell of gunpowder
09:42it's counterintuitive to your thought process when you see she's covered in blood but she wasn't hurt
09:48she's giving me a story I want to know the truth obviously but is this really the truth because how
09:54could you be in close proximity to somebody that gets killed and not be involved I was photographed even
10:01before we left at the house I like the brain matter on my face it's not a pretty picture
10:12we had crime scene investigators come in to process the scene looking for any kind of evidence the
10:20brother and Melissa Oxley Craig Nichols had moved in with Ben and Melissa at some point and was living
10:25there in the house and we noticed that there were shotgun shells on the dresser in the bedroom where Craig
10:31was at and then in the garage we noticed that there were shotguns it rises your suspicions of what's going
10:39on
10:41did Ben have an argument with Craig and did Craig wake up and shoot him in the middle of the
10:49night
10:51they had to look at everything once we got to station and all the residents of the house were there
11:00we
11:02immediately separated everybody Melissa went to one interview room Craig went to another interview room
11:08the only two suspects we have are these two adults and we have to separate and work our investigative
11:13skills to try to make sure we get the truth out of somebody when I interviewed Craig you know I
11:18asked him
11:18you know what did he know what he see there was shotgun shells inside his bedroom which brought suspicion
11:26immediately to him these questions that were obviously peaking my mind
11:31so you didn't hear anything at all?
11:34no my doors were shut
11:36did anybody come to the house?

11:41I was pretty tired last night
11:44I was in a pretty deep sleep even when I got there I didn't even know what was going on

13:58Change the idea of what's what and try to completely eliminate you and Craig.
14:04In your own words, why don't you tell me what happened?
14:07I was sleeping, and next to my head of Sam, I heard a gunshot, and I smelled good powder.
14:15And I was like, babe, did you hear that?

14:18I need to wake up.
14:20And I turned on the light, and I turned on the light and saw him with a hole in his
14:25head.
14:40They put Melissa and Craig in two separate rooms.
14:46The goal was to hear from both of them, make sure their stories matched.
14:51Investigators also wanted to find out if either one of them had a reason to kill Ben.

15:33In the back of my mind, I guess one of the biggest concerns, she wasn't injured being in close proximity

15:39The angle trajectory of everything, there is a little pellets at the level that should have struck you.

15:49Another problem I'm having is your clothes and everything have appearance of something you laid in.
15:55You laid down into the blood, as opposed to it being cast upon you.
16:01I think I nailed down this way, but then I came back over here, turn on the light, and look
16:06this way.
16:06And again, I have to clear these things up.
16:09She was the most closely related person to Ben, and she was right next to him when he got murdered.
16:14And it was very hard to believe that she slept right through the murder and didn't know anything about it.
16:19Another thing I don't understand is why, why did you not hear, or why did you not see anything?
16:26Like you hear somebody going down the hallway, or a shadow, or a car drive away.
16:38I don't know what it happened, but I don't know.

16:43We will find out who did this, and the idea is to get there as fast as we can.

17:40is Craig and Melissa involved together is this some kind of dispute between Melissa and Ben and
17:45Craig loves his sister and he was you know to offend her for whatever reason you want to make
17:50sure if one person's lying or when you're telling the truth you want to confirm those stories with
17:53each other they're both possible suspects I didn't hear anything going on I was sleeping
18:02and all of a sudden I got woke up with a bunch of lights in my face I think it's
18:06a possible
18:07scenario I think that Craig if he got mad at Ben could have committed the murder and not hurt his
18:11sister it would make a lot of sense whenever we have a person that's murdered look at the family
18:19so if anything comes up in the family you know sometimes the dirty laundry is there
18:24I'm gonna ask you bluntly and I apologize for doing it but I have to you know did you kill

19:06separately Craig eventually took a polygraph examination
19:10passed that the gunshot residue tests on Craig came back with no findings on him
19:17we eliminated Craig as a suspect
19:28I lost a best friend a brother a father figure all instantly
19:40when I was woken up I had no clue what was going on
19:44I was still in a daze from sleeping
19:48couldn't see anything because the lights were strobing in my eyes
19:53they just ordered me to get up out of bed

19:59I felt like I was being accused of murder of my own brother
20:04I wasn't able to sleep for numerous days
20:08every time I thought about laying down it
20:11I would just fall apart and I would just sit there and stare at the wall and cry
20:17my life was definitely flipped upside down
20:32Ben grew up in between Arizona and Hawaii and then had met his ex-wife Dawn in Indiana
20:39and then they had moved to Arizona where Alyssa was born
20:43by 2004 Ben had been divorced from his ex-Dawn
20:54Ben and I got married on September 17th in 2006 up at Tahoe
21:03Alyssa was happy
21:06we did a special ceremony for Alyssa
21:08me accepting her as my daughter
21:10and gave her a bracelet
21:15it meant everything to me
21:17she really was a part of my life just like he was
21:19I was accepting her just as I accepted him
21:25it was like mother-daughter
21:27we did everything together
21:31Ben had a way of always making me feel so loved
21:36he was a great husband
21:38like I can still feel the love

21:41like he was the one that gave me the power to be able to go on

21:46there was never a doubt in my mind
21:57one thing investigators did not expect
22:00was that Ben's six-year-old daughter

22:08I was hoping that maybe Alyssa
22:10might have had some information that she could

22:30I mean isn't that everybody's worst nightmare

23:38when Melissa was being interviewed by investigators
23:41she came up with a name for the investigators to look into
23:46what about Ben?
23:47does he have any enemies?
23:48one thing I can think of is
23:50Don's ex-boyfriend

23:54Melissa Oxley identified Ben's ex-wife as Don Oxley
23:56and that was the person he had had the daughter Alyssa with
24:01Melissa told me that the only person she could think of
24:04that would hated Ben was Don Oxley's ex-husband Jonathan Reynolds
24:09so it is definitely something you guys know that was personal
24:13when I first met Ben
24:15like I've always heard it's me
24:17hated him
24:18and always he's gonna get out and kill him
24:21I know him and Ben had had words
24:24and I also know that he was a shady character
24:28that's the only person that came to mind
24:30the whole time
24:32we learned that Jonathan Reynolds was released from prison
24:36the month prior
24:37he had a criminal history
24:39a lengthy one
24:42he was a violent felon
24:44and she thought maybe he could possibly be involved in this murder
24:47because he did not like Ben
24:49due to some domestic issues that Ben and Don had had a few years prior
24:53maybe Don complained about him
24:56or told him some negative things about him
25:00Jonathan also seemed to be jealous of other men
25:06so maybe he had some kind of animosity towards him
25:10looking at Mr. Reynolds who has a violent history
25:13it's very concerning obviously
25:14because that kind of fits a profile of somebody that would kill somebody
25:17he was very capable of murder
25:27after learning of Mr. Reynolds possibly involvement
25:30we immediately had two questions in our mind
25:33one was if he did commit the murder did he kill Don
25:36so we needed to immediately go talk to Don
25:38get a welfare check on her to see if she was still alive or had been hurt
25:40and secondly we want to know his whereabouts
25:46we learned that Don only lived about 20 minutes from Ben
25:49investigators went over to Don Oxy's house and made contact with her
25:54investigators went to check on Don's welfare
25:56they found at the residence was Don herself her older daughter and her son Devin
26:02and her friend's son James Matling
26:06she was safe and secure
26:08when investigators advised her of the death of Ben
26:12she appeared distraught or she made admissions about not liking Ben
26:17but had no way does she want the father of her daughter murdered
26:21Don was in shock
26:22she had an alibi that James and her were there watching a movie
26:26and went to bed around 4 o'clock in the morning
26:28and that was all that she knew
26:30until the rest of us woke her up roughly around 6 o'clock
26:34and we asked her about Mr. Reynolds and his ability to harm
26:38and when she had last had contact with him
26:40and she had said she had spoken to him that day
26:41because he had just gotten out of prison a couple days before
26:47Jonathan had months and months in prison
26:50was this festering?
26:51did he sort of go over plans in his mind to kill Ben?
26:58maybe he wanted to rekindle the relationship with Don
27:01sneaking into a dark house when everyone is asleep
27:04and they're defenseless
27:30when we heard that someone was murdered in the middle of the night
27:42the first thing I thought of was that is right around the corner
27:46from where I lived with my family
27:53it seems so safe in our neighborhood
27:56we couldn't believe it
27:57a lot of us sleep with the windows open
28:00we don't lock our doors
28:01you don't really think about what that would mean
28:04if someone broke into your house
28:07with the intention of murdering you or your family
28:12and especially when you're dead asleep
28:18you just don't think about that
28:28I had told the detectives the only person that I thought about
28:32was Don's ex, Jonathan
28:43detectives followed up on that
28:45found him and he was actually nowhere near the crime scene
28:49we were able to confirm with Jonathan that he was in Lancaster, California
28:53and we were able to confirm that with the local sheriff's office there
28:58and it was within I believe six hours of the murder
29:01so at that time
29:03he had a good alibi of where he was
29:05he wouldn't have made it from our location to LA in six hours
29:11after learning about Jonathan's whereabouts
29:13now we're looking back at Melissa
29:14thinking
29:16why is she providing this information on Jonathan
29:19what is her gain
29:20is there a different motive
29:21is she trying to throw off the investigation
29:24went to focusing back to Melissa
29:26as we start looking and you know
29:28kind of see what Melissa's patterns are
29:29what is she doing now
29:31I received a call that there was a life insurance policy
29:34that was taken out on Ben
29:36a few months prior to the murder
29:38it's concerning now that we have an insurance policy
29:40that she's going to be the beneficiary of almost $400,000
29:44that's a lot of red flags
29:46that's 400,000 reasons to commit a murder
29:50if that's not a motive
29:51I don't know what is
29:54I also find out that she's currently dating
29:57after approximately three months
29:58after the murder
30:00it's looking very suspicious
30:02for someone to be moving on that fast
30:04how can somebody move on so fast
30:05from the person they're supposed to love
30:07and then they're murdered
30:08and now we're already dating again
30:09I confronted her on everything
30:11from insurance money to the dating
30:13the idea of being watched
30:15or your every move being critiqued
30:18or under suspicion
30:20like it just it's never a good feeling
30:23and you lose privacy
30:25I was young and I was moving on
30:27and I needed to get out
30:29that was really the basic
30:31so you're not sitting at home and just depressed
30:34and overwhelmingly just lonely
30:37I guess I was kind of in my own world
30:39getting through
30:40surviving
30:43I think she was just lost
30:45which is understandable to me
30:47and then again we discussed the insurance money
30:50a little bit time to time
30:51and she again she didn't care about the money
30:53she just didn't care
30:54we learned that
30:55Melissa hadn't even attempted to cash the money
30:58or to even obtain the money
31:00wasn't even asking the questions
31:01on how to get the money
31:04I didn't know we had a life insurance
31:06had no clue what life insurance was
31:09or anything to do with it
31:15we are back to square one
31:18we still really don't have a really good suspect list
31:22you're rethinking the information
31:23what did I miss
31:24what did I miss initially
31:26we started looking at who we contacted
31:29and we started looking at his ex-wife Dawn
31:37so we started looking at Dawn
31:38and what motives she might have towards Ben
31:40after the divorce
31:42there was split custody of Alyssa
31:44between Ben and Dawn
31:45but as time progressed
31:46Ben petitioned the court
31:47for full custody of Alyssa
31:49and he was granted it
31:50Dawn was a single mom
31:52worked in the casino
31:53was a cocktail waitress
31:55she had two other children
31:57and then there was Alyssa
31:58and Ben took care of all of them
32:02it seemed to be pretty cordial
32:04but Dawn wasn't really in the children's life
32:09the child custody dispute between Ben and Dawn
32:12that weighed heavily on Dawn
32:14she took that very personally

33:29because we felt they had something to do with it
33:31we just didn't know what it was
33:34we did open surveillance
33:35where we followed them
33:36and made sure they knew
33:37we were following them around
33:40we wanted them to see us

33:43out and about in the community

33:45to add pressure
33:52to see if one of them
33:54would come forward with some information
34:00as we started looking at
34:01Dawn and James Matling
34:03we started realizing
34:04that there is some untruths there
34:05we started hearing a little bit
34:06about them being in a relationship
34:08which was denied at first

34:10is why was that
34:12held from us
34:14initial interviews at the house
34:16they said they never left
34:17we went back
34:18did some second interviews
34:19that's when Dawn said
34:20that James did leave
34:23they obtained the surveillance video
34:27we found that James was
34:29at the convenience store
34:30the morning of the homicide
34:35so we know that
34:36now his story has changed
34:37at first he never left the house
34:39and now we know he's out and about
34:41in the early morning hours
34:43of the night of the homicide

36:15is continuing to feel
36:16the pressure
36:17of the investigative team

36:19as a possible involvement
36:20in this homicide
36:23we could tell Dawn
36:24was very uneasy
36:26about the surveillance
36:28and we could tell
36:29it started to weigh on her
36:32there was a lot of stress
36:34going on
36:34and we just needed
36:35that stress to
36:36come out
36:37in some type
36:37of statement to us
36:43Dawn called
36:44and wanted to talk
36:45about the case
36:46and that she had
36:47had information
36:48on who killed Ben
37:07Ben and I were going
37:08through all our
37:09tough spots
37:11James said

37:17I thought would be
37:18serious

37:19didn't think about it

37:39at his own accord

37:41didn't want him
37:42to murder
37:42she was just angry

37:46took that out of context

38:08to all believe

38:10something told us
38:11this isn't the truth
38:13the hard part is

38:15and my heart

38:19we ended up giving her
38:20an immunity agreement
38:21for her to testify
38:22against James
38:26and I think
38:27that's the choice

38:28that we needed
38:29to punish the actor

38:31and then if she was
38:32not truthful with us
38:33then we need to go after
38:34and try to prove
38:35that she was untruthful
38:53James sits down
38:54and you could tell
38:55just he had so much stress
38:58and weight laying on his shoulders
38:59and he makes mention that
39:02he needed to get this off his chest
39:04he needed to confess
39:08she was always ranting
39:10and raving about Ben
39:12I said I'll take care of Ben
39:14and she said
39:15I don't want you to take care of Ben
39:16I want you to kill Ben
39:18I said you want me to kill Ben

39:23through the interview
39:24James tells us
39:25that this was Don's idea
39:28Don had wanted Ben dead
39:30and James told her
39:31that he would
39:33kill Ben for her
39:35during their time at the house
39:36they conspired
39:37how to commit the homicide
