04:26We want to welcome our attorney at law, Corporal Zahir Ali attached to the Trinidad and Tobago Police Service.
04:32Welcome, Corporal Ali. How are you?
04:34Good evening, Mark.
04:35It's a pleasure and honor to be here as always.
04:37Good evening to Trinidad and Tobago, my family on Beyond the Tape,
04:41my colleagues in the law enforcement agencies and those who may be visiting our beloved Trinidad and Tobago from various parts of the world.
04:50Mark, this afternoon, notwithstanding that a lot is happening in Trinidad and Tobago from a perspective of crime and criminality
04:59and perhaps some very other important matters from a national context,
05:07I want to take this opportunity this afternoon, Mark, and I want to refer, you know, when we came to this particular studio, you know, the voice of the people.
05:14And I want to take this opportunity to express, you know, on behalf of, you know, yourself and my good self and my extension Beyond the Tape and TV6,
05:22condolences to the family of Mr. Harilal Maharaj.
05:27Mark, that's a person who, you know, was an avid supporter of Beyond the Tape.
05:33And when I mean avid, I mean avid supporter in terms of some of the engagements.
05:38You know, he remind you of things that, you know, was or was spoken of to demonstrate his enthusiasm and his commitment and dedication to this particular program.
05:48So I want to take this opportunity to his family, you know, to express condolences.
05:52And he was also a person who contributed to the development of culture in Trinidad and Tobago.
05:57So I thought it was important to begin with that, you know, unfortunate news, you know, but condolences to the family.
06:02And, you know, may God continue to give you all the patience at this time.
06:05And I'll also extend it to any person who may be suffering, Mark, whether it be through the loss of a loved one or maybe through some illness or sickness or hardship.
06:14You know, there's a famous saying from Almighty God we came and to him we shall return.
06:19And sometimes people seem to miss that in terms of when they behave themselves, you know, when they are caring about themselves in relation to whether it be public life, whether it be their personal life.
06:30That is something that sometimes we miss.
06:31And I want to take this opportunity on his passing to remind all of us that a day will come.
06:36It's inevitable that we shall return to our maker.
06:38And let us be in a position to account for what we did we do with our life.
06:43What contribution did we make?
06:44What service did we give to humanity?
06:46So I just thought it was important to begin with that.
06:48But thank you very much for allowing me.
06:50Thank you so much, Corporal Allen.
06:51We really want to express our deepest sympathies to the family of Mr. Maraj and, of course, by extension, the Beyond the Tape family as well.
07:01All right.
07:02It's day 31 of the state of emergency.
07:06As you can imagine, we just wanted to quickly go through the statistics up to date.
07:12Updates here were initially number of operations.
07:18Seventeen hundred and twenty three prior to offenders target.
07:21Fourteen hundred and fifty one searches conducted.
07:24Ten thousand five hundred and thirty five traffic operations.
07:27One thousand four hundred and forty seven total persons arrested thus far.
07:32Thirteen hundred and fifty traffic offenses detected.
07:35Forty nine.
07:36Forty nine hundred and seventy firearms recovered so far.
07:39Fifty five.
07:40Twelve hundred and ninety three ammunition recovered and dangerous drugs seized.
07:45One hundred and fifty seven thousand one hundred and fifty nine grams of cannabis and eight hundred and sixty four grams of cocaine.
07:53So indeed, the police is moving on several operations on going across the island as we continue to try and root out, you know, not just persons who are hell bent on illicit activity,
08:07but some of the items that they are using to peddle their trade and firearms and so forth.
08:13Well, most importantly, Mark, and, you know, on last occasion, you know, I add to the to the to the statistics and I want to that particular fact,
08:20two particular categories with reference.
08:22Again, I'll make a salient call for the charges, you know, to be listed on the statistics.
08:28And most importantly, let me share with members of the public that the preventive order under the hands of the minister of national security that continues to be an area that
08:37I wish I'd say the power that has been exercised by the honourable minister, you know, on the submissions and applications of the police,
08:43with reference to persons who are required to be placed in or detained, I should say, to prevent any threat to public safety and security.
08:54So that's an area as well that, you know, we are pursuing.
08:56And I think in all things being equal, that's a very significant area.
09:01So that's a very, very strong authority or power that has been given to law enforcement by the minister who will exercise that power.
09:07And I think that we need to always be monitoring that as well in relation to when we're looking at the success or the statistics and looking at the impact of public safety and security.
09:16Yes. And as we talk about public safety and security, we we always find that, you know, we always go back to that statistic of firearms and correlation of violent crime.
09:27Yes. And, of course, by extension, homicides.
09:30And speaking of which, last night, the country recorded its, I would believe, 28th or 29th murder victim in the Esperanza village area.
09:41What we understand there was gunfire in that area, supposedly at a makeshift marijuana camp of some sort.
09:50Two men were in that camp and one man identified as Stefano, so far by police, was shot and killed and the other was injured.
10:01Apparently, he told police that he was able to use the deceased phone to make a phone call to contact the police.
10:09And they got to the area and they found the body of his friend there.
10:15Well, again, Mark, you know, why are we in a public emergency?
10:18You're still seeing these reported crimes, shooting, murders, you know, and other serious crimes.
10:26And again, it's a reminder for law enforcement about the level of engagement or the level of enforcement that is required,
10:36because we've seen clearly that the criminal elements still continue to chance their hand, if I should say that.
10:42And it's important for us to continue to persist and use, you know, all the avenues that we have within the rule of law to be able to deal with the situation.
10:49Mark, I would not stand on public platform and appear to be naive to the situation in terms of Trinidad and Tobago.
10:57It's a great challenge in terms of where we are looking at safety and security and looking to restore safety and security in quick time.
11:03But having said that, it's important for us, you know, to recognize and appreciate that it's a mammoth task.
11:09And, you know, we have heard numerous from different stakeholders about it's an all-out attack from a societal context, you know, from law enforcement, from a governmental context.
11:21And that's something I do not want us to be, you know, respectfully just, you know, using words to describe that.
11:27But let us, when we say it's a societal problem, we should see the society manifest in itself to be able to deal with this issue.
11:34So, again, Trinidad and Tobago, we continue to be faced with these very serious crimes.
11:39I think that matter that you make reference, I think one person was shot and killed and one was injured.
11:45Yes, correct.
11:46And taken to hospital.
11:47So, you're seeing also that, you know, a lot of collateral damage, if I should say that, at this time.
11:51But I know it's subject to an ongoing investigation.
11:53And members of the public, please exercise your due diligence.
11:57I heard, and very rightly so, Mark, where in this particular time, persons are migrating to different areas based on the intelligence.
12:04So, communities, be on the alert.
12:06If you identify persons that are not within an area that they should be, use that as an act of suspicion and report it to the law enforcement agency so that they can inquire as to who that individual is.
12:18All right, we're going to take a look at our headlines now.
12:27So, those were some of the headlines within the past 24 hours.
12:47Police was up in the D.B. Long Circular Road area where they found the remains of a person following extensive search of the area near a riverbank.
12:59And what we understand is that during that search, they also recovered what was bearing a work ID of a, they believe, a Mr. Winston Rostat.
13:12Now, if you recall, we have been highlighting Mr. Rostat and his friend, I believe Mr. Taylor, who would have been missing since late November, November, sorry, October 27th.
13:26They left Point 40 and they went up into that area there, supposedly to meet somebody.
13:34And I remember that Captain Valens Ramarat would have been basically showing us the last time that they were able to see that there was some kind of activity with their phones was sometime in November.
13:47Now, so it is believed the police, of course, have to do particular testing, DNA testing and so on, to see if those remains belong to Mr. Rostat.
13:57But, of course, the media spoke with his mother earlier today in Point 40. Let's take a listen.
14:28And everybody around here was in such a maze. You know, my family calling me every time. Do you hear anything about Winston yet? I said not yet.
14:41And what you thought about when he went missing, what you thought he would come back home?
14:47Yeah, we always say, well, they must be have them hide up somewhere. But when I see Armand, I tell them myself, I say, the mining, he and these two, it's two of them.
14:56It's he and the owner of the car. I say they won't mine them so long, they must be done, throw them somewhere.
15:03At times, the brother tell me that he went with the police and they find some car down in some valley or something.
15:11I can't imagine these people. I can't imagine who it is.
15:16The brother tell me, well, any time the police going and looking for anything, they'll be with them.
15:21They have some girl, the girlfriend of the other boy, who has been talking to Sean before.
15:27And the police say, what did she say? Well, they ain't get where she is yet.
15:31I ain't up to know if they get where she is yet.
15:35I don't know what we will do. But you can't be safe, no way.
15:43I don't know what really going on.
15:46And I think some of the police and them, when they find something, they take it and they took slides.
15:52And they ain't going to get to the bottom of it early. That is why things just happen like that.
15:58When you hear the news about kidnappings happening, I'm sure you never thought it would have reached your daughter.
16:05We see that. I really thought that.
16:09It's so sad.
16:11How has this affected you over the last few months?
16:14Well, because, you know, he always there for me to do this for me and that for me.
16:19And we always around.
16:21We always around.
16:22I put up my TV there.
16:30So that's the mother of Mr. Winston Rostat, Sybil George Hutchinson.
16:35Ninety-one years of age, speaking to Express reporter, Susan Mohamed Lilion.
16:40Certainly, really sad story.
16:42Well, Mark, definitely. And, you know, when you look at a person of that age,
16:46I just want to point out two things, you know, to the family.
16:49You could see that the worry that that person has been placed in a situation where persons
16:55that Mr. Rostan is, you know, reported missing.
16:59And then we see in the development.
17:02And then secondly, she made mention, you know, whether it's a fact or not.
17:06I think it's important to highlight it where, in her view,
17:09she believed that there was not a prompt response from law enforcement.
17:14And I want to take this opportunity on public platform to remind law enforcement officers
17:19under the Anti-Kidnapping Act.
17:22And when we are looking at the issue of missing persons,
17:24it's important when persons are reporting matters to the police,
17:27the police appreciate that under the Anti-Kidnapping Act,
17:30there's a duty and a responsibility for you to act properly,
17:33act decisively to investigate that matter.
17:36Because a lapse of 15 minutes, Mark, or 10 minutes can just be what it requires
17:42for that person not to return again.
17:45So, time is of the essence, you know, when reports are made,
17:48for us to act on it diligently.
17:50So, members of the public, not only for this particular instance,
17:53for any person who may go missing,
17:55I always indicate that treat that as a kidnapping,
17:58treat that as a potential for a murder,
18:01and hence why we all have to respond appropriately with reference to these matters.
18:05So, I just wanted to point out those two issues.
18:07But again, an unfortunate situation, Mark.

21:52Corporal Raleigh, I know you are a cricketer.

21:56captain of Trinidad and Tobago.
22:00So, I'm going to pose you some short poll this evening.

22:08We have a national issue in Trinidad and Tobago.
22:13An issue between the Auditor General
22:17and the Minister of Finance.
22:20As of yesterday,
22:22there was a big question from the Privy Council,
22:25one of the lawyers.
22:27Why the Finance Minister is not being investigated?
22:32As a taxpayer,
22:34as a concerned citizen,
22:37$3 billion not accounted for?
22:41I in Alamante could say it is financial fraud
22:46or some sort of fraud misbehaving public office.
22:50What mechanism does the TTPS have
22:56to intervene into that situation
22:59and bring relief to me as a citizen?

23:10A very, very strong inquiry from your good self
23:14on behalf of the people of Trinidad and Tobago.
23:16And before I answer you,
23:18I'll take the opportunity just to add a little more.
23:22The national captain of the under-15,
23:24the national captain of the under-19,
23:26and the national captain of the West Indies under-15
23:28to two youth World Cups
23:29and a former national senior cricketer as well.
23:31So I just want to give you a little more.
23:33I'm only saying that to inspire the young people
23:35who will be listening to pursue your dream
23:40and pursue whether it be sport, culture,
23:42whatever it may be,
23:44to ensure that we have a brighter Trinidad and Tobago.
23:46But again, Mark,
23:47this is you in relation to the Auditor General.
23:49I had the opportunity to peruse quickly
23:51the judgment of the Privy Council this morning.
23:55And the question that he asked,
23:58and the courts seem to have gone in that direction as well,
24:02that while there may be very strong constitutional provisions
24:04to be able to deal with a matter like this
24:07in relation to the conduct of the parties involved,
24:10in my respectful view, it does not stop.
24:12And the court would have taken up,
24:14respectfully from my understanding,
24:15clearly indicated that it doesn't stop
24:17any other opportunity to investigate this matter properly.
24:20So from a TTPS context,
24:22I think that when we have units like the Anti-Corruption Bureau,
24:26I think when you see matters in the public domain,
24:28I want to respectfully say to them that
24:30this is an opportunity for you to engage in an inquiry,
24:33ask some questions,
24:34and in asking your questions,
24:36it may also be good to have an engagement
24:38with the Office of the Director of Public Prosecutions
24:40so that the person who has the constitutional mandate
24:43and who will look after the well-being of the public interest,
24:46I think that that is where the discussion needs to go.
24:48So again, I think it's open for an inquiry,
24:50it's open for an investigation,
24:52and the courts have basically leaned on that side as well.
24:55So, excellent.
24:56I hope that the Anti-Corruption Bureau is listening.
24:59If not, again, I will take your inquiry
25:03or take your suggestion into the domain
25:06and executive of the TTPS to see what may be a possibility.

25:43because there was not sufficient evidence.
25:46And I am saying, if it's the correct person they took,
25:49whether the person was in camouflage,
25:51whether he was fake or he was not,
25:54the fact that he was held,
25:57and if it was the correct person who was held,
25:59how come that is not sufficient evidence?
26:02I'm wondering.
26:03That maps is not really maps.
26:04That's my first point.
26:05My second point is concerning the body cameras.
26:08I saw where some of them, the police officers,
26:11they are using it,
26:12and I listened to another program this morning
26:14on somebody who was a police before he said
26:17that some of them are using it or whatever.
26:20But my point is I heard where the PCA said,
26:24even though they were in cameras,
26:26he has not seen anything.
26:27What is the procedure concerning what happens?
26:29So when something happens,
26:31do you have to go to him to show him the video
26:34or he has to ask for it before he is shown?
26:37I'm not sure what's taking place with that.
26:39My last point is that boat that disappeared.
26:43I still saw where they said they got somebody
26:46and one of the bodies, they seem to say it's one.
26:49Something is wrong about that, you know,
26:51because if a boat is attached to something,
26:53just like that, it could just get away.
26:55Somebody has to answer for that,
26:57and I'd love to see how so many guns you all get.
27:00Continue, continue getting those guns
27:02because those guns could save lives.

29:39a tenured lawyer attached to the Trinidad and Tobago Police Service.
29:42And Nicola, I just wanted to correct you, of course,
29:45on the first point of the camouflage.
29:47What I understand that one of my colleagues
29:50would have did a follow-up story on that
29:52is that the person that they actually had in custody
29:55was not involved in that crime,
29:58and his lawyer spoke with the media the following day.
30:04Apparently, his client was not on that scene,
30:08but rather at the army camp when that incident occurred.
30:12And as far as I understand,
30:14they're still searching for the person
30:17that is suspected to be involved in that robbery.
30:20Well, Mark, thank you very much for bringing some clarity
30:24in relation to the investigation surrounding the person,
30:27the suspect who was wearing the camouflage
30:30or what's believed to be camouflage
30:32with reference to the robbery.
30:33Thanks for that.
30:34But, Nicola, thank you very much for your two submissions,
30:36and especially the body cam.
30:38Again, Mark, I'm seeing persons continuing to place a lot of focus,
30:41a lot of emphasis in relation to the body cams.
30:43And, you know, again, I will support that call.
30:46I think that when the members of the public
30:48are calling for transparency and accountability,
30:50I think that any apparatus or any device
30:53that will assist in promoting transparency and accountability,
30:55I think we should be excited
30:57and moving those matters expeditiously.

31:00And that both, I know, Mark,
31:02that continues to attract a level of investigation
31:07and focus in relation to exactly, you know,
31:10what transpired with reference to that boat
31:12allegedly had persons decomposing bodies,
31:17and then it disappeared, you know,
31:18on the intervention of the Coast Guard.
31:19So I know that there will be a full-fledged investigation into that,
31:22and hopefully we'll get some closure
31:24with reference to that particular matter.

34:29Today, it is not just about
34:31issuing tickets to errant road users,
34:33but it's more about
34:35interacting with the members of the public
34:37as it relates to road traffic safety.
34:41And that is what we are here about.
34:43And that, of course, is in keeping
34:45with the key differences
34:46strategic pillar number two.
34:48We have just finished our exercise
34:49on the Valencia station.
34:51We were passing through the arena area
34:53on Kennel Street
34:55where we saw a black Almeria,
34:57a black Toyota Corolla,
34:59and a Nissan Tapia Cedillo and Nissan Kicks.
35:02We intercepted the drivers
35:04after to see what was going on.
35:06While checking the drivers,
35:07we acknowledged that this driver
35:09seems to be intoxicated.
35:12While trying to intercept him,
35:14he actually tried to drive off
35:16and we had to call the interceptor
35:18and try to reach him.
35:20While waiting for the police here,
35:22we noticed that he overtook
35:24the old Tamish and other vehicles.
35:28This lady here.
35:30And this is the driver of the next vehicle.
35:32And at the same time,
35:34we are doing our civil duty
35:36All the police officers,
35:37don't make trouble.
35:45Well, it seems that motorists
35:46seem to have been caught in the act
35:47right after the act of hitting somebody.
35:50Well, Mark, again,
35:51it's always inspiring
35:52when you see joint operations
35:54between different law enforcement agencies
35:56and it's always welcome.
35:58And I want to say that the best engagement
36:01or the best way of building
36:03public trust and confidence
36:04is when you have a joint operation
36:05like that.
36:06That the public must feel
36:08the presence of the joint effort
36:10and if persons are in contravention of the law,
36:14then the law has to take its course.
36:16But again, inspired by it
36:18and may I just take the opportunity
36:20to advise the motorists and persons
36:22who are caught in these operations.
36:26I want you to be courteous.
36:28I want you to be courteous and be careful
36:30that your actions do not bother
36:33on a contravention of the criminal law
36:34where you are impeding, threatening,
36:35obstructing law enforcement agencies.
36:38So just be careful.
36:39You have a freedom of expression
36:40but just be careful
36:41that you do not stretch out too far
36:43that you yourself is caught
36:45within the criminal law.
36:46And to the law enforcement,
36:47I always call for ensuring
36:49that you are professional
36:50in your approach, Mark.
36:52So understanding that persons have their rights.
36:55They are entitled to ask questions.
36:56But again, if you're reading
36:59and you have been a student of your occupation,
37:01you will know how to treat that situation.
37:03So it's a two-way street.
37:04But again, I love the joint operations
37:07because that is what we need

41:10on that particular time, you know,
41:12the context of that particular game.
41:13You know, sometimes you have a time where, you know,
41:15you have that level of freedom and then sometimes
41:17you may have to be very circumspect
41:19because of the nature of the game.
41:20So I think it's all dependent on the circumstances.

41:34Very, as usual, very nice to see you all,
41:39but also, Corporal Ali, I want to get a little bit
41:42of your advice, as much as you could expound.
41:45This is just a hypothetical situation
41:48to get your legal advice.
41:50Let's just say, for example, myself and two persons,
41:54or just one person, I'll just use myself.
41:57Let's just say I might have introduced myself
42:00to a person in some way, or based on a pre-understanding
42:06of me, that other person decides, hey, you know what,
42:10based on what I heard, or based on my actual
42:12personal experience, I decide I really don't want
42:15to have any interaction with me as a person.
42:21That person might be from an opinion
42:23that I might be a bit controlling, maybe manipulative,
42:27maybe a bit dishonest, but that person will decide,
42:30hey, you know what, respectfully, I don't want anything
42:34to do at all with me.
42:36That person just decides to continue on with their life,
42:40whether it be go to school, go to work,
42:41try to provide for themselves,
42:44have their own independence, and I make it my business
42:47to go out of my way to try and prevent that person
42:51from continuing their life without me in it.
42:55So, directly or indirectly, I try to make it difficult
42:58for them, I might be engaged in certain breaches,
43:02or in point-general crisis, you whatnot.
43:05From a legal perspective, how would you view that scheme,
43:08that as much advice as you could give?
43:11Thank you very much.
43:14Well, Cole, if I get you right,
43:20this seems to be something that is in relation
43:22to a civil realm, where someone may be taken
43:26a particular position based on certain occurrences
43:29or maybe certain presumptions, and in terms of two persons,
43:34I want to say that from a civil context,
43:38maybe you can probably take some steps
43:40to really get, to have some level of reasoning
43:45so that maybe there may be some self-correction
43:47that can be done to ensure that you are, again,
43:51in that good relation.
43:52However, if there's a third party involved
43:54who is basically expressing a particular view
43:59on behalf of another person, you want to be careful
44:01that if you don't have hard facts,
44:03because you could be venturing down the context
44:05from a civil realm where you are basically slandering,
44:09or if you're putting things on paper,
44:10you are running into the realm of defamation
44:12without any justification or any reasoning,
44:15any lawful excuse to be able to make a no statement.
44:19So for third parties, be very careful
44:22on your pronouncements about individuals.
44:24If you do not have evidence, if you cannot support it,
44:27if you cannot justify it, if you're not,
44:29and Mark, even to put it in the context of a media,
44:31maybe you will be best positioned as well,
44:33even from a media context, when you are reporting,
44:36seeking the other person's view,
44:37if you are reporting something to ensure that,
44:39is it what, are you going on the Reynolds privilege?
44:43Are you looking at, there's full justification
44:46for what you are saying?
44:47So we need to be careful if third parties
44:48are speaking about another party,
44:50whether it be slandering or defamation.
44:51But if two parties are involved, we are reasoning, Mark,
44:54nothing stops from engaging.
44:55Why do you feel that way about me?
44:57What am I doing?
44:58What should I do?
44:59And see if you all can work it out.
45:01But in summary, I think it's more
45:03what you have spoken about,
45:04will more be done in the civil realm at this stage,
45:07unless there's more to the matter that you have on the table.

45:27I would like to find out about the laws
45:30when coming to what I've been seeing,
45:32is that people are having garages, right?
45:36And some of them don't have papers to produce liquor,
45:39and they will take up all human needs.
45:43Is that legal?
45:44Just like I was saying, it has clubs,
45:46especially in the European area,
45:48where you have to wait for the traffic to actually stop
45:52on one side for you to be able to pass.
45:56Could you give me a little bit of insight
45:58into the laws where that is going through?
46:01Hi, Ms. Norton.
46:03Thank you very much for your question, Mark.
46:07Mark, she's speaking in the context of persons parking,
46:11from my understanding, on the public road.
46:13And if you are investing in a property,
46:17and in this case, vehicle,
46:19in the first instance, you should be able to have
46:21a proper place where you can secure that vehicle
46:22to ensure that that vehicle is not causing
46:24any unnecessary obstruction,
46:26or not causing or placing the vehicle in a way
46:28where it's a breach of a traffic sign,
46:31or in some cases, even causing a public nuisance,
46:34just by way of some reference.
46:35So to answer the question,
46:37wherever that vehicle may be,
46:40you know, let's look at that particular area
46:41and see whether, in fact, where that vehicle is parked,
46:44where that vehicle is situated,
46:47whether, in fact, that area is a no-parking zone,
46:50whether it's on a public road.
46:51And what you have explained to me
46:52in terms of persons having to wait,
46:54for example, let's say if markets are dual,
46:57where you have vehicles,
46:58one going in one direction and coming in the other,
47:00imagine you have a vehicle that is,
47:02no road that may already be narrowed,
47:03that you are parked on the public road.
47:05It means that you have to wait now to negotiate.
47:07This is where the regional corporation
47:09should now step in to assist the TTPS
47:12to ensure that the road signs,
47:15that there's deep enforcement,
47:17so that those persons who are in possession of vehicles
47:20should be looking for a suitable place
47:21to secure those vehicles.
47:22But again, like in anything else,
47:24if there's no enforcement,
47:26if you don't point persons to the road,
47:27and this is where I call on the regional corporation,
47:30because we have the municipal police
47:31who have their role and function
47:32for those issues that we are speaking about.
47:36So it may be a good time
47:37for the chairman of those regional corporation
47:39in conjunction with TTPS
47:41to be doing some public awareness,
47:43not to be prejudicial to any area,
47:45in that Arang West and that Bongi Pro area.
47:48Just by way of reference,
47:48not to point at a particular area,
47:50because there are many other areas.
47:51You are seeing persons where,
47:53even who are doing mechanic
47:56and doing other forms of service
47:58do not have places to put the vehicle,
47:59and the vehicle is lying along the public road.
48:02And that is something that is a no-no.
48:04If there's enforcement,
48:05those persons can be held liable
48:07and culpable for those acts.
48:10So again, caller,
48:12look at the particular geographical area,
48:14see whether in fact it's a public road,
48:16see whether there are traffic signs erected,
48:18see what are the circumstances,
48:20so then you will know sufficiently
48:21whether the vehicle or the vehicle that you're focusing on,
48:24whether they're in contravention
48:25of the Municipal Cooperation Act
48:27or any other act that may be governed
48:30in that particular area.

51:59I'm your host, Mark Bassan, joined today by Corporal Zahir Ali,
52:02attorney-at-law of the Trinidad and Tobago Police Service.
52:05And you talk about Reynolds' privilege, and I think a lot of people are not,
52:08you know, a lot of people always say, why don't you all call names and so on and so forth.
52:12But Reynolds' privilege really, for me at least as an investigative journalist,
52:16is extremely important.
52:17Yes.
52:18Because it gives you that ability to ask questions of people
52:23and give them a period of time to answer.
52:26Yes.
52:27That does not mean to say if they don't answer that you don't publish
52:29or broadcast the story.
52:31Yes.
52:32But you would have shown in fairness and that you have given them
52:34a period of time to answer these questions.
52:36And that is where, you know, that comes into play a lot.
52:39So when people say, why don't you all call names and so on,
52:42there are certain legal parameters we as responsible journalists must follow
52:47when we are doing things, especially in the mainstream media.
52:50And, Mark, you know, thank you very much, you know,
52:52for bringing your expertise in that particular area.
52:54And I know that you are a firm practitioner in reference to that particular principle.
53:01And, you know, strangely, a previous caller spoke about the judgment
53:06from the Privy Council in reference to the Auditor General.
53:09And you know what was, you know, revealing in that judgment, Mark?
53:12What was revealing is that the way that they spoke again heavily
53:15about the importance of natural justice principles
53:18and the importance of fairness and due process.
53:22And, again, as a society, and, you know, to give it a simple,
53:27you know, when Adam and Eve was in the garden
53:30and that wrong act was committed,
53:33even the good Lord, in terms of the supreme law,
53:35give them an opportunity to account.
53:37So that natural justice principles and fairness is so important.
53:41And you spoke about it from a media context,
53:43where even engaging a person for a position,
53:46ensuring that you observe that natural justice,
53:48a right to be heard in relation to the matter.
53:51So, again, coming out of that judgment, the importance of that particular area.
53:54But, Mark, I know that we are coming to the end of this particular program.
53:59And I want to use this last two minutes or three minutes, you know, to, again,
54:04at this point in time, you know, in Trinidad and Tobago,
54:06we have a public emergency.
54:08And we must appreciate what a public emergency means.
54:11This already have an impact from an international context,
54:17when international communities looking on what's happening in Trinidad and Tobago.
54:20And while we may have certain parameters to say, okay,
54:23we have in the first instance of three months to look at,
54:25I think that the faster we restore public safety and security,
54:28it's going to now brew that confidence, you know, as a nation.
54:32And it's important that when we're looking at a nation,
54:34we're not being selfish, Mark.
54:36We all live here.
54:37We have a role and function.
54:38Whatever role and function we have, let us play to the best of our ability.
54:42So, I just want to emphasize upon that.
54:44And secondly, you know, that rule of law, Mark, legally speaking,
54:48I want to leave this afternoon Trinidad and Tobago,
54:50that whatever public office, and going back into that Privy Council judgment,
54:55whatever public office that you are holding,
54:57understand that that office does not belong to you as an individual.
55:02That office has been provided or has been given to you to promote the public's interests.
55:08And any action that you are taking, or any action that you intend to take,
55:12it must always have the public in the periphery.
55:16You know, if we appreciate that, we will be making good decisions.
55:20But again, the rule of law is important.
55:22And let us ensure that we behave properly in public office.
55:26Wherever we may be, let us behave properly in public office.
55:30So, I'm respectfully asking, you know, the public officials in Trinidad and Tobago,
55:34appreciate that the time that you may be there is not a time that will be unlimited.
55:40Your tenure is going to come to an end.
55:42And ensure that you leave the right legacy.
55:44So, Mark, thank you very much for this afternoon.
55:46And Trinidad and Tobago, continue to exercise your due diligence.
