00:16Vinayak, who practiced law for over 45 years, passed away after undergoing a radiofrequency
00:22ablation procedure in 2017.
00:25The court found the first defendant, an interventional radiologist at the National Cancer Institute
00:30in Putrajaya, liable for negligence, dismissing the suit against the second defendant, a plastic
00:35surgeon at the Kuala Lumpur Hospital.
00:38The radiologist was criticized for showing no compassion after being notified of the
00:42horrific burns suffered by the deceased and failing to inform the patient of a recommended
00:47cryoablation procedure.
00:49The plaintiff argued that had they been informed of the risks, they would have sought a second
00:53opinion.
00:55Justice Akhtar Tahir ordered the government to pay Jaisuri 800,000 ringgit for pain and
00:59suffering, 700,000 ringgit in special damages, and 500,000 ringgit in aggravated damages.
01:06The government has appealed the quantum awarded, but not the liability.
