00:01The Court of Appeal has ruled that former nurse M. Taniswari cannot proceed with a negligence
00:06lawsuit against her former employer, Thompson Hospital Sindiran Berhad, as she has already
00:10received compensation under the Employee Social Security Act.
00:15The ruling was delivered by a three-member bench chaired by Justice Supanglian, who said
00:19that Section 31 of the Act serves as a complete bar against civil suits for employment-related
00:24injuries, except in cases involving motor vehicle accidents.
00:29Supang pointed out that there are already two federal court judgments on this issue, and
00:34the lower courts are bound to follow these precedents.
00:38As a result, the Court of Appeal set aside the High Court's earlier decision and reinstated
00:42the Sessions Court's ruling to strike out Taniswari's suit.
00:47The court also ordered that 3,000 ringgit in costs be paid as mutually agreed upon by both
00:51parties.
00:52Taniswari, who joined Thompson Hospital in August 2016 and injured her back two months later,
00:59had received percasual compensation in 2017 and filed her negligence claim in 2022, which
01:05the Sessions Court struck out, citing Section 31 of the Act.
