Willard and Dibs react to Kyle Shanahan admitting fault in the accident he was involved in two weeks ago. Is there anything fishy about this to you?

00:26you came in today, you're like, I didn't even know the database existed.

00:32And you go to this database and it's every accident in California.
00:36So Kyle may not have known what the database said.
00:40Like if Kyle's insurance company is already like, sir, you're deductible.
00:45And then we're going to handle it from here.
00:47This is an at fault accident on your part.
00:50And Kyle's like, yeah, I know.
00:52And stuff because I was there and I was looking for my phone and I crashed into a poor girl
00:57and my eye almost flew out and the insurance company is like, yeah, this is this has been
01:02listed as your fault and we're going to handle it from here.
01:05And he's like, great.
01:06I'm going to put on sunglasses and go to practice.
01:08I have no idea what this database is, how that info got there.
01:14The same way you don't trust that this isn't a wild Niners conspiracy theory.
01:18I don't trust what police officers place on a piece of paper at a computer when they haven't
01:24had enough coffee and there's a hundred of them moving through their day.

01:29So that's all.
01:31I'm not saying I'm right.
01:33I just wonder why everybody's mind when we're talking about Kyle Shanahan, who has there
01:39is zero history of him being like, I'm captain cover up.
01:45And the second that anything incorrect went public, he called everybody into his office
01:50and told him otherwise.
01:52Like, why is everybody's mind going to TNT right now?

01:59Yes, for me personally, I can only speak to why my eyebrows are raised.
02:04And it's because of the inconsistency between the initial report and then what the database
02:11says.
02:11And now Kyle Shanahan basically threw Palo Alto PD kind of under the bus because they
02:17were, you know, as of this morning, it's like not her fault.
02:20It was a it was an illegal, not illegal, but a reckless left turn that caused the accident.
02:26And that's what was in the database.

02:28The police have not spoken publicly on this either.
02:31No, they released a statement.
02:32They haven't spoken publicly, but they released a statement.
02:34They didn't release a statement claiming fault.
02:37They just released a statement and said that we're not talking about this.

02:40And they said, you know, drugs and alcohol were played no role in it.
02:44And so, I mean, did they do toxicology on Kyle and or the other driver?
02:51Certainly not at the scene because Kyle was bleeding from the face, as you've said.
02:54And, you know, he's an ambulance comes and it's, yeah, boom, ambulance.
02:58And there's been differing reports as to whether or not she sustained injuries.
03:02Clearly not severe ones.
03:04We don't think.
03:04But that's been something that's been reported one way and then not reported the other.
03:09That's why my eyebrows are up because there have been just inconsistencies.
03:13And I'm not so bothered by the 11-day delay because he's on vacation and, you know, Palo Alto PD
03:20does not, they don't have to, hey, it was the Niners head coach.
03:23He got in an accident.
03:24I find this to be a completely private matter.
03:28I really do.
03:29I mean, unless the lady wants to come out and be like, that jerk, you know, he flew, I mean,
03:36like, Kyle Shanahan was in a terrible accident.
03:39It was his fault.
03:39He messed up.
03:40He took accountability.
03:41And thankfully, he's okay.
03:43That's his fault.
03:44Like, let's go live to Mark Grandy, who has this update from the Palo Alto Police Department.
03:48Yeah, the Palo Alto Police Department has officially released a statement.
03:51A lot of members of the Niners beat have this.
03:53This comes courtesy, though, of Nick Wagoner of ESPN.
03:55The Palo Alto PD writes, quote, Kyle Shanahan's statement that he provided is correct and that he was found at
04:03fault for the collision.
04:04There was a clerical error in the preparation of the report that was transmitted to the state database.
04:09We are in the process of correcting that error.
04:12It is the officer's discretion at the scene of the collision as to whether they issue a citation to either
04:17party.
04:18It is not uncommon for officers to elect to not issue a citation to either party involved in a collision.
04:25Neither party in this situation was provided preferential treatment, end quote.
04:30And they also add one more important piece.
04:33The clerical error was not made by the California Highway Patrol.
04:38They're not involved in the data entry.
04:40It just reads as that because it gets submitted to them later on.

04:44That is all incredibly believable to me.

04:50And I told you, I'll bring in the police report from my accident a month ago and show you all
04:55of the errors on it.
04:56I'm like, that's not what I said.

05:07They got that part right.
05:08And the insurance companies took care of it.

06:29what has been reported and released the way that the Palo Alto Police Department came out
06:34pretty quickly when the story broke and did a lot to try to just, we're going to close
06:49I don't want this, like, I mean, I understand there's a, it's a public record state, I get
06:55that, but there's no, like, the police are not under some obligation to have a news conference
07:01to tell everybody everything that happened in a car accident.
07:04They're not, but when you, especially when nobody has blown any sort of a whistle, right?
07:10But when you, when you come out crime here, so this becomes a thing and a story because
07:14Kyle Shanahan's the coach of the 49ers and he's a, he is a very popular public figure.
07:19And so when you come out and you say your initial statement, basically that's going to do it
07:25for that.
07:25No more information.
07:26Well, the database, somebody is going to sniff around and Eric branch and his colleague,
07:31they, they went and they found it and then some aggregator knockoff took it and ran with
07:36it and got credit in some corners.
07:38But once you get, once you get that database, it's like, oh yeah, it turns out it was listed
07:44as her fault.
07:46Could it have been inputted incorrectly?

07:48I mean, I'm, I'm not sure if that is what happened and maybe their report does say something
07:53different.
07:54And when they typed it in the computer, somebody didn't have enough coffee and he typed it in
07:58wrong.

08:02I just, the reason why it becomes curious to me is because it is Kyle Shanahan and you
08:08know, the initial report was he was on his phone and so he had his phone and then Kyle
08:13says, no, I dropped my phone.

08:16That's kind of, I mean, you know, when something's written on a report, that's kind of the same
08:19thing.
08:20He was grabbing for his phone.
08:22He was on his phone.
08:23He was touching his phone.
08:24He was thinking about his phone.
08:25I like whatever, right?
08:28It comes out.
08:29It's confusing.
08:30He addresses it.
08:31He tells everybody in great detail.
08:34By the way, if you want to go online, Kyle Shanahan, he's like, it was on my lap.
08:39It slid off my lap.
08:40It went down in between the seats.
08:42I reached for it, which by the way, is one of the worst things in life.

08:47You never get it and your hand hurts like hell.

08:53I'd like to ask somebody who builds cars, why couldn't you make that space a little bit
08:57bigger so that a human hand can fit down there?

11:07Yeah, real quick, I guess a couple of things.
11:09You know, I'm glad and certainly glad that no one got serious.
11:11I mean, it's serious, but he's going to recover.
11:13Kyle is and that's great.
11:14And I'm a Kyle supporter, so I'm not I don't bash him in the least.
11:18I support the guy.
11:19But, you know, what about the scenario that, you know, they had this accident.
11:24Kyle was at fault.
11:26He knew he was at fault.
11:27And, you know, she also knows that this guy is a prominently well-known, wealthy individual.
11:35And, you know, what's to say that, you know, look, we'll talk to you later.
11:39We want to take care of your car.
11:41Are you hurt?
11:41No, I'm not hurt.
11:42But your car is damaged.
11:43Well, we definitely want to fix you.
11:44We'll take care of that.
11:45But a day or two later, a lawyer calls and says, look, you know, we want to give you a
11:49hundred grand to kind of she says, no, no, you don't need to get.
11:52I'm not hurt.
11:52I just want to take care of my car.
11:54No, no, no.
11:54We want to give you a hundred thousand dollars.
11:56We we feel really bad about it.
11:58We take ownership and whatever.
12:00Well, you don't have to do it.
12:01But that's great.

12:04And then the story comes out.
12:05She's saying, you know, it was really my fault.
12:08You know, he didn't have he was a good guy about it.
12:10You know, it wasn't any big deal.
12:13And then here we are after the fact, Kyle saying, yeah, it was my fault.
12:17I mean, that doesn't seem too far fetched.
12:19I mean, now people have accidents like this.
12:21And that's why people have million dollar umbrella policies to cover situations like this.
12:25So that doesn't seem too far fetched to me.
12:29And the other thing regarding the phone, I can tell you from personal experience, you know, at least where I
12:34live, if you get stopped on a first offense with a phone in your hand at a stoplight, you're not
12:39even moving and you're sending a four minute text.
12:42You can get a ticket.
12:43You probably will get a ticket.
12:44And it'll be about one hundred and eighty two hundred dollars.
12:47The paper reported something like twenty dollar fine or something like that.
12:50Well, not not down here where I live.
12:52It's one hundred and eighty hundred and eighty bucks for the first offense.
12:55So I don't really know why the officers, they said they didn't offer favoritism.
12:58But, you know, when you cause an accident and you were using a cell phone, it seems like favoritism to
13:05me.
13:05I don't know what you want to call it.
13:06But anyway, I wish everybody well.
13:08But that's just my take on it.

13:11My thought goes to if I'm an officer and I have reason to believe that somebody might have been grabbing
13:16at their phone.
13:17I don't know necessarily how I would acquire that information immediately unless the person told me that.
13:24But oh, by the way, the person's eyeball might fall out.
13:28I tell you what, let's move past the ticket and let's get you an ambulance.
13:35That's where my mind would go.
13:37And as the Palo Alto police have already released in a statement, it is at the officer's discretion as to
13:42whether or not they want to issue citations.
13:44I don't look at that as favoritism.
13:46I look at the officers in that moment, probably thinking, you know what, let's worry a little bit less about
13:52our quota right now.
13:53And how about if we get this man's head fixed?
13:56Well, you can still go back and issue a citation later.
14:00And you can.
14:00The favoritism part doesn't play because one of the initial reports was that she made a turn that was, you
14:08know, reckless, a reckless turn, which she didn't get cited either.
14:11So if, in fact, it played out that way, where she cuts in front of Kyle Shanahan and they have
14:18a collision right there, well, you would definitely cite her for a reckless turn that caused him to almost lose
14:23his eye.
14:24Which may or may not have even happened.
14:26Again, how this all got translated into that database, we are never going to know at all.
14:33But we might.

14:36I mean, is this woman now going to call a press conference?
14:39I mean, Kyle, he took responsibility.

14:54Is it possible that everybody just acted like adults here?

15:39Well, there is plenty of evidence, actually, that these two parties are not out to get one another.

15:47This woman has not felt the need to freak out and go to the media.
15:50The police are doing their thing and have just admitted their fault in this.
15:56Kyle Shanahan has admitted his fault in this.

16:01Again, I keep referencing this and I hate it because it has nothing to do with each other.
16:05But I was just involved with an accident where two adults got out of the car and helped each other
16:11out.
16:11And the one who was at fault apparently was like, that was my fault.
16:15And the one who wasn't at fault was like, that was not my fault.
16:18And then this thing was over in 24 hours.
16:21Is it possible that two people just acted like adults here and realized that one of them was hurt and
16:28that's first and foremost above everything else when this thing happens?
16:32There's a man who's hurt.
16:34Let's deal with that first.
16:36And then we're going to worry about payoffs and whether or not we can end up on Netflix with a
16:41drama or anything like that.

16:46But without any reason to think otherwise, that's the way this all feels to me.

16:57And, you know, you've had 11 days between the accident and the initial report of what had happened.
17:03And that's a lot of time to, you know, have things get buttoned up.
17:08And, you know, maybe there's a clerical error and there's a initial police report.
17:13And I'm looking at the log here and I believe it was actually posted two days ago.

17:19Now, that's not out of the ordinary.
17:20If you look at the police log from two days ago, there are incidents from June 7th, July 1st, July
17:278th.
17:28It takes a while.

17:30Sometimes it takes no time at all.
17:32Especially for a detailed one with injuries.

17:34So it's an injury accident.
17:35And the other one's here.
17:36There's a petty theft.
17:37There are suspicious circumstances.
17:40So not every report gets filed the same day.
17:42And, in fact, a lot of these don't get filed right away.
17:45And so, yeah, it takes time to go ahead and ascertain exactly what happened.

17:55You know, I watch these videos on YouTube all the time with the police cam, body cam.
18:00And this doesn't make any sense at all.
18:02This makes no sense.
18:04Somebody getting into an accident like that with 40 stitches.
18:07This reeks of somebody having alcohol in their system, drugs in their possession.
18:11And sometimes these police departments, they just give a slap on the wrist to their own officers.
18:16So imagine what they're going to do to a celebrity, especially like Kyle Shanahan.
18:20He's bigger than a movie star over there.
18:22He's like a god.
18:23Mike, where are you going, dude?
18:25Like, you watch YouTube.
18:26So because you've watched YouTube, somebody got 40 stitches.
18:30And that means automatically alcohol is involved.
18:33Sounds like a wild accusation.
18:34It's pretty unfair to me, Mike.
18:37Well, nobody tested for drugs.
18:38Nobody tested for alcohol right away on both parties.
18:41That doesn't say that's totally abnormal.
18:43Right away, you're going to test for it.
18:45You're going to say, have you had anything to drink tonight?

18:48Who told you that none of those things were asked?
18:53They investigated and immediately reported that there was no alcohol or drugs present in either party.
18:59Yeah, and you can tell by Shanahan's reaction.
19:01A normal reaction would be like, oh, my God, I was messed up.
19:04I was goofing around on my phone.
19:06I effed up big.
19:07I could have killed somebody.
19:08Mike, that's enough out of you.
19:10I mean, what the hell are we talking about?
19:12Well, first of all, if you didn't suspect it, then even if you did suspect it, you would
19:19not put him through a field sobriety test when he's bleeding from the face.
19:23So if you don't, so this happens, police respond.
19:27And initially, you're going to smell to see if you smell alcohol.
19:30You're going to look to see if there's residue from drug use or anything.
19:33If you don't suspect it, you don't automatically have to tell the hospital, hey, you may want
19:38to draw the blood just in case.
19:41I mean, you can do that if you want, but they might have done that and it might have been
19:480.0 or 0.00.
19:50We don't know if they drew the blood.
19:52We don't know if it showed anything, etc.
19:54But they would not have put him through a field sobriety test with broken ribs and a
19:59bleeding face.
