Shumba James who spoke exclusively last year to TV6 News to clear his name of any involvement in a double murder in the Moruga district - has been detained under the Emergency Power Regulations following a gazetted legal notice signed by the Minister of National Security Fitzgerald Hinds.

00:05Emergency Powers Regulation 2024 following a detention order issued by Minister of National
00:10Security Fitzgerald Hines.
00:12According to the order, James has been identified as a credible suspect in various illegal activities
00:17including planning targeted killings of individuals assisting the police in their investigations.
00:23The detention is deemed necessary to prevent James from acting in a manner prejudicial
00:28to public safety and order.
00:30James can be detained at the Eastern Correctional Rehabilitation Centre, Santa Rosa, Rima or
00:35any other location as directed by the Minister.
00:39Sources confirmed that James has been detained over the last few days.
00:43The detention was authorised under paragraph 2 of the Schedule to the Emergency Powers
00:47Regulations 2024 which grants the Minister power to detain individuals without warrant
00:53for preventative purposes.
00:55Hines justified the detention by citing concerns for public safety and the need to maintain
01:01order.
01:02James can challenge his detention by making a case to the three-member SOE Tribunal.
01:07Legal sources say that he is expected to be detained for the period of 90 days.
01:11Reputed gang leader Calvin Lee, who was detained by police on December 29, 2024, was later
01:17released and placed under house arrest under the Emergency Powers Regulations 4.1c as authorised
01:24by the Commission of Police.
01:26His attorneys have since vowed to challenge his house arrest.
01:29A state of emergency was declared on December 30 and since then a tribunal has been established
01:34to review the cases of detained individuals.
01:37Guidelines set by the tribunal were gazetted on January 9 and outlined the rights of detainees
01:42and the processes for reviewing detention cases.
