00:00The Supreme Court has said that an open space adjacent to the Bhojshala site shall be provided to the Muslim
00:06side for offering the Friday press.
00:08That's the word coming in from the top court saying that it is an ad hoc arrangement.
00:14But the Supreme Court has confirmed that this is the area that is adjacent to the Bhojshala.
00:19This is an open space and the Supreme Court has allotted that space to Muslims so that they can offer
00:27their Friday press.
00:28As much as the Supreme Court has added that this is an ad hoc arrangement which means that it is
00:34not a permanent system that will be set up but at the moment until there is an option available.
00:41The Supreme Court has allowed the Muslim side to offer their Friday press in the open space that is adjacent
00:50to the Bhojshala site.
00:53Shishti Ojha joining me on the phone 9. Shishti what more has the top court said on this matter?
01:00Well yes the Supreme Court has passed a very important matter.
01:04It's important to note here is that the Muslim side has challenged the MP High Court's order in the Bhojshala
01:10case.
01:11The court has today refused to impose any interim stay on that particular High Court order.
01:16The top court has sought ASI an MP government stand on the petition that has now been filed by the
01:22Muslim side.
01:24An ad hoc arrangement however has been made, has been directed to be made by the Supreme Court so the
01:29Muslims could offer their prayers.
01:31The court has said that an open space adjacent to the Bhojshala site be provided to the Muslim side by
01:37the government for offering the Friday prayers while also clarifying that this is an ad hoc arrangement.
01:44Ad hoc arrangement in the sense that since the Supreme Court is still considering the matter and the matter is
01:50pending before the court.
01:51But till the time the hearing concludes, this is something the court has asked the government to do in the
01:56meantime.
01:57The court has also asked ASI if any structural changes have been carried out, if any structural changes are carried
02:04out, this will not be done without the leave of the court.
02:07The court will now hear the matter after three weeks, which is when the court will consider the responses that
02:12come in from the ASI and the MP government to this challenge that has been filed by the Muslim side.
02:21We also saw the Supreme Court be very cautious during the hearing clarifying that it should not make, nobody in
02:28the court including both the bench and the lawyer should not make any observation or expression which could affect the
02:35peace and the law and order situation there at Bhojshala.
02:40The court also remarked that these are sensitive matters and therefore it should be careful in using any expressions.
02:47We also saw the solicitor general Tushar matter appearing for the state question why the Muslim side has now come
02:53and challenged the order after so long.
02:55Two months have already passed and they are seeking a status quo challenge with the high court order after this
03:02time frame.
03:02So this is what has happened, the Muslim side as of now, they haven't managed to get the interim relief
03:08that they wanted in form of the state of the high court order, but they have definitely now managed to
03:14get an ad hoc arrangement at least, so they would be able to offer their prayers in a site adjacent
03:22to the Bhojshala.

03:24Shishi, can you further take us through the sort of arguments that were made and how the Muslim side is
03:29reacting to the order that has been given by the top court?
03:34Well, we saw the lawyers appearing for the Muslim side.
03:38Shesman warned point a lot that the arrangement that was at place with regard to how the Muslims offered prayers
03:43and how the Hindus offered prayers at the site has continued for many years.
03:48They raised the question why change that now?
03:50We also saw one of the senior lawyers comment that India is a country which is less of history.
03:56Even Mahatma Gandhi said that an eye for an eye would make the whole world blind.
04:00Again, questioning why change in arrangement now, which has lasted for so many years, peacefully.
04:06So these were basically the arguments that were made on behalf of the petitioners who also questioned the high court
04:15order and why such an order was passed and also the need for an interim stay to be given by
04:21the Supreme Court on the high court order.
04:22As I mentioned earlier, the state on the other hand, the government on the other hand, noted that the order
04:28of the high court was passed in May.
04:30Several things have happened since then.
04:32And the court questioned, the government questioned why have the petitioners now come in after two months to seek a
04:38status quo.
04:39Several administrative problems may arise.
04:42We also saw the court remark that these are sensitive matters.
04:46The matter is now going on before the Supreme Court.
04:48So the bench and the lawyer should be careful of the remarks or the expressions that are made in matters
04:53of such nature.
04:54No orders should be passed or no directions should be passed which could cause any tension at the site there
05:01or create any law and problems there.
05:05So we saw the court question the government if any, in an administrative way, any alternate arrangements could be made
05:12to ensure that in the time being that the court is considering this case, if any alternative site could be
05:17provided to the Muslims to offer their press.
05:20Remember if we talk about the high court order which is now under challenge, one of the directions even in
05:24the high court order was that an alternative site would now be allotted to the Muslim site.
05:29Considering that has taken some time, we saw the Supreme Court ask the government if something can be done now.
05:34The government was listening to it and therefore the court eventually in its order dictated that an alternative site be
05:40given adjacent to the Bhurshala.
05:42So the Muslims in the time being could offer their prayers there.
05:45The court will definitely consider the case after three weeks.
05:48Important things that the court would have to consider would be the reply that would now come in from the
05:53ASI and also the MP government.
05:55Basically what their stand would be to this particular challenge that has now been filed by the Muslim side.
