The Supreme Court has refused to extend the transit anticipatory bail of Pawan Khera till Tuesday in a defamation case filed by the wife of Assam Chief Minister Himanta Biswa Sarma.

00:00There is no relief for Pawan Khera from the Supreme Court.
00:03In the latest that is just coming in, the Supreme Court has refused to extend his transit anticipatory bail till
00:09Tuesday.
00:10Pawan Khera had sought bail that it must be extended till Tuesday so he could move to a competent court
00:18in Assam.
00:19Pawan Khera had argued that the court in Assam is closed.
00:24The Supreme Court has said that Pawan Khera can move an anticipatory bail application before the Assam court immediately.
00:30The Supreme Court has also clarified that the court will not be influenced by Supreme Court's observations in its earlier
00:37order.
00:40In fact, the Supreme Court has also said that as far as the Assam court is concerned,
00:44that is to decide Pawan Khera's application based on material placed and on its own merit.

00:56and most importantly, how can Pawan Khera's legal counsel now combat this legality?
01:05Well, Asha, as we remember, the Tulangana High Court had granted relief to Pawan Khera where one week transit anticipatory
01:12bail was granted to him on 10th of April, seven days.
01:15After that, the state of Assam challenged that before Supreme Court which had granted a stay on that particular order
01:20which was a major setback for Pawan Khera.
01:22Now, what we saw happen yesterday was Pawan Khera moving the top court again, seeking that stay order on the
01:28relief order be removed
01:29and also what Pawan Khera's counsel requested the court today was that he is basically seeking extension of that relief
01:35till Tuesday
01:36to enable him, to give him enough time to apply for a bail before, to apply for an anticipatory bail
01:42before a competent court in Assam
01:44because the courts there are closed right now, basically which is why he has not been able to move the
01:52local court there, the trial court there yet.
01:54The court, however, was not very convinced of the submissions made, however, the court did agree to give some few
02:00clarifications in his favour
02:01where the court has clarified that the observations made by SC will not come in his way when he moves
02:07the trial court.
02:08The trial court will have to decide the case based on the materials pleas before it, based on the evidence
02:12before it
02:12and also once again clarified that Pawan Khera is at liberty to move for anticipatory bail before a competent court
02:19in Assam.
02:20The court will decide the matter and will take up the case, will decide the matter without being influenced by
02:26any observations
02:27which have been made by the Supreme Court in its earlier order where it had stayed the order.
02:33Now, that matter, the main matter is already pending before a Supreme Court where notice was issued to Pawan Khera
02:39on the last occasion.
02:40Now, what will be important to see now is how the legal team, how the legal team decides to proceed
02:46further
02:46whether or not the local court, the trial court or the high court, if they move to the high court,
02:51whether court in Assam decides to grant him anticipatory bail or not. Back to you.
