00:00Former 1MDB Chairman Irwan Sirigar Abdullah has asked the High Court to throw out the
00:06company's damages suit, arguing that 1MDB altered its case because it was unable to
00:11prove he was responsible for its losses.
00:14Defence Council Kay Lavinia said 1MDB originally sought losses arising from its brazen sky
00:20investment and payments made to Abu Dhabi entities, but now seeks RM15.62 billion based on current
00:28financing liabilities and accumulated interest.
00:32She said this amounted to a complete departure from the company's pleaded case.
00:37Lavinia argued that Irwan was made a convenient defendant.
00:40She said the disputed transaction occurred between 2009 and 2014, well before he became chairman
00:47in May 2016.
00:49The lawyer said 1MDB's own evidence identified its former board and senior management as
00:55responsible for the transactions, yet the company withdrew its action against them.
01:01Lavinia submitted that 1MDB had already recovered about US$7.9 billion through settlements with
01:07the US Justice Department, Ambank, Deloitte and KPMG, and said the damages sought from Irwan
01:14amounted to double recovery.
01:16Counsel for 1MDB, Lim Chiwi, is scheduled to reply on July 16th.
