08:18There is a $4,800 bill for an emergency department visit that's dated the day of the incident.
08:25You went to the emergency room, yes?
08:26I did go to the emergency room.
08:28It was San Joaquín General Hospital that they took me to in French Camp.
08:31And then I see another bill from San Joaquín General Hospital for an emergency room, pharmacy, preventative care services.
08:38How do you explain those two bills?
08:40There was a bill for the hospital visit itself.
08:43There was a physician's bill, which is that other bill that you were talking about.
08:47And then there was the ambulance bill.
08:50And then I did get some prescriptions given to me at the hospital.
08:55So that's for their pharmacy there.
08:57Did you ever share your bills with the defendants?

09:00I had no inclination at that moment that there wouldn't be any reason why we wouldn't be able to work

09:06Because you actually told her that you wanted to make payment arrangements.
09:09So what happened?
09:10So we were constantly paying her.
09:12Right now my husband is on leave with disability.
09:13We have three kids and we all know California is very expensive.
09:16And I was constantly paying her $100 a month.
09:19The last payment she received, I believe, was October of 2024.
09:23My husband was not working.
09:24It was just me.
09:26And she texted me in December and she said, hey, I would like to meet up.
09:29So I said, okay.
09:31And I've never seen that phone call because also I wanted to discuss with her.
09:35I don't believe that all these bills we should be paying.
09:38I don't know where the $16,000 came from.
09:40But your dog got out and caused very serious injuries.
09:46So just digest that.

09:49Well, I'm on board with a statement that Judge Acker made to you.
09:52Based on the scars on your arm, the pain and suffering that you went through, that you could have brought
09:58this case in a civil court or even a Supreme Court, a higher court, and probably recovered $100,000.

10:06I mean, I saw the blood dripping off your arms onto the ground.
10:10I mean, it's just a total outrage.
10:12It's such an outrage that even if I looked at the medical records and wanted to accept what you were
10:16saying, that one of those bills wasn't good, still, any two of these bring her over $10,000.

10:32One, according to the police report you had, that the dog had bitten somebody back in 21.

11:02Frazier advised her dog named King has gotten out from the backyard multiple times in the past and has been
11:08warned about it from animal control.
11:11Frazier advised that she had King since 2016 and he has not been aggressive in the past.
11:17That's not true because on page 33, which is the next page, it says,
11:23Upon checking our databases, I discovered that King also had a previous bite on his record from November 5, 21.
11:32He was quarantined for 10 days at the Manteca Animal Services and then was reclaimed on November 16, 2021.
11:39And, of course, you don't remember not having your dog for 10 days while he was quarantined for a bite.
11:44Oh, no, I remember that.
11:46Because I want to go on further.
11:47It wasn't because of a bite.
11:48It was because he got out.
11:49It was not for a bite.

11:50But this is you here saying my dog didn't do anything but just jump up and scratch somebody.

13:40You say to her the next day, please send us any medical expenses for this.

14:46Ashani and Davian say they only agreed to pay for one medical bill, but more questionable bills kept coming, so

15:37But you should really be aware of what it is when you own pets, how you have to be responsible
15:41for them.

16:29So here's what we're going to do.

16:36Because the reason that we know that they didn't have insurance that covered this type of incident
16:42was because your lawyer obtained all the information that he could regarding coverage.

16:55And they investigate, according to the letter from State Farm.

17:00Somebody did call me for like a couple weeks after the incident.

17:04And who was it?
17:05And then they said that they're going to get in contact with our landlord.
17:08And then next thing you know, our landlord called us.
17:09Yeah, that's because they didn't have insurance.

17:11And that's what I was told.
17:12Now, Mr. or Ms. Frazier, you said that your landlord knew that you had a pit bull when you moved
17:17in.
17:18Yes, he did.
17:19And you also said, Mr. Frazier, that the landlord did not fix your fence.
17:22No, so I tried to fix it myself.
17:23Right.
17:23And the reason that you told your landlord to fix the fence was because your dogs had gotten out before.
17:28And you told the landlord that it was his responsibility to fix the fence because you guys are just renters.

17:36What year was it that you told your landlord that the fence was broken and that King had gotten out?

17:43The year that we moved in because it was the first.

17:46And so that fence was never fixed in 2018, 19, 20, 21, 22, and 23.

17:58These are all things that the lawyer should have hired an investigator to interview because if he did that, you

18:34The fact is, she wasn't even asking you for pain and suffering, which she was entitled to.

19:24And to have been attacked because of negligence like that, it's disheartening.
19:30It wasn't just negligence.
19:31It was gross negligence.
19:33And I'm going to tell you something else.
19:34It was gross negligence on your lawyer's part.

19:40I want to circle back to the question of rental insurance.
19:43Because you said you had rental insurance, so why not submit a claim?

19:50Honestly, I didn't even think about it, to be honest.
19:53I have never seen a homeowners or rental policy that did not exclude, very specifically, two breeds.
20:01And the reason I know this is because one of them I really wanted once upon a time, which is
20:05a Rottweiler.
20:05They're beautiful dogs.
20:07They're smart dogs.
20:08You know what the other breed is?
20:09Pit bulls.
20:10Pit bulls.
20:10So, Your Honor, I've never seen a policy that said we are going to cover for pit bull injuries.
20:15Your Honor, I do remember when he, when my husband did get the renter's insurance, he had to look.
20:19And that was the only one that would take a pit bull, because a lot of them were saying no.
20:22It's very rare.
20:23So why didn't you submit a claim?
20:24I don't know.

21:25do that,
21:26because if you ever put in a claim before for the other person's bite,
21:30now it would be on record that your dog has bitten at least two other people,
21:34and that would be a reason for you not wanting anybody other than who already knew
21:38to find that your dog had bitten just one more person.
21:43That was the reason why you never even suggested it, and this has to be a reason.
21:47Why would two people who can't afford, based on what you said, who can't afford to make a payment,
21:50not want to go through their insurance to give this woman something?
21:53We paid her a total of $650.
21:55Yeah, $600.
21:56And at the time it was hard.
21:57And then she messaged me because we had a cool relationship.
21:59Enough!
22:00You can't afford to take care of your problem, then you shouldn't have a problem.
22:03And the bottom line is, you're saying, oh, we made so many payments.
22:07You paid $600 to the $16,000 that she had to pay.
22:12And I know even when we're done with this, you're going to walk away and say,
22:15I don't understand it.
22:16We gave her $600.
22:17I mean, what do they want from us?
22:18We can't afford this.
22:20I don't have any other questions.

22:37The liability is clear.
22:39If she had one of these medical bills and then wanted the balance of her complaint to be for pain
22:45and suffering,
22:45this is one of the easiest $10,000 verdicts that I've ever seen.
22:49I mean, when I saw her and the blood dripping from her arm in the video, it was upsetting.
22:55And to think that they're going to come in and accuse her of falsifying documents, et cetera,
22:59she deserves every penny and I wish she could get more.
23:02Not all pit bulls are bad.
23:03They're not.
23:04And the reason that they get the rap that they do and the reason some communities are banning them
23:09is because of incidents just like this, when you've got morons who have pit bulls,
23:13don't train them properly, despite when they're getting out of their properties and roaming at large,
23:19prior bites and do nothing about it.
23:21And then everybody, every pit bull owner, despite how sweet they may be and how great they are,
23:27all get painted with that same broad brush.
23:29That's why.
23:30I would have given them the money.

23:33What were the little ones?

24:14afford to pay her.

24:16I am sure that times are tough, but that's not a legal defense.
24:21And one of the things that people have to think about when they take on obligations,
24:25certainly breeds like this, is you've got to think in the back of your head, like, what happens if something
24:30goes wrong?
24:31So what you have to do is make sure that you're doing all that you can to protect your family
24:37and the community.
24:39You know, Judge Levy's right.
24:41The death of the dog is on nobody's hands but yours.
24:46The liability is yours.
24:47We're going to hold you to it.
24:49And ma'am, this $10,000 is just the tip of the iceberg in terms of what we all think
24:53you would actually be entitled to.
24:55So we are very pleased to render verdict in your favor.
