00:00Previously, on Tribunal Justice...
00:03The truck had major problems that made it unsafe to drive.
00:06The motor could blow up, potentially.
00:08I'm 100% sure he's lying.
00:11I'm thinking about all the things that you did
00:13that would be textbook how not to buy a car.
00:17I probably should have had it checked out by a mechanic first.
00:19He's selling the truck.
00:20Truck sounds like a jet and has plenty of power.
00:24So, who is being dishonest here?
00:51Today's case was filed in McMinnville, Oregon.
00:55All right, I just want to clean a couple of things up, if I could.
00:58You sold the vehicle.
00:59Yes, Your Honor.
01:00This document was provided by the defendant, right?
01:04That was the ad?
01:05Correct.
01:05And you gave this to me, Ms. Busser,
01:07because you wanted to show us that he was being dishonest
01:10when he failed to list the engine problems, right,
01:12that he's complaining about right now, right?
01:15Yes.
01:15That ad is dated October 24th, 2024.
01:18So, he bought the truck on September 22nd?
01:21Mm-hmm.
01:22And then he's selling it on October 24th?
01:24On the listing, if you look at the photo,
01:26it says about a month ago.
01:27So, he listed about a month before October,
01:30which was two days after I sold him the truck.
01:33So, that's consistent with what he's saying.
01:34He says, by two days after the truck,
01:36he knows that despite what you specifically told him,
01:39and I'm not talking puffery,
01:40the truck runs great when it might just run good.
01:43That's puffery, and Judge Acker's 100% right.
01:46But you specifically told him that there were no engine problems, right?
01:49Yeah.
01:49Because there weren't any engine problems.
01:51There were not any.
01:51And you already testified that the mechanic told you
01:53there were no engine problems.
01:54Yeah, correct.
01:55But to be quite fair, Mr. Robinson,
01:57you also provided us with a text
01:59that was the text that you sent out to people
02:02when they responded to this partial ad.
02:05Now, mind you,
02:06the defendants provided us with this information, right?
02:08This ad.
02:09What you said is that this ad is not complete,
02:11and there were additional documents
02:13that they could have printed out
02:15and provided us with
02:16that had your explanation about the head gaskets.
02:19They just didn't print it out.
02:20Yes, Your Honor.
02:21And on your text message, though,
02:23that you did provide us with,
02:24this is you responding to one of those people
02:26who contacted you.
02:27I mean, yeah, it runs in drives
02:29but needs some pretty big repairs.
02:31It has low mileage,
02:32but I just got it out of the diesel shop,
02:34and it needs two injectors
02:36and has leaky head gaskets.
02:39You didn't know that they were going to come in here
02:40provide us with a half document
02:43to make you look bad,
02:44and so you gave us that text message
02:47to prove the falsity
02:48of what they were trying to pull the wool
02:50over our eyes.
02:51Did I get that right?
02:52Yes, Your Honor.
02:52Thank you.
02:53That's correct.
02:53On that receipt that we got from your mechanic,
02:56it was dated June 10th, 2024, right?
02:58Yeah, correct.
02:59June 10th, 2024.
03:00You got this work done,
03:01and you sold it September 22nd, right?
03:04Yeah, correct.
03:05And you say that you were driving it every day
03:07between June 10th
03:09until you sold it June 22nd, right?
03:11Yes.
03:12And that mechanic,
03:14his name was Zachary Heflin, right?
03:16Correct.
03:16Did you know him?
03:18No.
03:18You, ma'am?
03:20No, we were recommended by a friend of ours
03:22that takes their vehicle there.
03:23And that friend of yours said
03:24that this was a good mechanic, honest guy?
03:27Yeah.
03:27He's not going to try to rip you off?
03:29No.
03:29You have no reason to believe
03:30why Zachary Heflin
03:32would be biased against you, do you?
03:34No.
03:35Great.
03:36I think we have a witness
03:37that we like to bring in,
03:38Zachary Heflin.
03:42Coming up on Tribunal Justice.
03:45You said that the truck
03:46had 152,000 miles, didn't you?
03:48Yeah, right.
03:48And the car facts shows
03:50is 362,000 miles.
03:54So how do you explain that discrepancy?
04:02Justin Robinson is suing
04:03Aubrey Bogosian and her mom,
04:05Alyssa Busser, for $10,000.
04:07Justin claims they sold him a truck
04:09that was too dangerous to drive.
04:11But Aubrey and Alyssa say
04:12it was an as-is sale,
04:14and they never misrepresented anything.
04:17What's your name?
04:18Zach Heflin.
04:19Take a look at these two ladies over here.
04:21You recognize him?
04:22Yeah.
04:23Who is he?
04:24The mechanic.
04:25I'm going to make this real clear
04:27and simple for you.
04:28Yeah.
04:29Now that you see him
04:30standing right there,
04:31Yeah.
04:32Is there anything about your testimony
04:34you want to change?
04:35No.
04:35About what he told you?
04:37No.
04:37About problems and engine problems
04:39with that vehicle?
04:40No.
04:41Good.
04:41Digging in, doubling down.
04:44How long have you been a mechanic?
04:45Ten years.
04:46Did you work on this 2005 Ford F-350?
04:49Yes.
04:50Is that the truck
04:51that's on the screen right now
04:52that they brought in?
04:53Correct.
04:53And when they brought the truck in,
04:54it was not running, correct?
04:56Correct.
04:56They had to tow it in.
04:57Correct.
04:57Tell us about the inspection,
04:59what you did,
05:00and most importantly,
05:01what you told them,
05:02if anything,
05:03about substantial engine problems,
05:06specifically with the head gasket.
05:07So we took the truck in,
05:09pulled codes off of the truck.
05:11It had immediate injector codes,
05:13low oil pressure codes,
05:14and a ton of other random glow plug codes
05:17and similar stuff.
05:18Truck needed a wiring harness.
05:20I recommended we put an OEM Ford harness in it.
05:23Too expensive.
05:24They wanted to go with one they provided.
05:26Okay, no problem.
05:27We installed the harness,
05:29found more issues.
05:30Now the truck would crank,
05:31still no start.
05:32Found bad injectors,
05:34found a bad fuel injection control module.
05:36Tore the truck back apart,
05:38talked to them about it,
05:39told them what we recommended,
05:42which is removing the cab
05:43and doing the head gasket job.
05:45When you do that,
05:46all these little problems
05:47will not nickel and dime you.
05:49You do it once.
05:50When you do it once,
05:51it's done right.
05:52Warranty, no problem.
05:53That head gasket that you told them
05:55that you wanted to take the cab off to get to,
05:57it was your professional opinion
05:59that that needed to be replaced.
06:00Absolutely.
06:01And you told that to them.
06:02Correct.
06:02Hmm.
06:03I don't want to hear you.
06:04I got nothing to say to you.
06:06I want to hear from him.
06:07Go on.
06:08Once we installed the new set of injectors,
06:10a used fuel injection control module,
06:12trying to save some money,
06:13we did a high pressure oil pump,
06:15which was also not working properly.
06:17And then we did a fuel lift pump.
06:19These parts,
06:20one of them was not noted on the invoice
06:21because we were trying to help.
06:23They had $4,000 to work with.
06:25My repair would have been $12,000,
06:27but I knew they were in a tight spot.
06:29I wanted to fix the truck
06:30so they could at least use it or sell it.
06:32So we did everything in our power
06:33to make it run,
06:34but it was not correct.
06:36The truck needed a lot of work.
06:38If I understand your testimony,
06:40you provided the defendants
06:41with a list of items that needed to be fixed,
06:44including new head gaskets.
06:46They ignored your recommendation.
06:47It was a decline.
06:48Because it was going to cost an extra $8,000.
06:50Correct.
06:51And they fixed none of the engine problems
06:53and instead only authorized repairs to the truck
06:55so that it could get running and sold.
06:58Correct.
06:58Did you tell them
06:59that the truck should not be driven
07:01with a blown head gasket?
07:02Yes.
07:03And did you tell them
07:04that the truck was not safe to drive?
07:07Yes.
07:07Why would he lie?
07:08I don't know, Your Honor.
07:11This is for Mr. Heflin.
07:13I never received a list
07:14of the repairs that needed to be done.
07:17You mean a written list?
07:18He called me and told me.
07:18You mean a written list?
07:19He's not telling you
07:20he gave you a written list.
07:21He says that he told you verbally.
07:23He told you verbally
07:24the truck should not be driven
07:26with a blown head gasket.
07:27It's not safe to drive.
07:29You simply want to get it running
07:31so that you could sell it.
07:33Right?
07:33Correct.
07:34In addition to that, sorry,
07:35if I may go ahead.
07:36And there's more?
07:37Yes.
07:38When the truck was driven
07:39under light circumstances,
07:42they're presented no issues.
07:44When the truck was driven
07:46on the highway under high load,
07:48three-quarter throttle,
07:49for an example,
07:50the turbo would surge.
07:52That was made known.
07:53But that's only known
07:55out on the highway
07:56and under hard load
07:57and acceleration.
07:58Once you get back stopped,
08:00the coolant bottle
08:01has so much pressure
08:02that coolant will puke out
08:04onto the ground.
08:04And did you tell them
08:05that that turbo was bad?
08:06Yes.
08:07Yes.
08:08Engine problem, bad.
08:09Turbo, bad.
08:11Head gaskets, bad.
08:12Now, Judge Acker
08:14made it very clear.
08:15Used car, buyer beware.
08:17You're stuck
08:18unless you can prove fraud.
08:21Such as,
08:22there were no engine problems
08:23that existed prior to the sale.
08:25That the sellers
08:26were aware of those problems.
08:28The sellers intentionally
08:29hid those problems.
08:31and the sellers
08:33made false statements
08:35regarding those problems
08:37that persuaded you, sir,
08:39to buy that vehicle.
08:41That is fraud.
08:42Were you persuaded
08:43to buy the vehicle
08:44based upon their
08:45now-known misrepresentations
08:48regarding the major
08:49engine problems?
08:50Yes, Your Honor.
08:51I'm done.
08:53You should be ashamed
08:54of yourselves.
08:56Remember, Aubrey,
08:57I said that you would
08:58do better saying less.
09:00Yeah.
09:01And that includes
09:01in the initial transaction.
09:03Yeah, correct.
09:04Because I have something,
09:05you know,
09:06that I'm a little concerned
09:07about, too.
09:08And that is,
09:09in your ad,
09:10you said that the truck
09:11had 152,000 miles,
09:13didn't you?
09:13Yes, correct.
09:14But,
09:15what the two of you
09:17may not know
09:18is that our team
09:18does some independent research.
09:20And they pulled up
09:21a Carfax.
09:22And the Carfax shows
09:23that the last reported
09:25odometer reading
09:25was 362,000 miles.
09:30So how do you explain
09:32that discrepancy?
09:34Coming up
09:35on Tribunal Justice.
09:37If these things
09:38were wrong with the truck,
09:39we were misled as well.
09:41Because I would have never
09:43put my children
09:44in an unsafe vehicle.
09:51Defendants Aubrey Boghossian
09:52and her mom,
09:53Alyssa Busser,
09:54are being sued
09:55by Justin Robinson
09:56for $10,000.
09:57Justin claims
09:58the defendants lied
09:59about the condition
10:00of a truck he bought
10:01from them.
10:01But Aubrey says
10:02Justin came,
10:03saw and bought
10:04the truck as is.
10:05So they owe nothing.
10:07What the two of you
10:08may not know
10:09is that our team
10:10does some independent research.
10:12And they pulled up
10:12a Carfax.
10:13And the Carfax shows
10:15that the last reported
10:16odometer reading
10:17was 362,000 miles.
10:22So how do you explain
10:24that discrepancy?
10:25When I got the vehicle,
10:26it had about $150,000.
10:28And where'd you get it from?
10:30You said it was gifted
10:30from your father.
10:31I got it from my father.
10:32He got it from an auction
10:33probably two years
10:34before I had it.
10:35But you understand
10:36what's going on here?
10:37Yeah.
10:37Like, it all looks
10:38really, really bad.
10:40And Mom,
10:41did you have some
10:41way of refuting that?
10:43Because it's pretty
10:44compelling testimony.
10:46And it's hard
10:47for me to get
10:48my head around
10:48why he would just
10:49show up and lie.
10:50So how do you
10:51explain that?
10:52It's troubling.
10:53For one,
10:54Aubrey really never
10:55spoke to Mr. Heflin.
10:57I spoke to Mr. Heflin.
10:59The only time she...
11:00So much the worse.
11:01Your mom.
11:01She spoke to him
11:02was when we picked
11:03up the truck.
11:04And he told her
11:06in front of me
11:07to her face,
11:08you do not have
11:09to sell this truck
11:10if you do not want to.
11:11This is a good truck.
11:12It has a lot
11:13of good parts on it.
11:15He said that
11:16to my daughter
11:17to the point
11:17where she felt
11:18like she didn't need
11:19to sell the truck anymore.
11:20And she was conflicted.
11:22And that's why
11:22she cried
11:23the day that
11:24Mr. Robinson
11:25was coming to get
11:26the truck
11:27because she genuinely
11:28loved the truck.
11:29Now, if these things
11:30were wrong with the truck,
11:32we were misled as well.
11:34A hundred percent misled.
11:37Because Mr. Heflin,
11:39what he projected to us
11:41was that the truck
11:42could be bulletproofed
11:44and there would never
11:44be a head gasket issue.
11:46He never specifically said
11:49the head gasket is blown,
11:51the head gasket has a problem.
11:53If that was the issue,
11:54then why did he go
11:55through all these
11:56other efforts
11:57of trying to figure out
11:58what was wrong
11:59with the truck
12:00in between there?
12:02Okay, I'm going
12:02to stop you there
12:03and I'm going to let you
12:04or rather your witness
12:05have the last word
12:07because it's still
12:07your burden of proof.
12:09I did.
12:09I said that this
12:10would be a good truck
12:11if it had the head gaskets done.
12:13And to speak
12:14to the bulletproofing,
12:16that is a slang term
12:17used for doing head gaskets.
12:18They're not
12:19two separate repairs.
12:20I'm not aware of that.
12:21I'm not aware of that.
12:23He was not very clear
12:25on that the truck
12:26needed a head gasket.
12:27He stated that
12:28a friend of his
12:29had a truck like that
12:31for many and many years
12:32with lots of high mileage
12:34that has never had an issue
12:35so it would be fine
12:36if we didn't do it.
12:38Mr. Heflin knew
12:40my teenage daughter
12:40was driving that vehicle
12:42every day
12:42with not only her
12:43but my other three children
12:45in the vehicle every day.
12:46If he knew it was unsafe
12:49being a father himself
12:50I sure hope
12:52he would have pointed out
12:53hey Ms. Busser
12:54this vehicle is unsafe
12:56because I would have
12:57never put my children
12:58in an unsafe vehicle.
13:00Okay.
13:01And that's the fact of it.
13:02All right.
13:03Judge.
13:04Thank you.
13:04I'm just curious
13:05you know he has a family
13:07and all
13:08so why when
13:08you were first asked
13:10do you know him
13:10why did you both say no?
13:12Well we didn't know him before.
13:14We don't know him
13:15we live in a very
13:15very small town
13:16But that wasn't the question
13:17I think Judge Levy said
13:19have you ever heard of him
13:20do you know him?
13:21We said yes ma'am
13:21we did say yes.
13:22Did I see anybody say yes?
13:24I never saw a yes.
13:25You know they're lying
13:26and their mouths are moving.
13:27Ma'am, ma'am
13:28you both said no.
13:29Not on a personal level.
13:31That's enough.
13:31So I'm going to go back
13:32to you Aubrey
13:33how long did you have
13:35that vehicle not working?
13:37Like before I took it
13:38to the shop?
13:39Yeah.
13:39Like a few months.
13:42Just a few months
13:43because you had the car
13:43according to what you told us
13:45your father bought it
13:46at auction
13:47two years before that.
13:48Yeah I'm pretty sure.
13:49And in those two years
13:51you only put on
13:522,000 miles?
13:54We didn't ever
13:55drive it that often.
13:56When I got it
13:56You never drove it
13:57because it wasn't working.
13:58We live a mile
13:59from our school.
14:00Aubrey?
14:01My school is right
14:02around the corner
14:02and that's just
14:03where I drove it.
14:04Okay so that brings me
14:05to you
14:06because I'm guessing
14:07that if you said to her
14:09because most mechanics
14:10ask this question
14:11what do you use
14:12the car for?
14:13And if she said to you
14:14I used it just to go
14:15back and forth from school
14:16then you would have
14:17been correct
14:18if you said to her
14:19well then you could
14:20keep this car
14:21for as long as you want
14:22basically if that's
14:23all you're using it for.
14:24Would that be
14:24an accurate statement
14:26by me?
14:27No.
14:28Okay.
14:28The reason I say that
14:29is it is hurting
14:30the heads
14:31to drive it like that.
14:32It will crack them further.
14:34So it is okay
14:36to drive
14:37but it will have
14:38more issues
14:39when driven like that.
14:40I still think
14:41it's a solid truck
14:42if it had the head
14:43gasket job done.
14:45I do
14:45I mean
14:46three of these a month.
14:48It's a routine job
14:49for this pickup.
14:51It's just $12,000.
14:53However you cut it
14:54it's $12,000
14:55but that truck
14:56will run for
14:56100,000 miles
14:57after that repair.
14:58Did you ever tell her
14:59that she couldn't use it
15:00on the highway
15:01the way it was repaired?
15:02No.
15:03I told them specifically
15:05that the truck
15:06was not ready
15:07to go
15:07down the road period.
15:09So they could drive
15:10it on the highway
15:11if they wanted to.
15:12That's not my
15:13that's not my spot
15:14to make an assessment.
15:16That's it.
15:17Thank you very much.
15:17We're going to retire
15:18you to deliberate.
15:19Thank you.
15:19Court is now in recess.
15:21Parties will be recalled.
15:32Bold face liars.
15:34I mean
15:35the mom was a co-conspirator
15:36in committing that fraud.
15:38What is she teaching
15:39her daughter?
15:40I mean
15:40her dad's in prison
15:42her mother is telling her
15:43that it's okay to lie
15:44and commit outright fraud.
15:46Grand larceny.
15:47What she did
15:48was grand larceny.
15:50I mean
15:51it is absolutely insane.
15:52But for the fact
15:53that we were able
15:55to secure the testimony
15:56of that mechanic
15:58Mr. Heffler
15:59who I believe
16:00was super impressive.
16:03He was good.
16:03Super impressive.
16:05He was good.
16:05We would have been
16:06in a position
16:07to say
16:08as is sale
16:09insane.
16:11Now
16:12he bought the truck
16:13from them
16:13for 15,000.
16:15He sold it
16:16for six.
16:17My math
16:189,000
16:20is what is damage.
16:21I would award him
16:2310
16:23and give him
16:24$1,000
16:24for punitive damages
16:26based upon
16:27the outright lies
16:28and the fraud
16:29that not only
16:30that the two
16:31of those people
16:32committed
16:33when they sold
16:33the truck to him
16:34but the fraud
16:35on the court.
16:36I'm troubled
16:37by the evidence
16:38that came out
16:39and good on the plaintiff
16:40for having his case
16:41together
16:41because he had
16:42an almost
16:43insurmountable burden.
16:45It is very rare
16:47that we unwind
16:48a used car sale
16:50but I think
16:50based on these facts
16:51and the facts
16:53that our own team
16:53uncovered
16:54about that car fax
16:55which showed
16:56that the last
16:57reported odometer
16:58reading
16:58was almost twice
16:59as many miles
17:00as the defendants
17:01represented
17:02so I have no problem
17:03with the $10,000 verdict.
17:04Oh I have no problem
17:05with it either.
17:06I think that there
17:06were specific
17:08misrepresentations
17:08by the defendant
17:09to the plaintiff
17:10when he was making
17:11the purchase.
17:12I think that a lot
17:13of this was done
17:13way under the cover
17:15based on the timing
17:16of the whole situation
17:17by the crying
17:18the whole theatrics
17:19but on the other hand
17:20I think that
17:21what we were doing
17:22with the plaintiff
17:23is a lesson learned.
17:24You can't buy
17:25a used car
17:26at 9.30 at night
17:28negotiating prices
17:30before you even see it
17:31come across desperate
17:32because you want it
17:33not verify
17:35the information
17:35that you're being given
17:36that there was
17:37a mechanic
17:38that was warranting
17:39the work that was done
17:40so I think that
17:41our plaintiff
17:42who might have been
17:43shooting from the hip
17:44on a lot of prior car sales
17:45learned here
17:46the hard way
17:47that this was not
17:48the way to make
17:49a used car purchase.
17:51I don't care
17:51how cute little
17:53and young
17:53the seller appears
17:55to be
17:55sometimes looks
17:56are deceiving
17:57and in this case
17:58the truck looked good
17:59she looked credible
18:00but they were both
18:01being deceitful
18:02and lying.
18:03This is fraud
18:03at the inception
18:04and when there's fraud
18:05at the inception
18:06it's our job
18:07to unwind the deal.
18:0910,000 seems fine.
18:10Thank you.
18:14The court is back
18:15in session
18:16all parties are reminded
18:17that you're still
18:17under oath.
18:18Thank you Cassandra.
18:19You're welcome.
18:20We have deliberated
18:21and we have reached
18:22a unanimous verdict.
18:24First
18:25thank you sir
18:26Mr. Afflin
18:27for coming in
18:27and testifying
18:29and informing
18:29and enlightening
18:30the court
18:31as to the truth
18:32and the facts
18:33behind this case
18:34but for your testimony
18:36this case
18:37and I think
18:37that you know this sir
18:38would have turned out
18:39much differently.
18:40You understand that?
18:41Yes sir.
18:42Sure honor.
18:42Now
18:43Ms. Bogosian
18:44and Ms. Busser
18:45I'm going to give you
18:46a little bit of
18:46free legal advice
18:48from a former
18:48district attorney
18:49and I know that
18:50this is probably
18:51going to hit home
18:51to you because of
18:52where your dad
18:53is right now.
18:55What the two of you
18:56did was grand
18:58larceny
18:58by trick
18:59based upon the fraud
19:01that you committed
19:02by selling that truck
19:04and making material
19:06misrepresentations
19:07to fool
19:08an innocent purchaser
19:09and you did it
19:10for money
19:11and you ma'am
19:13as the mother
19:14to act as a co-conspirator
19:16with your teenage child
19:17if this case happened
19:19when she was 17
19:20and the authorities
19:21found out about it
19:22Child Protective Services
19:23would be involved.
19:24You'd be dealing with them.
19:26Now
19:26you were suing
19:27for the jurisdictional
19:28maximum of $10,000.
19:30Here's the problem
19:31with that.
19:32You bought it
19:33for $15,000.
19:34You sold it
19:35for $6,000.
19:36That leaves $9,000.
19:38Right?
19:39Yes, Your Honor.
19:40But the court
19:40has decided
19:41that based upon
19:42your egregious conduct
19:44not just by
19:45committing fraud
19:46against him
19:47but coming into
19:48this court
19:49and committing fraud
19:50on the court
19:51that punitive damages
19:53are appropriate.
19:55$1,000.
19:56So
19:57it is the
19:57unanimous verdict
19:58of this court
19:59judgment in favor
20:00of the plaintiff
20:01for $10,000.
20:02Good luck
20:03to you, sir.
20:04Do better.
20:06Thank you, Your Honor.
20:07Thank you so much.
20:08Just in case that's concluded,
20:09all parties are excused.
20:13The image of my daughter
20:15right now
20:15is very incorrect.
20:17She's a very honest human.
20:19Once I realized
20:20that I messaged her in
20:21and she just blocked me
20:21instantly
20:22that it wasn't
20:22going to go that way.
20:23There was a lot of lies
20:24told in the courtroom today
20:25and they were not by us.
20:27Verbal agreements
20:27should always be
20:28written down.
20:29We would have never
20:30ripped somebody off
20:31in that manner.
20:32Oh, I felt like
20:33I got stabbed
20:33in the stomach.
20:34Mr. Heflin
20:36was not very clear
20:37on the facts.
20:38I was trying to help.
20:39I gave him a discount
20:40and it bit me
20:42in the ass.
20:42No.
20:43I'm glad it's over.
20:44She might sell used cars
20:45but I will not.
20:47I will.
20:48Apple doesn't fall
20:49far from the tree.
