22:41legalized passive euthanasia
22:43in the year 2018.
22:46The case is of a 32-year-old man,
22:48Harish Rana,
22:49who has been in a vegetative state
22:51for 13 years of his life.
22:53His prime lost
22:55while lying in comatose
22:56after an accident
22:58had left him incapable
22:59of any movement.
23:02The court,
23:02while expressing its sympathies
23:04and the judges themselves
23:05being teary-eyed,
23:07pronounced the verdict
23:08allowing the parents of Harish
23:10to withdraw his nutritional support.
23:13For the first time in India
23:15in the year 2018,
23:16the Supreme Court
23:17legalized passive euthanasia.
23:20It also spelt out directions
23:22and gave an idea
23:23about what should be
23:25the way forward
23:25for a patient
23:26who has been diagnosed
23:28with something
23:28which makes him or her
23:29terminally ill.
23:31Both in the case
23:32wherein a patient
23:33had indicated
23:34what the way forward
23:35should be,
23:36had a living will
23:37and also in the case
23:38where patient
23:39did not have
23:41a directive
23:41or a living will.
23:44India has seen
23:45heated debates
23:45on euthanasia
23:46both active
23:48and passive
23:48especially in the case
23:50of Aruna Shanbhag
23:51a nurse who was
23:52brutally assaulted sexually
23:54in the year 1973.
23:57It caused
23:58severe brain damage
23:59and left her
24:00in a vegetative state
24:02for four long decades.
24:04the court has also urged
24:07the center
24:07to consider bringing
24:08a law on passive euthanasia
24:10even as heated debates
24:12on the legality
24:13and the morality
24:14of it continues.
24:17We're dealing with passive euthanasia
24:19now that isn't a PVS system
24:21right?
24:21If somebody is completely
24:23has intestinal lung disease
24:25the lungs have ossified
24:28only being fed by
24:30you know
24:32artificial feeding
24:34all of it
24:35like I said
24:35then in that event
24:37to not let a person
24:40who has lived with dignity
24:41die with dignity
24:43I think is very unfortunate
24:45and to that extent
24:46I say that
24:47I admire
24:48the common cause decision
24:50there are patients
24:51who are suffering pain
24:53but not necessarily
24:55they could live
24:55for two years
24:56three years
24:57five years
24:57and then palliative care

28:34the patient
28:35family went
28:35to the
28:35high court
28:36three years
28:37ago and

28:38declined
28:39to allow
28:39the withholding
28:41and withdrawing
28:41the treatment
28:42which he
28:42is on
28:43clinically
28:44assisted
28:44nutrition
28:45and hydration
28:45treatment
28:46so the
28:47patient
28:47family
28:48actually
28:48after this
28:49high court
28:50verdict
28:51went to
28:52the Supreme
28:52Court
28:53the Honorable
28:53Supreme

28:54also asked
28:55the Government
28:56of India

28:57this gentleman
