00:00thank you for modeling for us grandma vicky was always a huge ball of light
00:17everybody was welcome with open arms ryan was just a funny cute kid
00:24but as he grew over that's when trouble started
00:33vicky's fear was pretty intense but her love for ryan was awesome mom for your own safety
00:43get him out of that house lifetime worth of hate and anger just brutality and savagery
00:54so
01:08so that's her
01:11oh that's debbie's i know what's in there
01:1855 year old vicky burks is enjoying the festive season with her family
01:22i sit at my parents house when my mom's handing out presents
01:27ryan is playing a game in the background sitting next to my mom
01:32when things like this would happen like christmas time and stuff he kept to himself for the most part
01:38christmas was probably the most exciting time for vicky
01:42it's purple baby girl grandma really did love ryan so anytime the whole family was together
01:51she was as happy as to be
01:58vicky is born in bradenton florida in 1953 but when she is young the family moved to ohio
02:04where she meets martin burks vicky went to comes to high school
02:09and our first date was actually a swiss day dance
02:14me and vicky got married on july 17 1971. i was 19 and vicky was 18 years old it was a great day
02:24mike was born on november 26 1971. definitely exciting you know brand new start new house new family
02:40jason was born in march 1976 and it seemed good at the time
02:46i believe she would always be like that i wasn't the one that saw the problems she did
03:00it probably started around 1985 and it just developed from that point forward
03:09we got divorced after that she was seeing this young guy and she ended up marrying him
03:17wasn't very long it took for vicky to realize that things just weren't quite the way she had hoped
03:23they would be now she's six months pregnant she called me one day and made the comment that she just
03:31wasn't very happy and i said tell me what you want to do i'll see what i can do to help you out
03:38and we made arrangements for her to come back to springfield
03:41i think he came back in 1986 in december mom mom you're on camera camera we were just kind of happy
03:53to have my mom back and our parents back together but when she moved back she was already pregnant
03:59with my younger brother ryan was born on may 1st 1987. i was excited i was happy that it was happening
04:11i was 11 years old when ryan was born i was really looking forward to being a older brother
04:18dad took him and raised him as his own
04:24it's may 1988 the family celebrate ryan's first birthday
04:29ryan's sitting on my mom's lap so they're just unwrapping presents
04:35can you get the hang of it yeah
04:39vicky loved her sons tremendously she really did
04:42oh vicky was quite protective of her because she felt like she was the only one that he had
04:57but i told vicky that he's just like the other two boys there'll be no difference
05:03he called me dad all the time because you know i was there from day one
05:07this was when we got remarried in kentucky i was excited it was back together we're happy
05:22and now i got three kids
05:30we moved into the house on miller banna
05:32in that house in my eyes was my last home
05:44the burks family gathered to celebrate jason's high school graduation
05:51all my family was there my friends my band at the time was there it's time to wake up the neighborhood
05:58my mom's in a good mood she's excited her baby graduated
06:02oh she was bubbly any music you get her going
06:09one of my friends come over that was trying to introduce me to somebody that person would end up
06:15being my first wife mama burks down there with her two sons and i'm gonna bring her down the alley
06:23and nearly three years later in january 1997 20 year old jason ties the knot
06:29i think he was definitely excited about jason getting married it was a big deal
06:33mr and mrs jason burks
06:37ryan didn't want his brother to get married
06:40he didn't want him being with this girl you know she's invading my area
06:46actually of the day of the wedding he behaved but he was only nine see he wasn't really acting up a lot then
06:56but uh as he grew older that's when trouble started
07:02oh my first child christina was born on march 29th 1999
07:17because my mom never had a daughter of her own this was her chance to raise a girl
07:23say hi papa yeah what happened this one grandma's helped me open my presents
07:32all of the gifts grandma absolutely spoiling us
07:36christina hi christina here's ryan ryan was 11 years old when christina was born
07:46being an uncle was one of the few things he actually cared about i always thought of ryan
07:52as like my big brother my nickname for him was literally uncle bubba because i couldn't say brother
08:01and i followed him around everywhere like a lost puppy anytime i was over at my grandparents
08:07in a way it was me and uncle bubba against the world play it rye
08:21ryan wasn't super popular he had some friends once he started hanging out with the wrong crowd
08:28getting a negative reaction for him was his form of entertainment talking to yourself
08:34now i'm talking about him if he could make you angry he would laugh
08:46when ryan is 14 years old he has his first run-in with the police when i got home from work i got a
08:53phone call from the sheriff's department and they were holding ryan the deputy sheriff explains to us
09:02that these boys were in the press box at the football field at kenton ridge
09:10they had gotten onto the loudspeaker and were shouting profanities for the whole neighborhood to
09:17hear him he had to apologize to the school for what he had done he got a small fine and he had to do
09:27community work it didn't seem to phase ryan didn't care at all it was quite apparent how much different
09:37he was from the other two boys i mean it was like night and day and it just kept getting worse
09:43there's two paths you can go along the right way of doing something in the completely wrong way he
09:53would always choose the wrong path every single time
10:06mike needs a santa claus outfit on he looks like santa claus sitting there handing out gifts
10:11so this is christmas of 2001
10:13oh that's my brother mike there there's my mom my dad's filming
10:25i had bought that three four weeks in advance of what you told me
10:30and then there's blue eyes christmas for ryan as he got older he didn't partake as much
10:39he would look at his gifts and open them and then he would be gone
10:48ryan spent probably six seven hours a day playing video games
10:54it kept him from getting in trouble more than anything
11:02in 2002 ryan was charged with disorderly conduct from yelling out death threats out of the car
11:09that was new he never did that before ryan has to pay a fine and attend counseling
11:17i could see that this was just going to keep getting worse
11:22we were at the point then we just didn't know what to do
11:26my second child stephanie was born on january 26 2003
11:39hanging out with me and my sister really helped my grandma take a step back from living with ryan
11:46and the other one goes with the other one we were her highlighter of life's innocence in a way
11:54i see baby girl i see mike is playing santa claus he needs his outfit on thank you mikey
12:02i think that we probably thought that he'll grow up he'll mature and he'll settle down
12:19but that never really happened it only progressed worse and worse
12:26yeah ryan took it off when he's mad he's always in january 2004 the court places 16 year old ryan
12:34on probation indefinitely for drug abuse the way i saw ryan growing up and all of his violent outbursts
12:43that was just ryan being ryan i had this idealized version of my uncle that was uncle bubba and that
12:54was the good person that i knew but ryan was the monster that everybody else knew
12:59they were two different people but the same entity
13:08in 2004 ryan decided to take vicky's car out which he wasn't allowed to
13:15when he got home after that incident vicky was gonna call the cops and report a stolen car
13:22and he said if you call the cops i'm gonna hurt you we're constantly trying to figure out what to do
13:33how do we deal with it the court charges ryan with menacing and violating his probation
13:40they place him in juvenile detention for a minimum of six months the last time he went to juvenile
13:46he was turning 18 at that time the judge straight up told him he said if you don't straighten your act
13:54up you won't be going to juvenile now you'll be going to the jail vicky still was his mother
14:03and i kept telling her let him figure this out and she couldn't really do it she couldn't stop taking
14:10care i wasn't scared of ryan i felt off by his energy hey we're here today when i introduce you to a movie
14:24so this is ryan filming now across the street they had just built some new houses for a senior community
14:32we'll tell you a story turn this movie see over there that's where the old people live and ryan
14:42got in trouble a few times there too because they called the police on them man they don't like me
14:50it's hoping that you know once ryan matured things would get better and they only got worse
14:57in may 2006 ryan hits another car and speeds off he is charged with one count of hit and run we get a
15:08call from the sheriff's department come pick him up which i did he come back and he was just mad as a
15:17horn at everything i told him to leave the house go find some place to stay but you're not living here
15:24i was chasing him out of the house and he started just going in the kitchen and that's where vicky
15:31was standing ryan ended up pushing my mom down and she fell on her arm broke her arm in four places
15:39and from there he went into the front room where mike was standing he pushed him down and kicked him in
15:45the face police were called and then he was arrested ryan was charged with domestic violence
15:54they served him in 180 days but they reduced that to 90. well i never showed any remorse over that
16:04none he was still angry because he got 90 days in jail every time i'd kick him out she would let him back
16:12in the house and i kept telling her not to do that she just couldn't do it where is he gonna go
16:21what's he gonna do as bad as ryan treated my mom my mom still loved him my mom still protected him
16:30i'm like mom something bad is going to happen get him out of that house
16:44he was driving to work one day had a massive heart attack and died instantly
17:02probably worst day of my life
17:04so mike mike was kind of the glue to kind of help keep them all together
17:19ryan is back in jail on drug-related charges but attends the funeral with a deputy sheriff
17:24so when ryan came to the funeral he was shackled by his ankles and by his wrists
17:32ryan's crying his eyes out and i was kind of in shock because that's the first time i really saw ryan
17:38show that kind of emotion
17:42and i remember going up to him i gave him a hug and i'm like ryan
17:45we got to stick together
17:55christina be sure above us if you want to give it to him
17:58it's christmas 2008 and ryan's at home again with his family if you look he's not interested in
18:04anything that's going on in this point i didn't want him to come back home i really didn't
18:10do you want him to come back home again with his friends and friends and friends and friends
18:14in 2009 i was driving ryan and a friend to his party we got in an argument because i didn't want
18:21his friend in my truck i was mad i said i am not taking that kid anywhere i don't want him around you
18:30ryan was smoking a cigarette and he put it out my cheek
18:33so then i found charges i was the only one that wasn't scared because i knew i could handle it
18:44but vicky was the only one i was concerned about i didn't know ryan was capable of such violence
18:53like mom keep him out of that house he is going to kill you
18:58but her reaction was i don't know what to do he's my son i can't let him live on the streets
19:08one occasion when we got home the truck was missing so i drove around never found it
19:14come home and there's the truck so i walked in the house and i told him i said you're not
19:21take that truck i did report it stolen because he shouldn't have been driving when the police showed
19:30up at the house they grabbed him and hauled him away the police arrest ryan because of an outstanding
19:37warrant for domestic violence from his attack against martin he was given nine months in prison
19:43when ryan was locked up my parents were stress free but whenever ryan would come back you could cut
19:56the tension with a knife when you come out of prison he was definitely worse he was nasty
20:05i had to put a lock on my bedroom door to keep him out we never knew at any time
20:13what he was going to do or when or to who we were so desperate we're trying to figure out how
20:21we could get him in a situation like a halfway house just get him away from us
20:29vicki was so upset that she wrote a letter to the judge i'll read it for you honorable judge
20:36ryan dylan is our son and he threatens us daily he says if he goes back to jail
20:43when he comes back he will kill us or burn the house down we feel our safety is a concern
20:53we didn't get a whole lot of response from it you know because he's an adult
20:59they were just trying anything they needed help and they didn't know what to do
21:04so i was trying to get my parents to move to florida my dad thought he could just buy a duplex and have
21:16ryan live in one side and then they could live in their separate house they came down here to visit me
21:25just to see if they liked it ryan was acting great he's very relaxed we thought okay this might work
21:35when we got back home from that vacation things were normal for a short period of time
21:41but then everything started coming back again
21:44and it was progressively getting worse vicki's fear was pretty intense but her love for ryan was also
21:59she just wanted what was best for him and to protect him she was his mom
22:03he just couldn't stand her it was so obvious you could see it
22:16may 8th of 2012 i had come home from work and i noticed the pickup was missing
22:23if ryan got an accident we could get sued and lose everything just because of him when he got home
22:35vicki was very upset the main concern with ryan was we had no idea what to expect
22:45he was relentless he would not let up on arguing with his mom
22:50the argument continued until one o'clock in the morning worst part was him standing at the door
22:58beating on it and screaming at both of us he shouted he might as well kill us both and just take everything
23:09when i get up i would give her a kiss before i went down got cleaned up and went to work
23:14after putting the lock on the door i would lock it when i walked out just to make sure she was okay
23:23i knew ryan was awake because i could hear him in his room
23:27i went to work because every day i'd come home at lunch time
23:33when i got home ryan was standing in the kitchen that was not ryan he would normally be asleep
23:40ryan said to me i wish he hadn't told mom about the truck
23:48i asked ryan i said hey where's your mom and his response was she went shopping with her sister
23:55that was vicki's day off so i didn't think anything about it
24:01after i went back to work and finished out my shift i come back home and the truck was gone again
24:08i'm looking around vicki's nowhere to be found
24:17i called her sister and she informed me that she hadn't been with it
24:25now i'm a little nervous so i just kept calling everybody no sign of vicki anywhere
24:32uh yes um i think i need to report a missing person
24:47that's what's going on man we have a son leaving with us and you have records on him i'm sure ryan
24:58dylan we have a pickup truck that's also missing and my wife's car's here she's not as far as i can
25:07tell you she's been missing since at least six voters when uh the deputies arrived on the scene they met with uh martin burps
25:18i responded to meet with the uniform sergeant and deputy that was on scene
25:24investigators take martin to the sheriff's office to be questioned
25:28i immediately called clark county prosecutor andy wilson
25:31he found some smudges of blood and said hey andy something's not right at this scene
25:38with my experience and gut instinct it appeared that we might have had homicide on him
25:46i request that spatial agent brian white respond to process the scene
25:51a lot of the blood stains that we saw were airborne at one point meaning they could have been discarded
26:01from some sort of weapon you could see kind of the movement of where that blood had been flung
26:09and it was right above where that chair was and on the floor were a couple of divots
26:16he's like i think whatever happened happened right here
26:24the way the blood was disturbed something had been dragged through it everything flows from the
26:31kitchen to the back porch and there's a doorway there
26:36items were piled on top of it to make it look like it's never been used however those items also
26:42have blood stains on them and brian said i bet our bodies down there
26:52it was an entrance into a cellar we could immediately see blood stains leading down from the step
26:59and at the bottom of the steps we find a body
27:12martin bergs gave us information that she had a tattoo on her ankle
27:18when we saw the body was able to see the tattoo
27:20the trauma to her body was probably one of the worst i've seen it looked to us that there was some
27:33sort of a blunt object that was used to beat her we found in the laundry room there were clothes that
27:43tested positive for blood then we knew we did have a cleanup type situation
27:51everyone that was on scene or had contact with vicki burks were considered a possible suspect
27:58it was important for us to interview martin so you don't have anything to do with vicki's disappearance
28:03yeah how can you prove that because i was at work she disappeared the whole time i clocked him at uh
28:11probably about six i'm guessing 6 38 and i clocked out exactly at 3 15. but i didn't come home and lunch
28:21so was ryan home at uh 11 30.
28:26what was his demeanor calmer than he was the night before quite a bit
28:30so when marty was interviewed by the sheriff's detectives he gave a pretty good timeline of what
28:36he had done the morning that vicki went missing he made the comment at lunch time today he wished i
28:43hadn't told him all about the truck being gone i just kind of blew him off because i didn't want to
28:48get an argument with him on the lunch break i was able to obtain statements from his employers of his
28:54schedule for that day verifying that he was at work
28:57at around 10 30 of that evening our advocate and the detective went in that interrogation room
29:06and told marty that his wife was dead
29:14i was shocked i was upset i was mad first words out of my mouth is ryan did this
29:25he made comments like it's one of these days one of these days you people are going to wake up
29:31or something like that you know one of these days i will get eaten
29:35i wanted them to catch him so bad and i didn't care what they did or how they did it
29:45based on the information that we received ryan dylan was our prime suspect
29:50when a suspect flees from a murder somebody who's got a criminal history you're worried about the
29:59safety of anybody who comes across him at that point it's a race against time to get him into
30:05custody before he can do something else we had put a be on the lookout for the dodge dakota pickup truck
30:12and checked to see if anybody may have ran the license plate we had found that a deputy from
30:20all glase county around 70 80 miles north of springfield had stopped the pickup truck for a
30:25traffic violation at 2 29 pm the deputy found that it was ryan dylan that was driving the truck
30:32he he issued him a written warning and let him go about his way as detectives are working to hunt
30:42down ryan dylan the family received the devastating news i get a call and it's my dad he said jay i've got
30:53bad news your mom's dead and it wasn't an accident i said oh my god ryan killed mom and he's like yes
31:06all i can think of is my brother's on the loose where's my kids
31:11my mom sat me down on the couch grabbed my hand and she said ryan killed grandma
31:16i remember just screaming what and i just remember feeling like my entire world had been shattered
31:28she loved him with everything in her heart and soul and that didn't matter like to him
31:34i don't remember when i started crying until after i processed that the noise i was hearing was me
31:50screaming and crying into my mom's chest on may 10 2012 the medical examiner carries out vicki
31:59burke's autopsy the corner described her manner of death as blunt force trauma to the head
32:07both of vicki's pinkies were broken on both her hands and appeared to me as in a manner like she
32:13was trying to protect herself we asked martin burks if he would look around the residence and see if
32:20anything was missing that would resemble a blunt instrument and he later reported that an aluminum
32:27baseball bat that was kept in the mud room was missing i received a call at the delavan police
32:37department had located the truck the delavan police officer found ryan dilling walking down the road
32:48he lies about having the keys to the truck he lies about being involved in the truck
32:53he initially gives them a fake name after ryan was arrested we sent a team of detectives investigators
33:04up to wisconsin to conduct an interview what's going on with this truck the truck was stolen
33:11and i wasn't driving okay this guy is just fabricating and and making up these bizarre stories
33:18detective brownfield came into the interview later on we're here investigating the theft of the motor vehicle
33:27and we're also uh here to conduct an investigation on the death of your mother you know she was murdered
33:35what we really want is we want him to make a confession
33:55on may 14th of 2012 ryan was formally charged with vicky's homicide ryan requests to speak to a
34:04detective from wisconsin called shannon illingworth she had developed a little bit of rapport with ryan
34:10like i said whatever's happened has already happened there's nothing we can do about it
34:14all we can do is move forward i just don't want to get blamed for something that i didn't do
34:20detective illingworth interviews ryan on may 15th hoping to get a confession that i could see in your eyes
34:27you're hurting about something right now ryan but if they're not going to tell you the truth
34:33then the next best thing is to give us easily disprovable lies single or married well
34:41you weren't married she's done or just disappeared
34:48he gave us lie after lie after lie that we we very easily could disapprove
34:53do you realize you never even asked me how she did it never once you know why you didn't ask
35:02you don't know how she did it no i don't yeah you do there was none of it because he was the one who
35:08did it and he knew exactly uh what had happened on may 18th detective illingworth interviews ryan again
35:17after looking into some of his previous claims there's two people in the house between 7 and 11
35:23on that day i wasn't there that day we know that he's not telling the truth during that interview
35:31why does nobody have a marriage certificate for you and what happened to her where is she
35:39you have a kid too there was no record of him ever being married he said that he had a child
35:45no record at all i mean it just wasn't true i really i have no clue i know i didn't do any of
35:52this it hurt me and honestly it was the step back at some point he starts to maybe try to deflect
36:04towards marty a little bit the deep-seated anger and the issues that he had with his mom and with marty
36:12my mom probably had a lot of animals out there he also really ran down his mom a lot she's a terrible
36:19person lots of people don't like her again deflecting attention away from him trying to put it on an
36:26outside person ryan was extradited back to ohio on july 17 2012. the trial was in february 2014 and he
36:38pled not guilty ryan has maintained his innocence regarding us i don't believe that has changed today
36:45in my opinion this is what happened on the morning of may 9 2012.
36:52so marty leaves for work vicky's still in bed she comes down that morning and is sitting at that
36:59kitchen table ryan comes down he sees vicky sitting there he hits her across the head
37:09i think that she was knocked out of this chair
37:12she was probably on the ground he's throwing this blood up on the ceiling he's throwing this
37:19blood on the curtains he beats her until she stops moving dragging that body he throws her down in the
37:28cellar he spends the next couple hours before marty gets home for lunch cleaning that area
37:34up at some point marty gets home eats a sandwich real quick talks to ryan real quick goes out
37:43so we think shortly after marty leaves for work is when ryan hops in that truck and takes off
37:54part of me wanted to hate him for what he did to my mom and i remember seeing him
38:02and i kind of felt guilty that i almost had a little bit of sympathy for him
38:07the trial lasted five days the jury found him guilty of aggravated murder felony murder purposeful
38:16murder tampering with evidence and receiving stolen property i had to realize that uncle bubba
38:25really didn't exist and it was just ryan a monster
38:31the defendant was sentenced to life in prison without parole
38:37after the trial there's the appellate process
38:40he actually was able to have the aggravated murder conviction overturned
38:46the court said that there was plenty of evidence that he had actually done the murder but there
38:54wasn't enough evidence of premeditation ryan ultimately was sentenced to life in prison with
39:01the possibility of parole after 18 years
39:06the fact that he hasn't accepted responsibility for what he's done
39:08shows that he isn't reformed shows that he's not remorseful and if you can't be sorry or remorseful
39:17for killing your mom what kind of threat do you pose to society
39:21i have no emotional connection with ryan at all other than anger and he's not my son anymore
39:34if he gets out it would be nothing for him to do the same thing again
39:40sitting here now i hate ryan with every fiber of my being
39:45i'll never forgive ryan for what he did thank you for modeling for us when my grandma was still
39:57alive uh i was still going by stephanie i actually came out as transgender and i wish my grandma was
40:06here to support me being trans she was always supportive always very loving i miss her a lot
40:15definitely miss her keep thinking what would it be like if she was still around
40:32the first event i had after grandma died was a dance recital
40:38and when i looked out into the audience i saw
40:42steph i saw my dad i saw my stepmom i saw my grandpa
40:49and right next to all of them was one empty seat
