Attorneys for Acting Superintendent of Prisons Garth Guada now await the report of the Review Tribunal after hearing his matter on Monday.

Following the hearing the Tribunal will submit their report to Homeland Security Minister Roger Alexander- who will have the final say on whether Guada remains detained or revokes his detention order.

00:00Attorneys for Garth Gorda, who presented their case to the review tribunal,
00:04says they are confident that the tribunal will operate in the fairest manner possible
00:08as they challenge Gorda's continued detention.
00:11Because it appears to me from today they've conducted themselves very fairly, openly.
00:18We were permitted to make our submissions.
00:20The state was given the opportunity to make submissions after we got over some preliminary issues,
00:24which there were in this matter.
00:25There were preliminary issues.
00:27The tribunal heard submissions on the preliminary issues made a decision
00:31and permitted us to proceed to hear the application for the review of the detention order today.
00:38And while they are confident about the impartiality of the tribunal,
00:42they still indicate that there are serious concerns that need to be addressed
00:45related to the detention of their client for more than a month
00:48after he was held at his Malaba home on August 18th,
00:51accused of being an associate of the radical Islamic criminal gang
00:54led by alleged gang leader and murder-accused Rajayi Ali.
00:59The legal relief available to Mr. Guadu,
01:05and we are advising him on what his relief would be.
01:08I mean, you know, one would understand that
01:11insofar as the tribunal has conducted the hearing,
01:14the report goes to the very minister,
01:17and so that minister has to take a decision.
01:18So based on the instructions we have from Mr. Guadu,
01:22you know, we are considering what legal options are available to us.
01:25Yesterday, Guadu's other tiny crystal primus
01:28had written to police commissioner Alistair Guadu
01:30asking that an investigation be opened
01:32into Homeland Minister Roger Alexander's unauthorized visits
01:36to the maximum security prison
01:38prior to him becoming a minister
01:40where he allegedly met gang leaders in the run-up to the general elections.
01:44Boudu said while they hoped for a transparent investigation,
01:46he would let that matter take its course.
01:48Yes, there are allegations made.
01:51We've asked for an investigation of those allegations,
01:53and until that investigation is conducted and a finding is made,
01:56you know, I mean, I really wouldn't go any further
01:58to cast any aspersions on anybody.
02:01While they're with the outcome of the tribunal's report
02:03and the decision of Minister Roger Alexander,
02:06they reveal that their client continues to be kept at Tetran Barracks
02:09in inhumane conditions.
02:11He still has no access to toiletries,
02:13that he's being kept in a cell 24 hours a day,
02:17that there is lighting in the cell,
02:19very bright lighting that does not come off whatsoever.
02:23He has indicated that the bathroom in the cell is flooded
02:27and he has to scoop out the water with half of a bottle, right?
02:34He has contracted an infection on his foot
02:36based on that dirty water that has accumulated in the cell.
02:40He's not being given water.
02:43He is only given a 355 milliliter bottle of water
02:47when he has meals, which is three times a day.
