She has sent a pre-action protocol letter in which she is seeking compensation of about two hundred thousand dollars after she says her pet was overdosed by his attending vet.

00:00 A Trent City-based attorney-at-law, Shoba Nandlal, has commenced legal proceedings against
00:05 a private veterinary clinic for what she terms medical negligence and breach of contract and
00:11 duty of care, which she claims led to the death of her purebred teacup Maltese named Kailal.
00:18 According to the pre-action protocol letter sent by Justicia Omnibus Lord Chamber to the
00:24 veterinary clinic, the woman took her pet to the clinic for a skin rash on January 24, 2024,
00:31 and produced photos and a receipt to support her claim. Detailing the events, Nandlal's attorney,
00:37 Hari Narayan Singh, says Kailal's weight and temperature were taken before the vet on duty
00:43 examined his rash. The dog was diagnosed with a fungal infection and Nandlal was advised to
00:49 follow a strict regime of using fungal shampoo, a balm and one 200 mg Ketoconazole tablet per day
00:59 for 30 days. After getting home that day, Nandlal says she followed the instructions but said
01:05 immediately after Kailal ingested the tablet, he began moving lethargic and was unable to walk.
01:13 According to the pre-action protocol letter, he passed stool, stumbled and fell. Thereafter,
01:18 the dog started having violent seizures and frothed from the mouth. Thinking Kailal had
01:24 an overdose, Nandlal gave him charcoal tablets and returned to the vet's office.
01:29 She says the receptionist dismissed her suggestions that Kailal had an overdose
01:34 and told her she was overreacting and the symptoms were normal. The vet reportedly
01:40 sent a message to the worried pet owner to put the dog in a dark room for the night,
01:45 and if seizures persisted, she could return him to the clinic for a free visit.
01:50 The woman says she returned home and tried comforting the teacup Maltese,
01:55 but he stretched out and continued convulsing. An emergency vet sought through Facebook,
02:01 visited Kailal and according to that vet's letter, the purebred male dog was overdosed
02:08 as his size determined he was to take 15 mg of the tablet and not 200 mg as administered.
02:16 She says the differential diagnosis included ketoconazole toxicity, bufotoxin toxicity
02:25 and paracquat poisoning. Nandlal says her dog continued convulsing in a stiff position
02:31 until 7.30 the following morning. She says he endured labored breathing, gurgling sounds
02:38 and a racing heartbeat. According to her attorney, he "suffered a torturous, painful
02:44 and untimely death." The dog was described as the sole companion of the family and was purchased
02:51 for $10,000 seven years ago. The attorney is seeking to have the vet disciplined before the
02:58 Veterinary Board of TNT for breach of duty. The owner, who considered the dog to be her son,
03:04 is said to have been severely affected by her pet's sudden death and was even forced to seek
03:10 counselling. Her attorney says compensation in the range of $100,000 to $200,000 is reasonable
03:18 for the pain and suffering endured by the pet and its owner. This would include the cost of another
03:25 purebred teacup Maltese, reimbursement of the sums paid to the clinic and damages for pain
03:32 and suffering. We have been advised that in TNT there are few cases in this area of law.
