09:31and this is evidence that diana can use against him
09:35he offers to let greg see some of it for free
09:38the rest he's gonna have to pay for
09:41this is a classic setup
09:43it's not a phone call that any credible private investigator would make
09:48it's a classic bait and switch
09:50preying on the desperation of somebody who wants to clear their name
09:56at 10 53 pm the man calls back but this time with a specific set of instructions
10:03he directs greg to a location where a package will be taped to a pole off a dirt road
10:09near avenue de soledad and rancho santa fe road
10:13greg cycles in the area on a regular basis so he's familiar with the location
10:18but he still hesitates in a moment of clarity greg decides that he needs to call the police
10:28he explains the situation and asks them should i go
10:34from an investigator's perspective i'd like to have this conversation with greg
10:39and let him weigh out the pros and cons and make an informed decision
10:43as to whether he's going to attend this meeting or not
10:45ultimately the dispatcher tells greg that the decision is up to him
10:50greg has no idea what this so-called evidence could possibly be
10:55but he worked hard to clear his name
10:58the last thing that he wants is for the whole custody arrangement to be ripped apart again
11:03so he decides to go
11:08greg knows that safety in numbers is best
11:10so he calls his buddy jason who lives in the same apartment complex and asks him to go along with
11:16him
11:17greg and jason drive to the location and make their way along the path
11:21just in case they arm themselves with whatever they can find
11:26greg grabs a flashlight and gives jason his son's baseball bat
11:35as they approach the pole greg spots something familiar
11:42there's a beach towel on the ground oddly it looks just like his son's favorite towel
11:56jason circles the pole but finds nothing there's no package as the caller said there would be
12:02greg and jason should probably be getting a little bit worried by now
12:07if the scene isn't presenting the way they anticipated then something's off
12:13greg shines his light around the bushes searching for any clues about the strange situation
12:21greg sees what looks like clothing on the ground
12:26suddenly he realizes it's a person lying in the bushes with a rifle
12:33in that split second the trap is sprung greg yells gun but it's too late
12:41the shot hits greg under his left armpit as greg and jason flee six more shots are fired
12:51at this point they're in full fight or flight mode and wisely they choose flight
12:59in a desperate bid for safety greg and jason make a frantic escape
13:10greg jumps in the car and just starts reversing while jason is so desperate to get out of there
13:16that he runs past the car and so greg has to stop and pick him up
13:21the fact that greg was able to drive at all after suffering a gunshot wound
13:26like that illustrates the human body's ability to survive
13:33it also tells us how desperate he was to get away from whoever it was who was shooting him from
13:39the bushes
13:45as the gravity of the situation sets in greg's adrenaline begins to fade
13:52he's forced to pull over to the side of the road
13:56jason asks greg have you been shot and that's when greg realizes that his left side is covered
14:03in blood he knows he needs to get to a hospital but he's too dizzy to drive and at this
14:10point greg
14:10loses consciousness jason calls 9-1-1 frantically explaining to the dispatcher that his friend has
14:19been shot by a sniper if somebody calls police and reports a sniper all assets will be sent the danger
14:29level to the public and to any police officers responding is enormous so everything and anything
14:35that is available will be sent to the scene these calls although rare are about as serious as they come
14:44the 911 call comes in at 11 13 pm a police officer is on the scene just moments later
14:57the first officer on scene finds greg bleeding in his car he's unconscious but he's alive
15:05because of the potential danger posed by the sniper authorities can't risk letting an ambulance into the area
15:13when you're responding to a potential active sniper situation balancing the needs of the victim
15:20the safety of the public and the safety of first responders is a very tricky situation to be in
15:26the responding officer makes the decision to transport greg to the hospital himself in his squad car
15:34as greg fights for his life a swat team takes over the scene
15:39the swat team otherwise known as a special weapons and tactics team is a highly trained response team
15:46for situations just like this if there's an active shooter in the community you can expect a swat team to
15:53respond in a situation like this swat needs to quickly take control every citizen in the area and on the
16:02street
16:02the community is a potential target the community goes into lockdown local streets are shut down for
16:10several blocks a reverse 911 call urges residents to stay home until 3 a.m a reverse 911 call or
16:19an emergency
16:20alert is a tool that law enforcement uses to get information out quickly to a large group of people
16:27or a community residents will get a message on their cell phones similar to an amber alert with specific
16:34instructions from the authorities
16:38the swat team searches the hillside where greg was shot for hours but they come up with nothing
16:45at 6 a.m with no shooter found police call off the search
16:55detective scott stallman from the carlsbad police department is assigned as the lead detective on the case
17:02in the morning the media are all over the crime scene and as a journalist you want the scoop especially
17:08when it's this sensational but the police remain hushed about every detail the crime scene is unusual
17:17there's no spent shell casings
17:21despite greg and jason saying they heard seven shots when the shooting occurred
17:26either the shooter is being meticulous enough to pick up their shell cases or they have a device
17:33attached to the firearm that captures the shell cases as they're being ejected
17:39but the shooter did leave behind something else that stands out
17:46police find the children's beach towel that greg had spotted but they also find a second towel
17:55that has human feces on it
17:59it's not unheard of for feces to be left behind at a crime scene it does happen but a suspect
18:06who
18:06would leave behind evidence like that may as well have left their driver's license behind at the scene
18:12it's a great source of dna evidence
18:17as the investigation gets underway the detective's first stop is to pay a visit to greg's ex-wife diana
18:26investigators would always begin by speaking to those closest to the victim including family members
18:32or in this case ex-family members they may have nothing to do with the crime or they may have
18:39background information on the victim and the problems that he's been having with anybody else
18:45any threats that have been made to him or any circumstances that he may be going through that
18:50may explain why somebody would want to kill him in this case the detective knew that diana obviously
18:58wasn't the shooter but maybe she knows something that could help out the investigation and help
19:03identify whoever that was in the bushes diana tells the detective that she doesn't have any
19:09information about who could have shot greg she was home alone all night
19:18with no suspects the best lead detective stallman has is the phone call that greg received from the
19:25alleged private investigator he puts a trace on the call in this day and age phone records can be a
19:35treasure trove of information however because in this case it came from a burner phone determining who
19:40the person was who made that call it's going to be a very difficult task criminals use burner phones
19:47as a tactic when they're committing crimes to evade detection and it provides evidence of planning
19:54and deliberation for that crime the use of an untraceable phone is a setback for the detective
20:01but even the most careful criminals still make mistakes investigators are able to track down just
20:08when and where this burner phone was purchased it was bought just four miles away from greg's
20:15apartment just two weeks before the shooting when the detective contacts the store they get a lucky
20:22break it's only been two weeks and they still have surveillance video of the purchase the store emails
20:28images from the surveillance footage to the detective when he opens the photos they reveal someone familiar
20:36the burner phone was bought by diana lovejoy the happy marriage between diana lovejoy and greg mulvahill
20:50transforms into a bitter divorce when diana accuses greg of abuse
20:58a long investigation clears him of the allegations and greg is awarded 50 50 custody of their son
21:04and a sizable divorce settlement
21:11just as his life is getting back on track greg is lured to the woods by a mysterious male caller
21:20claiming to have proof that he's an abuser after all
21:25but instead the man opens fire with a rifle severely wounding greg
21:32when police investigate the source of the phone call they discover it came from a burner phone that
21:38was purchased by greg's ex-wife diana
21:45investigators now know diana was involved in the murder attempt of her ex-husband
21:51the surveillance videos from the store showing diana buying the burner phone prove it
21:56but diana is obviously not the man who made the phone call nor is she the sniper in the bushes

22:04point in time police suspect that they're dealing with a murder for hire case
22:09detective stallman pays another visit to diana police obtain a search warrant for diana's home
22:17besides seizing her computer they also find the same clothes she was wearing in the surveillance video
22:24when she was buying a burner phone that link is enough to bring her in for questioning faces are
22:30hard to match on video but physical evidence like clothing can be keys to breaking a case wide open
22:37it's amazing how often suspects overlook these little details
22:46at the police station diana faces intense scrutiny during questioning diana continues to deny
22:56any involvement in the shooting repeating her previous claim that she was home all night
23:03detective stallman wants to know if she hired someone else to do the shooting which diana also denies
23:10she's got her story and she's sticking to it
23:16but part way through questioning diana's story suddenly changes diana continues to insist
23:24that greg is an abuser despite evidence to the contrary she claims to be afraid of him
23:30and mentions her shooting instructor weldon mcdavid had offered to help protect her from her ex
23:37when a suspect introduces a new character into their storyline it opens up a new investigative avenue
23:43for the detectives police are going to be very interested to see how this new character fits into the narrative
23:54diana describes how nearly a year earlier she had gone to an indoor shooting range in oceanside called iron sights
24:03determined to learn how to defend herself from greg diana bought a gun and wanted to learn how to use

24:16so weldon began giving her private shooting lessons according to diana
24:25she and weldon were soon more than just student and teacher over time the two became friends diana confided
24:34in weldon how scared she was for herself and her son's safety diana tells the detective that mcdavid offered
24:44to help protect her from greg diana claims that she asked weldon to scare her ex and offered him two
24:53thousand dollars one thousand up front and another thousand later diana's story is implausible because
25:02that's not what happened and diana's story didn't come out until she was confronted with the evidence
25:08of the burner phone even if it was meant to be a scare tactic it went off the rails in
25:13a big way
25:16the fact that she did pay him makes the story even less plausible it doesn't make any sense
25:23the detective quickly shifts his focus to weldon mcdavid he now has a name to match to the dna
25:30conveniently left at the crime scene mcdavid is also a physical match based on the description
25:37given by greg and jason for the sniper in the bushes at the crime scene
25:43he's a 50 year old former marine a trained marksman and a firearms instructor on september 8th
25:50a week after the shooting police bring weldon mcdavid in for questioning they don't tell him that they
25:57already know he's involved in the attempt on greg mulvihill's life
26:06in any investigative interview information can be your best weapon you don't always want the person
26:12you're interviewing to know everything that you know it's a great way to keep the upper hand and if
26:18they don't know what you know it's easier to catch them in a lie the detective begins by asking weldon
26:25where he was the night of the shooting weldon claims he doesn't remember he also refuses to give
26:31over his cell phone it's not off to a great start detective stallman asks mcdavid is there any reason
26:39your dna would be in the area of the shooting mcdavid claims he doesn't even know where the shooting
26:46occurred so detective stallman plays along and points it out on a map
26:53so detective stallman pulls out what could be his best piece and he asks him have you ever taken a
27:00dump in the woods confronting a suspect with a big piece of evidence like that is a common tactic
27:07during an interview it has the potential to yield some great results this is the point where mcdavid
27:13realizes that maybe he left something behind at the crime scene that he shouldn't have now it's
27:18weldon's turn to try and think fast on his feet weldon's story suddenly changes he remembers he was
27:27in the area on a run and that he needed to relieve his bowels lucky for him there was a
27:36towel there so
27:37he used it mcdavid knows he's caught in a lie so he pivots he begins grasping at straws and he
27:48just
27:48becomes more and more nonsensical with his explanations at that point when they start to pivot they may be
27:56trying to change their story they may be trying to tell more lies to cover up that initial lie that's
28:02when
28:02you know that you're on the right track weldon doesn't seem to know how he got to the crime scene
28:09he can't point himself out on a map nor does he know where his car is at first he says
28:16he found the
28:17towel there but later on he says he was paid to put the towel there suddenly he clams up completely
28:25and he
28:26says he thinks he's being set up when a suspect stops cooperating it can certainly throw a wrench
28:32into your investigation but in this case the detective already has everything he needs so it's
28:38not a problem at all as weldon is being questioned at the police station authorities are also carrying
28:45out a search of his house hidden in the garage they find an upper portion of an ar-15 rifle
28:52the same gun
28:53used in the attempt on greg's life the weapon has a suppressor attached to it which is illegal in
29:01california it also has a brass bag meant to capture spent shell casings as they're ejected from the
29:08firearm inside the brass bag are seven shell casings which match the number of shots that greg and jason
29:16reported from the scene authorities arrest both diana lovejoy and weldon mcdavid on charges of
29:24conspiracy and attempted murder but as police look further into mcdavid they discover that this isn't
29:32his first time crossing the line several years earlier he was on tv threatening to kill someone
29:43diana lovejoy's accusations of abuse against her estranged husband greg mulvihill are proven false
29:51and the couple divorce three weeks before diana is due to pay greg a hundred and twenty thousand dollars

32:52this doesn't sit well with diana it's around this time that she goes to iron sights

35:33he takes his rifle and he heads to the bushes at this point all the careful planning goes out the

35:43weldon weldon makes the call to greg pretending that he's a private investigator then at some point
35:49he can't hold it any longer so he grabs one of the towels and heads to the bushes
35:58when greg arrives he's brought along a friend this wasn't part of the plan
36:05now weldon weldon has to improvise which isn't his strong suit weldon shoots at greg and hits him the
36:13first time then he fires six more shots as greg and jason take off running but they all miss
36:23now mcdavid is nervous cell phone records show that he calls diana after the attempted murder and they
36:31speak for eight minutes then she drives back to the same spot where she dropped him off to pick him

39:23she had no idea he was going to get shot it's not clear what scaring greg was supposed to accomplish
39:30as an explanation it doesn't make a lot of sense diana's claim that she didn't know weldon was going
39:37to shoot greg is even more implausible especially when you consider that weldon got out of the car
39:42dressed in camouflage and carrying a rifle prosecutors also had one more piece of evidence
39:49up their sleeves after she dropped weldon off diana went home and checked the online neighborhood
39:56group chat to see if anyone had heard gunshots if she didn't expect anyone to be shot why would she

41:01when weldon can't decide on which of two contradictory arguments to go with

41:12just too good of a shot to have missed that if he intended to kill greg he would have but
