00:01he was the victim of a prolonged and brutal attack a revenge murder it was just shocking
00:11beyond belief why would anyone want to do a thing like that a brutal murder revenge the
00:18need to get even that drives some people to kill love hates jealousy these emotions drive people
00:26to do unimaginable things you're under arrest by suspicion of murder is it your intention to kill
00:33her is it your intention all alone he vents his frustration in his anger on her you never really
00:40know who a person is you can't trust anyone he couldn't accept that there was no part of her that
00:47wanted him back as a motive for murder revenge is the most shocking of all you see a certain level
00:55of premeditation because someone's festering on this anger it's an eye for an eye a tooth for a
01:00tooth and it's all about power forensic psychiatrist dr shaham dass and criminologist honor de roe
01:08townsend investigate the triggers that make people go to extraordinary lengths to commit these horrific
01:13crimes really hard to imagine who hated her enough to walk her dead nobody can expect anybody to survive
01:21such an attack the underlying motive was revenge pure and simple cold and cow it's the 24th of
01:47march 2005 and the family of 36 year old bike enthusiast keith philpot become concerned when he cannot be
01:54contacted by phone we went down to keith's flat and we looked all around his curtains were so sure
02:03I was like trying to convince my mom not maybe gone on a bike ride that day maybe gone out
02:08early
02:08hadn't opened his curtains from the outside of his home there's no sign anything untoward has gone on but
02:18then we looked through the letterbox because we're like shouting him and we seen the bathroom door was
02:24hanging out of his hinges by 9pm it's almost 24 hours since anyone has heard from Keith his twin brother
02:36Kevin becomes
02:37concerned Kevin was going around to Keith's flat and on the way there he bumped into two acquaintances of
02:47Keith's the two friends are also concerned for Keith's whereabouts but when they arrive at the flat there is
02:55still no sign of Keith so they phone 999 the police arrived at the scene the decision that is made
03:07by the
03:07police officer to kick in the front door and what the fee is Keith Philpott in his living room laid
03:23on his
03:23back and he's clearly dead my brother Kevin made the phone call to mom I just said to mom he's
03:34dead
03:36mom rang me again she said the same thing to me Keith's dead German he just like
03:51following the devastating news Keith's family rushed to the scene we all made our way around to Keith's
03:58flat it was swollen with police left then and the amount of police that were there we knew it wasn't
04:04a natural death something untoward has happened to him and that he had been murdered the question no one
04:16can fathom at this stage is who would murder Keith for a crime to happen at home they usually either
04:25their intimate partner violence or their violence by people who know you they could could be neighbor
04:30violence it could be friends it could be an ex-partner so it was a bit of a mystery when
04:38Keith's body was
04:39found because he was very well liked in the community and he had a very strong and supportive family so
04:44what had happened to Keith so we know that the door wasn't forced open what does that mean to you
04:55so
04:56that suggests that Keith either knows the perpetrators or very quickly trusted them and let them in another
05:05potential option would be that it was an ambush that the perpetrator or perpetrators forced their way in as
05:10he was opening the flat I'm really not sure what the motivation was or the kind of person who would
05:16do this and for me we have to ask why him why was he targeted for everything that we know
05:21about him
05:21he's quite an unassuming person he's just a character in the neighborhood Keith was born into this really
05:31happy family not far from Middlesbrough and he had four older siblings and he had a twin
05:39Keith and his twin brother Kevin were the youngest siblings in a large family unfortunately there
05:45were complications surrounding their births the twins were on prematurely they were supposed to be born I
05:52think in December or January and they were born in November mom noticed that they weren't developing as
05:59they should they weren't crawling when they should have been sitting up things like that so she got them
06:05assessed aged one Keith and twin Kevin were diagnosed with learning disabilities they went to a special
06:14school never went to a mainstream school could do a lot on their own learning about Keith's learning
06:21disability it also comes to mind is this a hate crime is this an attack on him because of his
06:27learning
06:27disability or is it just that he's vulnerable so people see him as somebody they can exploit somebody
06:33they can target bully maybe unfortunately we do see quite a high prevalence of hate crimes against
06:40people with learning disabilities these sort of disability hate crimes might happen either because
06:46they're easy targets and they can't necessarily defend themselves or it could be because of
06:52miscommunications that might arise in differing types of nonverbal communication or verbal communication
06:59how that can lead to misunderstandings and that can escalate out of control
07:06detective superintendent Tony Hutchinson takes charge of the investigation he is shocked by the
07:12ferocity of the ferocity of this crime it was a very brutal murder Keith had been tied up both his
07:20ankles and his wrists were bound with identical socks and he's been ganged
07:27he had obviously sustained horrific head injuries and we're not taught and never beaten that's gone on for like a
07:37couple of minutes here this has gone on for a long time
07:42his face was almost featureless that's how bad it was
07:48but further details of Keith's injuries shock police to the core but then they've also put open his stomach
07:59which at the time I described that as being medieval you know when you talk about disemboweling that's what happened
08:06to Guy Fawkes
08:10Keith's murder bears all the hallmarks of a kind of classic hate crime but what wasn't clear perhaps to police
08:19at that stage was that what lay behind it also was an act of revenge
08:4136 year old Keith Philpott has been found murdered in his flat in County Durham his body has been bound
08:49gagged and disemboweled
08:55we clearly have got some dangerous people on the loose
08:59but this wasn't a random attack this has gone on for a long time
09:03and that in turn suggests that it was a target attack he's attacked in his own house he was clearly
09:09the target
09:09we need to find out why
09:14I think just looking at the level of brutality that Keith had to endure
09:18is just horrific and it's so unnecessary so over the top
09:24we have to ask why him why was he targeted what has gone on in Keith's life what has led
09:30to this point
09:32police want to know more about Keith's background to understand why he might be targeted
09:39Keith was a really well liked character in his hometown it was well known for his love of bicycles he
09:45was really good at repairing them
09:48if anybody's chain come off the bike or things like that they used to come to Keith and Kevin and
09:51Keith and say like can you fix my bike for me can you put my chain back on
09:55he liked preparing bikes for people he liked being out on bikes he loved seeing his family and friends
10:04but as Keith grew into adulthood he aspired to move away from the family home
10:10Keith was a bit more independent than Kevin Kevin wanted to stay at home with mom but Keith wanted to
10:16get a bit of independence
10:19Keith wanted to have his own place he wanted to be able to come and go
10:23have a key to his front door keep his place as he wanted it which is very important to him
10:28have his own kind of belongings around him
10:31and that speaks to his wish to you know live an ordinary and happy life
10:39eventually Keith got himself a rented flat in Billingham 15 minutes walk from his mother's house
10:46Keith's twin Kevin joins his sister at their brother's former address
10:52this is where Keith used to live in a lovely little house
11:12he wanted his own little independence he didn't have a lot but he had it all perfect and everything in
11:17it was so
11:19clean and precise everything had its own little spot he just had it like how he wanted it
11:24which it was it was just a perfect little home he felt safer yeah
11:32Keith didn't have a job he filled his days with activities he really liked seeing people was sociable and watching
11:41TV and he loved his mobile phone which is a kind of lifeline to him
11:45he had local friends who looked out for him
11:49although he lived independently he still come to mom's every day for his tea because there's only certain things that
11:55he can manage just like basic meals beans on toast and maybe
11:59put a pizza in but not cooked proper meals or get no nutrition out for anything like that
12:05but on the evening of the 23rd of March Keith doesn't appear at his mom's house as usual
12:12that night his mom had prepared one of his favorite meals which was sausages and mash
12:17and so they were very very concerned because he never missed that dinner with his family
12:25police make an attempt to retrace keith's final movements in the hope it will lead them to his killer
12:32keith had last been seen with family and friends at 10pm on the wednesday and that he would be found
12:40in his house dead by the police 9 30 on the thursday that's our time window
12:48with such an horrific attack it's ds hutchinson's hope that someone in the neighborhood might have seen or heard something
12:57the immediate thing is the door to door the house to house around where keith lives
13:03and then we start to look at the cctv but in this case in 2005 there's not as much cctv
13:12around as it is now and there was nothing from the crime scene
13:18but the house to house inquiry helps narrow down the window in which the murder may have taken place
13:24we knew that keith had been last seen at 10pm we knew that his new bike had a squeaky wheel
13:32and there was a lady who lived in the same street as keith who heard a squeaky wheel of a
13:41bike going past the house at about 1am
13:45with keith's bike missing officers believe his killer may have used it to cycle away from the crime scene
13:54that tentatively gave us the 10pm or 1am window when people were in keith's family
14:05for the time being it is decided that police will carefully control what information about keith's death is released into
14:12the public domain
14:13and that also includes what they tell keith's family
14:18it was only the next day that we got told in bits and bobs you know we got told he
14:24was stabbed
14:24then we found out that he was bound and garved
14:28i would rather have just said like this is what's happened to him
14:31rather than every day we just got told a different story every day and it got worse every day
14:38pathologists examine keith's body attempting to piece together the story behind his murder
14:45his face and head had been beaten severely initially the pathologist thought that the head injuries were what had killed
14:57him
14:57and that the wound to his stomach the disemboweling that just happened after death
15:05only when we got to the post-mortem did we discover that there was actually blood in his stomach cavity
15:12because once you die your blood stops pumping
15:15so it then became apparent that when he'd been disemboweled he was still alive
15:25the other thing that you should always remember with regards to the callous nature of this offence
15:31was that they locked the door because we had to break the door down
15:35they've locked the door behind them and walked away and left them to die
15:44so as a criminologist what does this extreme level of violence say to you
15:49this is what we'd refer to as overkill because really it doesn't take this much to kill another human being
15:57it can be as simple as just a few blows to the head but this was an extended attack over
16:03the course of multiple hours
16:05and so that to me suggests a real level of hatred in this attack
16:09this wasn't just for the purpose of killing keith quickly this was out of anger and maybe revenge
16:15yeah they gutted him and they left him to bleed to death so it feels like whoever did this really
16:22wanted keith to suffer
16:24it was basically a form of torture
16:27they were willing to commit time to this there might have even been an element of them enjoying this
16:33and you've got to wonder how keith ties into all of this he's not an aggressive person
16:38he doesn't have a history of violence or fights so i don't understand at this point why he's been the
16:45target
16:48with such a violent and seemingly unprovoked attack police hope the crime scene itself
16:53will help them reconstruct what happened
16:57at that particular crime scene there wasn't a lot of blood
16:59there'd be no fighting keith's incapacitated when all of this is happening he's on the floor in his title
17:07so there's not like blood splatters here and everywhere he hasn't been stabbed where there's a big sort of stabbing
17:15action
17:16and you wouldn't find perhaps blood on the ceiling or up the wall it's not that type of attack
17:23police noticed that several items are missing from keith's flat
17:29there was a games console plug but no games console there was cd rack there was no cds in
17:37on the wednesday when keith last seen he actually bought a new pedal cycle and it wasn't in the flat
17:45so where's his bike where's this games console where's the cds
17:53investigators make another crucial discovery
17:57and there was a knife missing from the knife block
17:59on the balance of probabilities that's the weapon
18:02so it's not an organized crime there's just been a massive escalation in the behavior of the offenders and the
18:10violence
18:13what's strange about this case as well is that there doesn't seem to be a lot of pre-planning involved
18:19in this attack
18:20it seems like something escalated in the moment
18:23because the perpetrators didn't bring anything with them to bind keith
18:28they used his own socks
18:29and they used one of his own knives to kill him
18:31so what happened inside keith's house
18:34and how did it escalate so far
18:39his phone was his lifeline
18:40they never switched them off that was his lifeline
18:42that was his phone
18:43they would ring mum every day
18:45and mum used to ring him so yeah
18:47that was the contact we had with him
18:52could there be evidence on keith's phone that might identify the killer
18:56police want to know more about his social circle
19:02he had made friends with a woman in her late teens
19:07who lived just very near to where he lived
19:10a very very innocent relationship
19:13of what he would have probably thought of as a friendship
19:18the person had come round to his flat on many occasions
19:23and he'd enjoyed having a friend who wasn't a family member
19:29and they just know sick drink tea and coffee things like that
19:32they're absolutely fine just friends
19:35but after a while there were feelings in keith's family
19:38that the girl might be starting to take advantage of his trusting nature
19:43one of the sad things about many people with learning difficulties is that
19:49people don't necessarily want to be friends with them
19:52and yet it's a real human thing that we all need friends
19:57we all get lonely and keith wanted to have friends
20:01he was a vulnerable adult keith was too trusting
20:05and these people were taking advantage of him
20:08keith was very proud of his independence
20:11but obviously at some point that had some downsides
20:14so his family were concerned
20:17but it was difficult for them to intervene
20:19because he was a young adult
20:22according to keith's family
20:24the woman even obtained keys for the flat
20:26so she could let herself in
20:29she invited both girl and boy friends round to the flat
20:33when keith was there
20:35and also on occasion it was believed that
20:38she was also using his phone
20:40so it was an innocent friendship
20:43on keith's part
20:44but perhaps one could term it as more transactional
20:47in some ways for the woman
20:51there were friends at one time
20:52they were absolutely fine just friends
20:54and then it had a fallout
20:56as i say they weren't friends no more
20:58and that's when he that's when it got nasty
21:03it's then that the family say that keith had been receiving threatening text messages
21:08and had felt too frightened on occasion to actually go out
21:13the anonymous messages begin not long after keith's falling out with the female friend
21:20and the texts reveal a potential motive in connection with the same woman
21:25keith was accused of sending sexually inappropriate texts to this person
21:32the threatening texts were claiming
21:35that he was involved in an inappropriate relationship with her
21:43to the police's surprise
21:44the threatening texts are about one of the same women
21:47that meet keith's brother kevin
21:49on his way round to the flat
21:50the night keith was found dead
21:53one of them had said to kevin
21:55if anything's happened
21:56to your brother keith i'll be there for you
21:59and i remember screaming to the police
22:01that's the reason why he's died because of them
22:21police investigating the murder of keith philpot
22:24want to know more about the abusive messages he received
22:29we heard that he was getting threatening text messages
22:31he didn't show any of us
22:35they come to the conclusion that the texts were about the same woman
22:39that had been hanging out at keith's flat
22:43they were saying you must leave her alone
22:46or else saying we'll come round to your flat we'll break your legs
22:50and so keith was obviously understandably frightened
22:56police suspect the motive for keith's murder could be revenge
23:03revenge is the act of causing harm or hurt to somebody else
23:07because the perpetrator themselves feels disrespected or wronged in some way
23:12this anger is festering inside someone
23:14and all they can fixate on is getting revenge
23:17and they do that by enacting what they feel is a proportionate attack on another human being
23:24we know that these allegations of sexually inappropriate behavior were made against keith
23:29and it seems like these people have believed this
23:31and they've decided to do something about it
23:34they are acting like vigilantes
23:39police are investigating whether these allegations towards keith could be true
23:45but a closer look at his victim profile suggests otherwise
23:49keith could hardly read could hardly write and so how on earth could he have sent anything
23:59keith's got learning disabilities so what he would do if he received a text
24:03he would go to the corner shop ask whoever was working behind the counter to read what had been said
24:11and then that person he'd asked to send a text message in his dictation
24:17just the reason just to get nasty just the reason to get back at him for not letting him basically
24:24abuse his house
24:27as detectives consider the implications of the texts there's a breakthrough in the case
24:34a man walks into the police station and says to the officer on the desk
24:39i'm responsible for the murder
24:42that man was called sean swindon
24:46sean swindon is a 24 year old local man
24:51he's not only says he's responsible for the murder he says i put the guy's stomach open we'd never put
24:57that out into the media
25:01it is something that only the killer would know
25:06there are multiple reasons why someone might turn around and confess to the crime that they've committed
25:11it could be that they've only planned out as far as the attack and then they're left with the consequences
25:16and they panic and turn themselves in
25:18it could be that they fear that they're about to be caught and so they think that turning themselves in
25:24will mitigate their circumstances in court
25:26or it could be that they've had a change of heart they're feeling guilt and they want to repent
25:33now in police custody swindon is immediately questioned
25:38during his interview sean swindon first and foremost says he was alone
25:43he says he went to keith's house
25:46he was invited in
25:48they sat in the talk for a couple of hours
25:53it turns out that swindon heard about the rumors that keith had been sexually inappropriate with the woman and decided
25:59to confront him
26:00he claims he asked keith to stay away from her
26:07Sean swindon said that keith refused they had an argument
26:15Sean swindon then said he ran in and locked himself in the bathroom and it was keith who's kicked down
26:20the door
26:21according to sean swindon
26:23Keith then got a knife from the block and sean swindon disarmed him and then stamped on his head
26:32it is then swindon claims that he cut keith's stomach
26:39he's trying to say that keith philpot was the instigator of the violence and he reacted to that
26:47i don't think sean swindon was ever trying to claim self-defense i think what he was trying to say
26:53was i did not go around with the intention of any violence
27:01however ds tony hutchinson begins to doubt what swindon has told him
27:07there were so many holes in that story
27:10keith philpot i don't think he's ever had a fight in his life
27:14but those elements of the truth in that
27:16and the best lies are always those that are closer to the truth
27:22what do you make of swindon's version of events then
27:25i think it seems pretty unlikely that keith is the instigator of the violence in this
27:30nothing about his background or anything that anyone's ever said about keith would suggest that he's capable of you know
27:39instigating this
27:40and to me it just suggests that swindon is trying to come up with an excuse he's trying to get
27:44out of this mitigate his circumstances and that's it
27:47absolutely instinct of desperation to me it feels like he's kind of you know clutching at straws
27:53swindon repeatedly claims that he acted alone
27:59police were surprised that it was just him because they thought from the scene that they'd seen that there must
28:07have been more than one person there
28:11keith philpot had been tied up both his ankles and his wrists were bound with identical socks to the ones
28:19he was wearing
28:20and the sock drawer in the bedroom was open
28:23it's very difficult to tie somebody up if you're by yourself
28:28see one person can't go and get the socks
28:31and then at the same time make sure that the that keith's compliant it's impossible
28:37as soon as somebody goes in the bedroom keith would have made a run for it
28:40keith philpot never got an opportunity to make a run for it
28:44had he had that opportunity he would have taken it
28:48i'm still convinced there's more than one person involved
28:52when detectives review sean swindon's record they find no history of violence but make a curious discovery about his whereabouts
29:01the night of the attack
29:02sean swindon had been reported missing from home on the night that keith was killed
29:09he was actually discovered by police officers sometime on the friday staying at a friend's house
29:15and he basically said okay i'm going home later i had an argument with my girlfriend
29:20you don't need to worry you don't need to be involved
29:22at the time police think nothing of it
29:25but for other officers now investigating keith's murder sean swindon's movements seem suspicious
29:32and a few days on those suspicions are proven right
29:36the police take a call from another person
29:40who says that he has been sworn to secrecy but he doesn't feel he can keep this particular secret
29:47which is that a friend of his has said that he was involved in the murder of keith
29:56police interview this new informant
30:00obviously we need to test the validity of what he's saying
30:03but he was able to go into a lot of detail with regards to what had happened at the crime
30:08scene
30:09the detectives who interviewed him were more than satisfied that he was telling the truth
30:13so that witness was either at the crime scene or he's being told by somebody who was
30:22the accomplice named in the call is michael peart
30:25what's more his movements the night of keith's murder are also suspicious
30:31on the night of the murder sean swindon had stayed at michael peart's house because that's where the police found
30:37him when he was reported missing
30:41michael peart's arrested brought in for questioning and he pretty much straight away confesses
30:50but he confesses in a totally different way to sean swindon
30:54police listen to michael peart's version of events
30:58he says they burst away in
31:01says keith's flat
31:04keith's tried to barricade himself into the bathroom
31:08sean swindon's kicked that door in
31:10they've then tucked in the living room
31:13one of them's gone and got the socks out the drawer
31:15they've tied him up
31:16michael peart tells police that sean swindon was the ringleader
31:21and that although he tried to make him stop
31:23he ultimately joined in with the attack
31:25and he actually describes being there for over two hours
31:31assaulting keith stopping and having a cup of tea and a cigarette and then starting again
31:39so as i always thought there was just like this egging each other on and the escalation
31:47but could the motive of revenge over the alleged allegations of keith sending sexually inappropriate texts
31:53be the only reason both men murdered him
31:56what we did find in michael peart's house was some of keith philpot's property
32:01there were some of keith's cds
32:05keith philpot wore a three lions an england signet ring
32:10and that was at sean swindon's house
32:14so sean swindon actually took the ring off his finger
32:17while he was laid there injured
32:26and as detectives monitor the killer's movements in the aftermath of the attack
32:30they find out what happened to the stolen items
32:35so we examined the cctv in a place called norton
32:38which is a small village which is all like other suburbs of stockton where michael peart lives
32:43and it's not a million miles away from billyham
32:46we saw swindon and peart walking down the high street
32:51see them going into second-hand shops where they're clearly trying to sell
32:57some of keith's belongings
33:00but for tony hutchinson the relatively low value of the items stolen
33:04compared to the acts inflicted on keith
33:06demonstrates that financial gain is not the core motive
33:10this particular crime was different
33:12in so much as that there was an element of extreme violence
33:17and once i accept that all murders are violent
33:22this had an element of extreme violence
33:25sean swindon maintains that the incident was born out of keith's alleged inappropriate relationship with the woman
33:33and in questioning he continues to stick to his story
33:37that he'd only ever intended to warn keith off any further friendship with her
33:42sean swindon argued that he hadn't gone to keith's flat
33:47with the intention of causing him extreme harm and then murdering him
33:53but that seems really difficult to believe given the overwhelming violence that happened
33:59the fact that he'd enlisted the support of michael peart to go with him
34:05the fact that they had broken down the bathroom door
34:09and the fact that the attack had lasted for several hours
34:11it's very difficult to believe that a long attack of that sort wasn't to some extent premeditated
34:20during michael peart's interview
34:24he describes how they basically were outside of keith's flat
34:30they then waited for him returning
34:33which he did just after 10pm
34:35after he said goodbye to his brother and mate
34:38and as soon as keith's putting the bike into the hallway they've just come and barged in
34:45it confirms premeditation
34:47and means the items they stole were more of an afterthought
34:51what's more cctv further reveals the demeanour of both men that night
34:56as they go into a shop you can see them buying cans of lager and they're laughing and joking
35:04obviously the cctv of them going in the shops doesn't really progress the murder investigation
35:11but what it does show is like their total disregard for human life
35:19you know they've murdered somebody in absolutely barbaric circumstances
35:24that now they're laughing and joking by cans of lager
35:27speaks volumes about them as individuals
35:32what do you make of that?
35:34i think it's really unusual
35:35because we even know that swindon was walking around
35:39wearing keith's gold ring in the days after the attack
35:44maybe it's another indication that this attack was not thought through or planned
35:50or maybe that he kind of got caught up in this almost group mentality
35:55with just piers along there as well
35:57because it seems really bizarre
35:59it's like his conscience caught up with him
36:01but it took a few days
36:02absolutely there seems to be a disconnect isn't there
36:04on the one hand this callous disregard for the well-being of keith
36:10even going as far as torturing him over a prolonged period of time
36:13and then fairly quickly afterwards seeming to do a 180
36:16and feeling this level of guilt and confessing
36:19it's really hard to get here to get my head around those two opposing forces
36:25and as charges are brought against both men
36:28michael peer reveals how sean swindon persuaded him to take part in the attack
36:33fueled by revenge for what he thought keith had done
36:36on the night of keith's killing sean swindon says to michael peat
36:45will you come with me because we're going to go and sort out a pedophile
36:49michael peat's only got two previous convictions both for assault each time
36:53on somebody who he perceived to be the pedophile
37:15both sean swindon and michael peat claim they murdered keith philpot as revenge for him allegedly being sexually inappropriate with
37:23a younger woman
37:24and police have discovered that peat has a criminal history of assaulting people he believes to be paedophiles
37:31sexual abuse is one of the worst crimes that you can commit and i think there's general abhorrence of it
37:40in society
37:41and so if you subject someone falsely to that allegation
37:48it's not that unusual for that person who's falsely accused to be subjected to awful violence a kind of lynch
37:57mob mentality
38:00there is a known core group of people who spend a lot of time and effort to hunt down attack
38:06and hurt paedophiles
38:07and you have to wonder why that is what the psychology is behind that
38:11maybe they themselves were abused when they were younger or maybe they're in some way judged by society
38:17so they want to find a target that's lower down in the hierarchy
38:21somebody that they themselves can judge and there's nobody better to be in that position than a paedophile
38:30michael peat thinks that he is allowed in his head
38:35to like assault paedophiles willy-nilly because he's not doing anything wrong
38:42we know that pert was showing off bragging so what does this say about his psychology
38:47clearly it's somebody that lacks empathy that doesn't have any kind of remorse or regret
38:53but it's also possible that he actually feels morally justified in his actions
38:58and he's telling other people because he wants some reassurance
39:01so he believed the lies about keith he thought that keith was some sort of sexual predator
39:07so sean swindon had enlisted his help thinking that he would want to get involved with another case where
39:15someone was being accused of an inappropriate relationship in this way
39:21the woman in question continued to see keith even after these texts were sent
39:28and there's no suggestion that there was ever any impropriety from keith towards her
39:34and so it is baffling as to why those accusations were made and then believed
39:41the whole premise of this attack is based on a lie
39:48keith philpot was not in any way shape or form a paedophile
39:54uh he had a friendship with that female acquaintance and that's all it was a friendship
40:02uh swindon didn't like it but with the accusations made by the woman about keith
40:07it was too late
40:10he wanted to stop this friendship
40:12swindon had told michael pitt that keith philpot is a paedophile
40:18he wanted to know keith philpot was not in the case of keith philpot
40:21but he knew sean swindon and sean swindon had um effectively enlisted his his help
40:28and they decided to go together to keith's flat to confront him about this unfounded accusation
40:40in october 2005 sean swindon and michael pitt plead guilty to keith's murder at teesside crown court
40:48no charges are brought against the person who is alleged to have made the original allegations about keith
40:54i was always pleased when anybody pleaded guilty to an offence like this
41:00because it means that the family don't have to go through a trial they don't have to go to court
41:08every day
41:09they don't have to listen to all of the evidence
41:15it was a relief for the whole family especially for my mom not to stand and go through a trial
41:21because if she'd have had to listen to everything that went on in that house on that night and everything
41:25it's just unreal
41:27she would never ever have gone over it
41:32the judge recommends that swindon serves a minimum of 20 years and pate serves 15.
41:40well my view at the time was that they were unduly lenient minimum tariffs
41:48i'd always maintained that the crime itself was like sadistic
41:52i've said it was medieval and execution and the fact that left them alone known he would die without medical
42:00assistance
42:02swindon and pate's lenient sentences are repealed
42:07sean swindon's counsel argued during the case that
42:11that his sentence should be lowered
42:14because he had genuinely believed
42:17that a female friend
42:19had been dragged into
42:21an inappropriate relationship
42:23with keith
42:24and that he'd committed
42:26this horrific crime as a kind of revenge
42:29but
42:31one it was untrue
42:32and most importantly
42:34we have a criminal justice system
42:36so people don't carry out acts of revenge
42:42i'm just left feeling sad about this case
42:44because the tragedy is that
42:47whilst in a lot of cases
42:49you might be able to understand where this revenge motive has come from
42:53in this case
42:55it was just a lie
42:57that led to keith's death you know
42:59there was nothing that he could have done to stop it
43:01and he was so vulnerable and it's just devastating
43:04yeah it's like the lies just snowballed out of control with just such tragic consequences
43:11the appeal is eventually upheld
43:13and sean swindon's sentence increased to a minimum of 28 years and pate to 22.
43:23but for keith's family nothing will ever make up for the loss of such a loved and loving family member
43:31i miss my brother keith every day
43:34and i wish he was here to enjoy our christmas with us and birthdays and stuff
43:44after keith died it was a long time before we could bury him
43:47because the extent of his injuries because two people had done it
43:50they had to have two separate post mortems
43:54so we couldn't lay him to rest
43:56it was a lovely service church was packed
43:59it was a like

44:08i remember my mom constantly saying to me
44:11why christine why why did they do it
44:13why that's all she kept saying
44:14i couldn't answer her
44:16because there was no reason why
44:18it was just like so senseless
44:20she wasn't a very religious person
44:21but after that she was like there's no god
44:24for letting that happen to keith
44:25i couldn't answer my mom's questions why
