00:01The High Court in Shah Alam has dismissed Ismaneera Abdul-Manaf's appeal against her conviction
00:06and five-year jail sentence for neglecting her six-year-old son, Zayn Rayan Abdul-Matin,
00:12causing him physical injury three years ago.
00:15Judge Noor Hisham Ismail ruled that the session's court had made no error of fact or law
00:21and was justified in finding that the defence had failed to raise reasonable doubt.
00:25The court also dismissed the prosecution's cross-appeal,
00:29ruling that the five-year sentence was neither inadequate nor excessive.
00:34Noor Hisham said the charge under Section 31, Subsection 1, Subsection A of the Child Act, 2001,
00:42clearly set out the elements of the offence and the alleged manner of neglect.
00:47Ismaneera filed her appeal on January 5,
00:49challenging the conviction and the session's court's decision
00:52delivered by Pataling Jaya Sessions Court Judge Dr. Sializa Warno
00:57on October 31 last year.
00:59The High Court had earlier dismissed her application
01:02to stay the sentence pending the appeal.
01:05Ismaneera was also ordered to perform 120 hours of community service
01:09within six months of completing her prison term.
01:13She was charged under Section 31, Subsection 1, Subsection A
01:17of the Child Act, 2001,
01:19read with Section 34 of the Penal Code,
01:22which carries up to 20 years' imprisonment,
01:24a fine or both.
