00:11bring out the top three stories we've got our eyes on.
00:15Number one, we start with what's happening in the Twisha case. Remember, 10 days on, her husband is still absconding.
00:23But a very important conversation and judgment has come out in court. It's sort of the only sort of silver
00:31lining in the case at the moment.
00:33The court has said that there will be a second autopsy. But when will that happen? And when will the
00:39investigation even begin? We have to wait and see.
00:42Also on our minds today, a special focus. A lot of times stories from India go unheard. So this time
00:49we've got to you the story of Hyderabad's green lungs, which are shrinking.
00:56Despite a court order, the felling of the trees continues. So we tell you what exactly is wrong there. And
01:05we'll also bring you some activist voice.
01:06Also coming up on the program, it is extremely hot all over in North India, in Delhi as well. But
01:15it has also led to water shortage.

01:48Big win for Tusha Sharma's family. Madhya Pradesh High Court accepts a plea for a second postmortem to be conducted
01:54by the Ames.
01:55This time, Delhi doctors will travel all the way down and do an autopsy.

02:07Absconding since 12th of May, Tusha's husband, Samant Singh, is to finally reappear.

04:36Swisha is dead.
04:38A young bride got sort of, she's gone now under deeply suspicious circumstances.
04:45And today, after days of silence, absconding claims and mounting pressure,
04:49there is finally a dramatic turn in the case.
04:51For 10 days, Swisha's husband, Samar Singh, has remained untraceable.
04:57The police in Madhya Pradesh just cannot seem to find him.
05:02The police has given out several rewards, but they didn't seem to know where he is at all.
05:09He has remained untraceable as investigators searched for answers.
05:13Tonight marked the 11th day since police began looking for him.
05:18The husband, remember, who had remained absconding for days, now says he is ready to surrender.
05:24That's the statement his lawyer made in court, of course.
05:26But not before making a series of emotional, strongly worded submissions in the court through his lawyer.
05:35Samar Singh argued that he was being unfairly portrayed, insisting he is neither powerful or capable of influencing the investigation.
05:44Yeah.
05:45Powerful and investigate, you know, sort of influential people.
05:49They don't get to run away from the government for 11 days.
05:52He also said in a major assurance in court that Samar Singh is ready to surrender before the trial court.
06:00In an emotional appeal that was made by his lawyer, the defence told the court that Samarath wants time to
06:07perform and prepare, guess for what?
06:09For Tvisha's final riots.
06:13His lawyer also made it clear that instead of pursuing anticipatory bail, Samarath now intends to surrender, then seek regular
06:21bail through legal process.
06:24And finally, the defence lashed out at what is called a social media drama.
06:30Around the case.
06:32Even seeking restrictions on media coverage.
06:35A gag order.
06:37And while Samar Singh's defence pushed for relief in court, the prosecution came down, arguing that this is far too
06:46serious a case for a sort of leniency.
06:49The prosecution told the court that the custodial interrogation of Samarath is crucial to piece together the events leading to
06:57Tvisha's death.
06:58Serious allegations were also levelled against Tvisha's mother-in-law, Giribala Singh.
07:04We all know her by now.
07:06With the prosecution claiming that there were attempts to tamper with the evidence.
07:11And in a sharp remark, the prosecution argued that an absconding accused should not be granted the luxury of legal
07:20protection without first surrendering 11 days.
07:25The state maintained that the case now clearly falls within the ambit of serious dowry death investigation, requiring strict scrutiny
07:37by the court.
07:38The prosecution even further claimed that there is a material indicating dowry demands allegedly made by both Samarath Singh himself
07:48and his mother.
07:50And finally, then the prosecution strongly attacked the earlier bail granted to Giribala Singh, the mother-in-law in this
07:57case,
07:58telling High Court that the trial court's order would shock the conscience of the judiciary.
08:05But as the court battle intensified, a larger mystery around Tvisha's death still remains, you know, sort of unresolved.
08:13The dramatic shift after days of accusations, outrage and questions over why Tvisha's husband had not appeared before the investigation.
08:20If he's not guilty, why is he on the run?
08:24And even as the legal strategy changes, the allegations, they remain pretty explosive.
08:29Earlier, Samarath's side had claimed that Tvisha suffered from drug addiction, claimed that WhatsApp chats in the case had been
08:36tampered with, claimed that allegations against him were based on imagination.
08:40And now the big question, will Samarath finally answer the investigators directly?
08:45Will he surrender finally?
08:48Will we finally get some answers?
08:50Will a CBI inquiry, which has now been sought, will it even begin?
08:54But this controversy no longer centres around the husband.
08:58Because tonight, the spotlight remains fixed on Tvisha's mother-in-law.
09:04A former judicial officer facing some serious allegations.
09:09Allegations that have intensified public scrutiny around the case.
09:12Giribala, remember, is currently out on anticipatory bail.
09:15She got it within a day.
09:18But the controversy surrounding her role continues to deepen and then there are questions that nobody knows answers to.
09:24What happened in the crucial hours between Tvisha's death?
09:28Why was she allegedly not taken to the hospital immediately?
09:33What do Tvisha's final messages really reveal?
09:36What do they tell us about her state of mind?
09:38What all evidence from the scene was properly secured or not?
09:42And why does the post-mortem report continue to leave room for doubt?
09:46Because tonight, despite the latest courtroom twist, the mystery, that's not solved.
09:54Tvisha's family says that this was not suicide.
09:58The accused insist that they are being framed and investigators continue to piece together the final hours of the young
10:05woman whose death has triggered outrage, suspicion, even heartbreak and loss of absolute, you know, faith or any kind of
10:14hope.
10:16Now, at the moment, all eyes are on one question.
10:21When will Samarth Singh finally surrender because the police is just not being able to grab him?
10:28And when he does, what will he tell the cops?
10:32The same cops who so far have not been able to find him.
10:35The same cops who appear to be sort of, you know, playing with the system around, not knowing where it
10:42will go and being lenient.
10:44All of those remain to be the big questions we still do not have answers to.

11:02The High Court in Madhya Pradesh has agreed for a second post-mortem report of Tvisha, remember?
11:07Also saying that Ames Delhi will send doctors for the second autopsy.
11:10That's important because the claim or the allegation, at least at this point, by Tvisha's parents was that the doctors
11:19were also, you know, influenced in a way and did not carry out autopsy in the right manner.
11:25Also, the Madhya Pradesh High Court, remember, said that Tvisha's body must be preserved.
11:30It's been more than 10 days now.
11:33Meanwhile, her in-laws say that conduct a second autopsy with videography so that there is, there is, you know,
11:43specific evidence over there.

16:35Anisha, spectacular, right? That it's playing according to a script over here.
16:39And the script has been written by Samarth and his family and his lawyers.
16:44They said we are going to do this. Police has been looking for them.
16:47There is media trial. People are asking questions.
16:51But things are happening exactly how Samarth planned.
16:53He's come and surrendered the way he wanted.
16:56Well, clearly, Sonal, we are looking at what finally Samarth surrendering before the court.
17:03Remember, just two hours ago, this argument was being put before the Madhya Pradesh High Court by his lawyers
17:10that he should be allowed to surrender and he should be allowed to file a regular bail plea immediately.
17:18Interestingly, what I can tell you, Sonal, is that when he said that he should be allowed to file a
17:25regular bail plea
17:26and the regular bail plea should also be heard immediately,
17:29that saw an immediate pushback from the prosecution, from the police, the solicitor general clearly saying
17:35that the luxury of such urgent hearing should not be given to somebody who is an accused in a case
17:41like this.
17:44Clearly, however, the court said, well, the procedure is there.
17:48When he goes to the court, he can file whatever plea he wants.
17:53The police, of course, also gets the right to seek remand, to seek custody.
17:58And the police have made this very clear.
18:00They will take him for custodial interrogation.
18:03They have 24 hours?
18:04No, that would have been if he had surrendered before the police.
18:07If you surrender before the police, then the police has to produce you before a court within 24 hours.
18:13If you surrender before the court, the court then issues notice to the police, asks them,
18:18well, what do you want now?
18:19The police then says, well, we want him for a police custody remand for custodial interrogation
18:24for ABC number of days, 1, 2, 3, 4, whatever days.
18:27They can take him for up to 14 days.
18:29So, we'll now see how this is going to play out before the trial court as Samad has surrendered.
18:35But remember, the drama that we saw in the high court today from Samad's lawyer.
18:41I'm quoting him here, the entire argument was in Hindi.
18:45So, he said,
18:56That was the argument he made.
18:58So, what was he doing?
18:59See, and he has sought that her body, which has been at the Ames Mall, should be released to him
19:05because he is the husband, he, you know, that is the kind of argument we're seeing here.
19:15So, after the kind of case that has happened here, it's a dowry death case.
19:20This woman, within just a few months of her marriage, has died in a very suspicious manner.
19:27The second post-mortem has finally been ordered by the high court after her.
19:31And we don't know how successful that's going to be because the body has been in that state.
19:35Ames and police themselves had given an order just a couple of days ago
19:39to actually say that they do not, they do not know if the body is fit enough for a second
19:44autopsy.
19:45And now they're saying that the Ames, you know, doctors from Delhi Ames will go and make that happen.
19:50But what a, this, what a joke.
19:54I'm trying to, I'm trying to think of another word, but what a joke.
19:57Look, the irony of this entire outrage that we're seeing right now, Sonal,
20:01is that this is not an isolated case.
20:05Yeah.
20:06And strangely enough, Sumert's lawyer also said the same thing,
20:10that there are thousands of dowry death cases, there are thousands of deaths in this type of cases.
20:15Why are you targeting me?
20:18Simply because there was media outrage.
20:20Now, that is what shows the apathy of the system.
20:24For 10 days, if the Ames in Bhopal is saying that we do not have the infrastructure to preserve the
20:33body.
20:33The high court is questioning,
20:35we had read in the news that the body is not proper infrastructure to keep the body.
20:40How do you go to Delhi and go to Delhi?
20:42It's good to be that you preserve it from Delhi.
20:45You bring in the doctor's team from Delhi to conduct the second post-mortem.
20:50The solicitor general also made a very interesting argument.
20:54That we don't object to the second post-mortem.
20:57But for us, the findings of the first post-mortem are enough to be actionable.
21:03What was the finding in the first post-mortem?
21:05That this is suicide.
21:06The first post-mortem did not go into the details of the injuries that were found on her body.
21:12Yeah, injuries that the parents have spoken about.
21:14It did not have the belt that was mentioned as evidence.
21:18It does not keep into account, okay?
21:21Because all of us have now seen the CCTV footage of how she was brought in.
21:25Things that were happening in the house.
21:27There's another CCTV footage I'm told that we are trying to verify.
21:32We are trying to verify to see if that was also done.
21:35That's just about a few hours before Tvishar died.
21:37So much is happening in this case.
21:39But I have a couple of questions.
21:40A lot of focus is on the husband and should be.
21:44Why?
21:45If he's so worried about, you know, cremating his wife's body, why is he on the run?
21:50He should be home to actually lead it.
21:52Why did his mother-in-law, Tvishar's mother-in-law, ask for anticipatory bail?
21:57I want to go to the anticipatory bail for a minute.
22:00Is it usual that people just apply for it and get it on Monday?
22:04No.
22:06Anticipatory bail in a dowry death case usually takes some time.
22:11You take some time to think about it.
22:13You listen to what the police has to say and then you give it.
22:17In this case, and that has been flagged by the government in their appeal.
22:21It's been flagged by the family, by Tvishar's family in their appeal against the anticipatory bail.
22:27That this matter was heard and decided on the same day that it was filed.
22:32And that is why they are claiming here that the mother-in-law, who is a retired judicial officer,
22:38in fact, used her influence to get this anticipatory bail.
22:43And that is why the High Court has also agreed to hear this matter on Monday.

23:11And this apparently seems to be the CCTV footage from that parlor.

23:31And, all right, and that's where she's entering in and we see her.
23:36I'm just going to cross-check with our producers and get that right.
23:39The lady we see highlighted, that is Tvishar.
23:46All right, I'm waiting for a confirmation on this one.
23:49And try to see how exactly this happens.
23:51This is, however, the date is very prominent and clear.

23:57And that also sort of talks about the timing as well.
24:02So, this is another CCTV footage that has just emerged.
24:06Let us try and make sense of this a little bit more.

39:32with his battery of lawyers doing what he wants to do, living where he wants to live and then making
39:37some absurd claims inside the court as well. Let me try and see. Can we dial back Dheerajji on his
39:43phone and find out what's happening? All right. I'm requesting my producers to see if we can
39:49connect with Dheeraj on the phone again to see what exactly is happening inside Jabalpur court
39:55right now. Meanwhile, Anisha, am I, is this an overstatement of what I'm saying right now?
40:01Like you are the legal expert. Does this happen regularly?
40:06Unfortunately, sometimes, yes. We've seen cases where an accused was brought, the judge is not
40:11there. The accused just remains seated in the court premises for hours, then the proceedings start.
40:18But the way we've been describing it, he went to this court, then went to that court and then went
40:24that back to this court. Normally, what should be happening is that the police should have already
40:29reached. And that is exactly why this outrage that we are seeing is so in your face. Because
40:36right now, Sonal, what we're seeing is a mockery of justice. Not just a mockery of justice,
40:42but a very, very stark look at just how slow our legal system, our policing system really is.
40:49Now, remember, he's not yet surrendered. He is not yet before a court of law. If the police really
40:57wanted to arrest him, they can arrest him as long as he's not actively inside a courtroom. If he's in
41:02the court premises, but not in the courtroom, he can be arrested.
41:05Ah, that's, that's the loophole there. So, but it seems that the police doesn't seem to, but he might
41:13be. The information that you have, I'm sure his lawyers also have, which is the reason why, which is probably
41:18why he's sitting inside the courtroom and not coming out. Because he knows the minute he comes out, the police
41:23is going to take custody of him, which he wants to avoid at this point. The really amazing point in
41:30this
41:30entire drama that we are seeing playing out on our screens right now is the fact that the moment he
41:37does surrender before the magistrate, the police will seek custody. The police ought to also get
41:43custody considering that this is a dowry death case, that this is a case where the law on paper
41:50is extremely strict. The law on paper says if there is a dowry death, there is a presumption of guilt
41:57guilt that the court shall presume that the husband and the law on work.
42:00But I want a clarification on this. Do we have Ravish? Can I go to him for a quick clarification?
42:07Ravish, is this case made, is this abatment to suicide case made or is this dowry death case made?
42:15Okay, this is a dowry death case, as of now. And when the investigation will grow, obviously,
42:22when there is a dowry death, because even after a divorce, it is a dowry death. It is a dowry
42:31death
42:31and it is registered automatically. And there is a investigation that the officers of the ACP level
42:34are doing. Under their guidance, they are going to get further. So it is a dowry death,
42:40but one thing is clear, which is saying that Ravish had suicide, the police commissioner is saying that Ravish
42:49has suicide. So if it is suicide, then obviously, this is an abatment of suicide case. Because if
42:54someone has suicide, then obviously, there will be no reason for it. And the WhatsApp chats
42:59that India Today has accessed, the first time we have seen, the Instagram chats that we have seen
43:03on the 16th of May. So we have seen that Ravish, who is with his friends, his relatives, his mother,
43:11they are saying that he is mentally harassed. And he has so much tortured, that he has very serious
43:21allegations that his friends are giving a suggestion, that I am trapped, now you don't
43:27have to do this. I am trapped in this marriage. That means that she was harassed from the beginning.
43:35And you have thought that it wasn't much time for the marriage. Ravish, I have to clarify
43:40one thing, then I have to quickly take a break as well. If it is a dowry death case,
43:46then it is a dowry death case in India, it is a crime in India. And it is a dowry
43:49also a crime in India. So in this case, are the parents of Tvisha also under the scanner if
43:58this case is a dowry death? No? Anisha is saying no. Clarify it.
44:05So, dowry death and giving dowry are two very different matters. Under the dowry prevention act,
44:13at the time of giving or taking dowry is when you can be acted against.
44:18All of that is done and over with. Now there is a death.
44:23Okay, that's a good clarification.
44:24A crime that has to be acted on against the husband and against the in-laws. What the parents did
44:31is a very separate thing.
44:32Hold that thought, Anisha. Hold that thought because I'm told we have to take a very short commercial break.
