00:00Twisha case. Samar Singh, her husband's lawyer, has now said that Samar Singh is withdrawing the anticipatory bail plea in
00:08the Madhya Pradesh High Court and has offered to surrender before the trial court.
00:13Big breaking news coming in this minute. Remember Samar Singh, who was on the run for the last 10 days.
00:19He had first applied for anticipatory bail in a lower court which was rejected after which he had applied for
00:27anticipatory bail in the Madhya Pradesh High Court.
00:31But now in the latest, this is the development that has come where Samar Singh's lawyer has confirmed that he
00:38is withdrawing anticipatory bail plea.
00:42He has offered to surrender before the trial court. 10 days that he's been on the run.
00:48In fact, even in the high court, in the Madhya Pradesh High Court, when they had filed for anticipatory bail
00:54plea, saying that Samar Singh denies all the allegations and the allegations that have been leveled so far are based
01:04on imagination, was the version of Samar Singh that was put forth in court.
01:09But now, a change in mind. Samar Singh, who has been on the run, his lawyer has now confirmed that
01:16he is withdrawing the anticipatory bail plea and has offered to surrender before the trial court.
01:22Several versions that have come in these 10 days, especially on behalf of Samar Singh, where his mother Giribala Singh
01:30spoke.
01:30She not just went on to assassinate the character of Twisha and many, many controversial statements that she made, but
01:41also alleged that Twisha's family was out there to see Samar behind bars.
01:47And now, this is the latest that has just come in. Samar Singh will surrender.
01:53That is exactly what his lawyer has confirmed, that Samar Singh, the husband of Twisha, has withdrawn the anticipatory bail
02:02plea and has offered to surrender before the trial court.
02:04My colleague Anisha Mathur joining us on the broadcast with details on what has led to the change of mind.
02:14Well, we are yet to hear the detailed arguments on behalf of Samar Singh.
02:20What I can tell you is that the lawyer for Samar Singh has said that he is ready to surrender
02:26before the magistrate.
02:28Interestingly, so Esha, the Solicitor General of India who is appearing for the Madhya Pradesh government,
02:34has said that the husband needs to surrender before the investigation for the police and cannot claim to surrender before
02:45the magistrate.
02:47The entire process has to be followed properly.
02:50At the moment, Esha, as we speak, the Supreme Court, I beg your pardon,
02:55the Madhya Pradesh High Court has decided that before they hear Samar Singh's plea,
02:59they will first hear the petition filed by Twisha post-mortem in the case.
03:06And the High Court is currently hearing arguments on that issue about that whether the second post-mortem should be
03:16allowed or not.
03:17Interestingly, in that matter also,
03:22the Madhya Pradesh are arguing against the second post-mortem,
03:26questioning why when there is already...
03:31Anisha Samar Singh is a criminal lawyer himself.
03:34His mother is a former Sessions judge.
03:37And they understand that they have a fair sense of how the courts work.
03:43But clearly, both the mother and son have felt very cornered in the last 10 days.
03:49Giribala Singh's statements that particularly put her and her son in the spot,
03:54given how they looked at Twisha and the sort of perception that they tried to create of her that hugely
04:00backfired.
04:01But now, both the mother and son with a fair understanding that they have to be accountable.
04:07Giribala Singh's anticipatory bail that has been challenged by the Madhya Pradesh government.
04:12And that hearing also, if it has begun, Anisha, do give us details.
04:16But Samar Singh, ready to surrender.
04:18And when that would be, what more are we picking up?
04:22Well, as I said, Suyesha, Samar Singh's lawyer has said that he is ready to surrender,
04:30that he will surrender before a magistrate court.
04:34And this is a very interesting hearing that is currently going on, Suyesha,
04:40because the lawyer for Giribala Singh is also making certain arguments with regard to the second post-mortem
04:49and whether it should have been allowed or not.
04:52And I can tell one very interesting argument that is being raised before the court right now, Suyesha,
05:00is that the family, the in-laws of Suyesha Singh are arguing against the second post-mortem.
05:08Samar Singh, of course, as you mentioned, he has said that he is ready to surrender before the magistrate court,
05:14that he will want to surrender and argue for regular bail.
05:22Of course, matter has not yet been heard.
05:24But let me repeat once that matter was mentioned by the lawyer that I am ready to surrender before the
05:30magistrate.
05:31That matter has not yet been heard by the court,
05:34which is currently hearing the issue of whether post-mortem,
05:38the second post-mortem as demanded by the parents should be done or not.
05:44Back to you.
05:46Oh yes, but that is certainly a big development given the fact that Samar Singh had been on the run
05:51for the last 10 days
05:53and was trying very hard to get an anticipatory bail.
05:57How? His lawyer had applied in a lower court.
06:00The anticipatory bail plea got rejected.
06:02Then in the Madhya Pradesh High Court is where the anticipatory bail plea had been filed.
06:07But now a decision that Samar Singh has taken along with his lawyer to pull back on the anticipatory bail,
06:16to surrender to the cops and then apply for regular bail.
06:2010 days that he has been absconding.
06:23He did not face the cops.
06:25He has not been questioned yet.
06:27And Giribala Singh, the mother of Samar Singh, who is the mother-in-law of Twisha,
06:34was out on anticipatory bail plea.
06:36But we don't know what's going to happen on that front
06:38because that bail is also being challenged by the Madhya Pradesh High Court.
06:45I want to take this back to my colleague Anisha,
06:47who is tracking all the developments of what is happening in the court,
06:50especially with both the mother and the son.
06:52The mother in specific, Anisha,
06:54because her anticipatory bail plea is being challenged by the Madhya Pradesh government
06:58and that is 2.30 was the scheduled time for the hearing.
07:02And Samar Singh, of course, his lawyer is saying,
07:05will surrender, but when will that be?
07:07How will that be?
07:08Is something we are trying to get.
07:11Details off.
07:14Well, Suyesha, the court is currently dictating the order after hearing the lawyers
07:21with regards to the question of post-mortem and release of the body.
07:26Remember, it's a very interesting argument that is going on in the court right now
07:30as Suyesha's in-laws are saying that the body should be released to them for last rites.
07:36The court is now hearing this matter with regards to whether a second post-mortem should be allowed or not,
07:42whether the family, since her parents had asked for second post-mortem.
07:48So, at the moment, Suyesha, what I can tell you is that Samar Singh has said he is ready to
07:54surrender.
07:55The question also being asked about why is it that the autopsy already performed by Ames
08:04is being questioned.
08:07The family has said there should be a second autopsy either by Ames Jammu or Ames Bhopal
08:15or any such similar Ames or a medical institute.
08:22The high court at the moment, Suyesha, as we speak, a high court is pronouncing its order,
08:29is saying body must be preserved.
08:33Body must be preserved at the moment.
08:36And we will just update our viewers very, very shortly as the lawyer,
08:42as the court pronounces its order, Suyesha.
08:46Oh, yes, absolutely.
