00:00Former Selangor MP Baru Bian, one of six former PKR MPs sued by the party for breaching a RM10
00:07million bond signed before the 14th general election in 2018, has applied to strike out
00:13the suit against him. Baru said the High Court of Malaya has no jurisdiction to hear his case
00:19as the cause of action arose in Sarawak. The 68-year-old lawyer said he signed the bond
00:25in Kuching on April 25, 2018, three days before filing his nomination papers to contest the Selangor
00:32seat. He said his involvement with PKR was confined to Sarawak, where the party had its state headquarters
00:39in Kuching. The former Works Minister and Sarawak PKR Chief Baru Bian said in an affidavit that
00:46his lawyers advised him the cause of action arose in Sarawak, North Peninsula, Malaysia. Under the
00:52federal constitution, jurisdiction lies with the High Court of Sabah and Sarawak, while
00:57the High Court of Malaya has no authority over the suit filed against him. However, PKR Secretary
01:03General Fujia Saleh argued that the cause of action originated in Malaya, as the party's
01:09headquarters in Putaling Jaya administers all PKR affairs, including Baru's membership.
