00:00The family of the late Theo Benghag has filed a fresh application to compel the police to
00:05launch a murder probe into his death 17 years ago.
00:08Lead counsel Ramkarpal Singh said the application for leave to commence judicial review was
00:13filed at the High Court last month, seeking a declaration that Theo's death should
00:17be investigated for murder and a court order requiring the police to complete the probe
00:21within 120 days.
00:24Co-counsel Lim Wei Jietz said the previous wrongful confinement probe under Section 342
00:28of the Penal Code had nothing to do with Theo's death and was a minor offence compared to
00:33murder.
00:34Theo, an aide to then Selangor Executive Counselor Ian Young-Hian-Hwa, was found dead in July 2009
00:40on the fifth floor of Plaza Masalam in Sha'alam, hours after he arrived for questioning at the
00:45Selangor Malaysian Anti-Corruption Commission Office.
00:48An inquest initially returned an open verdict, but in 2014, the Court of Appeal ruled that
00:53his death was caused by one or more unknown persons, including MACC officers.
00:59Two special investigation teams were set up in 2011 and 2015 to probe Theo's death, but
01:04both were classified as no further action by the public prosecutor, while the AGC later
01:09said there was insufficient proof to establish an offence against any individual under the
01:14law.
