00:00 Najib Razak's lawyers have called on critics to check the law before making disparaging
00:06 remarks concerning court proceedings involving the former prime minister yesterday.
00:11 Najib was seeking leave of the high court to commence judicial review proceedings in
00:15 a bid to compel the government to produce a supplementary order, purportedly issued
00:20 by the former king, allowing him to serve the remainder of his sentence under house
00:24 arrest.
00:25 Solicitors Shafi and Co. said news reports suggesting that the proceedings chaired by
00:30 Justice Amarjeet Singh were conducted secretly were inaccurate.
00:34 The lawyers said Order 53, Rule 3, Sub 2 of the Rules of Court 2012 stated that an application
00:40 for leave to commence judicial review proceedings must be made ex parte to a judge in chambers.
00:46 They said that since the onset of the COVID-19 pandemic in 2020, chamber matters were often
00:51 conducted in open court, though purely to ensure social distancing.
00:56 The solicitors said the council's request for the public to be excluded from proceedings
01:00 was therefore in line with the present rules of court.
