00:10Bar's Judicial Review Appeal before the Court of Appeal.
00:14Justice Nurulhuda Nuraini Noor said the Bar's appeal, challenging the Attorney General's
00:19decision to discontinue the case, would be rendered academic if she made a ruling.
00:24Nurulhuda said she had taken note of submissions made by Zahid's counsel, Hisham Teh Potek,
00:29on the white powers recorded to the AG as public prosecutor under Article 145 Sub 3 of the
00:35Federal Constitution and Section 254 of the Criminal Procedure Code. Nurulhuda noted a federal court
00:41ruling that the AG's constitutional powers are not absolute and may be subject to judicial review.
00:46She fixed the hearing for April 24th and allowed Bar Representative S. Abilash to submit an amicus
00:52curiae despite Hisham's ejection that the Bar had no locus stand-eye. Zahid sought to convert his
00:58discharge not amounting to an acquittal to a full acquittal after the AG classified the
01:03case as NFA due to insufficient evidence with the prosecution stating it did not object to the
01:08application. Previously, the High Court dismissed the Bar's bid for judicial review and Zahid had
01:13been granted a DNAA on 47 charges by Justice Colin Lawrence-Sakira despite a prima facie case
