00:00Former Finance Minister Daim Zainuddin and his family have again failed to commence judicial
00:05review proceedings over an investigation by the Malaysian Anti-Corruption Commission into
00:10their finances.
00:11This comes after the Court of Appeal dismissed their appeal from the High Court's rejection
00:15of their application for leave.
00:17Justice Azizah Nawawi, who led a three-member bench, said the court was bound by a federal
00:21court ruling that the investigative powers exercised by law enforcement agencies were
00:26not subject to review.
00:28Deciding otherwise, she said, would expose the criminal investigative process of all
00:32law enforcement agencies in the country to constant judicial review.
00:36Azizah also said the complaints made by Daim and others could be raised in the criminal
00:40proceedings, whether during the trial or when applying to strike out the charges.
00:44Daim, his wife Naima Khalid, their four children and Ilham Tawassan Diran Berhad filed their
00:49judicial review application on January 10 and named MACC and the public prosecutor as
00:55respondents.
