00:00The family of murdered Mongolian national Athantouya Sharibu has filed for leave at
00:05the Apex Court to appeal a Court of Appeal decision absolving the government from liability over her
00:11death in 2006. Lawyer Sangeet Cardio, representing Athantouya's family, told FMT that the applications
00:18were filed at the federal court on Thursday. Separately, in a statement, she said a case
00:23management was scheduled for March 19th before Deputy Registrar Wan Noorazimin Qasim.
00:29She said the applications invited the federal court to consider several questions of law arising from
00:35the civil proceedings brought in respect of Athantouya's death. These questions of law include
00:41those relating to the scope of vicarious liability of the government, where acts of state agents result
00:46in the unlawful deprivation of life, and the statutory framework governing damages in civil
00:51claims arising from unlawful killings. On January 20th, the Court of Appeal found the government
00:57not vicariously liable for the actions of former policemen Sirul Azhar Umar and Azila Hadri on the
01:04grounds that they were not performing their official duties at the time of the murder.
01:09It also upheld liability against Sirul, Azila, and political analyst Raza Baginda for their
01:15involvement in Athantouya's death. Sirul and Azila were convicted of Athantouya's murder in 2015.
