00:00The Court of Appeal has overturned a High Court ruling that had compelled the government to
00:05adjust the pensions of former civil servants under a 2016 service circular.
00:10Justice Asahari Kamal Ramli, delivering the unanimous decision of the three-member bench,
00:15said the pension adjustment issue had already been settled by a previous Court of Appeal
00:19ruling in 2022. The bench further clarified that today's ruling applies only to Amina Ahmad and
00:2556 others, the respondents in the current case. Asahari said, the respondents' judicial review
00:31application was res judicata and an abuse of process. Amina, who retired after serving the
00:38foreign ministry, filed a judicial review application on January 12, 2024 in her personal
00:43capacity and on behalf of 56 retired members of the public service. Following today's decision,
00:50the government is no longer required to pay 1.7 billion ringgit in pension arrears to 500
00:553131,976 retirees as previously ordered by the High Court.
