Lawyers for former JetStar pilot Greg Lynn have told the court of appeal, he should be given bail ahead of a retrial. Mr Lynn was acquitted last year of the murder of Carol Clay, with the court of appeal ordering a retrial. His barristers have argued that saturation media coverage has ensured there would be no possible chance Mr Lynn gets a fair trial this year.

00:01The court heard today from obviously defence and prosecution.
00:06Defence lawyers for Greg Lynn are arguing that he should be given bail as he has no
00:13prospect of a fair trial in the near future.
00:16As you mentioned he stands accused of murdering Carol Clay who went missing in Victoria's
00:21High Country in March 2020.
00:25He was sentenced to 32 years in jail after being found guilty of her murder in November
00:322024.
00:34He had pleaded guilty and has always maintained his innocence and in December last year the
00:39Court of Appeal quashed the conviction and ordered a retrial.
00:44They said that the conviction should be set aside due to a number of serious irregularities
00:49in the course of the trial that gave rise to a miscarriage of justice.
00:53He remains in custody awaiting a retrial.
00:57And his lawyers have asked, as I mentioned, for bail for him.
01:03That decision on bail will be announced, is expected to be heard next Thursday.
01:10And what arguments did the lawyers make today?
01:12Well his barrister Dermot Dan wants him to be bailed for exceptional circumstances which
01:18includes his vulnerability and expected delays before a retrial and what he says are issues
01:25with the prosecution's case.
01:27Mr Dan says his client has a tight family unit.
01:32If he is bailed he says he would live with his son in his home.
01:37Mr Lynne's son has also offered substantial life savings and the equity in his home as a
01:45guarantee for Mr Lynne should he get bail.
01:48His lawyers have also said that he has the support of his wife who was there today and as they
01:54prepare to celebrate their 22nd wedding anniversary on Saturday.
02:00The defence also argued that sensational explosive media reporting related to Mr Lynne meant that
02:08that fair retrial could not occur in the near future.
02:12But the prosecution has argued that the high bar of exceptional circumstances was not met
02:19and that the bare bones facts of the case were serious enough to deny bail.
02:25So no date for the retrial has been set but Supreme Court Judge David Beach said a retrial,
02:32if not delayed, could be held in August this year.
