04:11As mentioned in the hot list, Sunday's episode of Real Housewives of Atlanta was an interesting one.
04:16If you've been watching this season, you know that Portia Williams has been talking about having a baby with her new boyfriend Todd.
04:22But she wants him to sign a baby nut before she gets pregnant, which will stipulate all his responsibilities as a co-parent.
04:29So today's viewers poll is this.
04:32Would you have a co-parent agreement or a baby nut before getting pregnant?

04:42Joining us right now via Skype is family law attorney, Crystal Holmes, who can share some insight on this topic.
04:49Welcome to the show, Crystal.
04:51Thank you for having me.
04:53Great.
04:54Can you tell us exactly what is a baby nut?
04:57And is this even a correct legal term?
04:59Well, as Portia's boyfriend asked, is this a real, real thing?
05:04Uh, no, it's not.
05:06Um, you have to be really careful when parties decide to have babies and they're not married.
05:12Um, because you can't, you can't contract things such as visitation and custody and even child support in that manner.
05:23Um, if you do, you can always write down an agreement.
05:26And of course I encourage clients to try to agree to as many things as they can.
05:30But if you do, you might find out later that a lot of those terms in this baby nut are not going to be enforceable in a court of law.
05:39Now, is a baby nut a better option than child support or can you have both?
05:44No, it's not a better option because if you have a part, if you agree in a baby nut to child support, it's not enforceable.
05:53So if that noncustodial parent doesn't follow their obligations and pay the child support per this baby nut, you're kind of left out in the wind.
06:02You will have to go to the court.
06:05Okay, so we saw Portia on Real House of Atlanta struggle to get her boyfriend to sign the baby nut.
06:11How do you approach a man about this?
06:13What should, and what should his reaction be about moving forward?
06:17Basically, how do you go about legally co-parenting the child that you're about to have?
06:22Right.
06:23It's, it's a hard thing.
06:24Now, of course, the, a baby nut would be similar to, I guess, what you would know as a prenuptial agreement.
06:31And if parties are planning on getting married, they can put certain things that relate to a baby in a prenup.
06:38For example, who's going to be responsible for the medical expenses in giving birth for this child, for example.
06:45But when it comes to, like I said, custody and visitation, that's a different story.
06:50Moms and dads just need to try to come together and talk about these things before the baby comes.
06:55That's always great.
06:56But once the baby is born, you need to take that additional step in drafting a formal agreement that can then be turned into a court order that will address your child support and address your custody and visitation issues.
07:11You know, we read a story in The Guardian.
07:13Leah Hunter wrote about how she and her partner did not want to have child support.
07:18Child support. Do you advise women against that if you supposedly have a good relationship with your partner?
07:25Well, you know, you don't have to go to the courts if you don't need to.
07:28If you have a great relationship with your partner and you trust them, you don't need to go to the court.
07:33However, understand that in order to have child support awarded, you will have to go to a court.
07:39Now, you can always come to the table and agree and do an agreement, but it will have to become a court order.
07:45Okay.
07:46Now, I'm assuming that the law already covers responsibility for children in marriage, but should engaged women get a baby nut too?
07:54Engaged women probably should have some sort of document that outlines what the responsibilities are going to be.
08:03Not necessarily for the children or the potential child, but how are we going to deal with costs for the baby and those types of things.
08:11But like I said, understand as far as visitation and custody and child support, that's not going to be legally enforceable.
08:19So, let's hope, assuming they don't get married, they need to understand that that document is not going to help them necessarily in a court of law.
08:27It could be used as evidence, but it's not something that's going to be enforceable.
08:31In your practice, have you ever had a client come to you with this idea of a baby nut?
08:37Oh, yeah.
08:38They want to know what can they do.
08:40A lot of times, one party has cut off the other party, someone's pregnant, they won't speak to them.
08:47And there's really not much you can do in that scenario but wait until the baby is born and address it with the courts.
08:55But yes, people do come and, you know, like I explained to them, just like I'm explaining on this show right now,
09:00you can't really put provisions involving custody, visitation, or limiting child support in this kind of document.

09:49That's so interesting because I always hear like the worst when it comes to dads.
09:54But like Leah Hunter wrote, like they had a really good relationship and they made it work this document.
10:00So, I think the good fathers who are not with their child's mother don't get enough credit for making it work.
10:09So, that's just my personal opinion.

17:03Okay, and so why do you think Love Jones still resonates with people 20 years later?
17:06You know, it was a universal story, really, about love and romance.
17:10And I think that at the time that it had come out, you know, a lot of people weren't used to seeing black people in love and black people vulnerable.
17:19And there was a certain sort of, you know, way that they spoke and how they lived and how they, you know, how they saw life and what the prism that they looked through was a lot different than what you've probably seen with movies like Menace to Society or Dead Presidents.
17:36So it was really nice for us to do that movie.
17:39And when you have just like a great song, it can stand the test of time.
17:43Yeah.
17:44And that was so well-crafted and people still love the movie.
17:49Yeah.
17:50I can't believe it's been 20 years.

17:52Why do you look the same?
17:53That's the real question.
17:55I give that to my mother and father, the genetics.
17:58My mom and pop still look very young, but, you know, just trying to do my best to stay young at heart.

18:37You know, it was an underworld of these poets and intellects that I wasn't even aware of until we started doing the movie.

19:11Can you tell us a little bit about that?

19:14Deuces is a crime drama.
19:15I'm kind of getting back to a little bit of the crime drama.
19:18It's a crime drama that stars myself, Megan Good, Lance Gross, Rick Gonzalez, Rotimi, Lala Anthony.
19:27It's a, you know, it's about loyalty, about friendship, about love, deceit.
19:32And it's something that we produced along.
19:35I produced my company, Take Men Entertainment, produced along with Queen Latifah's company.
19:39Okay.
19:40So, you know, we just want to do something that we felt could really resonate.
19:46It does have a combination of love, has some edginess to it.
19:51And it comes out this Saturday, April 1st on Netflix.

20:23It's an audio drama that really reflects on the lives of African Americans in the 1940s at a time where black communities were self-sufficient.
20:33Black folks had their own businesses.
20:36We had our own department stores.
20:38We had our own grocery stores, our own schools, you know, museums, churches, you name it.
20:43We had our true community and we wanted to do a series that sort of reflected that.
20:48And a lot of people don't know that the economic engine from which they were sufficient was running numbers.
20:56You know, gambling, if you will, racketeering, but they flipped it into something, you know, bigger.
21:01After a while, other communities began to adapt that system.
21:05And then the government came in and turned it into what is today the Mountain Day Lottery.
21:10And so that stars myself, Lawrence Fishburne, Wood Harris, Tracy Ellis Ross, Tika Sumter.

21:18We got my brother Lamar Tate in it, Corey Hardwick, Amari Hardwick.
21:22That's like an all-star cast right there.
21:24We got a lot of people to come in and it's theater of the mind.

22:20And the thing about it is we don't go by other people's standards.

22:25What works in our relationship and our household may not work for the next people, but it's what we create and what we do.
22:31And we don't get involved with anybody else's business.
22:33We just do our thing.

22:42The one thing about our relationship and our family, we have three children, we have three boys, and our children are truly our pride and joy.

22:54But when it comes to our children and what we have, you know, I think it's okay to have some level of privacy.

27:16Last year we had Oprah Winfrey, which was amazing.

27:27I think, like a lot of people, this year above any other year with a lot of people feeling disenfranchised
27:33and just fearful of the uncertain future with the political climate that we're dealing with,
27:38people are going to be flocking to the Essence Festival in droves.
27:41And I think the Essence Fest team has left no stone unturned with bringing some of the most thought-provoking speakers.
27:47Like, we have Ayanla Van Zandt, who we know is going to fix all of our lives.

27:52Then we've got Congresswoman Maxine Waters, who you guys just spoke about earlier in the show.

27:58And then you have Michael Eric Dyson and then Ava DuVarnay, just to name a few.

28:05You've got NOLA poet Cleo Wade and then Mary Pat, who is a 19-year-old sophomore in college at Spelman,
28:13who's making history running for public office.
28:15Like, I don't remember what I was doing at 19, but it wasn't running for public office.
28:19So, this is definitely not the year to sleep on Essence Festival.
