00:57What's going on?
01:01I think he's dead in the bed.
01:03I can't care if he's been shot in the face.
01:06Or somebody hit him with something in the face.
01:09But it's all bloody in hell.
01:11It was mid-morning.
01:12I was at home when dispatch contacted me.
01:21And there was some incident in the Cushing area.
01:25Cushing's a very small town.
01:28It's one of those communities where you pretty well know everyone else.
01:38The victim's stepfather called 911.
01:41They gave me the address.
01:45They said, the James Kelly residence.
01:49I knew Mr. Kelly.
01:51James is a lifelong resident of Cushing.
01:55You have to prepare yourself and your mind on what you may see.
02:01Especially when you know the victim.
02:04I arrived on scene.
02:07I met with the investigator vault.
02:10I went into the bedroom.
02:13The television was on.
02:18And I walked over to the bed.
02:21He was laying there under the cover.
02:25And I had to get up there pretty close.
02:28And I pulled the cover back.
02:32It was a mess.
02:37A center point was punched in on the face.
02:45And everything exploded out.
02:47Almost like putty.
02:50The gunshots have been fired in a very close range.
02:54Something unique has occurred.
02:57You see something horrific like this.
02:59And you realize you know that person.
03:03It becomes personal.
03:07It was a very, very terrible day.
03:20Very terrible day.
03:22My stepdad, David, he said, there ain't no way to put it.
03:25But I believe your brother is no longer with us.
03:28And he said that he had been shot.
03:33So I put my boot on and took off up there.
03:38And then, you know, all the questions started running through my head.
03:43Who would do something like this?
03:45We're dealing with an individual that has suffered a gunshot wound to the head and is deceased.
03:52Is this an accidental shooting? Is it a suicide? Or is it a homicide?

03:56When the deputies get to the crime scene, they start looking around.
04:00Nothing is out of order.
04:01There hasn't been any sort of assault.
04:02There's no sign of forced entry.
04:06As we're looking in the room, there was what appeared to be a handgun near the body.

05:01It's very apparent that James was shot as he slept in bed.

05:10But he pretty well got along with everybody.
05:13As far as I knew, he did not have any enemies.
05:19And it was time to go to work for the family.
05:27James was my little brother.
05:29We were 15 months apart, so pretty much where you seen one, you seen the other one.
05:36Everybody around here called us the crazy Kelly boys.
05:43We had a great childhood.
05:45We'd always go fishing, water skiing, knee boarding.
05:49I've known him since he was a kid.
05:54He was kind of a daredevil.
05:56If James seen a mud puddle, he's going to step in it.
06:01That was James.
06:04If he loved you, he loved you.
06:06He was going to have your back.
06:13James and his wife Marse met at the party.
06:17James was 19 and Marse was 22.
06:22And Marse had a big attitude.
06:26Just like James, she liked to race and drive fast and, you know, if he thought that was
06:32sexy.
06:33Marse did find him attractive.
06:37They felt like they were a good couple when you seen them.
06:41Marse, she's notified that James has been shot.
06:50She's at her place of employment when the call came in.
06:54A friend of the family picks her up.
06:59They're driving towards Cushing when they get pulled over for speeding.
07:08Annie Muldner.
07:10She is the one that exits the vehicle and then approaches the deputy before he can get out
07:15of the vehicle.
07:16She is just hysterical.
07:21Yelling, screaming.
07:36The officer realizes something's happened to her husband and she needs to get to the scene.
07:47Then allows them to continue on.
07:49She got back in the car and drove on to Cushing.
08:01James and Marse, it was definitely an on-again, off-again relationship before they were married.
08:09They had both been in previous relationships.
08:12They were a blended family.
08:15James had two sons and Marse had three daughters.
08:22Marse was a child herself when the oldest child Shana was born.
08:29I guess you could say Shana was a typical teenager, you know.
08:36Stepkids always have a hard time being introduced to a new dad.
08:42But I could see the pride in his eyes when he talked about his stepkids.
08:46James kind of just treated them all like his.
08:50He tried to give them everything that they wanted.
08:54I could tell he loved them.
08:56And he loved Marse.
08:57James and Marse, they end up getting married.
09:13Oh, the wedding, it was real nice.
09:17All of his friends was there.
09:20But it was real good.
09:22He was growing up, settling down.
09:24Very proud of it.
09:29James started his own trucking business.
09:32They had a number of vehicles.
09:35They had four-wheelers.
09:36They had jet skis.
09:40They seemed like a real, real happy family, you know.
09:45But you're on the outside looking in.
09:48What you see and what it really is, is kind of two different things.
09:55It certainly wasn't all flowers, hearts, and unicorns.
10:00James and Marse, they seemed at times to be very tight.
10:03And then they seemed at times to be very apart.
10:07They may be arguing at each other at the mud park one night.
10:11And then the next time you see them, they're lovey-dovey that day.
10:14Just a roller coaster for their kids.
10:17It wasn't necessarily a good thing.
10:20We believed that Mr. Kelly was executed with the gunshot to the face.
10:33As we're looking in the bedroom where Mr. Kelly was,
10:38we started taking photographs of the scene.
10:42We're still trying to determine clues.
10:46Then a spot in the cell phone.
10:50It was lying on the floor near the foot of the bed.
10:54And something uniquely stands out to me.
10:58That call line on the end of the cell phone was still open.
11:04This is not normal.
11:07Why is it still openly engaged?
11:11There's nothing to indicate that James was on the phone when he was killed.
11:15It's just plain weird.
11:18Maybe there was a conversation taking place during the killing.
11:24One possibility was that the killer had used that phone.
11:28When the police find James' phone with an open line, it's highly unusual.
11:47We're going to get that telephone analyzed.
11:51Those phone records could hold some valuable information.
12:00Marcie arrives at home.
12:03She gets out very calm and collected.
12:06Very nonchalant.
12:08Her behavior is very different from the way she had been acting when they were pulled over.
12:15James is laying in the bed with his face shot half off.
12:26And she's just as calm as a cucumber.
12:30This was really bizarre.
12:33She's not even asking questions.
12:35The rest of the family is very distraught.
12:38And Marcie goes and feeds the dogs.
12:46It made me mad.
12:48Is that all you can think about is your dog?
12:53Maybe she's just in so much shock that the body and the mind hasn't comprehended what happened yet.
13:01We start talking to the witnesses and the neighbors and the family members.
13:12The detective, Doug Richardson, took Marcie in the house, set her on the couch, and was asking her questions.
13:20Marcie was employed at a local hospital.
13:26She tells me that she goes to work at 6 o'clock at night, speaks to James two or three times.
13:35And James tells her, I want to wake up at 7.30.
13:39Call me at 7.30 in the morning.
13:44Marcie said that she went to call the home phone.
13:47And once James didn't pick up the phone, she contacted James' stepfather.
13:54I think he's dead in the bed.
14:00There is no doubt Marcie had a solid alibi for the time of this shooting.
14:05But James' death wasn't the first tragic death in Marcie's life.
14:17There was a massive heat wave here in Texas.
14:21Some sort of short in the electrical system caused the house to catch on fire.
14:32Both Marcie's mother and Marcie's middle child were killed in that fire.
14:38When Shana was six, Shana was so distraught that she tried to end her own life, even as a child.
14:51To lose your grandmother and your sibling, that's just a tragedy that most of us can't even imagine.
14:59And for Marcie, I can only imagine the tragedy of a mother losing their child.
15:06After the fire, Marcie quit doing things that mom should do as far as guiding their child.
15:20She's just lost one kid, so she wants the other kid to be happy.
15:25Have whatever you want, girl. Go for it.
15:27But whatever Shana wanted wasn't what she needed.
15:31Marcie, she was asleep at the wheel.
15:34She had become a pretty sorry parent.
15:37Once we saw the scene, we believed it was an execution-style shot for sure.
15:51When you're looking at the type of crime that we're looking at, everybody's a suspect.
15:56It's as important to see who is at the scene, but just as important as who's not at the scene.
16:04The family has gathered around, close friends have gathered around, but Shana's nowhere.
16:11As we are collecting information from the individuals that are on the scene,
16:16we start to hear details about rebelliousness on his stepdaughter's part,
16:23conflicts between Mr. Kelly and Shana.
16:28People started coming forward and telling us Shana hated James.
16:34Hated him with a passion.
16:37We needed to find Shana.
16:48Shana wasn't the typical ideal student.
16:53She was a wild child.
16:56She was the cool kid.
16:58She smoked.
17:00She drank.
17:02She had a boyfriend.
17:04She was 15 and had her own car.
17:09Driving around with no driver's license.
17:14She was just running wild.
17:18Shana didn't abide by nobody's rules but Shana's.
17:21Investigators pretty quickly realized that Marce and Shana, they didn't have a traditional mother-daughter relationship.
17:34The relationship between Marce and Shana was friend, not mom and daughter.
17:41Shana's staying out all night, partying, not going to school.
17:48James was not okay with Shana hanging out, getting high and drinking.
17:55But her mother's validating all that behavior.
17:59After that fire, the special relationship that Marce and Shana had was cemented.
18:07Marce was letting Shana run wild.
18:14She wouldn't put any limits on Shana.
18:17Marce demonstrates bad parenting move after bad parenting move.
18:22And just when you think it couldn't possibly be any worse than it was, she makes this incredibly horrible parenting decision.
18:29As we were investigating and interviewing, I discovered something shocking.
18:42Marce allowed her 15 year old to be in a sexual relationship with an adult.
18:48Shana started a relationship with a Dallas Christian.
18:54He was 23 years old.
18:56Dallas had a terrible reputation.
18:58Dallas was a sex offender.
19:00He was everything a mother would not want her daughter to be involved with.
19:07He was a wannabe Billy badass.
19:12A macho man.
19:14I don't think Marce cared.
19:17Whatever was keeping Shana quiet and keeping her pipe down.
19:22You want to have sex with your boyfriend?
19:24Here's my house.
19:25Use it.
19:26Weird is an understatement for what this is.
19:31For her to show up with this sex offender, James, I'm sure, was livid about this situation.
19:41What do you do at this point as stepdad?
19:44Your authority is somewhat limited.
19:47At one point, James took her car away from her.
19:51She was really pissed.
19:52It just seemed like everything was getting worse and worse.
19:57Marce and Shana was definitely making it a nightmare for her.
20:02James' stepdaughter, Shana, is not on the scene.
20:15Marce told me that Shana was at a friend's the night James was killed.
20:20But when the police start looking into Shana, they realize something important.
20:26We conduct a background investigation on Shana.
20:30And we find that she had been arrested for assault family violence.
20:35But it wasn't with her stepfather, James.
20:38The incident was between her and her mother.
20:42There had been some blow up over whether or not Shana was going to clean her room.
20:52It was like a match to kindling.
20:55It just lit up.
20:57Shana lost her temper.
21:00She shoved Marce, pushed her into a glass door.
21:04You know, there's blows exchanged, pushing and shoving and punching.
21:13Two strong, tough women going at it.
21:15You probably could have sold that as a main event somewhere.
21:18She spent the night in jail.
21:23Shana ends up on juvenile probation.
21:27Shana was so out of control.
21:32She was getting closer to the edge.
21:35Shana became a huge source of tension for James and Marce.
21:44James and Marce, they butted heads more and more.
21:53Marce was a rebel.
21:56She didn't change her lifestyle after she had the kids.
22:01She still, you know, went out partied, smoking and drinking.
22:07It was, it was getting bad.
22:11James felt like it was two against one.
22:16The whole dynamics was probably just a powder keg ready to explode.
22:26Shana's violent.
22:29She's on probation.
22:31We needed to find Shana.
22:33It's very imperative that we speak to her.
22:36Law enforcement locates her with Dallas Christian.
22:41They're not aware that they're being looked at as potential suspects.
22:46The two of them go to the sheriff's department to talk to the investigators.
22:53I interviewed Shana first.
22:56When I called him this morning, nobody would tell me what happened to him.
23:04Where were you at yesterday?
23:06Yeah, I went home last night, about nine o'clock.
23:09He got my clothes.
23:11I sat down with my dad and we talked for a little while.
23:15And I asked him, could I go stay at a friend's house?
23:19He just talked.
23:21He was like apologizing to me for the way he talks to me.
23:26I apologize until I talked to him.
23:29And that's the last time I talked to my dad.
23:36Once I established the baseline story with Shana, I went and interviewed Dallas.
23:41He's nervous.
23:42We start to see anomalies in their stories where the accounts that they're giving don't match each other.
23:59To me, it's just signs of deception.
24:04I've been around Dallas a bunch and so, I mean, I don't know if I can say this, but that kid's too dumb to lie.
24:10I don't think you're giving us the story as it unfolded Saturday night.
24:17I'd have to say I'm calling bullshit on you.
24:20I press him on what he knows about the death of James.
24:25Now we're getting down to the meat and bones of this.
24:28That's when now Colton Weir enters the picture.
24:30Dallas tells me that Colton says something to the fact that James is dead and I got rid of the gun.
24:50This is huge. This is the moment they've been waiting for.
24:56Investigators learned Colton was a little high school friend of Shana's.
25:03He wanted to be part of Shana's crowd.
25:08I always suspected that Colton kind of had a crush on Shana.
25:14Colton was a really rough kid.
25:19I didn't really ever like being around Colton.
25:22He always made me very uncomfortable.
25:25There was something a bit creepy about Dallas and Colton.
25:30I just knew they were bad people and I didn't want to be around them.
25:34We pick up 15 year old Colton Weir.
25:44We come back to the sheriff's office.
25:46He's very quiet.
25:49Head down.
25:51No eye contact.
25:53I believe you're a smart enough kid to know what you're in here for.
25:57Yes, sir.
25:59I tell him that it's just best to tell the truth.
26:02I took my chair and moved in closer.
26:06I looked in your face and I can tell that you need to get it off your chest.
26:11It's eating you alive and you need to talk to me about it.
26:15Get it off your chest, son.
26:17Tell me what happened.
26:19Yes, sir, I will.
26:22Colton's interview turned out to be critical.
26:26Go ahead and let's finish out the story.
26:28She is looking for somebody to do it.
26:33It was the key that opened everything.
26:37He pointed the finger at Shana.
26:39My story is that I was with my friend's Shawnee River bottom.
26:54It wasn't just Colton and Dallas at the Shawnee River bottom.
27:02You're telling me that you stayed at the river bottom with Shana?
27:07Yes, sir.
27:09Colton confirms that Shana was with Colton and Dallas too.
27:14They put the rifle in the trunk of Shana's car and they take off for the Kelly residence.
27:23Dallas Christian is the driver of the car.
27:27Shana was in the front seat.
27:29Shana leads Colton to the house, lets Colton in, shows him where James is asleep.
27:50Colton's head immediately went down, his hands were by his face and he nodded.

28:26This is that television moment.
28:29The sheriff's deputies, they've got a shooter that's confessed and they realized that we're dealing with premeditated murder of James by a group of people led by Shana.
28:52Shana's the one that brought every one of these guys into this scheme of hers to kill James.
29:02Shana's motivation to having James killed was to get him out of the picture.
29:07I have no person to stop me from doing whatever I want to do.
29:12Unbelievable.
29:14We knew we had the willing participants in this, but we think there's more to this story.
29:23According to this family friend who brought Marseille home,
29:35Marseille's behavior was very different from the way she had been acting inside the car before they were pulled over.
29:45The family friend said she had been very calm about things up until then.
29:58That sudden change in behavior is very strange.
30:03Her behavior was flipping.
30:06And then as the police go back and start talking to Dallas, they realize a shocking truth about who planned this execution of James Kelly.
30:28You're going to need to come straight. You need to tell us how it got planned.
30:38Marseille said she wants to kill me.
30:41It's like, aha. Shana wasn't the mastermind.
30:57This mother and daughter have conspired to kill James.
31:02But it was the mother leading the child.
31:08Shana's mother, Marseille, was the mastermind.
31:13It's crazy.
31:14We find out that Marseille had offered $10,000 jet skis, 18 wheelers and all kinds of other miscellaneous items for James' murder.
31:32Jaw-dropping. I mean, a jet ski.
31:38I was like, oh gosh. I mean, that's it. That's what your life is worth.
31:44That's what the woman that you married said I do.
31:48That's what you're valued at.
31:51A few thousand dollars and some jet skis.
31:55A mother offering to pay her child's friends to kill her husband.
32:05That disgusts me. It's sickening.
32:10Now's the real moment of truth.
32:13But yet she had a solid alibi.
32:15We quickly needed to get Marseille to our office for an interview.
32:32These kids are saying you talked to them.
32:35And you offered them money.
32:37Well, I don't know where they got it or why they saved it.
32:40There's an almost absence of emotion.
32:45Just pretty nonchalant.
32:48I don't understand where they're coming from.
32:51She could show some signs of intelligence.
32:55But she could also play dumb and confused.
32:59And there are written up statements saying, would you take care of this for me?
33:05I need him dead.
33:07She tried to minimize by just downplaying, oh, well, yeah, they know I wasn't serious.
33:27We didn't have any real facts linking Marse Kelly with the crime that was committed.
33:33But we started getting the cell phone records and were able to corroborate what they're telling us.
33:42I realized how much of a hold Marse had on Shana.
33:48It is now unquestionable that in the hours leading up to James' murder, that Shana and Marse are talking to each other.
33:57We find out those calls are to see when James has actually gone to bed so that the plan can be acted out.
34:07And then there was this mystery of the open cell phone lying on the floor near the foot of the bed.
34:15The investigators pretty quickly realized a shocking truth.
34:22I don't even think the devil would be that evil.
34:25When the deputies are looking at the crime scene, one of the things they find is James' cell phone with an open line.
34:41It turned out to be a call to Marse.
34:50But James didn't call anybody. Shana did.
34:56It is truly our belief that Marse was trying to hear the gunshot to know it happened.
35:10Marse didn't have a conscience, nothing. Just pure evil.
35:15During their investigation, we found a very clear motive.
35:28Marse stood to come out of this with a lot of money.
35:32There was a life insurance policy.
35:34They owned multiple vehicles.
35:37And she could take this money and just move on.
35:40And to Shana.
35:43James was the one thing standing between her and freedom.
35:49She's probably just thinking, I can get rid of mom's problem and my problem once James is gone.
35:56Marse knew she could get Shana to do stuff like that.
36:03I just kind of fibergassed how it all came to a head.
36:06Right under your nose.
36:10She hasn't seen a murder in more than 15 years.
36:15But the people here were especially outraged when they found out it appeared to be a murder for hire.
36:25Marse and Shana, Dallas and Colton get arrested.
36:29And they're all forecharged with capital murder.
36:32But there was a problem.
36:35Marse, she had a solid alibi for the time of this shooting.
36:41She had plausible deniability simply because, well, I can prove I was at work when this happened.
36:49We're unsure if we have enough evidence to convict Marse of this crime.
37:00But all of a sudden, people start showing up at the sheriff's department.
37:03These really shocking allegations start appearing.
37:09Marse had solicited them with the same type of items as payment.
37:15Money, jet skis, 18-wheelers.
37:18There was one young man who said she took me in the closet and we had this conversation where she asked me if I would kill James.
37:30She asked me if I would do it.
37:33And I told her she was out of her mind.
37:43Here's Marse sitting in a courtroom with basically her life on the line.
37:48Marse's defense was, I didn't have anything to do with this.
37:53Dallas and Colton and Shana did this.
37:56And then there was a big twist.
38:00Shana does something I hadn't anticipated.
38:05Marse convinced her daughter to testify for her mom.
38:11I told Shana she was making the worst mistake of her entire life.
38:21Shana testified my mom didn't know anything.
38:26This daughter was willing to risk her own freedom.
38:30She was willing to lie for her mom.
38:33And her mom was willing to let her do that.
38:36Marse, she was more than willing to throw Shana under the bus and say,
38:41that's the guilty party and yes, she inspired these others to do it.
38:45I didn't have anything to do with it.
38:47A terrible mother.

38:51She's heartless.
38:53She is as close to demonically possessed as I've ever seen.
39:00It felt like, you know, somebody just, just hit me in the gut.
39:06I would like to see Marse and Shana fry.
39:11That would make me feel a little better.
39:15But it didn't work.
39:18It didn't work.
39:20We end up having more than sufficient evidence to convict Marse.
39:25The verdict is guilty.
39:27Marse is sentenced to life without parole.
39:31At Shana's trial, Marse Kelly, she never, ever tried to take any of the heat off of her daughter.
39:48Marse put Shana out to dry.
39:52Most parents would stand up and say, no, no, no, no.
39:57Marse was too busy trying to cover her butt.
40:01Shana got exactly what she deserved for taking James Kelly's life.
40:13Greed and selfishness in the form of Marse Kelly is what led to James's death.
40:35A man is dead.
40:41And for what?
40:43This mother and daughter, they were master manipulators.
40:48But I put all the blame on Marse as the mastermind of this.
40:54The buck started and stopped with her.
40:58Hopefully, they'll stay exactly where they're at the rest of their lives.
41:01We don't need people like that out.
41:12I miss James a whole lot.
41:16The little phone calls, shooting the breeze.
