Transcript
00:009-1-1 what is the address of the emergency I don't know I'm just at the corner it's like
00:29Sheridan and 20th we're in the parking lot right behind the Dunkin Donuts it's right by that like
00:34the bar in Northern Lights of Sun 3 what's going on there some guy just got shot and he's on the
00:41ground he's like face down and they took off in a silver two-door Pontiac he's in the parking lot
00:47like face down we're standing right next to him he's still conscious and he's still breathing
00:52where did he get shot at where did he get shot at I don't know he's face down he's not talking
00:56on April 5th 2018 just after 8 p.m. we responded to a report of a shooting at that point we didn't
01:22know if the victim was alive or dead but we knew as officers that this was a very bad situation
01:26when we got to the scene we activated their body cameras
01:31EMS was very quick to arrive they started working on the victim who had one single gunshot wound to
01:49his chest yeah they're doing CPR on a guy like that one number who are these folks that are right here
01:55oh this guy here's got a car he wants to get out but yeah no we're shutting the place down
02:01at that point in time we weren't sure if he was alive or dead or what the situation was
02:06so during all this commotion the victim was pronounced dead on scene
02:13in the parking lot near the victim a wallet had been located and opening it a Colorado ID was found
02:26to an Andrew Genesec this is a very crazy circumstance for me because I went to high school with Andrew
02:36during that time he played football and I was a manager of the football team so I interacted with
02:42Andrew pretty frequently I was in shock Andrew he was the sweetest kid actually was the first boy in our
02:58family on my side and my mother just adored him he was a chunky little baby I kept saying how can three
03:09folds of fat in your legs be so darn cute but Andrew was always a big kid Andrew was a very curious little
03:18boy seeked a lot of pleasure in music I think that was his biggest passion
03:24yeah it was April 6 when I found out I got up that morning and I get a call from the Edgewater PD
03:46and they said I'd like to come over to your house and talk to you and I'm thinking what the hell
03:52happened they get there it's Brandon chalice and a victim's advocate they come into my house and we're
04:02all sitting at my kitchen table and he said there's just no way to tell you but Andrew's dead
04:12all I could do was cry it just didn't seem like it was real it just felt like my world just crumbled
04:27at that time
04:29so I was working at the time and I got a call from one of our buddies on the football team
04:39and I could tell immediately something was wrong I could hear it in his throat and he said Andrew
04:45was murdered yesterday and we just broke into tears and what do you say or do it was just shock
04:52there's no words for what that moment feels like
04:59once everything had kind of calmed down we turned our attention to the evidence some of the evidence
05:18that I found on scene it was a single spent nine millimeter shell casing nearby the Andrew's wallet
05:25that had cash inside of it I also located a cell phone with a sticky note on the back with a order
05:32for barbecue as we were scanning the parking lot looking for additional evidence we didn't locate
05:40any firearms I also located Andrew's car in the parking lot and we found no weapons inside of Andrew's
05:46car when you see the wallet is still underground and the money's missing motive becomes unclear it makes
05:55you think was this a target attack did the suspect know the victim we knew that we were gonna have to
06:00dig deep to solve this mystery as we were combing the scene we noticed that there was a camera on the
06:09side of nearby barbecue restaurant which matched up with the sticky note that I found on Andrew's phone
06:15right next to the scene now we're asking ourselves could that camera have caught the shooting the
06:21shooter or very least the vehicle that left the scene so officers went to the restaurant started
06:27knocking on the front door tried the door nobody was answering they tried going around the back then
06:35continued knocking on the door finally somebody kind of peeked through notice it was uniformed law
06:40enforcement officers trying to get in and answer the door for us you can tell we had an incident
06:46happen out here in the parking lot let me see if our camera actually yeah if you guys have camera
06:51footage that would be awesome they were able to pull up the video footage for us almost immediately
06:56which was a miracle somewhere the dude was on the ground back there when you pulled her up okay
07:01so you can catch the corner of it right here it looks like okay so you might be able to see something
07:06okay video footage it was pretty grainy we could see what happened but not great we were able to look
07:14at the time stamp which was directly in the vicinity of the 911 call it was hard to see what type of
07:20vehicle it was so the surveillance had to be sent off to forensics for analysis or further investigation to
07:26be able to identify the vehicle and persons inside the vehicle but we appreciate your help man that's
07:32awesome once we exited the restaurant we turned our attention to the two nine one one callers they
07:40were still unseen in the barbecue parking lot right now they're the closest thing we have to the truth
07:46behind what happened to Andrew we didn't know what kind of connection they have with the case a lot of
07:50times when we interview witnesses you want everything to be their own raw emotions raw feelings raw
07:56memories and testimony without being guided or coerced so we made the decision to take the 9-1-1 callers to
08:03the station for an interview
08:04all right so I've told you before Corporal Nathan Rivers for investigating the shooting at the
08:24Duncan Ellis parking lot could you state your full name Alexis Jordan Ellis okay okay and you're the
08:31one that called 9-1-1 right yes okay so let's start with the just take me through
08:37okay we pulled up we parked in the back parking lot my friend got out to go into the dispensary
08:48um sitting on my phone playing on Facebook um heard the shot thought it was a firework for a second so
08:56I looked up and saw the victim um face down on the floor and there's a silver Pontiac in front of the
09:04victim um and the shooter was in front of the car still kind of standing by the victim's body with the
09:11gun pointed at him and then got back into the Pontiac on the passenger side so from the information we
09:17got from Alexis this instance seemed really quick really sudden and then she dropped this bombshell
09:22on us so when somebody discloses that they're on probation because they were a witness to another
09:40murderer it definitely raises a lot of suspicion it raises a lot of questions so why are you here
09:45what type of situations do you put yourself into was she involved in the murder in some way shape
09:52or form this was a significant lead that could potentially help us find out what happened to
09:57Andrew as we were talking to this 911 caller Alexis obviously we got this information that she was on
10:11probation and she had been a witness in this other murder so we had to start treading lightly and
10:16making sure that we were paying extra attention to what was going on so you've heard again go off
10:21yeah it makes it seem like either really bad luck or really suspicious that this person's at the wrong
10:40place at the wrong time yet again so then we turn our attention to our second 911 caller when we're
10:46interviewing two people who are the same incident at the same time we're hoping to get pretty much the
10:51same story and hopefully some additional information from each witness but we're hoping that the stories
10:59primarily line up I walked up to the dispensary was in there for maybe five minutes left her in the car
11:05because she doesn't have her ID and she can Alexis I came back out looked at her I saw this dude on the
11:13ground I was talking 911 and then she was standing there we didn't start CPR immediately both of the 911
11:20caller stories actually were very consistent with each other and they'd provide a lot of the same information
11:25when we were able to check and see if they had any past connections to Andrew we found out they
11:31they had none neither one of them so we took them off of our suspect list okay but one thing was for
11:39certain somebody pulled the trigger and that person was still out there the moment I realized what had
11:51happened the only thing running through my mind was that I needed to try and help when I tried to speak
11:56to him the only thing he said was please help me when I found out Andrew didn't make it it it hurt my
12:03heart I I worked really hard to try and get him back it it definitely stung the thing that's amazing about this
12:13young woman once the car sped away she ran to him and she asked him if he was okay and he said no can you
12:24help me and she said I she said she held him and he died in her arms I told her that the only salvation I
12:40have is knowing that when he left this world those monsters weren't the last thing that he saw that he saw her
12:49shortly after we were conducting our interviews a call for a missing person comes in it turned out to
13:07be Andrew's girlfriend Jessica when you get a call like that one of the things you want to do is you
13:11want to drop everything go interview that caller and find out what's going on it when we got to the
13:19apartment Jessica was a little concerned as to why so many officers have shown up I asked her some brief
13:26questions about what Andrew had done where he had gone what he was doing so he was just going out to pick
13:33up dinner and didn't come back he didn't say he was going anywhere else usually he he informs me if
13:41he's gonna do some other errands on top of something like this okay so as I'm initially speaking with
13:46her I don't want to give her too much information about what happened to Andrew because I'm not sure
13:51if she has anything to do with this and I'm hopeful she doesn't but you never know he's probably got
13:56like 15 missed calls from me and then he and then I I called him about two or three o'clock this morning
14:02and his phone was just dead when's the first time you try to call him after 8 30 I think I probably
14:08tried to call him around 9 3 and 10 so after having a brief interview with Jessica coming to determination
14:15that Jessica probably didn't have any involvement in this I sat her down and I had to tell her that
14:23Andrew wasn't missing that Andrew had been shot and that he was killed
14:27oh my god
14:30I know it's I know it's very difficult for you and I know I answered all these questions that were kind
14:37of barraging you this is kind of difficult one of the most difficult things a police officer can do
14:43or be a part of is letting somebody know their loved one has passed away or had been killed just
14:48seeing the reaction to people being delivered that news takes a toll on everybody on scene
14:56I'm just not expecting to hear that he's been shot and killed in a parking lot down the street from my
15:02apartment I know and but there was no easy way for me to tell you obviously
15:08she was devastated she was sad she was crying she was confused uh and I think she was hurt
15:17and you're sure it's him
15:19I'm I we're so we had his identification everything on scene and his work ID
15:25and as we were trying to piece together Andrew's final minutes we asked Jessica some very pointed questions
15:31does he carry a gun
15:33so yes uh sky
15:35scc1
15:36all right nine millimeter
15:39what color is it
15:41it's uh silver and black
15:44where do you keep that gun
15:46I keep it in its case in our closet
15:49the scc wide pistol is a small compact nine millimeter nine millimeters the same caliber that we found on scene
15:56we asked her if anything was missing and that's when she tells us one of the guns and was
16:03so to me at this point I'm wondering well maybe in that struggle was Andrew's firearm taken from him
16:09and maybe used against him
16:10is there anywhere else that firearm would be
16:14that's the only place I can think of possibly because I don't know if he put that in his car or not
16:21because he always kept everything in here
16:24during the initial investigation of the crime scene officers did
16:27search Andrew's vehicle and they did not locate the gun inside the vehicle
16:32if the gun wasn't in the apartment and it wasn't in the car where was it
16:36did you guys let anybody else borrow your firearms or anything like that
16:39no no no we we don't even tell anyone about him the only people that know about him are our parents
16:44we knew we weren't dealing with just a homicide but that family's worst nightmare
16:48I needed to contact his mother Julie Genisek
16:56I called Julie I told her that I needed to have a conversation with her
17:00and it was something we had to do in person when I got to Julie's house I was able to ask Julie some questions
17:07one of those questions I asked Julie was if her son had any enemies
17:11she indicated to me that he had one that she knew of
17:15and it was Jessica's brother
17:18her brother had gotten out of jail and threatened Andrew
17:23at the time we realized that it was something critical
17:27I mean somebody coming out of prison
17:29I I yeah I don't take it lightly
17:33with this new information about Jessica Andrew's girlfriend
17:45that about a year prior Jessica's brother threatened Andrew
17:49and with Andrew's gun being missing and unaccounted for
17:53now I'm wondering why didn't Jessica tell us this
17:56and is this a credible or serious threat
17:58it was imperative for us to bring in Jessica once more for a question
18:03you doing okay
18:05yeah
18:07I wanted to keep Jessica at ease I didn't want her to feel attacked
18:10I wanted to know why she hadn't told us about this incident involving her brother and Andrew
18:15your brother had threatened Andrew
18:19yeah
18:19he didn't threaten him directly it was indirectly to me
18:25can you elaborate on that for me
18:27I had some concerns obviously if somebody's threatening to kill your loved one
18:35especially if that person's a family member and now there's a potential that a firearm is missing from your house
18:40that would be information that you might want to share with law enforcement
18:43my brother and I were having a fight and that's when he said his comment and uh it really unnerved me so I told Andrew and then Andrew wanted to take it to the police and the police said your best option would be just to move away from the situation so we did
19:04there was a part of me that was thinking she might be trying to protect her brother at this point but I didn't know it was a mystery
19:11he
19:12he just said that he would take him out with his friend or whatever
19:18what do you think he meant by that
19:21I mean well the first thought to my head is to kill him
19:25so this information I think it kind of broadened our scope a little bit and now we just had more information to follow up on
19:32Andrew hasn't seen my brother in a year
19:34or talked to him or anything and Andrew has not come up in a conversation between my brother and I
19:40so um
19:43retrospect kinda seems a little important though
19:46with the threats from Joseph to Andrew and the fact that a gun was missing I thought this is pretty serious
19:53uh we need to find Joseph
20:00we divided our workload and we provided this lead to CBI to follow up on
20:06they located Joseph picked him up brought him in for an interview and CBI conducted the interview with Joseph
20:14Joseph was extremely cooperative he fully admitted that yeah he did have that confrontation
20:21and that he did threaten Andrew he stated he would never actually follow up on that threat
20:26and Joseph was able to provide an alibi that he was actually out of the state during the time of this incident
20:32it's a little frustrating once you get rid of a lead and you cross off your board
20:36and you've got to refocus your attention you just kind of reprioritize
20:40to me the whole thing was sad I felt for Andrew
20:49he definitely was quirky he had this grin he would get
20:52especially when he was being sarcastic that he would give
20:55but
20:56one of the things about Andrew
20:58and sometimes it's uncomfortable to talk about
21:00is he was bullied a lot
21:01but
21:02I never once saw Andrew
21:03treat them poorly
21:04or be negative towards them
21:06he still treated everyone with kindness and respect
21:09after he passed
21:10obviously I had a lot of questions
21:12why him?
21:13we didn't get a ton of details initially
21:15and
21:16we lost a loved one
21:17we couldn't believe it
21:18after exhausting a lot of our leads we finally got the security footage back from forensics from the scene at the barbecue restaurant
21:32we were hoping that they could clean up the video enough for us to see any additional details and what was going on between Andrew and this other party
21:39so in the video footage you can see it as clear as we're going to get it
21:43you can see Andrew start walking towards the restaurant
21:46and
21:48you can see headlights approach from one direction
21:50Andrew gets confronted by another party
21:53there's a brief altercation
21:57you see a flash a gunshot goes off
22:00Andrew falls to the ground
22:02party runs into the vehicle
22:04and a vehicle takes off speeds past Andrew
22:07seeing that footage was pretty upsetting to me that somebody would do something like this
22:15especially because it was to Andrew, my friend
22:19seeing that really motivated me to do the best work I could to try to help Andrew get justice along with his mom Julie
22:27from watching that video footage we couldn't tell if the shooter was a male, female
22:31we couldn't tell ethnicity
22:33we couldn't tell how many people were in the car
22:35it's a little frustrating
22:37with further review of the footage
22:39the investigation had a huge breakthrough
22:41because we could also see that it was not a silver Pontiac that was used
22:44like the 911 caller reported
22:46it was actually a silver Mitsubishi Eclipse
22:49and we were able to get a partial plate of that Eclipse
22:52when we determined we had a partial plate for this vehicle
22:56and that we knew that it was a Mitsubishi Eclipse
22:59we started running it
23:00we managed to come back with two hits
23:03for a Mitsubishi Eclipse
23:06similar color with that partial license plate
23:09one of them belonged to a runner car
23:12and it hadn't been registered in a year or two
23:15the other one came back currently registered to an Alicia Valdez
23:20looking into her background she had a pretty long rap sheet
23:24and at the time she had a warrant out for her arrest
23:27from the El Paso County Sheriff's Office for a burglary
23:30based on that information we knew we needed to talk to her
23:33and see how she was involved in Andrew's death
23:36as we're conducting our investigation
23:38obviously this is a big investigations for a small city
23:41so we're still relying on other agencies for our help
23:45with the investigation
23:46we put an attempt to locate on the vehicle
23:49two days later we learned that Denver had pulled over that vehicle
23:58for an improper left turn
24:00that was a huge break for us
24:02Alicia gonna have you step out for a second
24:06don't grab anything with you okay just step on out for me
24:12go ahead and put this
24:15can I ask why?
24:16I'll tell you in a sec okay
24:18oh yeah
24:19alright go ahead and put your cigarette down
24:20okay sorry
24:21you're okay
24:22alright
24:23put your hands behind your back
24:25get a warrant okay
24:26why?
24:27why do you have a warrant?
24:28you probably know that better than I do
24:29but we're gonna do some research
24:30and tell you exactly what it is
24:31as a detective when you tell somebody
24:33that they have a warrant for their arrest
24:35and they try to play dump
24:37it's kind of aggravating
24:39but it's also kind of entertaining
24:41because you're the one that committed a crime
24:42that has the warrant for your arrest
24:45so why are you trying to pretend that you don't?
24:47yeah they put out a felony warrant out for you
24:49felony warrant?
24:50yeah
24:51officers were able to place her into custody
24:53without further incidents
24:55and our focus then turned to the other individuals
24:57that were in the vehicle
24:59stand up man
25:00stand up
25:01Sheriff Major Ben
25:04what's going on?
25:07as we were sitting there trying to find out
25:09as much information as we could
25:11from everybody else that was on scene
25:13it was immediately discovered then
25:15that there was a 9mm pistol
25:18on the front passenger seat
25:20pointing towards the officer in plain view
25:23it's the same caliber that was used
25:25and the murder of Andrew Janicek
25:27you're not going to tell me
25:28there's a gun in the seat next to you?
25:29what?
25:31you're not going to tell me
25:32that you're going to try to leave a gun
25:33on the seat when you left?
25:37that'd be nice to know wouldn't it?
25:38oh and a pocket full of bullets
25:39how about this?
25:41I'm about to get out of the car
25:42officer I have a gun on me
25:45right?
25:48you ever been convicted of a felony before?
25:50okay
25:54okay
25:55all right
25:56from my experience
25:57whenever somebody is involved
25:59in a pretty serious crime
26:00like Andrew's homicide
26:02the first thing that people think about
26:04is what they need to do
26:05with the item used in the killing
26:08and where they're going to hide it
26:09or destroy it
26:10there was a thought that maybe
26:11this is Andrew's missing gun
26:12or you know at the very least
26:14that maybe this is the gun responsible
26:16for the murder of Andrew Jenisek
26:19did you let them know that this is in the car?
26:21what is it?
26:22uh
26:23sccy nine mil
26:26it was at that point in time
26:27that we realized
26:28that this is a lot more serious
26:30than just a traffic stop
26:31for an improper left turn
26:33and we realized that we might be looking
26:35at the crew responsible
26:36for Andrew Jenisek's murder
26:46we realized that the puzzle pieces were starting to fall into place
26:53and we might be one step closer
26:55to getting justice for Andrew and his family
27:00the suspects were taken back to the police department for interviews
27:08we separated all of them
27:10so we could get their version of the events and their story
27:13and they wouldn't be able to dilute it with each other's information
27:17the first person we interview is Caleb Vigil
27:19the guy who had the gun in the car
27:22all right Caleb the last part of the form reads
27:24if you want to talk to me about what happened
27:26your answer is yes
27:27if you don't want to talk to me
27:28you should say no
27:34okay
27:35and our interview is concluded at 6.51
27:38when Caleb lawyered up
27:43obviously all questioning ceased against him
27:46it's frustrating because now he's a dead end in the investigation
27:49but we did have other people to interview and investigate at that point in time
27:56we arrested Caleb for being a felon in possession of a weapon by previous offender
28:00then we turned our attention to the person driving the car
28:03Alicia Valdez
28:05at first for that interview
28:07we didn't want to go in too hard
28:08and kind of scare her off
28:10what kind of car is it?
28:12uh, 2006 Mitsubishi Eclipse
28:14okay
28:20um, so who else uses your car?
28:22um, really mainly just me
28:25um, I don't really like people driving my car
28:28I get really bad anxiety
28:30I don't really trust people
28:31we were hoping to get some information about
28:33where her vehicle had been the night
28:36that Andrew was killed
28:37where she had been
28:38and if she knew
28:39where her vehicle had been that evening
28:43your car
28:44is at the scene of a murder
28:48someone got out of your car
28:50shot someone
28:51and killed them
28:52got back into your car
28:53and drove away
28:54you just told me that you were driving your car all week
28:57you were there when it happened
28:59you were there when it happened
29:01right?
29:03you need to tell me the truth
29:06saying how she had continued to
29:08stick to her story
29:09even though we knew she was lying
29:11just motivated me and everybody
29:13to prove that she had involvement
29:15in what happened to Andrew
29:16uh, I...
29:18honestly I don't recall
29:20you don't recall?
29:21I don't
29:23since Caleb was found with the firearm
29:25and with a pocket full of ammunition
29:28uh, we were working under the impression
29:30that Caleb was probably our shooter
29:32and I believed that she had information
29:34that could tie the whole case together
29:36okay, look
29:40we have it on video
29:41I know that the person who shot this guy
29:44is a guy
29:46okay
29:50I know it wasn't you
29:51I know it was your car
29:55you tell me you're the only one driving your car
29:57so you were driving the car
30:00I mean
30:01yeah, but
30:02I don't
30:03I don't
30:04recall being
30:05in
30:06wherever you're saying
30:07I was
30:08I'm
30:09I'm the only one that drives my car
30:10but
30:11I don't recall
30:12she had so many holes in the story
30:14she wasn't able to answer certain questions
30:16and
30:17you know, her body language alone
30:19was just showing a lot of signs of deceit
30:22I'm not sure somebody's going to be down
30:23to talk to you about this
30:24and more likely serve you a warrant for murder
30:28at that point in time
30:29the color drained out of her face
30:30and the realization of what was going on
30:32seemed to finally hit her
30:35your car is ours
30:36it's wanted in our case
30:38so I don't know if you own the car
30:39I don't know if you have a lien on it
30:42Alicia was a little bit shocked
30:44she didn't really understand
30:45or pretended she didn't understand
30:47and couldn't believe that this was happening to her
30:50Alicia was arrested in connection with the murder
30:53we still had a lot of uncertainties
30:55we still didn't know who was driving the vehicle
30:57who pulled the trigger
30:58who all was actually in the vehicle when this happened
31:01at this point we turned our attention to
31:04the other person in the car
31:05Devon Howard
31:07I think Alicia cares for you a lot
31:08she made that real clear to us
31:11she's going to pay for it
31:16she's going to screw herself over
31:19to protect you
31:23we all know
31:24that car has been involved in some bullshit before tonight
31:31very recently
31:37which is where her problems come in
31:40from our interview with Devon
31:42it was almost like he wanted to provide information
31:45to keep Alicia out of trouble
31:47not because he wanted to do it to clear his conscience
31:49or be a good person
31:50but simply because he wanted to keep Alicia out of trouble
31:53because they were dating at the time
31:56the mountain is waiting to fall on top of her
31:59and it's happening as we speak
32:03that car was using to drive by
32:06got the license plate of that
32:08I don't want to mind getting her out of trouble
32:09but
32:11I don't like a lawyer so I know what is safe to be said
32:23my instincts were telling me that Devon had a lot more information
32:28a lot more knowledge about what had happened
32:30than what he was telling us
32:32we weren't able to determine what role Devon played
32:34and what happened to Andrew
32:36so we had no way of holding him at the time
32:39we interviewed him
32:41so at this point we had to make a pivotal decision
32:43the only information that we had gotten from Caleb
32:46during his interview
32:48was the address for his apartment
32:50which is where he lived with Devon Howard
32:53we thought Caleb was the shooter
32:55and that's why we executed the search warrant
32:57of Caleb's apartment
32:59when we got to the apartment
33:04you got to be careful because
33:06in situations like this
33:08a lot of times people have backup plans
33:10or they're associated with other people
33:12who don't like law enforcement
33:14so you have to treat this with a very serious matter
33:16clear
33:18let's go check here
33:23look good?
33:24right?
33:25clear
33:27find the TV
33:29we're good
33:31we check behind the bed
33:33yeah
33:34behind but not under
33:35I don't think anybody can know
33:37behind is clear
33:39insecure
33:41I've been hearing stuff but I couldn't tell
33:43one of the biggest keys of evidence that we found
33:45inside the apartment was a box of ammunition
33:48that had the same casing on it
33:50that was a casing that was found on scene
33:52but as the case was starting to take shape
33:57one question still lingered
33:59why Andrew was murdered
34:01and the mystery of who killed Andrew Jenicic
34:04was finally starting to unravel
34:15we still needed information to prove that these suspects were tied to Andrew's death
34:20after we stopped Alicia and impounded the Mitsubishi Eclipse
34:25we ended up doing a search warrant on that vehicle
34:28in that vehicle we found a receipt from the 7-Eleven close to the crime scene
34:33the night of Andrew's murder
34:35we took that receipt to the 7-Eleven
34:38when we got there we asked them to see their video footage
34:41they were more than happy to provide that to us
34:45being able to see that footage was huge
34:48we see the vehicle pull up
34:50we see Devon get out of the driver's seat
34:52not Alicia
34:54we see Devon exit the vehicle
34:56we see Alicia get out of the vehicle
34:58we see Caleb Vigil get out of the vehicle
34:59one of the big things that that security camera footage showed
35:02is Alicia was not the one driving even though she swore up and down
35:06that she never lets anybody else drive her vehicle
35:08so now we have our witnesses
35:11we have a gun
35:13we have our shell casing
35:15we have our vehicle
35:17and we have two murder suspects in custody
35:19Alicia and Caleb
35:22and now we're just looking for Devon Howard
35:24because we had no reason to initially keep him
35:26but now with this new footage
35:28we know he was there
35:29we know he was involved
35:31and now we need to get him back in custody
35:35we had gotten some tips that Devon was trying to skip town
35:39he had reached out to somebody about potentially getting his face tattooed to cover up his appearance
35:45we got information that he was going to be meeting with a tattoo artist in a parking lot at a local ice hockey rink
35:52myself, Officer Young, and a couple other investigators set up at this ice rink
35:58and waited for Devon Howard to get there
36:01all of a sudden we see Devon walking across the street and we pounce
36:09probably one of the best feelings for this case
36:13we ended up placing Devon Howard into custody
36:16and we take him in for another interview
36:17at this time we come at him with just the facts
36:21I think the only thing that he really cared about was trying to keep Alicia out of trouble
36:28you guys know she did not oppose the trigger
36:30that's what matters
36:32I'm just here to get her out of trouble
36:34I'm not here to get anyone out of trouble
36:36except for myself, honestly
36:38when you got situations like that
36:40and you got people not wanting people to get in trouble
36:42that clearly shows that they know more than what they're leading on
36:45and you want to be able to press that issue
36:48alright, so when you
36:50you see this go down, right?
36:53you leave
36:55you come out
36:57you come out here and make this way
37:01do you hit this guy?
37:03Muzana, do you hit the...
37:06accidentally, yes, I was a little panicked
37:08because as I said, it was not planned
37:10I accidentally hit him
37:12do you remember if he was lying down or was he up?
37:15I don't remember any of that
37:17I remember it happened somewhere in front of me
37:19I tried to turn
37:21but I still remember running him over because I felt it
37:23Devon admitted to us that
37:25that Caleb had shot and killed Andrew
37:28and that Devon himself was the driver of the vehicle that night
37:32I was shocked
37:34I was shocked that he had no remorse
37:36no remorse
37:38for what he and his friends had done
37:40and I was disturbed that
37:42he cared so little and valued so little
37:44somebody else's life
37:46I understand, and I'm not saying you weren't
37:48but we're just trying to understand what
37:50what the mindset is
37:51it's just a random act that goes bad
37:53I don't know why the crew got shot
37:55I don't know how the situation occurred
37:57all I know is that the person
37:59ain't up getting shot
38:00my opinion was Andrew went to Billy Simms
38:10to go to dinner and was confronted by our suspects
38:14and was there to be robbed
38:17Caleb Vigil murdered Andrew in the process
38:20while trying to be robbed
38:22and the suspects then just took off
38:24without taking his money or phone or anything like that
38:27because that wasn't their intention to murder
38:29they were there to rob him
38:32Andrew died because they showed no compassion for other living beings
38:38I don't think I'll ever experience something like this again
38:42for me to investigate a homicide that involves somebody that I went to high school with
38:47is something that I'll probably and hopefully never have to go through again
38:51The gun that was found in the Mitsubishi Eclipse next to Caleb Vigil
38:57was not Andrew's missing gun
39:01but it was the murder weapon
39:03it was test fired and sent off to the lab
39:06and they were able to confirm that it was the same firearm that was used to kill Andrew Janicek
39:14In the summer of 2019 Caleb, Devon, and Alicia were all sentenced in the homicide of Andrew Janicek
39:20they're all serving life without parole
39:24this entire incident was callous, it was senseless
39:30the amount of pain that his family and his friends have to endure to this day
39:36I can't fathom
39:38nor do I ever want to
39:40and it's a tragedy
39:42on this page I'm looking at my picture with the football team and Andrew
39:52you can see me on the front row
39:54I didn't play football, but I wanted to be a manager
39:58because a lot of my really good friends were on the football team
40:01Andrew was standing here in the third row
40:02I just remember how much of a gentle giant he was and how he was valued as a person and as a friend
40:09and as a member of the football team
40:12and I'm just really sad that what happened to Andrew occurred
40:15to lose someone that you see having a legitimate, lifelong relationship with
40:26just leaves a hole there
40:28and no one can fill that
40:30no one's going to be what Andrew was
40:32he was one of one
40:34I lost a lifelong friend who would be here with me
40:38playing with my kids
40:40talking about the difficulties of work, balancing everything
40:42it's just gone
40:45and that's the part that hurts the most
40:47I sat on a board for parents of murdered children for almost three years
40:54and I did talk to people
40:56and I heard a lot of horror stories
41:01and you can survive it, but you need help too
41:07this is just not the normal process of death
41:13I was supposed to go first
41:18but I think as humans we have to grow
41:22and try to navigate our lives in a new path
41:25This is typical of psychosis that has to be put out in place
41:28so maybe we want to go first
41:30and just build our lives in a new path
41:32And than two years I have to Best of National
41:38Ebene with the Best of Fame
41:40I have to start working with my family
41:43Sophie and Paul
41:45I want to keep thatST
41:47again's suffering
41:48I've been to healthy
41:50I've got something in a new path
41:51and just gallery
