00:00Fox News is seeking to dismiss California Governor Gavin Newsom's $787 million defamation suit,
00:07calling it a political stunt to boost his 2028 presidential ambitions.
00:12Newsom filed the suit June 27th after host Jesse Waters accused him of lying about a call with President Trump.
00:22Why would Newsom lie and claim Trump never called him? Why would he do that?
00:26The issue stems from when and whether Newsom and Donald Trump spoke about the immigration enforcement actions
00:33that led to fiery demonstrations in the Los Angeles area in June.
00:37Newsom says he had a 16-minute call with Trump on June 7th.
00:41Donald Trump, however, gave a different timeline, saying at a June 10th press conference that he had spoken with Newsom a day ago.
00:48Newsom then denied receiving any call or voicemails.
00:51At the time, Newsom's lawyers said he would drop the suit if Fox retracted Waters' claim
00:57and if both the network and the host issued on-air apologies.
01:01Waters apologized on-air last month, saying Newsom, quote,
01:06didn't deceive anybody on purpose, but was confusing and unclear with his comments.
01:11He didn't deceive anybody on purpose, so I'm sorry. He wasn't lying. He was just confusing and unclear.
01:17Despite Waters' apology, Newsom did not drop the suit.
01:21In its response to the lawsuit, Fox News argued that the case should be dismissed
01:26and that Newsom should be ordered to pay its legal fees.
01:29At a minimum, Fox's lawyers wrote,
01:31Waters' query about why Newsom would lie is an opinion based on disclosed facts
01:36that enjoys full First Amendment protection.
01:40Lawyers also claim Newsom was deliberately seeking media attention,
01:44amid speculation that he might run for president in 2028,
01:47and the network ridiculed the governor's intention to amend the lawsuit.
