The Industrial Court ruled in favour of the Malayan Commercial Banks Association in its
00:06
trade dispute with the National Union of Bank Employees over festival aid for bank employees.
00:13
Court Chairman D. Parmalingam said the memorandum of agreement on festival aid, dated April
00:18
5, 2023, had no legal or binding effect as it was not formally recognised under the Industrial
00:24
Relations Act 1967.
00:27
He said the MOA only provided for a one-off payment in 2023 and did not obligate banks
00:32
to pay festival aid in subsequent years.
00:35
Parmalingam said he was bound by the principle of stare decisis, citing past similar rulings
00:40
by the High Court, Court of Appeal and Federal Court.
00:45
He criticised NUBE for trying to reintroduce the MOA as an implied term of employment despite
00:50
the precedence set in the NUBE vs HSBC Bank Malaysia Berhad case.
00:56
The court rejected NUBE's attempt to overturn an Apex Court decision, with Parmalingam accusing
01:01
the union's General Secretary, Jay Solomon, of feigning ignorance about the previous ruling.
