00:00The Industrial Court ruled in favour of the Malayan Commercial Banks Association in its

00:06trade dispute with the National Union of Bank Employees over festival aid for bank employees.

00:13Court Chairman D. Parmalingam said the memorandum of agreement on festival aid, dated April

00:185, 2023, had no legal or binding effect as it was not formally recognised under the Industrial

00:24Relations Act 1967.

00:27He said the MOA only provided for a one-off payment in 2023 and did not obligate banks

00:32to pay festival aid in subsequent years.

00:35Parmalingam said he was bound by the principle of stare decisis, citing past similar rulings

00:40by the High Court, Court of Appeal and Federal Court.

00:45He criticised NUBE for trying to reintroduce the MOA as an implied term of employment despite

00:50the precedence set in the NUBE vs HSBC Bank Malaysia Berhad case.

00:56The court rejected NUBE's attempt to overturn an Apex Court decision, with Parmalingam accusing

01:01the union's General Secretary, Jay Solomon, of feigning ignorance about the previous ruling.
