00:06seeking a declaration that a provision in the Dangerous Drugs Act 1952 disallowing him bail
00:12violates his constitutional rights.
00:15Represented by Federal Counsel Muhairi Muhammad Noh, the government informed
00:19Justice One Ahmad Farid Wan Saleh of his position in the High Court today.
00:24Rafiq Rashid Ali, Yusuf's lawyer, said the government took the same stand in respect
00:29of a constitutional challenge to Section 41B of the DDA,
00:34which Yusuf referred to the Federal Court for determination previously.
00:38Following today's court proceedings, Rafiq announced that they have been
00:41instructed to submit their affidavits by January 20th.
00:45Yusuf was charged at the Magistrate's Court in September
00:48with cannabis trafficking and possession of fake guns.
00:52He then filed a lawsuit seeking to declare Section 41B,
00:56which disallows bail to those charged with drug offenses, unconstitutional,
01:00and asked for the issue to be referred to the Federal Court for determination.
