00:01The High Court in Kuala Lumpur has dismissed businessman Albert Tay's application to transfer
00:07his five corruption charges involving former senior political secretary Datuk Seri Shamsul
00:13Iskandar Mohamed Akin from the Sessions Court. High Court Judge Justice Noor Ruwina Ma Nerdin
00:19made the dismissal on Friday on grounds that the case involved issues that were not complex
00:25and could still be ventilated at the Sessions Court. Tay, whose real name is Tayjian Cheng,
00:32had sought the transfer, arguing that the charges raised constitutional issues under the Malaysian
00:37Anti-Corruption Commission Act 2009. The 37-year-old faces four charges of giving 140,000 ringgit in bribes,
00:48including cash, furniture and electrical goods, to Shamsul Iskandar. The alleged bribes were intended
00:56as an inducement for Shamsul Iskandar to assist companies in which Tay had interests in obtaining
01:02approval for mineral exploration licences in Sabah. The offences were allegedly committed at several
01:09locations in Kuala Lumpur and Putrajaya between November 2023 and March 2024. Tay also faces a
01:18charge of giving a bribe amounting to nearly 65,000 ringgit to Shamsul Iskandar at a bank in Country
01:25Heights, Kajang, between November 2023 and September 2024. All five charges were framed under Section 17,
01:34Subsection B of the MACC Act 2009 and are punishable under Section 24, Subsection 1 of the same Act.
01:43Upon conviction, the provision carries a jail term of up to 20 years and a fine of at least five
01:50times the
01:51amount or value of the bribe, or 10,000 ringgit, whichever is higher.
