00:00The KL High Court has dismissed a leave application
00:05by lawyer Mahajoth Singh,
00:07who is seeking to challenge two orders linked to his class.
00:10The KL High Court has been sent to his client, Albert Tay,
00:13that were issued to him by the M.A.C.C.
00:15Among the items that M.A.C.C requested in the orders were Tay's mobile phone.
00:20Documents relating to the purchase of furniture, clothing, a camera, and copper.
00:25She has made copies of WhatsApp conversations between Tay and several individuals.
00:30After a brief decision on Friday,
00:32Justice Alice Locke Ye Ching said that the law was clear
00:35and settled that matters pertaining to investigative functions of the enforcement authority
00:40were not amenable to judicial review.
00:43She also said that the applicant
00:45had failed to establish his argument on allegations of bad faith.
00:48The court did not make an
00:50order as to costs.
00:51His application to quash the...
00:55M.A.C.C.'s notices
00:57for
00:58Mr. Mahajoth to
01:00reveal communications between
01:05M.A.C.C.C.
01:06himself and his client Albert Tay.
01:07Right?
01:08As you will recall,
01:10the M.A.C.C.
01:11The M.A.C.C. had issued notices like that
01:13and we had strongly objected.
01:15M.A.C.
01:16Because it infringes the solicitor client...
01:20M.A.C.
01:21M.A.C.
01:22M.A.C.
01:23M.A.C.
01:24M.A.C.
01:25M.A.C.
01:26and to have privileged communication
01:30with their lawyers.
01:31Okay?
01:32This is a fundamental cornerstone of...
01:35the law in Malaysia.
01:36That communication between lawyer and client...
01:39cannot be...
01:40demanded by any enforcement body.
01:43Such as for example the M.A.C.C.
01:45the police or any other enforcement body.
01:47If you break that principle,
01:49no one is safe.
01:50So that is why we filed a case in court...
01:53saying that the notice issued by...
01:55M.A.C.
01:56M.A.C.
01:57M.A.C.
01:58M.A.C.
01:59M.A.C.
02:00So we are disappointed with the decision.
02:03We respect the decision but we disappointed it.
02:05the decision which we think is incorrect.
02:10So therefore we will be filing an appeal to the court of appeal immediately.
02:15The solicitors will be filing an appeal to the court of appeal immediately.
02:19In December,
02:20Tay was charged in court for graft alongside former senior political secretary.
02:25To the Prime Minister, Datuk Seri Shamsul Iskandar, Muhammad Akin.
