A warning this next story contain details of alleged indecent assault. A high-profile athlete has denied making up an allegation that he was kissed by Alan Jones at a public event, telling a Sydney court he couldn't get it out of his memory. Mr Jones has pleaded not guilty to 22 charges of indecent assault and sexual touching.

00:01The complainant is now being quizzed and pressure is being placed on him about some of the more specific details
00:08he gave police initially when he gave his first statement back in 2024 and some of the evidence that he's
00:13come out from him in his evidence in chief throughout this trial so far.
00:17So he faced a full day of his cross-examination. It just finished towards the end of the day but
00:24he was pressed on a number of matters at the startles about that event in 2015.
00:29So complainant M, who's a prominent athlete, alleges that on two separate occasions Alan Jones kissed him on the mouth
00:35without consent, once at a public event in 2015, the other occasion in 2020 at Mr Jones' Circular Quay apartment.
00:43Now the defence barrister, Gabrielle Bashir SC, was quizzing this complaint about some of the more specific details about where
00:52Mr Jones and where himself were positioned at this 2015 event when the alleged kiss took place.
00:58He accepted while he might not have these specific details of body positioning where people may have been seated on
01:04that night, he did say that he knew the kiss happened because he couldn't get it out of his memory
01:09and that was a sticking point of today in his evidence.
01:13And there was also taken to the text messages, which the prosecution raised as evidence of that kiss that was
01:20sent by Alan Jones on that same night in 2015, allegedly when the complainant was either home or on his
01:26way home.
01:27We know that Alan Jones allegedly sent,
01:29Darling, great to see you. Sorry I didn't catch up after. I hope you can feel my kisses.
01:34Now the prosecution raised that as evidence that this kissing incident took place.
01:38Then the complainant replied, let me know when we can catch up. Lots of love.
01:42Now the defence pushed to this complaint that if you were supposedly agonising or apprehensive to respond to Alan Jones,
01:50why did you reply in that fashion and reply in a way that suggests that you would meet up again?
01:55He says he was agonising over what he may write back. He said he didn't want what had happened to
02:00have happened and he wanted things to go back to normal and that's why he says he replied in that
02:06fashion.
02:06And then later on today we move to the allegations in 2020.
02:10He alleges that he visited Mr Jones at his apartment for the last time.
02:14He says it was in the evening and then eventually as towards the end of that discussion, the meeting that
02:21they had there,
02:22that Alan Jones kissed him multiple times in the mouth and kept saying things like, I love you, you don't
02:26understand how much I love you.
02:28And he says that kiss moved towards the corner of his lip and that he could also feel Mr Jones'
02:33genitalia up against his leg.
02:34That's when he says he pushed him away and said, OK, mate.
02:37Now, some of the details there, he didn't mention in his first police statement or any of his five police
02:43statements about the back and forth of the kissing and saying, I love you.
02:47So, that was the first time we heard about that evidence was actually in the evidence in chief.
02:50So, his question about that allegation as well, he says over time, unfortunately for him, he's had to replay this
02:57event in his memory.
02:58It was put to him on multiple occasions that this event didn't occur.
03:01He denied that.
03:02It was also put to him that Alan Jones was actually broadcasting at that time from his Fitzroy Falls property
03:07because this was in the middle of the COVID-19 pandemic.
03:10And they say he was hosting his radio program show from his Fitzroy Falls property and the Sky News property.
03:16But he remained adamant that this interaction took place in Mr Jones' circular key apartment and that it was around
03:22about the 19th of March 2020.
03:24He wasn't specific on the date, but he says it was around that time and remains adamant that that occurred
03:30on that time and then that Mr Jones kissed him on both occasions.
03:33But he will be back tomorrow for the re-examination by the prosecution.
