00:12sometimes we talk about an act of God so say your car is parked outside tree falls on it from
00:20your
00:20yard tree falls on it on your roof which is your car well generally that's considered an act of God
00:28and insurance will cover it however one of my pet peeves when you go and you look at houses and
00:35recently I was out with a client and we were looking at a property and I was walking near
00:41the property line and I could clearly see that this tree was rotted and it was gonna fall and when
00:50it does fall it will fall into the property that the purchase that my client is purchasing so what
00:58do you do how do you circumvent that well you can talk to the neighbor you can send them a
01:05nice email
01:06but just by doing that you are putting them on notice and that in a court of law that will
01:14stand
01:15in your favor should the tree fall onto your property who's going to clean it up now again
01:21most of the time when a tree falls down on your property the the current owner will clean it up
01:28but where does the responsibility truly lie it's putting that notice out absolves you the the homeowner
01:37current homeowner of the cleanup let me show you an example of exactly what I'm talking about
01:42you can't see the property line it's clearly behind these the brush and that tree is on the
01:52neighbor's property so when you look at the storm recently and it came down who has to clean it up
02:00well
02:01again because that tree is hanging over on this property the property owner right here is responsible
02:09for the cleanup however in advance if they discussed it with the neighbor and said listen you have to
02:16take that tree down because it's going to come down then that responsibility would be the neighbor
02:23on the other side of the line and that's the deal you know I always enjoy wearing my jay and
02:30the
02:30americans hat uh they put out great music uh during the 60s early 70s and two of the original members
02:38still perform with the band and uh they're just still excellent to hear and everyone always enjoys it
02:45uh tonight I was supposed to see Art Barfunkel uh he had to cancel his concert due to a lung
02:53infection
