00:00Although the preventive detention orders against Dominic and Genevieve Hadid were revoked last week by the Homeland Security Minister who
00:08said they will be the subject of continued monitoring and surveillance by the TTPS, the Attorney General's Office has issued
00:14a new statement about the Privy Council's response to a court matter during their detention.
00:19The Attorney General's Office said, quote, the court never denied any appeal by the state. It merely stated that an
00:25application, perhaps in writing, could be made to the court by the respondents, the Hadid's, for interim relief, that is,
00:33early release, end quote.
00:35At the time of the Hadid's detention at the state facility, the state appealed the ruling by a first panel
00:39of the Court of Appeal on July 17th that the Hadid's be released from detention and placed under house arrest
00:45with strict conditions.
00:47On the evening of July 17th, the state received a stay of that ruling from a second panel of the
00:52Appeal Court, which was chaired by the Chief Justice, as the state sought leave to appeal to the Judicial Committee
00:58of the Privy Council.
01:00The Attorney General's Office included a text of the response from the Judicial Committee of the Privy Council to the
01:05Hadid's application for the expedited hearing of the stay.
01:09It stated, quote, the court does not wish to deal with the appeal in a rush in the last few
01:15days of the term, and that it appears to us that the immediate issue of the respondents' continued detention could
01:21be addressed more conveniently by means of an application by the respondents to lift the stay, end quote.
01:28The response of the Registrar further said the Judicial Committee would proceed to list the appeal in October.
01:34The Registrar's Office is pointing out that the state's appeal to the Privy Council was successfully accepted and has been
01:40rostered for the new term, which commences in October 2026, for a date yet to be fixed.
01:46And it counters that the Hadid's application for an expedited hearing for early release by the Privy Council in the
01:52current term, which concludes at the end of July 2026, was not accepted.
01:57The Agist's Office referred to, quote, the many misleading reports and commentary by local media houses and social media platforms,
02:05which claimed that the state was in some way defeated or denied at the level of the Privy Council, end
02:11quote.
02:12The Attorney General's Office then said the Registrar of the Privy Council felt it necessary to issue a further clarification
02:18of the court's position to the parties, which it said was unprecedented.
02:22The Agist's Office said the Registrar of the Privy Council wrote that, quote, if an application is made by return
02:28by the respondents to this court to lift the stay made by the second constitution of the Court of Appeal,
02:35this court would issue directions to ensure that it is dealt with speedily on the papers in the course of
02:41next week.
02:42For the avoidance of doubt, the appellant would have assured the time to respond, end quote.
02:47The Attorney General's Office is cautioning members of the legal fraternity and the media that, quote, the intentional misrepresentation of
02:54statements, decisions and directives of the court are tantamount to the offence of contempt of court, end quote.
03:00As Dominic and Genevieve Hadid are no longer in state detention, the AG's Office said the matters brought by the
03:05state will proceed as and when rostered by the Privy Council in the new term.
