00:00The parents of seven-year-old Angelica Jogi, who died after a jet ski collision at Pigeon Point Heritage Park
00:07in Tobago on April 8,
00:08issued a pre-action protocol letter on Tuesday, signaling their intention to pursue legal action against the jet ski operator,
00:16the Tobago House of Assembly and Pigeon Point Heritage Park Ltd.
00:20According to the letter, the family was bathing in the sea within what was described as a designated bathing area
00:27at Pigeon Point Heritage Park
00:28when a jet ski entered the area and collided with family members.
00:32The attorneys stated that Angelica sustained multiple traumatic injuries and later died as a result of those injuries.
00:39The family's attorneys alleged that the operator failed to exercise reasonable care in operating the jet ski
00:45and failed to keep the craft under proper control.
00:48The proposed claim also alleged that the operator entered an area being used by bathers
00:53and failed to avoid striking members of the public who were lawfully using the breach.
00:58However, the letter further stated that responsibility for the incident extended beyond the operator
01:04and included failures by public authorities.
01:07According to the proposed claim, the THA and Pigeon Point Heritage Park Ltd.
01:12were responsible for the management, operation, supervision and safety of activities conducted at the facility,
01:19including watercraft operations.
01:21The family alleged that both entities failed to establish, implement, maintain and enforce adequate safety measures
01:28to protect beach users from the risks posed by jet skis and other watercraft.
